(ख ) उपरोक्त खण्ड ( क) से भिन्न अनुज्ञप्तिधारियों/संस्थाओं के लिए
6 . रक्षा सेवा कार्मिकों को प्रदाय की जाने वाली , भारत निर्मित विदेशी मदिरा पर देय आबकारी शुल्क असैनिक ( सिविलियन्स) द्वारा , रम के लिए दी जाने वाली शुल्क के 30 प्रतिशत की दर से तथा भारत निर्मित विदेशी मदिरा [ व्हिस्की, ब्राण्डी, जिन, वोदका, वाईन एवं माल्ट ( बीयर ) इत्यादि के लिए दी जाने वाली शुल्क के 45 प्रतिशत की दर से प्रभारित की जाएगी.
स्पष्टीकरण -1 विदेशी मदिरा ( स्पिरिट ) में सम्मिलित हैं , व्हिस्की, ब्राण्डी, रम , जिन, वोदका, लिकर्स, कार्डियल, बिटर तथा उनके मिश्रण तथा अन्य स्पिरिट युक्त निर्मितियां, जिसमें स्पिरिट मुख्य घटक हो.
स्पष्टीकरण -2 माल्ट मदिरा में सम्मिलित है, बीयर, स्टाउट, एल पोर्टर, साईडर आदि.
स्पष्टीकरण -3 " रक्षा सेवा कार्मिक " से अभिप्रेत है, ऐसा रक्षा सेवा कार्मिक, जो रक्षा कैन्टीन संगठन के माध्यम से विदेशी मदिरा प्राप्त करते हैं और उसमें सम्मिलित है सीमा सुरक्षा बल के कार्मिक और भारत तिब्बत सीमा पुलिस के कार्मिक तथा केन्द्रीय औद्योगिक सुरक्षा बल के कार्मिक, जो संबंधित प्राधिकृत थोक रक्षा कैन्टीन के माध्यम से विदेशी मदिरा प्राप्त करते हैं . ".
7. यह अधिसूचना दिनांक 1 अप्रैल 2021 से प्रवृत्त हुई समझी जायेगी.

6. The excise duty of the indian made foreign liquor issued to the defence services personnel shall be charged for Rum at the rate of 30 percent and for other indian made foreign liquor [Whisky, Brandy , Gin , Vodka , Wine, Malt (Beer) etc. ] at the rate of 45 percent of duty , payable by the civilians .
Explanation - 1- Foreign liqour (Spirit) includes Whisky, Brandy, Rum, Gin, Vodka , Liquor, Cordial , Bitter and their mixtures and other preparations , containing spirit as main ingredient .
Explanation - 2- Malt liquor includes Beer, Stout , Ale , Porter , Cider etc.
Explanation -3- "Defence services " personnel shall mean defence service personnel receiving foreign liquor through the Defence Canteen Organization and includes the personnel of the Border Security Force , Indo - Tibetian Border Police and Central Industrial Security Force , receiving foreign liquor through the respective authorized wholesale military canteens ." .
7. This notification shall be deemed to have come into force with effect from 1 " April 2021 .

L. - 2) , Hotel Bar (F. L. - 3 ) and Resort Bar (F. L. - 3 A) run by Madhya Pradesh Tourism Development Corporation from the provisions of rule 20 of the Madhya Pradesh Foreign Liquor Rules , 1996. "
2. This Notification shall be deemed to have come into force with effect from 1 " April 2021 .

In exercise of the powers conferred by Section 62 and Section 63 of the Madhya Pradesh Excise Act , 1915 (No. II of 1915) and sub- rule (2) of rule 8 of Madhya Pradesh Foreign Liquor rules , 1996 and in supersession of this Department's earlier Notification No. (25 ) B - 1-87-05-2 - V, dated 29 March 2006 and in supersession of relevant provision of other orders issued in this behalf, the State Government , hereby , fixes the consolidated annual licence fee for F. L. - 10 B licence for BIO liquor of all the manufacturers as Rs . 05.00 lakh.

In exercise of the powers conferred by sub-section ( 1 ) of Section 27 and Section 63 of the Madhya Pradesh Excise Act , 1915 (No. II of 1915 ) , and in supersession of this department's No. F -B -1-01- 2018-2-V-(09) , dated 31st March 2018 and other orders issued in this behalf, the State Government , hereby, prescribes the annual licence fee of B - 3 (brewery licence ) , issued under the Madhya Pradesh Beer and Wine Rules , as Rs . 15.00 lakh .
2. This Notification shall be deemed to have come into force with effect from 1st April 2021 .

