सूचना

क्र. एफ- 4-2-2021 - छब्बीस- 2.- नियमों का निम्नलिखित प्रारूप जिसे राज्य सरकार उभयलिंगी व्यक्ति (अधिकारों का संरक्षण) अधिनियम, 2019 (2019 का 40) की धारा 22 द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए , बनाना प्रस्तावित करती है, अधिनियम की उक्त धारा की उपधारा (1 ) द्वारा अपेक्षित किए गए अनुसार उन समस्त व्यक्तियों की जानकारी के लिए , जिनके कि उससे प्रभावित होने की संभावना है, एतद्वारा प्रकाशित किया जाता है और एतद्वारा यह सूचना दी जाती है कि मध्यप्रदेश राजपत्र में इस सूचना के प्रकाशन की तारीख से तीस दिवस की अवधि का अवसान होने के पश्चात् उक्त प्रारूप नियम पर विचार किया जाएगा.

किन्हीं भी ऐसी आपत्तियों या सुझावों पर, जो प्रमुख सचिव, मध्यप्रदेश शासन, सामाजिक न्याय एवं निःशक्तजन कल्याण विभाग , मंत्रालय, वल्लभ भवन, भोपाल के कार्यालय में उक्त प्रारूप नियमों के संबंध में किसी भी व्यक्ति से ऊपर विनिर्दिष्ट कालावधि का अवसान होने के पूर्व प्राप्त हों, राज्य सरकार द्वारा विचार किया जाएगा, अर्थात्:-

प्रारूप नियम

1. संक्षिप्त नाम और प्रारंभ.-

(1 ) इन नियमों का संक्षिप्त नाम मध्यप्रदेश उभयलिंगी व्यक्ति (अधिकारों का संरक्षण) नियम, 2021 है.

(2) इनका विस्तार सम्पूर्ण मध्यप्रदेश राज्य पर होगा.

(3) ये मध्यप्रदेश राजपत्र में इनके प्रकाशन की तारीख से प्रवृत्त होंगे .

2. परिभाषा.-

(1 ) इन नियमों में, जब तक कि संदर्भ से अन्यथा अपेक्षित न हो-

(क) "अधिनियम " से अभिप्रेत है, उभयलिंगी व्यक्ति (अधिकारों का संरक्षण ) अधिनियम , 2019 (2019 का 40);

(ख ) " शपथ पत्र" से अभिप्रेत है , अपने स्व- चिन्हित लिंग की पहचान का प्रमाण- पत्र प्राप्त करने के लिए किसी आवेदक द्वारा प्रस्तुत किया जाने वाला प्ररूप -2 में स्व- प्रमाणित शपथ पत्र;

(ग) "आवेदक" से अभिप्रेत है, कोई उभयलिंगी व्यक्ति जो नियम 3 के अधीन आवेदन प्रस्तुत करता है ;

(घ ) "आवेदन" से अभिप्रेत है, प्ररूप -1 में यथा उपबंधित आवेदन पत्र;

(ड.) "कोई आधिकारिक दस्तावेज " से अभिप्रेत है और इसमें सम्मिलित हैं उपाबंध-1 में सूचीबद्ध सभी दस्तावेज, जिन्हें राज्य सरकार राजपत्र में अधिसूचना द्वारा पुनरीक्षित कर सके;

(च) "अपील प्राधिकारी " से अभिप्रेत है , संभागीय आयुक्त (राजस्व);

(छ) "पहचान प्रमाण- पत्र" से अभिप्रेत है, जिला मजिस्ट्रेट द्वारा अधिनियम की धारा 6 अथवा धारा 7 के अधीन क्रमशः प्ररूप 3 अथवा प्ररूप -4 के रूप में जारी प्रमाण पत्र;

(ज) "भेदभाव" से अभिप्रेत है, लैंगिक पहचान और अभिव्यक्ति के आधार पर कोई भेदभाव , बहिष्कार या प्रतिबंध , जिसका प्रयोजन या प्रभाव , दूसरों के साथ बराबरी के आधार पर, सभी मानवाधिकारों और राजनीतिक, आर्थिक , सामाजिक , सांस्कृतिक , नागरिक या किसी अन्य क्षेत्र में मौलिक स्वतंत्रताओं और इसमें उचित आवास से इनकार सहित सभी प्रकार के भेदभाव सम्मिलित हैं, की मान्यता, उपभोग या प्रयोग को कम करना या निष्प्रभावी करना है;

(झ) "सरकार" से अभिप्रेत है, मध्यप्रदेश सरकार;

(ञ) " पहचान पत्र" से अभिप्रेत है, इन नियमों के प्रवृत्त होने से पूर्व जिला मजिस्ट्रेट द्वारा जारी " पहचान प्रमाण - पत्र " अथवा किसी राज्य प्राधिकारी द्वारा किसी उभयलिंगी व्यक्ति को जारी किए गए " पहचान पत्र" के आधार पर धारा 6 के अधीन प्ररूप -5 में उल्लिखित किसी उभयलिंगी व्यक्ति को जारी 906(1)

अथवा धारा 7 के अधीन लिंग परिवर्तन पर किसी उभयलिंगी व्यक्ति को प्ररूप-6 में जारी फोटो पहचान पत्र;

(ट) " चिकित्सा संस्थान " से अभिप्रेत है, ग्रामीण क्षेत्रों अथवा शहरी क्षेत्रों अथवा विदेश में स्थित कोई चिकित्सा संस्थान चाहे वह निजी अथवा सरकारी अस्पताल या क्लीनिक हो;

(ठ) "प्रक्रिया" से अभिप्रेत है, धारा 6 अथवा धारा 7 के अधीन पहचान प्रमाण- पत्र जारी करने के लिए जिला मजिस्ट्रेट द्वारा अपनाई जाने वाली प्रक्रिया;

(ड) "धारा " से अभिप्रेत है, अधिनियम की धारा ;

