क्र. एफ - 12-83-2021- बी-1- दो. पुलिस अधिनियम, 1861 ( 1861 का 5 ) की धारा 2 के साथ पठित धारा 46 की उपधारा ( 2 ) तथा ( 3 ) द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए, राज्य सरकार, एतद्वारा, मध्यप्रदेश पुलिस रेग्युलेशन में निम्नलिखित संशोधन करती है, अर्थात्ः-

संशोधन

उक्त रेग्युलेशन में, -

1. रेग्युलेशन 501 के पश्चात् निम्नलिखित रेग्युलेशन स्थापित किया जाएं, अर्थात्ः-

" 501 - अ पोस्टमार्टम रिपोर्ट के साथ बाडी स्केच संलग्न किया जाना.-

पोस्टमार्टम परीक्षण करने के लिये नियुक्त चिकित्सा अधिकारी, पोस्टमार्टम रिपोर्ट के साथ एक बॉडी स्केच तैयार करेगा . बॉडी स्केच मुद्रित प्रारूप में होगी जिसमें मानव शरीर पर आई चोटों को चिन्हांकित किया जावेगा .

स्पष्टीकरण- मानव शरीर के मुद्रित प्रारूप में मानव शरीर का ललाट और शरीर के पीछे का भाग दोनों समाविष्ट होगें । बॉडी स्केच के मुद्रित प्रारूप का नमूना परिशिष्ट 'ए' पर संलग्न है। 501- ब कतिपय प्रकरणों में पोस्टमार्टम के फोटोग्राफ और वीडियो ग्राफ.-

(1) पुलिस कार्रवाई के दौरान किसी व्यक्ति की मृत्यु के प्रकरण में धारा 46 दंड प्रक्रिया संहिता, 1973 या धारा 129 से 131 दंड प्रक्रिया संहिता , 1973 या पुलिस अभिरक्षा में मृत्यु के मामलों में, यथास्थिति, मजिस्ट्रेट या अन्वेषण अधिकारी , अस्पताल या प्रभारी चिकित्सक को मृतक के पोस्टमार्टम के दौरान मृतक की फोटोग्राफी और वीडियोग्राफी की व्यवस्था करने के लिए सूचित करेगा ।

सभी प्रकार के प्रकरणों में मृतक के फोटोग्राफ लेने की व्यवस्था की जाएगी ।

(2) उक्त फोटोग्राफी एवं वीडियोग्राफी पुलिस फोटोग्राफर या राज्य सरकार के द्वारा नामांकित फोटोग्राफर की व्यवस्था करके की जाएगी और जहां उपरोक्त में से कोई भी उपलब्ध नहीं है, एक स्वतंत्र अथवा निजी फोटोग्राफर की सेवाएं उपयोग की जावेंगी ।

(3) ऐसे फोटोग्राफ और वीडियोग्राफ को पंचनामा या जप्ती पत्रक के अधीन जप्त किया जाएगा और विचारण के दौरान ऐसी फोटोग्राफ/वीडियोग्राफी को साबित करना सुनिश्चित किया जाएगा । (4) अन्वेषण अधिकारी यह सुनिश्चित करेगें कि जहां ऐसे फोटोग्राफ और वीडियोग्राफ को यदि इलेक्ट्रॉनिक रूप में लिया जाता है वहां इन्हें पंचनामा अथवा जप्ती पत्रक के माध्यम से जप्त किया जाए तथा मूल को संरक्षित करने के कदम उठाए जाएं । यह सुनिश्चित करने के लिये कि धारा 65 ख भारतीय साक्ष्य अधिनियम , 1872 (1872 का 1) के तहत प्रमाण पत्र प्राप्त कर लिया गया है और विचारण के दौरान उसको साबित किया जायेगा ।

(5) वीडियों और फोटोग्राफ को एक पृथक मेमोरी कार्ड में संग्रहीत किया जायेगा, जिसमें धारा 65 ख भारतीय साक्ष्य अधिनियम , 1872 ( 1872 का 1 ) का प्रमाणित प्रमाण पत्र संलग्न किया जाएगा।

(6) जहां पोस्टमार्टम की कार्यवाही इलेक्ट्रॉनिक रूप में अभिलिखित की जाती हैं, वहां पोस्टमार्टम की कार्यवाही की सम्यक रूप से प्रमाणित फाइल को विधिवत प्रमाणन के साथ अटैचमेंट के रूप में मेमोरी कार्ड के साथ रखा जाएगा जब तक कि व्यक्तिगत मेमोरी कार्ड न्यायालय के समक्ष प्रस्तुत करना संभव न हों। "

2- रेग्युलेशन 747 के पश्चात निम्नलिखित रेग्युलेशन अंतः स्थापित किया जाए अर्थातः-

"747 क- मौका पंचनामा

(1) अन्वेषण अधिकारी द्वारा घटनास्थल का एक साइट प्लान संलग्न किया जाएगा सीन महजर या पंचनामें के साथ संलग्न किया जाएगा। 824( 1)

(2) अन्वेषण अधिकारी द्वारा साइट प्लान अपनी हस्तलिपि में बनाया जाएगा जिसमें घटनास्थल के संबंध में निम्नानुसार उल्लेख होगाः-

(क) घटना का स्थान ;

(ख ) वह स्थान जहां शव (या शवों) को पाया गया;

(ग) स्थान जहां मुख्य पदार्थ एवं हथियार पाए गए;

( घ) रक्त के दाग और / या शरीर के तरल पदार्थ गिरे;

(ङ) वह स्थान जहां कारतूस के खोखे यदि कोई पाये गये या निशान पाया गया;