क्र. एफ- बी- 1-16-2021-2- पाँच- ( 09 ) .-मध्यप्रदेश आबकारी अधिनियम, 1915 ( क्रमांक 2 सन् 1915 ) की धारा 62 एवं धारा 63 द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए, राज्य सरकार, एतद्वारा , मध्यप्रदेश विदेशी मदिरा नियम, 1996 में निम्नलिखित और संशोधन करती है, अर्थात्ः-
संशोधन
( 1 ) " ( एक ) -प्ररूप एफ. एल. 2 में, शर्त क्रमांक 7 - क में, अंक ' 240 ' के स्थान पर, अंक ' 480 ' तथा अंक ' 600 ' के स्थान पर, अंक ' 1200 ' स्थापित किए जाएं;
(दो) - प्ररूप एफ.एल. 3 में, शर्त क्रमांक 6- क में, अंक ' 240 ' के स्थान पर, अंक ' 600 ' तथा अंक ' 480 ' के स्थान पर, अंक ' 1200 ' स्थापित किए जाएं; और
(तीन)- प्ररूप एफ.एल. - 3 क में, शर्त क्रमांक 5 में, अंक ' 240 ' के स्थान पर, अंक ' 600 ' तथा अंक ' 480 ' के स्थान पर, अंक ' 1200 ' स्थापित किए जाएं. ".
(2) " ( एक) - नियम 8 के उपनियम ( 1 ) के खण्ड ( क) में शब्द एवं अंक ' एफ. एल . 4क ' का लोप किया जाए;
(दो) - नियम 8 के उपनियम ( 1 ) के खण्ड ' ( घघ ) ' का लोप किया जाए ;
(तीन)-नियम 8 के उपनियम ( 2 ) , ( 3 ) , ( 6 ) एवं ( 7 ) में, शब्द एवं अंक ' एफ.एल. 4 क' का लोप किया जाए;
(चार)- नियम 14 के उपनियम ( 3 ) में शब्द एवं अंक ' एफ. एल . 4क ' जहां कहीं भी वह आएं हों का लोप किया जाए;
(पांच) -नियम 14 के उपनियम ( 12 ) में, शब्द एवं अंक ' एफ.एल. 4क ' का लोप किया जाए; और
(छह) - नियम 18 के उपनियम ( 6 ) , ( 9 ) एवं ( 12 ) में, शब्द एवं अंक ' एफ.एल. - 4क ' का लोप किया जाए. ".
(3 ) नियम 8 के उपनियम ( 1 ) के पश्चात्, निम्नलिखित उपनियम अंतःस्थापित किया जाए, अर्थात्ः- " 8 ( 1 -क) रेस्टोरेंट बार, होटल बार, रिसोर्ट बार एवं क्लब बार के अनुज्ञप्तिधारी द्वारा विहित समय के पश्चात् बार संचालन के लिए अनुज्ञा चाही जाती है, तो 5,000 रुपये प्रतिदिन अतिरिक्त फीस लेकर 2 घण्टे की अतिरिक्त कालावधि, कलक्टर द्वारा दी जायेगी . ऐसी अनुज्ञा प्राप्त कर अनुज्ञप्तिधारी अनुज्ञप्त परिसर में मदिरा की बिक्री रात्रि 01.30 बजे तक एवं उपभोग का समय रात्रि 02.00 बजे तक रख सकेगा . यह विशिष्ट अनुज्ञा उपरोक्त लायसेंसों हेतु वित्तीय वर्ष में अधिकतम आठ दिवस हेतु दी जा सकेगी . यह अनुज्ञा कलक्टर के विवेकाधीन रहेगी." .
(4) नियम 8 के उपनियम ( 2 ) के पश्चात्, निम्नलिखित परन्तुक अंतःस्थापित किया जाए, अर्थात्ः- " परन्तु मध्यप्रदेश पर्यटन विकास निगम के होटलों, तथा ऐसे होटलों जिन्हें राज्य शासन द्वारा विशिष्ट श्रेणी के होटल के रूप में अधिसूचित किया जाए, के बार लायसेंसों का नवीकरण 3 वर्ष के लिये, राज्य शासन द्वारा विहित प्रक्रिया अनुसार एक मुश्त किया जाए. ".
यह अधिसूचना दिनांक 01 अप्रैल 2021 से प्रवृत्त हुई समझी जाएगी.