(ढ) "राज्य" से अभिप्रेत है , मध्यप्रदेश राज्य ।

(2 ) अन्य समस्त शब्दों और अभिव्यक्तियों के, जो अधिनियम में प्रयुक्त हुए हैं किन्तु परिभाषित नहीं किए गए है, वही अर्थ होंगे , जो अधिनियम में उनके लिए समनुदेशित किए गए हैं ।

3. पहचान प्रमाण-पत्र जारी करने के लिए आवेदन.-

(1 ) पहचान प्रमाण पत्र प्राप्त करने का इच्छुक उभयलिंगी व्यक्ति, प्ररूप -1 में यथाविहित आवेदन करेगा ।

(2) राज्य सरकार द्वारा ऑनलाइन सुविधाएं विकसित किए जाने तक आवेदन जिला मजिस्ट्रेट को व्यक्तिगत अथवा डाक द्वारा प्रस्तुत किए जाएंगे और तत्पश्चात् आवेदन किया जाएगा:

परंतु राज्य सरकार दूरस्थ क्षेत्रों अथवा अलाभकारी परिस्थितियों में रहने वाले उभयलिंगी व्यक्तियों द्वारा पहचान प्रमाण - पत्र के लिए आवेदन प्रस्तुत करने को सुकर बनाने हेतु ऐसे उपाय अपना सकेगी जैसे कि वह आवश्यक समझे :

परंतु यह और कि अवयस्क बच्चे के मामले में, ऐसा आवेदन ऐसे अवयस्क बच्चे के माता- पिता अथवा अभिभावक द्वारा तथा देखरेख और संरक्षण के मध्यप्रदेश राजपत्र, दिनांक 18 नवम्बर 2021

जरूरतमंद बच्चे के मामले में किशोर न्याय (बालकों की देखरेख और संरक्षण ) अधिनियम, 2015 के अधीन सक्षम प्राधिकारी द्वारा प्रस्तुत किया जाएगा ।

(3) ऐसे उभयलिंगी व्यक्ति से, जिन्होंने अधिनियम के प्रवृत्त होने के पूर्व चाहे पुरुष , महिला या उभयलिंगी के रूप में , लिंग परिवर्तन आधिकारिक रूप से दर्ज कराया है, इन नियमों के अधीन पहचान प्रमाण-पत्र के लिए आवेदन प्रस्तुत करने की अपेक्षा नहीं की जाएगीः

परंतु ऐसे व्यक्तिं अधिनियम के अधीन किसी उभयलिंगी व्यक्ति को प्रदत्त सभी अधिकारों और पात्रताओं का लाभ उठाएंगे ।

(4 ) राज्य सरकार दूरस्थ क्षेत्रों अथवा वंचित परिस्थितियों में रहने वाले उभयलिंगी व्यक्तियों द्वारा पहचान प्रमाण - पत्र के लिए आवेदन अनुविभागीय अधिकारी (राजस्व) , तहसीलदार, नायब तहसीलदार को प्रस्तुत करेगी ।

4. धारा 6 के अधीन पहचान प्रमाण - पत्र जारी करने के लिए प्रक्रिया.-

(1 ) जिला मजिस्ट्रेट प्ररूप -2 में किसी व्यक्ति के लिंग पहचान की घोषणा करने वाले प्रस्तुत शपथ - पत्र के आधार पर, किन्तु किसी चिकित्सा जांच के बिना सत्यता के अध्यधीन रहते हुए आवेदन पर कार्यवाही करेगा और आवेदक की एक पहचान संख्या जारी करेगा, जिसे आवेदन के प्रमाण के रूप में उदृत किया जा सकेगा । (2) निवास स्थान के निर्धारण के प्रयोजन के लिए आवेदक को आवेदन की तारीख से पिछले बारह माह की नियमित कालावधि के लिए जिला मजिस्ट्रेट के क्षेत्राधिकार के अधीन आने वाले क्षेत्र का निवासी होना चाहिए और प्ररूप -2 में इस प्रभाव का एक शपथ पत्र प्रस्तुत किया जाएगा तथा कोई अतिरिक्त साक्ष्य नहीं मांगी जाएगी । 5. धारा 6 के अधीन किसी उभयलिंगी व्यक्ति के लिए पहचान प्रमाण पत्र का जारी किया जाना-

(1 ) जिला मजिस्ट्रेट , नियम 4 में उपबंधित प्रक्रिया का अनुसरण करते हुए ऐसे व्यक्ति का लिंग उपदर्शित करते हुए प्ररूप -3 में आवेदक को पहचान प्रमाण - पत्र जारी करेगा । 906(3)

(2) उक्त पहचान प्रमाण- पत्र , शपथ पत्र के साथ सम्य्करूप से भरे गए आवेदन के प्राप्त होने के तीस दिन के भीतर जारी किया जाएगा ।

(3) उप- नियम (1 ) के अधीन जारी पहचान प्रमाण - पत्र, उपबंध -1 में उक्त पहचान प्रमाण- पत्र में विनिर्दिष्ट लिंग के अनुसार में यथा - उपबंधित ऐसे सभी आधिकारिक दस्तावेजों में उभयलिंगी व्यक्ति को, यदि ऐसा आवश्यक हो तो उसके नाम और छायाचित्र के साथ ही साथ लिंग परिवर्तित करने का आधार होगा ।

(4) जिला मजिस्ट्रेट उप- नियम (1 ) के अधीन पहचान प्रमाण - पत्र जारी करते समय , आवेदक को प्ररूप -5 में उल्लिखित उभयलिंगी पहचान पत्र जारी करेगा । (5) उभयलिंगी पहचान पत्र को राज्य सरकार द्वारा लोक सेवा के प्रयोजनों के लिए अपने अभिलेखों में अन्तर्विष्ट किया जाएगा ।

(6) कोई प्राधिकारी जिसने नियम 3 के अधीन किसी आवेदक द्वारा दिए गए आवेदन पर आधिकारिक दस्तावेज जारी किए थे, ऐसा आवेदन किए जाने के पन्द्रह दिन के भीतर आधिकारिक दस्तावेजों में आवेदक का नाम अथवा लिंग अथवा दोनों को परिवर्तित करेगा ।