(च) प्रकाश का स्रोत, यदि कोई हो; और

(छ) प्राकृतिक और मानव निर्मित संरचनाओं या संरचनाओं जैसे दीवारों, गड्डों, बाड़, पेड़/ झाड़ियों, यदि कोई हो; और

(ज) संरचना और उनके स्थान की ऊंचाई ।

(3) अन्वेषण अधिकारी द्वारा स्केच को तैयार करने के बाद , यदि उपलब्ध हो तो पुलिस ड्राफ्ट्समैन द्वारा एक स्केल्ड साइट प्लान तैयार किया जायेगा, अथवा राज्य सरकार द्वारा प्राधिकृत या नामनिर्दिष्ट ड्राफ्ट्समैन द्वारा घटनास्थल का दौरा करने के बाद स्केल्ड साइट प्लान तैयार किया जाएगा । महाजर या पंचनामें में सुसंगति विवरणों को उक्त साइट प्लान में मार्क किया जाएगा तथा आपस में सहसंबंधित किया जाएगा । " (4)

3. रेग्युलेशन 815 के पश्चात निम्नलिखित रेग्युलेशन अन्तः स्थापित किया जाए , अर्थातः-

"815 क - पोस्टमार्टम रिपोर्ट तैयार करने के लिए नियुक्त चिकित्सा अधिकारी , मेडिको लीगल रिपोर्ट के साथ एक बॉडी स्केच तैयार करेगा। बॉडी स्केच मुद्रित प्रारूप में होगा जिसमें मानव शरीर पर आई चोटों को चिन्हांकित किया जाएगा ।

स्पष्टीकरण- मानव शरीर के मुद्रित प्रारूप में मानव शरीर का ललाट और शरीर के पीछे का भाग दोनों दृश्य होंगे। बॉडी स्केच के मुद्रित प्रारूप परिशिष्ठ ' ए' पर सलग्न है । " । 824 (2)

No F 12-83 /2021 /B - 1 . Two , In exercise of the powers conferred by sub - section (2) and (3) of section 46 read with section 2 of the Police Act , 1861 (No. 5 of 1861 ) , the State Government, hereby , makes the following further amendments in the Madhya Pradesh Police Regulations , namely: -

AMENDMENTS

In the said Regulations , -

(1) After Regulation 501 , the following Regulations shall be inserted , namely: - " 501 -A BODY SKETCH TO ACCOMPANY POST MORTEM REPORT.-

The medical officer , appointed to hold post- mortem examination , shall prepare a body sketch accompanying the post- mortem report . The body sketch shall be in the printed format indicating the injuries on the human body .

Explanation- The printed format of the human body shall contain both a frontal and rear view of the human body . A specimen of the printed format of body sketch is appended herewith as annexure- "A " .

501 - B PHOTOGRAPHS AND VIDEO GRAPHS OF POST MORTEM IN CERTAIN CASES.-

(1 ) In case of death of a person in police action [ under Section 46 Criminal Procedure Code, 1973 or Sections 129 to 131 Criminal Procedure Code , 1973 or death while in police custody , the Magistrate or the Investigating Officer as the case may be , shall inform the hospital or doctor- in- charge to arrange for photographs and videography for conducting the post- mortem examination of the deceased. The photographs of the deceased shall also be arranged to be taken in all cases .

(2) Such photograph and videographs shall be taken either by arranging a police photographer or a nominated photographer of the State Government , and where neither of the above are available , an independent or private photographer shall be engaged .

(3 ) Such photographs and videographs shall be seized under a panchnama or seizure memo and all steps shall be taken to ensure proper proof of such photographs /videographs during Trial .

(4) The Investigating Officer shall ensure that such photographs and videographs , if taken electronically , are seized under a panchnama or seizure memo and steps are taken to preserve the original , and ensure that certificate under Section 65B Indian Evidence Act, 1872 ( 1 of 1872) is obtained and taken to be proved during trial .

(5) The video and photographs shall be stored in a separate memory- card, accompanied by a duly certified certificate under Section 65B ofIndian Evidence Act, 1872 ( 1 of 1872) .

(6) Where post - mortems are recorded in electronic form , the file containing the post - mortem proceedings , duly certified , should be placed with the memory - card as an attachment unless individual memory - cards are not capable of being produced before the Court . " (2) After Regulation 747 , the following Regulation shall be inserted, namely: - "747 -A SPOT PANCHANAMA.-

(1 ) A site plan of the place of occurrence of an incident shall be appended by the Investigating Officer to the scene mahazar or spot panchnama .

(2) The site plan shall be prepared by the Investigating Officer by hand, and shall disclose , -

(a) the place of occurrence ;

(b) the place where the body (or bodies ) was / were found;

(d) blood stains and/ or body fluids had fallen;

(e) the place where bullet shells , if any , were found or have caused impact;

(f) the source of light , if any and;

(g) adjoining natural and man - made structures or features such as walls , pits , fences , trees /bushes , if any ; and

(h) elevation of structures and their location.

(3) The preparation of this sketch by the Investigating Officer shall be followed by a scaled site plan prepared by police draftsman , if available , or such other authorized or nominated draftsman by the State Government who shall prepare the scaled site plan after visiting the spot .

(4) The relevant details in the mahazar or panchnama shall be marked and correlated in the said site plan . "

(3) After Regulation 815 , the following Regulation shall be inserted, namely: - " 815 - A BODY SKETCH TO ACCOMPANY MEDICO LEGAL CERTIFICATE.-

The medical officer , appointed to hold post - mortem examination , shall prepare a body sketch accompanying the Medico Legal Report . The body sketch shall be in the printed format indicating the injuries on the human body. Explanation : The printed format of the human body shall contain both a frontal and rear view of the human body . A specimen of the printed format of body sketch is appended herewith as annexure- "A. " .
