क्र . एफ ए 3-33-2017-1 - पांच- ( 72 ) .-मध्यप्रदेश माल एवं सेवा कर अधिनियम , 2017 ( 2017 का 19 ) की धारा 9 की उपधारा ( 1 ) और धारा 15 की उपधारा ( 5 ) के तहत् प्रदत्त शक्तियों का प्रयोग करते हुए , राज्य सरकार , परिषद् की सिफारिशों के आधार पर , एतद्वारा , इस विभाग की अधिसूचना क्र . एफ ए- 3-33-2017-1- पांच ( 42 ) , भोपाल , दिनांक 05 अगस्त , 2017 में और आगे भी निम्नलिखित संशोधन करती है , अर्थात्ः- उक्त अधिसूचना में: -
क . अनुसूची I में -2.5 % ,-
(i) क्रमांक 71 और उससे संबंधित प्रविष्टियों के बाद , निम्नलिखित क्रमांक और प्रविष्टियां अंतःस्थापित की जाएंगी , यथाः-
"71 क 1209 इमली के बीज बुवाई के अलावा किसी अन्य उपयोग के लिए " ;

"186क 3826 हाई- स्पीड डीजल के साथ सम्मिश्रण के लिए तेल विपणन कंपनियों को आपूर्ति किए गए बायो-डीजल " ;
(iv) क्रमांक 187क और उससे संबंधित प्रविष्टियों को हटा दिया जाएगा;
(v) क्रम संख्या 234 और उससे संबंधित प्रविष्टियों को हटा दिया जाएगा;
(vi ) सूची 1 में, मद संख्या 231 और उससे संबंधित प्रविष्टियों के बाद, निम्नलिखित प्रविष्टि को अंतःस्थापित किया जाएगा, यथाः
"(232) पेम्ब्रोलिजुमाब (कीटूडा) " ;
(vii) सूची 3 में, मद संख्या (ख ) (2) और उससे संबंधित प्रविष्टियों के बाद, निम्नलिखित प्रविष्टिको अंतःस्थापित किया जाएगा, यथाः
"(3 ) दिव्यांगो द्वारा उपयोग किए जाने वाले वाहनों के लिए रेट्रो फिटमेंट किट";
ख. अनुसूची II में 6%,
(i ) क्रम संख्या 80क के सामने, कॉलम (3) में, प्रविष्टि के स्थान पर, निम्नलिखित प्रविष्टि को प्रतिस्थापित किया जाएगा, यथाः
"बायो-डीजल (हाई- स्पीड डीजल के साथ सम्मिश्रण के लिए तेल विपणन कंपनियों को आपूर्ति किए गए बायो-डीजल के अलावा) " ;
क्रमांक 122 और उससे संबंधित प्रविष्टियों को हटा दिया जाएगा; (ii)
क्रमांक 127 से 132 और उससे संबंधित प्रविष्टियों को हटा दिया जाएगा;
(iii)
(iv) क्रमांक 201 और उससे संबंधित प्रविष्टियों के बाद, निम्नलिखित क्रम संख्या और प्रविष्टियों को अन्तःस्थापित किया जाएगा; यथाः
निम्नलिखित अक्षय ऊर्जा उपकरणों और उनके उत्पादन के पुर्जे लिए भागों "201 क 84 , 85 या 94 का अनुसरण उत्पादनः
(क) जैव गैस संयंत्र;
(ख) सौर ऊर्जा आधारित उपकरण;
(ग) सौर ऊर्जा जनरेटर;
(घ) पवन मिलें, पवन संचालित बिजली जेनरेटर
(डब्ल्यूओईजी);
(ङ) ऊर्जा संयंत्रों/ उपकरणों के लिए अपशिष्ट;
(च) सौर लालटेन/ सौर लैंप;
(छ) महासागरीय तरंगें / ज्वारीय तरंगें ऊर्जा उपकरण /पौधे;
(ज) फोटो वोल्टाइक सेल, मॉड्यूल में असेंबल किया गया है या नहीं या पैनलों में बना है । 874( 1)

स्पष्टीकरणः - यदि इस प्रविष्टि में निर्दिष्ट सामान आपूर्ति किया जाता है, एक आपूर्तिकर्ता द्वारा , अन्य सामानों की आपूर्ति के साथ और सेवाएं, जिनमें से एक विनिर्दिष्ट कर योग्य सेवा है में उल्लिखित तालिका के क्रमांक 38 की प्रविष्टि में अधिसूचना एफ ए-3-33 / 2017 / 1 / पांच (42) भोपाल दिनांक 05 अगस्त 2017 के लिए माल की आपूर्ति का मूल्य इस प्रविष्टि के उद्देश्यों को ऐसी सभी आपूर्तियों के लिए प्रभारित सकल प्रतिफल के सत्तर प्रतिशत के रूप में समझा जाएगा और सकल प्रतिफल का शेष तीस प्रतिशत प्रभारित उक्त कर योग्य सेवा के मूल्य के रूप में समझा जाएगा । " ;
(v) क्रमांक 205क से 205ज और उससे संबंधित प्रविष्टियों को हटा दिया जाएगा;
(vi) क्रमांक 232 और उससे संबंधित प्रविष्टियों को हटा दिया जाएगा;
ग. अनुसूची III में - 9% ,
(i) क्रमांक 26ख और उससे संबंधित प्रविष्टियों के बाद , निम्नलिखित क्रम संख्या और प्रविष्टियां अन्तःस्थापित की जाएंगी, यथाः

No. F A 3-33 /2017 / 1 /V (72) : In exercise of the powers conferred by sub- section ( 1 ) of section 9 and sub - section (5) of section 15 of the Madhya Pradesh Goods and Services Tax Act, 2017 (19 of 2017) , the State Government, on the recommendations of the Council , hereby makes the following further amendments in this department's Notification No. F A3-33-2017-1 -V(42) dated the 29th June, 2017 , namely: -
In the said notification ,
(a) inSchedule I - 2.5 % , -
(i) after S. No. 71 and the entries relating thereto , the following S. No. and entries shall be inserted, namely : -
71A 1209 Tamarind seeds meant for any use other than sowing" ;
"
(ii) S. Nos . 138 to 148 and the entries relating thereto shall be omitted;
(iii) after S. No. 186 and the entries relating thereto , the following S. No. and entries shall be inserted , namely : -
" 186A 3826 Bio- diesel supplied to Oil Marketing Companies for blending with High Speed Diesel " ;
(iv) S. No. 187A and the entries relating thereto shall be omitted;

No. 38 of the Table mentioned in the Notification No. FA 3-33- 2017-1-V(42) , dated the 29th June, the value of supply of goods for the purposes of this entry shall be deemed as seventy per cent. of the gross consideration charged for all such supplies , and the remaining thirty per cent . of the gross consideration charged shall be deemed as value of the said taxable service.";
(v) S. Nos . 205A to 205H and the entries relating thereto shall be omitted;