(7) कोई आधिकारिक दस्तावेज , जिसमें उभयलिंगी का लिंग , नाम और छायाचित्र उक्त पहचान प्रमाण- पत्र के आधार पर पुनरीक्षित किया गया है, उसमें वही क्रम संख्या अथवा संदर्भ संख्या होगी जैसी कि ऐसे उभयलिंगी व्यक्ति, जो आधिकारिक दस्तावेजों में नाम या लिंग या दोनों में परिवर्तन कराने की वांछा रखता है के मूल आधिकारिक दस्तावेजों में हो :

परंतु समस्त अभिलाभ जिसका कि कोई उभयलिंगी व्यक्ति किसी राज्य प्राधिकारी द्वारा जारी किए गए पहचान पत्र, यदि कोई हो, के आधार पर लाभ प्राप्त करने का पात्र था, उनका इन नियमों के अधीन जारी पहचान प्रमाण-पत्र के आधार पर उस उभयलिंगी व्यक्ति द्वारा अभिलाभ प्राप्त किया जाता रहेगा । 6. लिंग परिवर्तन के लिए पहचान प्रमाण-पत्र जारी किए जाने के लिए प्रक्रिया.- (1) यदि कोई उभयलिंगी व्यक्ति या तो पुरुष या महिला के रूप में लिंग परिवर्तन के लिए चिकित्सीय अन्तःक्षेप से होकर गुजरता है तो ऐसा व्यक्ति उस चिकित्सा संस्थान के चिकित्सा अधीक्षक अथवा मुख्य चिकित्सा अधिकारी द्वारा , जिसमें वह व्यक्ति उक्त चिकित्सीय अन्तःक्षेप से होकर गुजरा है जारी उस प्रभाव के मध्यप्रदेश राजपत्र, दिनांक 18 नवम्बर 2021

प्रमाण- पत्र के साथ , धारा 7 के अधीन पुनरीक्षित पहचान प्रमाण- पत्र जारी किए जाने के लिए जिला मजिस्ट्रेट को प्ररूप -1 में आवेदन कर सकेगा ।

(2) जिला मजिस्ट्रेट, उप - नियम (1 ) में निर्दिष्ट किसी आवेदन की प्राप्ति पर उक्त चिकित्सा प्रमाण पत्र की सत्यता का सत्यापन करेगा ।

(3) निवास स्थान के निर्धारण के प्रयोजन के लिए आवेदक को आवेदन की तारीख से पिछले बारह माह की नियमित अवधि के लिए जिला मजिस्ट्रेट के क्षेत्राधिकार के अधीन आने वाले क्षेत्र का निवासी होना चाहिए और प्ररूप -1 में आवेदन के साथ इस प्रभाव का एक शपथ - पत्र प्रस्तुत किया जाएगा तथा कोई अतिरिक्त साक्ष्य नहीं मांगी जाएगी ।

7. पहचान प्रमाण- पत्र जारी किया जाना-

(1 ) जिला मजिस्ट्रेट धारा 7 के अधीन लिंग परिवर्तन चाहने वाले प्ररूप -4 में उल्लिखित आवेदक को, यथास्थिति, पुरुष या महिला के रूप में ऐसे व्यक्ति का लिंग दर्शित करते हुए , एक पुनरीक्षित प्रमाण - पत्र जारी करेगा ।

(2) जिला मजिस्ट्रेट इसकी प्राप्ति के पंद्रह दिन के भीतर उप- नियम (1 ) के अधीन पुनरीक्षित प्रमाण - पत्र जारी करेगा ।

(3) उप- नियम (1 ) के अधीन जारी किया गया पहचान प्रमाण - पत्र आवेदक को उपबंध -1 में उपबंधित सभी ऐसे आधिकारिक दस्तावेजों में, यदि ऐसा आवश्यक होतो , उभयलिंगी व्यक्ति के लिंग , छायाचित्र के साथ साथ नाम को उक्त पहचान प्रमाण- पत्र में विनिर्दिष्ट लिंग के अनुसार, यथास्थिति , पुरूष या महिला के रूप में अभिलिखित या परिवर्तित करने का हकदार बनाएगा ।

(4) जिला मजिस्ट्रेट लिंग परिवर्तन के लिए पहचान प्रमाण - पत्र जारी करते समय , आवेदक को प्ररूप- 6 में उल्लिखित पहचान पत्र जारी करेगा ।

(5) राज्य सरकार द्वारा लोक सेवा के प्रयोजन के लिए उनके अभिलेखों में पहचान प्रमाण-पत्र तथा पहचान पत्र का जारी किया जाना अंतर्विष्ट किया जाएगा । (6) आधिकारिक दस्तावेज जारी करने वाला प्राधिकारी , नियम 3 के अधीन किसी आवेदक द्वारा किए गए आवेदन पर, ऐसे आवेदन किए जाने के पन्द्रह दिन के 906(5)

भीतर आधिकारिक दस्तावेजों में आवेदक का नाम या लिंग या दोनों को परिवर्तित करेगा ।

(7) कोई भी आधिकारिक दस्तावेज जिसमें उक्त पहचान प्रमाण - पत्र के आधार पर उभयलिंगी का लिंग , नाम या छायाचित्र पुनरीक्षित किया जाए, उसमें वही अनुक्रमांक या संदर्भ संख्या होगी , जैसे कि ऐसे उभयलिंगी व्यक्ति के मूल आधिकारिक दस्तावेज में है, जो आधिकारिक दस्तावेजों में नाम या लिंग या दोनों में परिवर्तन चाहता है ।

8. आवेदन को अस्वीकृत किए जाने की संसूचना. -

(1) नियम 3 के अधीन किए गए आवेदन के अस्वीकृत किए जाने की दशा में जिला मजिस्ट्रेट , आवेदक को ऐसी अस्वीकृति के लिए कारण या कारणों को संसूचित करेगा ।

(2) जिला मजिस्ट्रेट ऐसी अस्वीकृति की तारीख से तीस दिनों के भीतर जिला मजिस्ट्रेट द्वारा उठाई गई आपत्तियों का अनुपालन करने वाले आवेदक द्वारा किए गए किसी अनुरोध के आधार पर आवेदन की अस्वीकृति के विनिश्चय की समीक्षा कर सकेगा ।