No. -F-B - 1-16-2021-2-V ( 09 )-In exercise of the powers conferred by Section 62 and Section 63 of the Madhya Pradesh Excise Act , 1915 (No. II of 1915) , the State Government , hereby , makes the following further amendments in the Madhya Pradesh Foreign Liquor Rules , 1996, namely :-
AMENDMENT
(1) " ( i) In Form F. L. - 2 , in condition number 7 - A, for the figure '240' , the figure '480' and for the figure ' 600' , the figure ' 1200' shall be substituted;
(ii) In Form F. L. -3 , in condition number 6- A, - for the figure ' 240' , the figure '600' and for the figure ' 480' , the figure ' 1200' shall be substituted; and
(iii) In Form F. L. - 3A , in condition number 5, for the figure '240' , the figure '600' and for the figure '480' , the figure ' 1200' shall be substituted. " .
(2) " (i ) In clause (a) of sub - rule ( 1 ) of rule 8 word and figure 'F. L , -4A' shall be omitted;
(ii) Clause ' dd' of sub - rule ( 1 ) of rule 8 shall be omitted;
(iii) In sub -rule (2) , (3 ) , (6) and (7) of rule 8 word and figure ' F.L. - 4A ' shall be omitted;
(iv) The word and figure ' F.L- 4A ' wherever they occur in sub - rule (3 ) of rule 14 shall be omitted ;
(v) In sub -rule (12) of rule 14 word and figure 'F. L- 4- A' shall be omitted ; and
(vi) In sub- rule (6) , (9) and ( 12) of rule 18 word and figure 'F. L. - 4A' shall be omitted. " .
(3) After sub- rule ( 1 ) of rule 8 , the following sub - rule shall be inserted , namely :-
"8 ( 1- A) Permission for operating the Restaurant Bar , Hotel Bar, Resort Bar and Club Bar after the prescribed time by the licensee , may be granted by the Collector for an additional period of two hours , on payment of additional fee of Rs . 5,000 per day. Under such permission the licensee may sell liquor in the licensed premises upto 01:30 Am and the time for the consumption of liquor may be till 02:00 Am . This specific permission may be granted for above bar licenses for a maximum period of 08 days in one financial year. Permission shall be given at the discretion of the Collector . " .
(4) After sub- rule (2) of rule 8 , the following proviso shall be inserted , namely :-
"Provided that the bar licenses of hotels of Madhya Pradesh Tourism Development Corporation and the hotels notified by State Government under special category shall be renewable for 3 years at a time, as per the procedure laid down by State Government . " .
2. This notification shall be deemed to have come into force , with effect from 1st April 2021 .

क्र. एफ- बी - 1-16-2021-2 - पाँच-( 10 ) .- मध्यप्रदेश आबकारी अधिनियम, 1915 ( क्रमांक 2 सन् 1915 ) की धारा 63 के साथ पठित धारा 62 की उपधारा ( 1 ) तथा उपधारा ( 2 ) के खण्ड ( घ ) द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए तथा इस निमित्त जारी इस विभाग की पूर्व अधिसूचना क्रमांक एफ- बी-1-20-2017-2- पांच, ( 21 ) दिनांक 13 जुलाई, 2017 को आंशिक रूप से अतिष्ठित करते हुए, राज्य सरकार, एतद्वारा , मध्यप्रदेश देशी स्पिरिट नियम , 1995 में निम्नलिखित और संशोधन करती है, अर्थात :-

उक्त नियमों में, नियम 10 में, विद्यमान तृतीय परन्तुक के स्थान पर, निम्नलिखित परंतुक स्थापित किया जाए, अर्थात्:-
" परंतु यह भी कि देशी मदिरा भाण्डारण भाण्डागार में बोतलबंद देशी मदिरा के भण्डारण पर अधिकतम अनुज्ञेय छीजन कांच की बोतलों के लिए 0.1 प्रतिशत तथा पैट बोतलों के लिए 0.05 प्रतिशत होगी. ".
2. यह अधिसूचना दिनांक 01 अप्रैल 2021 से प्रवृत्त हुई समझी जाएगी.

