अधि. सू. - 17 क्र. एफ-1-16-2021 -अठारह 3.- मध्यप्रदेश नगरपालिक निगम अधिनियम, 1956 ( क्रमांक 23 सन् 1956 ) की धारा 308 - क, के साथ पठित धारा 433 तथा मध्यप्रदेश नगरपालिका अधिनियम, 1961 ( क्रमांक 37 सन् 1961 ) की धारा 187- क, के साथ पठित धारा 355 तथा 356 द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए, राज्य सरकार, एतद्वारा, मध्यप्रदेश नगरपालिका ( अनुज्ञा के बिना भवनों के संनिर्माण के अपराधों का प्रशमन, शुल्क एवं शर्तें ) नियम, 2016 में निम्नलिखित संशोधन करती है , अर्थात्-

उक्त नियमों में:-
1. नियम 5 के स्थान पर, निम्नलिखित नियम स्थापित किया जाए, अर्थात्ः-
" 5. प्रशमन शुल्कः- मध्यप्रदेश भूमि विकास नियम , 2012 के नियम 21 के उपनियम ( 3 ) के खण्ड (ख ) तथा ( ग ) में वर्गीकृत क्षेत्रों हेतु विभिन्न उपयोग के लिए निर्मित भवनों के लिए प्रशमन शुल्क निम्नानुसार होगा:-

नियम 21 (3 ) ( ख) तथा 21 ( 3 ) ( ग ) में उल्लिखित निर्मित क्षेत्र हेतु प्रभार्य/अनुज्ञा शुल्क का छः गुना.
कलक्टर मार्गदर्शिका द्वारा अवधारित भूमि के बाजार मूल्य की दर अनुसार बिना अनुज्ञा निर्मित क्षेत्र के मूल्य का 9 प्रतिशत.
कलंक्टर मार्गदर्शिका द्वारा अवधारित भूमि के बाजार मूल्य की दर अनुसार बिना अनुज्ञा निर्मित क्षेत्र के मूल्य का 12प्रतिशत .
कलक्टर मार्गदर्शिका द्वारा अवधारित भूमि के बाजार मूल्य की दर अनुसार बिना अनुज्ञा निर्मित क्षेत्र के मूल्य का 6 प्रतिशत.
ऐसे भवन जो वाणिज्यिक, व्यापार , औद्योगिक, सिनेमागृह, होटल अथवा मिश्रित भूमि उपयोग में हो अथवा उपयोग प्रयोजन किये जाने हेतु आशयित हो.
परन्तु, जहां सक्षम प्राधिकारी की अनुमति के बिना सम्पूर्ण भवन का निर्माण किया गया है, कालम 3 में उल्लिखित शुल्क अनुज्ञेय निर्मित क्षेत्र के लिए देय होगा ( जिसमें खुला क्षेत्र , एफ.ए.आर. ग्राउंड कवरेज , ऊंचाई आदि शामिल है ) और अनाधिकृत निर्माण के लिए जो अनुज्ञेय एफ.ए.आर. से अधिक है . 30 प्रतिशत की अधिकतम सीमा तक अनधिकृत निर्माण की सीमा के आधार पर कालम ( 4 ) , ( 5 ) , ( 6 ) में उल्लिखित प्रशमन शुल्क देय होगा. यदि अनधिकृत निर्माण अनुज्ञेय एफ.ए. आर . के 30 प्रतिशत से अधिक है तो अतिरिक्त अनधिकृत निर्माण को हटाने या इस हटाने के बाद ही प्रशमन किया जाएगाः
परन्तु यह भी कि , ऐसे भवनों के निर्माण का प्रशमन नहीं किया जाएगा जो बिना अनुमति या दी गयी अनुमति के उल्लंघन में बनाए गए हैं, यदिः-
(क) ऐसा सन्निर्माण नियमित भवन पंक्ति को प्रभावित करता है.
(ख ) ऐसा सन्निर्माण राज्य सरकार द्वारा पर्वतीय स्थल या पर्यटन महत्व के स्थल या परिस्थितिकी के बिन्दू से सवेंदनशील रूप में अधिसूचित क्षेत्र के भीतर आता है .
(ग) ऐसा सन्निर्माण वाहनों की पार्किंग करने के लिए विनिर्दिष्ट क्षेत्र के भीतर आता है .
(घ) ऐसा सन्निर्माण सड़क की सीमाओं में या सार्वजनिक सड़क के संरेखण को प्रभावित करने वाले क्षेत्र के भीतर आता है.
(ङ) ऐसा सन्निर्माण जल निकायों के लिए विनिर्दिष्ट क्षेत्रों के भीतर आता है .
( च) ऐसा सन्निर्माण नदी किनारे से 30 मीटर के भीतर या ऐसी और अतिरिक्त दूरी के भीतर आता है तो संबंधित नगर के मास्टर प्लान में विनिर्दिष्ट की जाए.
(छ) ऐसा सन्निर्माण किसी नाले तथा जल प्रवाह के क्षेत्र के भीतर आता है .
(ज) इस तरह के निर्माण संरचनात्मक और अग्नि सुरक्षा को प्रभावित करते हैं:
परन्तु यह और भी कि, अनाधिकृत कालोनियों में किए गए अनाधिकृत निर्माण के प्रशमन के लिए, विकास शुल्क जमा कराने के प्रमाण प्रस्तुत करने के पश्चात् ही ऊपर दी गई दरों से प्रशमन शुल्क प्रभार्य होगाः
परन्तु यह और भी कि, जो व्यक्ति अनुज्ञा के बिना या प्रदान की गई अनुज्ञा के उल्लंघन में निर्मित सन्निर्माण के प्रशमन के लिए दिनांक 28 फरवरी 2022 तक आवेदन प्रस्तुत करता है तो उसे इस नियम के अनुसार संगणित किए गए प्रशमन शुल्क पर बीस प्रतिशत की छूट प्रदान की जाएगी.