9. अपील का अधिकार. - आवेदक को आवेदन की अस्वीकृति की सूचना की तारीख से साठ दिन के भीतर अंतिम आदेश के लिए राज्य सरकार द्वारा नाम निर्दिष्ट अपील प्राधिकारी को अपील करने का अधिकार होगा ।

10. सरकार द्वारा उभयलिंगी व्यक्तियों के कल्याण , शिक्षा , सामाजिक सुरक्षा और स्वास्थ्य के उपाय -

(1 ) उभयलिंगी व्यक्तियों को उनके अधिकारों और हितों की रक्षा करने तथा सरकार द्वारा बनाई गई ऐसी योजनाओं तथा कल्याण संबंधी उपायों तक उनकी पहुंच को सुकर बनाने के लिए , सम्मिलित करने हेतु राज्य सरकार सभी विद्यमान शैक्षणिक, सामाजिक सुरक्षा, स्वास्थ्य योजनाओं, कल्याण उपायों, व्यावसायिक प्रशिक्षण और स्व-रोजगार योजनाओं की समीक्षा करेगी ।

(2) राज्य सरकार, उपाबंध- दो में यथा- विनिर्दिष्ट शैक्षणिक, सामाजिक सुरक्षा और स्वास्थ्य योजनाओं और कल्याण योजनाओं तथा कार्यक्रमों को इस रीति में तैयार मध्यप्रदेश राजपत्र, दिनांक 18 नवम्बर 2021

करेगी जो उभयलिंगी व्यक्तियों के प्रति संवेदनशील , गैर - कलंकित और भेदभाव रहित हों ।

(3) राज्य सरकारें, अपने कार्यक्षेत्र के अधीन किसी सरकारी अथवा निजी संगठन, शैक्षणिक संस्था में भेदभाव को प्रतिषेधित करने और कब्रिस्तानों सहित सामाजिक और सार्वजनिक स्थानों तक साम्या पूर्ण पहुंच सुनिश्चित करने के लिए पर्याप्त कदम उठाएंगी ।

(4) राज्य क्षेत्र सरकार, उभयलिंगी व्यक्तियों के अधिकारों की सुरक्षा के लिए इन नियमों के प्रवृत्त होने की तारीख से दो वर्ष के भीतर अधिनियम की धारा 12 की उप-धारा (3) में निर्दिष्ट पुनर्वास केन्द्र सहित किंतु उन तक सीमित नहीं होने वाली संस्थागत और अवसंरचनात्मक सुविधाएं , पृथक् हयूमन इम्यूनो डेफीशिएंसी वायरस सीरो - सर्विलांस सेंटर, चिकित्सालयों में पृथक् वार्ड और प्रतिष्ठान में पृथक् शौचालय सृजित करेगी ।

(5) राज्य सरकार कल्याण योजनाओं के लाभों को अपने लिए प्राप्त करने के लिए , उभयलिंगी व्यक्तियों को शिक्षित करने , जानकारी देने और प्रशिक्षित करने, उभयलिंगी व्यक्तियों को उनके अधिकारों के प्रति शिक्षित और प्रशिक्षित करने, उभयलिंगी व्यक्तियों के विरुद्ध कलंक और भेदभाव का उन्मूलन करने और इसके प्रभावों को कम करने के लिए जागरूकता अभियान चलाएगी ।

(6) राज्य सरकार अपने कार्यक्षेत्र के अधीन आने वाले विद्यालयों और महाविद्यालयों में शिक्षकों और संकाय के संवेदीकरण के लिए उपबंध करेगी जैसी कि-

(क ) समानता और लैंगिक विविधता के लिए , सम्मान को प्रोत्साहन देने के लिए शैक्षणिक पाठ्यचर्या में परिवर्तन;

(ख) स्वास्थ्य सेवा व्यवसाइयों का संवेदीकरण;

(ग) चिकित्सा शिक्षा के लिए पाठ्यचर्या में परिवर्तन; और

(घ) कार्यस्थलों में संवेदीकरण कार्यक्रम ।

(7) सभी शैक्षणिक संस्थानों में यह सुनिश्चित करने की शक्ति के साथ एक समिति होगी , कि उभयलिंगी छात्र, उन्हें धमकाने वाले व्यक्तियों, जिसमें शिक्षक भी सम्मिलित हैं, की उपस्थिति से प्रभावित न हों, जहां उभयलिंगी व्यक्ति किसी उत्पीड़न या भेदभाव की दशा में संपर्क कर सकेंगे । 906(7)

(8 ) राज्य सरकार, उभयलिंगी व्यक्तियों के अधिकारों की सुरक्षा के लिए इन नियमों के प्रवृत्त होने की तारीख से दो वर्ष के भीतर अस्थायी आश्रयों, अल्पावास गृहों और चिकित्सालयों में पुरुष , महिला अथवा पृथक् वार्ड के विकल्प के साथ वास सुविधा और प्रतिष्ठान में शौचालयों सहित किंतु उस तक समिति न रहने वाली संस्थागत और अवसंरचनात्मक सुविधाएं सृजित करेगी ।

(9) राज्य सरकार द्वारा बनाई गई योजनाओं तथा कल्याण संबंधी उपायों के प्रयोजन के लिए एक राज्य उभयलिंगी कल्याण बोर्ड एवं जिला उभयलिंगी कल्याण बोर्ड का गठन किया जाएगा ।

(क) राज्य उभयलिंगी कल्याण बोर्ड -

(एक) राज्य उभयलिंगी कल्याण बोर्ड का गठन निम्नानुसार किया जाएगाः-

अध्यक्ष 1. माननीय मंत्री, मध्यप्रदेश शासन , सामाजिक न्याय एवं निःशक्तजन कल्याण विभाग

सदस्य 2.

