क्र. एफ 19-2-2019- बारह-1- पार्ट.- खान एवं खनिज ( विकास एवं विनियमन ) अधिनियम , 1957 ( 1957 का 67 ) की धारा १ख के साथ पठित धारा 15 एवं धारा 23 ( ग ) द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए, राज्य सरकार, एतद्वारा , मध्यप्रदेश रेत ( खनन, परिवहन, भण्डारण एवं व्यापार ) नियम, 2019 में निम्नलिखित और संशोधन करती है, अर्थात्ः-
संशोधन
उक्त नियमों में,-
1. नियम 7 में, उपनियम ( 1 ) में, शब्द एवं अंक " रुपए 125 " के स्थान पर शब्द एवं अंक " रुपए 250 " स्थापित किए जाएं.
2. नियम 8 में, -
(1) प्रथम पैरा में, शब्द " निगम " के स्थान पर , शब्द " निगम एवं कलक्टर " स्थापित किए जाएं.
(2) उपनियम (8 ) के स्थान पर , निम्नलिखित उपनियम स्थापित किया जाए, अर्थात्ः-
" ( 8 ) निविदा प्रक्रिया हेतु समूह की निविदा की तिथि एवं समय नियत रहेगा एवं इस कालावधि का अवसान होने के पश्चात्किसी विनिर्दिष्ट समूह के लिए प्राप्त सभी निविदाएं, निविदा प्रपत्र में उल्लिखित तिथि के अनुसार खोली जाएंगी. प्राप्त निविदाओं में से उच्चतम निविदाकार को निगम कलक्टर द्वारा सफल निविदाकार घोषित करते हुए, इसकी सूचना सफल निविदाकार को दी जाएगी . इसके अतिरिक्त निगम/कलक्टर द्वितीय उच्चतम निविदाकार को भी सूचित करेगा यदि उसकी निविदा राशि का अंतर उच्चतम निविदाकार से 10 प्रतिशत से अधिक न हो. इसके पश्चात् नियम 11 में यथा उल्लिखित प्रक्रिया प्रारंभ की जा सकेगी. ".

नियम 12 में, उपनियम ( 6 ) में, शब्द " निगम " के स्थान पर, शब्द " निगम/ कलक्टर " स्थापित किए जाएं. 3.
4. नियम 13 में, उपनियम ( 2 ) के स्थान पर, निम्नलिखित उपनियम स्थापित किया जाए, अर्थात्ः- " ( 2 ) वचनबंध प्रस्तुत करने की तिथि से 15 दिवस के भीतर प्ररूप- पाँच में रेत समूह ठेका अनुबंध का निष्पादन राज्य शासन के अनुमोदन उपरांत कराया जावेगा, संपूर्ण खदानों की सूची अनुबंध का भाग होगी . अनुबंध का भारतीय स्टांप और रजिस्ट्रीकरण अधिनियम , 1908 ( 1908 का क्रमांक 16 ) के उपबंधों के अधीन पंजीयन कराया जाएगा. खदानवार वैधानिक अनुमतियां प्राप्त होने पर, पृथक् पृथक् खदानवार ठेका अनुबंध किया जावेगा. ".
5. नियम 16 में , प्रथम पैरा के अंत में, कॉलन के स्थान पर , पूर्ण विराम स्थापित किया जाए तत्पश्चात् निम्नलिखित वाक्य जोड़ा जाए, अर्थात्ः-
" उक्त ठेका समर्पण , राज्य शासन का अनुमोदन प्राप्त कर, किया जा सकेगाः ".
6. नियम 25 में, उपनियम ( 2 ) के पश्चात्, निम्नलिखित उपनियम स्थापित किया जाए, अर्थात्ः-
" ( 3) इन नियमों में जब भी कोई संशोधन अपेक्षित हो, प्रशासकीय विभाग द्वारा मुख्यमंत्री के समन्वय में आदेश प्राप्त कर, किया जा सकेगा.".
No. F - 19-2-2019 - XII - 1 - Part . In exercise of the powers conferred by Section 15 and Section 23 (C ) read with Section 9B of the Mines and Minerals ( Development and Regulation ) Act , 1957 (67 of 1957 ) , the State Government, hereby , makes the following further amendments in the Madhya Pradesh Sand ( Mining , Transportation , Storage and Trading ) Rules , 2019 , namely:-
AMENDMENTS
In the said rules ,-
1. In rule 7 , in sub - rule ( 1 ) , for the words and figure "Rs . 125 " , the words and figure "Rs . 250 " shall be substituted.
2. In rule 8 ,-
(1) In the first paragraph , for the word " Corporation" , the words "Corporation and Collector " shall be substituted.
(2) For sub - rule ( 8 ) , the following sub - rule shall be substituted , namely:-
"(8) The date and time of tender of group for the tender process shall be fixed and after expiry of this period, all the tenders received for any specific group shall be opened as per the date mentioned in tender document . Declaring the highest tenderer as the successful tenderer from the tenders received by the Corporation/ Collector, information shall be given to the successful tenderer . Beside this , the Corporation/Collector shall inform to the second highest tenderer if the difference of his tender amount is not more than 10 % of the tender amount of highest tenderer . Thereafter the process as mentioned in rule 11 may be started ." .
3. In rule 12 , in sub - rule ( 6) , for the word "Corporation " , the words " Corporation/ Collector " shall be substituted .

4. In rule 13 , for sub - rule (2 ) , the following sub - rule shall be substituted , namely:-
"(2) The sand group contract agreement may be executed after the approval of the State Government in Form- V within 15 days from the date of submission of the undertaking , the list of entire mines shall be part of the contract . Agreement shall be registered under the provisions of Indian Stamp and Registration Act , 1908 ( No. 16 of 1908 ) . On receipt of mine wise statutory clearances , separate mine wise contract shall be done . ".
5. In rule 16, in the end of first para , for colon , full stop shall be substituted and thereafter the following sentence shall be added , namely:-
"The said contract may be surrendered , after getting the approval of the State Government: " .
6. In rule 25, after sub - rule (2) , the following sub -rule shall be added , namely:-
"(3) Whenever any amendments are required in these rules , it may be made after getting order in coordination of the Chief Minister , by the administrative department ." .