704(1) Noti.No. - 17 -F.No.F- 1-16/2021 /XVIII - 3.- In exercise of the powers conferred by Section 308 - A read with Sections 433 of the Madhya Pradesh Municipal Corporation Act , 1956 (No. 23 of 1956) and Section 187 -A read with Section 355 and 356 of the Madhya Pradesh Municipalities Act , 1961 (No. 37 of 1961) , the State Government , hereby, makes the following further amendments in the Madhya Pradesh Municipal ( Compounding of offence of Construction of Buildings , Fees and Conditions) Rules , 2016 , namely: -
In the said rules , -
1. For rule 5, the following rule shall be substituted, namely-

"5. Compounding Fee- The fees for construction of buildings constructed for different uses in the areas classified under clause (b) and ( c) of sub - rule (3) of rule 21 of Madhya Pradesh Bhumi Vikas Niyam, 2012 , shall be as under : - S.No.

Five times of the chargeable/License fees for built-up area mentioned in rule 21 ( 3 ) ( b ) and 21 (3) ( c) .
Such building which is used or intended to be used for residential , social , religious , cultural, educational educational or health purposes .
(ii)
Six times of the chargeable/License fees for built-up area mentioned in rule 21 ( 3) ( b) and 21 (3 )(c) .
Such building which is used or intended to be used for commercial , trades , industrial , cinema, theater , hotel or mixed land use purpose .
Compounding Fees for the unauthorized construction inFAR , MOS and Ground Coverage , which is up to 10 percent more than the permissible limits of FAR.

Compounding Fees for the unauthorized construction inFAR, MOS and Ground Coverage, which is more than 10 percent and up to 20 percent of permissible limits of FAR . (5)
Compounding Fees for the unauthorized construction in FAR, MOS and Ground Coverage, which is more than20 percent and up to 30 percent of permissible limits of FAR. (6)
7.5 percent of value ofbuilt-up area without permission as per market value of land determined by collector guidelines.
5 percent of value of built - up area without permission as per market value ofland determined by collector guidelines .
10 percent of value ofbuilt-up area without permission as per market value of land determined by collector guidelines .
9 percent of value ofbuilt-up area without permission as per market value of land determined by collector guidelines .
6percent of value of built- up area without permission as per market value ofland determined by collector guidelines .
12 percent of value ofbuilt-up area without permission as per market value of land determined by collector guidelines.
Provided , that where entire building has been constructed without permission of the competent authority, the fee mentioned in column (3 ) shall be payable for permissible built up area , ( in which open area, FAR, Ground Coverage , Height etc. is included) , and for the . unauthorized construction which is more than permissible FAR , up to a maximum limit of 30 percent , compounding fee as mentioned in column ( 4) , (5) & ( 6) shall be payable based on मध्यप्रदेश राजपत्र, दिनांक 31 अगस्त 2021

extent of unauthorized construction . In case the unauthorized construction is more than 30 percent of the permissible FAR, the compounding shall be done only after removing the additional unauthorized construction or getting it removed:
Provided further , that the compounding of offence of constructing building without permission or in violation of the permission granted shall not be allowed for the constructions which:
(a) affect the regular building line ;
(b) come within the area notified by the State Government as a hill station or a place of tourist importance or sensitive from the point of ecology ;
(c) come within the area specified for parking of vehicles;
(d) come within the boundary of roads or within the area affecting alignment of public roads ;
(e) come within the area specified for water bodies ;
(f) come within thirty meters or such further distance from the bank of river, as may be specified in the Master Plan of the concerned town;
(g) come within the area of any nallah and water stream;
(h) affect the structural and fire safety :
Provided also that , compounding fee for the unauthorized constructions in the unauthorized colonies , shall be charged at the rates as given above , and only after producing the proof of deposit of development fee:
Provided also that , the persons who apply for compounding of the constructions made without permission or by violating the permission granted , by 28th February 2022, shall be given a discount of twenty percent on the compounding fee calculated under provision of this rule ." .