सचिव अपर मुख्य सचिव/ प्रमुख सचिव / सचिव, सामाजिक न्याय एवं निःशक्तजन कल्याण विभाग

(दो) जिला स्तरीय उभयलिंगी कल्याण बोर्ड के सम्मिलन वर्ष में चार बार आयोजित किए जाएगे । सम्मिलन की गणपूर्ति एक तिहाई होगी । सम्मिलन में की गई कार्रवाई के विवरण शासन / संचालनालय, सामाजिक न्याय एवं निःशक्तजन कल्याण विभाग को भेजे जाएंगे । 11. भेदभाव के विरूद्ध उपबंध.-

(1 ) राज्य सरकार शिक्षा , रोजगार , स्वास्थ्य देखभाल, सार्वजनिक परिवहन, जन जीवन में भागीदारी , खेल- कूद, अवकाश और मनोरंजन तथा लोक अथवा निजी पद धारण करने के अवसर सहित किसी सरकारी अथवा निजी संगठन अथवा प्रतिष्ठान में भेदभाव का प्रतिषेध करने के लिए पर्याप्त उपाय करेगी ।

(2) राज्य सरकार इन नियमों के प्रवृत्त होने की तारीख से दो वर्ष के भीतर अधिनियम के उपबंधों के अनुसार उभयलिंगी व्यक्तियों की सुरक्षा के लिए आवश्यक उपायों और प्रक्रियाओं पर व्यापक नीति तैयार करेगी । मध्यप्रदेश राजपत्र, दिनांक 18 नवम्बर 2021

(3 ) उप- धारा (2) के अधीन तैयार की गई नीति में कमजोर उभयलिंगी समुदायों की सहायता एवं सुरक्षा के लिए निवारक और निरोधक प्रशासनिक उपाय और पुलिस सम्मिलित होंगे ।

(4) राज्य सरकार अधिनियम की धारा 18 के अंतर्गत व्यक्तियों के समय से अभियोजन के पर्यवेक्षण के लिए उत्तरदायी होगी ।

(5) उभयलिंगी व्यक्तियों के विरुद्ध अपराधों की निगरानी करने और अधिनियम की धारा 18 के अधीन मामलों का समय से पंजीयन , जांच और अभियोजन सुनिश्चित करने के लिए राज्य सरकार जिला मजिस्ट्रेट और पुलिस महानिदेशक के प्रभार के अधीन एक उभयलिंगी सुरक्षा सेल स्थापित करेगी ।

12. रोजगार में समान अवसर.-

(1 ) प्रत्येक प्रतिष्ठान अवसंरचना समायोजनों, भर्ती, पदोन्नति और अन्य संबंधित मामलों सहित किन्तु उन तक सीमित न रहते हुए रोजगार से संबंधित किसी मामले में किसी उभयलिंगी व्यक्ति के विरुद्ध गैर- भेदभाव सुनिश्चित करने के लिए सभी उपायों को कार्यान्वित करेगा ।

(2) प्रत्येक प्रतिष्ठान उभयलिंगी व्यक्तियों के लिए एक समान अवसर नीति प्रकाशित करेगा ।

(3) प्रतिष्ठान विशेषतः अपनी वेबसाइट पर समान अवसर नीति प्रदर्शित करेगा । ऐसा करने में असफल रहने की स्थिति में अपने परिसर में विशिष्ट स्थानों पर इसे प्रदर्शित करेगा ।

(4) निजी प्रतिष्ठान की समान अवसर नीति में अन्य बातों के साथ - साथ निम्नलिखित ब्यौरे अंतर्विष्ट होंगे-

(क) उभयलिंगी व्यक्ति प्रतिष्ठान में अपने कर्तव्यों का प्रभावी रूप से निर्वहन कर सकें, इसके लिए उन्हें अवसंरचनात्मक सुविधाएं (जैसे यूनिसेक्स शौचालय) , सुरक्षा एवं बचाव के लिए उपाय (परिवहन और गार्ड) और सुविधाएं (जैसे स्वच्छता उत्पाद ) प्रदान किए जाना है । 906(11)

(ख) कर्मचारियों की सेवा शर्तों के बारे में कंपनी के सभी नियमों और विनियमों की प्रयोज्यताः

(ग) कर्मचारियों के लिंग की पहचान की गोपनीयता बनाए रखना ।

(घ) शिकायत अधिकारियों के ब्यौरे ।

13. शिकायत निवारण.-

(1 ) राज्य सरकार द्वारा यह सुनिश्चित किया जाएगा कि इन नियमों के प्रवृत्त होने की अधिसूचना की तारीख से तीस दिनों के भीतर प्रत्येक प्रतिष्ठान धारा 11 के अनुसार एक शिकायत अधिकारी नियुक्त करे ।

(2) शिकायत अधिकारी , ऐसी शिकायत प्राप्त होने की तारीख से दो दिनों के भीतर प्राप्त शिकायतों पर कार्रवाई करेगा ।

(3) प्रतिष्ठान का प्रमुख ऐसे मामलों में तत्काल कार्रवाई करेगा जहां उपरोक्त समय सीमाओं के अनुसार कार्रवाई नहीं की गई हो ।

(4) राज्य सरकार, अधिनियम की धारा 12 की उप- धारा (1 ) और (2 ) के विशेष संदर्भ के साथ अधिनियम के अध्याय पांच के उपबंधों के समुचित कार्यान्वयन को सुनिश्चित करने के लिए एक वर्ष के भीतर शिकायत निवारण तंत्र भी स्थापित करेगी जो हेल्पलाइन और आउटरीच केंद्रों के माध्यम से कार्य करेगा । (6) शिकायत निवारण तंत्र ऐसी शिकायतों के हेल्पलाइन पर आने की तारीख से तीस दिनों के भीतर शिकायतों का समाधान करेगा और अधिनियम की धारा 18 में अधिकथित शास्तियों को अधिरोपित करने के लिए सक्षम होगा ।

14. राष्ट्रीय परिषद्.-

(1 ) राष्ट्रीय परिषद् उभयलिंगी कल्याण और राज्य और स्थानीय स्तर पर अधिकारों के संरक्षण की निगरानी , समीक्षा और मूल्यांकन के मामलों पर राष्ट्रीय परिषद् के साथ समन्वय के लिए जिम्मेदार होगी ।