AMENDMENT
In the said Rules , in Rule 10, for the existing third proviso , the following proviso shall be substituted, namely :-
"Provided also that the maximum wastage allowed on storage of bottled country liquor stocked in a country liquor warehouse shall be 0.1 percent for glass bottles and 0.05 percent for Pet bottles . " .
2. This notification shall be deemed to have come into force , with effect from 1st April , 2021 .

नियम 17 में, उप- नियम ( 2 ) के स्थान पर, निम्नलिखित उप - नियम स्थापित किया जाए, अर्थात्:-
" ( 2 ) एफ. एल. 6 , एफ. एल. 10- क, एफ. एल. 10 - ख अनुज्ञप्तिधारी के पास एवं विदेशी मदिरा भाण्डागार में बोतलबंद विदेशी मदिरा/बीयर/ वाईन के भण्डारण में अधिकतम त्रैमासिक अनुज्ञेय छीजन नीचे विहित किए गए अनुसार दी जाएगी : -
0.05 प्रतिशत
पैट बोतलों में
(एक)
(क) विदेशी मदिरा, स्प्रिट
0.1 प्रतिशत
(दो) कांच की बोतलों में एवं बॉटल्ड इन ऑरिजन ( बी. आई. ओ. ) के लिए.
0.1 प्रतिशत (ख ) बियर / वाईन
(एक) केन में
कांच की बोतलों में
0.2 प्रतिशत.".

No. -F - B -1-16-2021-2 - V ( 12)-In exercise of the powers conferred by Section 62 and Section 63 of Madhya Pradesh Excise Act , 1915 (No. II of 1915) and sub rule (2) and (3) of rule 9 of the Madhya Pradesh Foreign Liquor Rules , 1996 , the State Government , hereby, makes the following amendment in the Notification No. F - B- 1-01-2018- 2-V( 17) , dated 31st March 2018 issued by the department previously , namely :-
AMENDMENT
In the said notification,-
"1. Serial number-4 , 8 and 9 shall be omitted.
2. After serial number- 14 a new serial number 15 shall be inserted:-
"15. Consolidated fee of Rs . 10.00 lakh for the Registration/Renewal of all labels of BIO foreign liquor for every financial year or part thereof. " .
3. This notification shall be deemed to have come into force with effect from 1st April , 2021 .

क्र. एफ- बी- 1-16-2021-2 - पाँच- ( 13 ) .-मध्यप्रदेश आबकारी अधिनियम, 1915 (क्रमांक 2 सन् 1915 ) की धारा 62 एवं 63 द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए, राज्य सरकार, एतद्वारा , मध्यप्रदेश आसवनी नियम , 1995 में निम्नलिखित और संशोधन करती है, अर्थात्ः-
संशोधन
उक्त नियमों में,-
1. नियम 3 के उपनियम ( 11 ) में, शब्द " ग्यारह लाख पचास हजार " के स्थान पर शब्द " अठारह लाख " स्थापित किए जाएं.
2. नियम 4 के उपनियम ( 43 ) के पश्चात्, निम्नलिखित उपनियम अन्तःस्थापित किए जाएं, अर्थात्ः-
" ( 44) आसवनी से अन्य स्थान के लिए रेक्टिफाइड स्पिरिट अथवा ई.एन.ए. का परिवहन एवं निर्यात करने वाले सभी वाहनों में इलेक्ट्रानिक लॉक विद जी. पी. एस. का उपयोग अनिवार्य रहेगा. "
3. यह अधिसूचना दिनांक 01 अप्रैल , 2021 से प्रवृत्त हुई समझी जाएगी .

AMENDMENT
In the said rules ,-
1. " In sub - rule ( 11 ) of rule 3 , for the words "Eleven Lakh Fifty Thousand " the words "Eighteen Lakh " shall be substituted . "
2. After sub- rule (43) of rule 4 , the following sub- rule shall be inserted , namely: -
"(44) . It shall be mandatory to use electronic lock with G. P. S. in all the vehicles transporting or exporting Rectified Spirit or E. N. A. from distillery to any other place. "
3. This notification shall be deemed to have come into force with effect from 1 " April , 2021 .