उपाबंध-2

विचारित की जाने वाली कल्याण योजनाओं की सुझाई गई सूचीः

1. स्वास्थ्यतक पहुंच

(क) उभयलिंगी समुदाय को सभी एमटीएफ और एफटीएम पद्धतियों सहित सुरक्षित और निःशुल्क पुष्टिकरण सर्जरी , परामर्श और हार्मोन प्रतिस्थापन उपचार प्रदान करने के लिए प्रत्येक राज्य में कम से कम एक शासकीय चिकित्सालय को सुसज्जित किया जाएगा ।

(ख) निजी चिकित्सालयों में उभयलिंगी व्यक्तियों से संबंधित एसआरएस की प्रक्रियाओं हार्मोन उपचार , लेजर उपचार, परामर्श और स्वास्थ्य से जुड़े अन्य मुद्दों को राज्य चिकित्सा बीमा कवर करेगा ।

(ग ) चिकित्मा बीमा / आरोग्यश्री कार्ड ।

(घ) सभी स्वास्थ्य देखरेख सुविधा उभयलिंगी व्यक्तियों के लिए अलग से वार्ड सुनिश्चित करेंगी ।

2. शिक्षा तक पहुंच

(क) उभयलिंगी छात्रों के लिए छात्रवृत्ति ।

(ख) स्कूलों में समावेशी और समान गुणवत्तापरक शिक्षा जो समानता और लिंग विविधता के सम्मान को बढ़ावा देती हो ।

( ग ) शिकायत निवारण प्रावधानों सहित शैक्षिक संस्थानों में रैगिंग के विरुद्ध संरक्षण । (घ) आवासीय सरकारी विद्यालयों और विश्वविद्यालयों में उभयलिंगी व्यक्तियों , जेंडर नॉन-कॉनफॉरमिंग और इंटर- सेक्स बच्चों के लिए आवास और शिक्षा की सुविधा । 3. आवास तक पहुंच

(क) किफायती आवास

(ख) संकटग्रस्त उभयलिंगी युवा के लिए आश्रय और सामुदायिक केंद्र , जो पौष्टिक भोजन तथा परामर्श उपलब्ध कराते हों ।

(ग) स्वच्छता सुविधाओं और सुरक्षित पेयजल तक पहुंच ।

4. कन्याणकारी उपाय

(क) खाद्य सुरक्षा योजनाओं तक सार्वभौमिक पहुंच और राशन कार्ड का उपबंध । (ख) वृद्ध, अशक्त अथवा अन्य कमजोर उभयलिंगी व्यक्तियों के लिए पेंशन । (ग) घर से बहिष्करण की समस्या से जूझ रहे उभयलिंगी व्यक्तियों के लिए वृद्धाश्रम और विश्राम गृह ।

(घ) उभयलिंगी व्यक्तियों के लिए उत्पीड़न मुक्त स्थल सार्वजनिक परिवहन । 5. आर्थिक सहयोग

(1 ) जीवन बीमा का सार्वभौमिक कवरेज ।

(2) ऋण सुविधा सहित बैंकिंग और वित्तीय सेवाओं तक पहुंच ।

(3) मनरेगा जैसी रोजगार गारंटी योजनाओं और सभी सामाजिक सुरक्षा योजनाओं में उभयलिंगी व्यक्ति का स्पष्ट समावेश ।

(4 ) आजीविका कार्यकलापों के लिए स्व- सहायता समूहों का गठन ।

NOTICE

The following draft of Rules which the State Government proposes to make in exercise of the powers conferred by section 22 of the Transgender Persons ( Protection of Rights ) Act , 2019 (40 of 2019 ) is hereby published as required by sub - section ( 1 ) of the said section of the Act for the information of all persons likely to be affected thereby and notice is hereby given that the said draft rules shall be taken into consideration after the expiry of a period of thirty days from the date of publication of this notice in the Madhya Pradesh Gazette .

Any objections or suggestions may be submitted at the office of Principal Secretary , Government of Madhya Pradesh , Social Justice and Disabled Persons Welfare Department , Mantralaya , Vallabh Bhawan , Bhopal from any person with respect to the said draft rules before the expiry of the period specified above shall be considered by the State Government , namely: -

DRAFT OF RULES

Short title and commencement .

( 1 ) These rules may be called the Madhya Pradesh Transgender Person ( Protection of Rights ) Rules , 2021 .

(2) They shall extend to the whole of the State of Madhya Pradesh .

(3 ) They shall come into force from the date of their publication in the Madhya Pradesh Gazette .

2. Definition.-

( 1 ) In these rules , unless the context otherwise requires , - (a) " Act " means the Transgender Persons ( Protection of Rights) Act , 2019 (40 of 2019 ) ;

(b) " affidavit " means self- attested affidavit in Form - 2 to be submitted by an applicant seeking certificate of identity in their self - identified gender ;

(d) " application " means the application form as provided in Form - 1 ;

(e) " any official documents " means and includes all documents listed in Annexure 1 , which the State Government may revise , by notification in the Official Gazette;

( f) "Appellate Authority" means the Divisional Commissioner ( Revenue ) ;

(g) " Certificate of Identity " means a certificate issued by the District Magistrate under section 6 or section 7 of the Act in Form - 3 or Form - 4 respectively ;

(h) " discrimination " means any distinction , exclusion or restriction on the basis of gender identity and expression which has the purpose or effect of impairing or nullifying the recognition , enjoyment or exercise , on an equal basis with others , of all human rights and fundamental freedoms in the political , economic , social , cultural , civil or any other field and includes all forms of discrimination , including denial of reasonable accommodation ;

( i ) " Government" means the Government of Madhya Pradesh;

(j ) " Identity Card " means a photo identity card issued to a transgender person mentioned in Form- 5 under section 6 or issued in Form 6 to a transgender person on change of gender under section 7 on the basis of certificate of identity " issued by the District Magistrate or an identity card to a transgender person issued by a State authority prior to the coming into force of these rules ;

(k) "medical institution " means any medical institution whether hospital or clinic , private or public , in rural areas or urban or overseas ;

(1 ) " procedure ' means procedure to be adopted by District Magistrate for issue of certificate of identity under section 6 or section 7;

(m) " section " means section of the Act ;

(n) " State " means the State of Madhya Pradesh .

(2) All other words and expressions used herein but not defined herein and defined in the Act shall have the same meaning assigned to them in the Act .

3. Application for issue of certificate of identity.-

(1 ) A transgender person desirous of obtaining a certificate of identity shall make an application as prescribed in Form 1 .

(2) The application shall be submitted to the District Magistrate in person or by post till online facilities are developed by the State Government and there after the application shall be made :

Provided that the State Government may undertake measures , as it deems necessary , to facilitate the submission of applications for certificate of identity by transgender persons living in remote disadvantaged conditions : areas or Provided further that in case of a minor child , such application shall be made by a parent or guardian of such minor child and in the case of a child in need of care and protection by the competent authority under the Juvenile Justice ( Care and Protection of Children) Act, 2015 .

transgender , prior to the coming into force of Act shall not be required to submit an application for certificate of identity under these rules :

Provided that such person shall enjoy all rights and entitlements conferred to a transgender person under the Act.

(4) The State Government shall submit the application for identity certificate by Transgender persons residing in remote areas or in deprived conditions to Sub - Divisional Officer (Revenue ) , Tehsildar , Naib Tehsildar.

4. Procedure for issue of certificate of identity under section 6.-

( 1) The District Magistrate shall , subject to its correctness get the application processed based on the affidavit submitted , declare the gender identity of any person in Form 2 but without any medical examination and issue an identification number to the applicant which may be quoted as proof of application .

(2) For the purpose of determination of the place of residence , the applicant shall be a resident of the area under the jurisdiction of District Magistrate for a continuous period of past twelve months as on the date of application and an affidavit to this effect shall be submitted in Form -2 and no additional evidence shall be called for .

5. Issue of certificate of identity for a transgender person under section 6.-

( 1) The District Magistrate shall issue to the applicant , a certificate of identity in Form 3 following the procedure provided in Rule 4 indicating the gender of such person .

(2) The said certificate of identity shall be issued within thirty days of receipt duly filled application along with the affidavit .

SO (3) The certificate of identity issued under sub - rule ( 1 ) shall be the basis to change the gender as well as the name and the photograph , if necessitated , of the transgender person in all such official documents as provided in accordance with the gender specified in the said certificate of identity in Annexure - 1 .

(4) The District Magistrate shall at the time of issuance of the certificate of identity under sub- rule ( 1) , issue a transgender identity card to the applicant mentioned in Form - 5 .

(5) The transgender identity card shall be included by the State Government in their records for the purposes of public service .

(6) The authority that issued the official document , on an application made by an applicant under rule 3 , shall change the name or gender or both of the applicant in the official documents within fifteen days of making of such application .

(7) Any official document wherein gender , name and the photograph of transgender are revised based on the said certificate of identity , shall bear the same serial or reference number as in the original official document of such transgender person who seeks change in the name or gender or both in the official documents :

Provided that all benefits that a transgender person was entitled based on an identity card , if any , issued by a State authority shall continue be enjoyed by that transgender person based on the certificate of identity issued under these rules .

6. Procedure for issuance of a certificate of identity for change of gender.-

( 1 ) If a transgender person undergoes medical intervention to change sex either as a male or female , such person may apply in the Form - 1 , along with a certificate issued मध्यप्रदेश राजपत्र, दिनांक 18 नवम्बर 2021

to that effect by the Medical Superintendent or Chief Medical Officer of the medical institution in which that person has undergone the said medical intervention to the District Magistrate for the issue of a revised certificate of identity under section 7 .

(2) The District Magistrate shall , on receipt of an application referred to in sub - rule ( 1 ) shall verify the correctness of the said medical certificate .

(3 ) For the purpose of determination of the place of residence , the applicant shall be a resident of the area under the jurisdiction of the District Magistrate for a continuous period of past twelve months as on the date of application and an affidavit to this effect shall be submitted along with the application in Form - 1 and no additional evidence shall be called for .

7. Issuance of certificate of identity.-

( 1 ) The District Magistrate shall issue a revised certificate of identity to the applicant mentioned in Form 4 seeking change in gender under section 7 , indicating the gender of such a person as male or female , as the case maybe .

(2) The District Magistrate shall issue the revised certificate under sub - rule ( 1 ) within fifteen days of its receipt .

(3 ) The certificate of identity issued under sub - rule ( 1 ) shall entitle the applicant to record or change the gender , photograph as well as the name , if so necessitated , of transgender person in all such official documents provided in Annexure 1 , in accordance with the gender specified in the said certificate of identity as male or female , as the case may be .

(4) The District Magistrate while issuing the certificate of identity for change of gender shall simultaneously issue an identity card to the applicant mentioned in Form - 6 .

(5) Issue of the certificate of identity and the identity card shall be included by State Governments in their records for the purpose of public service .

(6) The authority that issued the official document on an application made by an applicant under rule 3 shall change the name or gender or both of the applicant in the official documents within fifteen days of making of such application .

name or (7) Any official document wherein gender , photograph of transgender revised based on the said certificate of identity shall bear the same serial or reference number as in the original official document of such transgender person who seeks change in the name or gender or both in the official documents .

8. Communication of rejection of application.-

( 1) In case of rejection of application made under rule 3 , the District Magistrate shall inform the applicant the reason or reasons for such rejection .

(2) The District Magistrate may review the decision of rejection of the application based on a request by the applicant complying with the objections raised by District Magistrate made within thirty days from the date of such rejection.

9. Right to appeal . The applicant shall have right to appeal within sixty days from the date of intimation of the rejection of the application , to the appellate authority as designated by the State Government for a final order .

10. Welfare measures , education , social security and health of transgender persons by Government.-

( 1 ) The State Government shall review all existing educational , social security , health schemes , welfare measures , vocational training and self- employment schemes to include transgender persons to protect their मध्यप्रदेश राजपत्र, दिनांक 18 नवम्बर 2021

rights and interests and facilitate their access to such schemes and welfare measures framed by that Government .

(2) The State Government shall formulate educational , social security and health schemes and welfare schemes and programmes as specified in Annexure II in a manner to be transgender sensitive , non - stigmatizing and non- discriminatory to transgender persons .

any (3) The State shall take adequate steps to prohibit in discrimination Government or private organization , educational institution under their purview and shall ensure equitable access to social and public spaces , including burial grounds .

(4). The State Government shall create institutional and infrastructure facilities , including but not limited to , rehabilitation centre referred to in sub - section ( 3 ) of section 12 of the Act , separate human immuno deficiency virus sero - surveillance centers , separate wards in hospitals and washrooms in the establishment , within two years from the date of coming into force of these rules to protect the rights of transgender persons .

to (5) The State Government shall carry out an awareness communicate and train campaign educate , transgender persons to avail themselves of the benefits of welfare schemes , educate and train transgender persons on their rights , eradicate stigma and discrimination against transgender persons and mitigate its effects .

(6) The State Government shall also provide for sensitization of teachers and faculty in schools and colleges under their purview , such as-

( a) Changes in the educational curriculum foster respect for equality and gender diversity;

(b) Sensitization of health care professionals ;

(d) Sensitization programmes in workplaces .

(7) All educational institutions shall have a committee where the transgender persons may approach in case of any harassment or discrimination , with powers to ensure that transgender students do not have to be affected by the presence of the persons bullying them , including teachers .

(8) The State Government shall create institutional and infrastructure facilities , including but not limited to , shelters , short-stay temporary homes and accommodation , choice of male , female or separate wards in hospitals and washrooms in the establishment within two years from the date of coming into force of these rules to protect the rights of transgender persons .

(9) A State Transgender Welfare Board and District Transgender Welfare Board shall be constituted for the purpose of the schemes and welfare measures made by the State Government .

( a) The State Transgender Welfare Board.-

The details of the action taken in the meeting shall be sent to the State Government / Directorate , Social Justice and Disabled Welfare Department .

11. Provisions against non - discrimination.-

( 1 ) The State Government shall make adequate measures to prohibit discrimination in Government or private organization or establishment including in the areas of which includes the field of education , employment , healthcare , public transportation and participation in public life , sports , leisure and recreation and opportunity to hold public or private office .

(2 ) The State government shall within two years from the date of coming into force of these rules formulate a comprehensive policy on the measures and procedures necessary to protect transgender persons in accordance with the provisions of the Act .

(3) The policy formulated under sub - section (2 ) shall include precautionary and preventative administrative measures and police to help and protect vulnerable transgender communities .

4) The State Government shall be responsible for the supervision of timely prosecution of individuals charged under section 18 of the Act .

(5) State Government shall set up a Transgender Protection Cell under the charge of the District Magistrate and Director General of Police to monitor cases of offences against transgender persons and to ensure timely registration , investigation and prosecution of cases under section 18 of the Act .

12. Equal opportunities in employment.-

( 1) Every establishment shall implement all measures to ensure non - discrimination against any transgender person in any matter relating to employment including , 906(33)

but not limited to , infrastructure adjustments , recruitment , promotion and other related issues .

(2) Every establishment shall publish an Equal Opportunity Policy for transgender persons .

(3) The establishment shall display the Equal Opportunity Policy preferably on their website , failing which , at conspicuous places in their premises .

(4) The Equal Opportunity Policy of a private establishment shall , inter alia , contain details of -

(a) Infrastructural facilities ( such as unisex toilets ) , measures put in for safety and security (transportation and guards ) and amenities ( such as hygiene products ) to be provided to the transgender persons so as to enable them to effectively discharge their duties in the establishment ;

(b) Applicability of all rules and regulations of the company regarding service conditions of employees ;

(d) Details of the complaint officers .

13. Grievance redressal.-

(1) It shall be ensured by the State Government that every establishment designates a complaint officer in accordance with rule 11 within thirty days from the date of coming into force of notification of these rules .

(2) The complaint officer shall act upon the complaints received within two days from the date of receipt of such complaints .

(3) The head of the establishment shall take action forthwith in such cases where action has not been taken in accordance with the above time limits .

(4) The State Government shall also establish a grievance redressal mechanism within one year , which shall operate through helpline and outreach centers , for ensuring proper implementation of the provisions of Chapter V of the Act with special reference to sub- sections ( 1 ) and (2) of section 12 of the Act .

(5) The grievance redressal system shall resolve the grievances within thirty days from the date of bringing of such grievance to the helpline , and shall be competent to impose penalties as laid down in section 18 of the Act .

14. National Council.-

( 1 ) The National Council shall be responsible for coordination with the National Council on matters of monitoring , review and evaluation of transgender welfares and protection of rights at the State and local levels .

(2) National Institute of Social Defence shall act as the secretariat in the National Council to facilitate the discharge of its functions .

Annexure - II

Suggested list of welfare schemes to be considered:

1. Access to health

(a) At least 1 government hospital in every State shall be equipped to offer safe and free gender affirming surgery , counseling and hormone replacement therapy to the transgender community , including all MTF and FTM procedures .

(b) State medical insurance shall cover procedures of SRS , hormonal therapy , laser therapy , counseling and other health issues of transgender persons at private hospitals (c) medical insurance / arogyashri cards .

(d) All healthcare facilities should ensure that there are separate wards for transgender persons .

2. Access to education

(a) Scholarship for transgender students .

(b) Inclusive and equitable quality education in schools that fosters respect for equality and gender diversity .

(d) Facilitation of accommodation and schooling for transgender , gender non conforming and intersex children in residential government schools and universities .

3. Access to housing

(a) Affordable housing .

(

b) Shelters and community centres for at risk transgender youth that provide nutritious food and counseling .

(c ) Access to sanitation facilities and safe drinking water .

4. Welfare measures

(a) Universal access to Food security schemes and provision of ration cards .

(1 ) Universal coverage of Life Insurance .
