Whereas, the State Legislature is not in session and the Governor of Madhya Pradesh is satisfied that circumstances exist which render it necessary for him to take immediate action;
Now, therefore, in exercise of the powers conferred by clause (1) of article 273 of the Constitution of India, the Governor of Madhya Pradesh is pleased to promulgate the following Ordinance:-
1. This Ordinance may be called tJe Madhya Pradesh Panchayat Raj Short title. Avam Gram Swaraj (Sanshodhan)

2. During tJ:e period of operation of this Ordinatlce, the Madhya Pradesh Madhya Pradesh Act Panchayat Raj Avam Gram No. I of L994 to be Swaraj Adhiniyam, lgg3 (No. 1 temporarily amended. of 19941(hereinafter referred to as the principal Act) shall have effect subject to the amendment specifred in section 3.
3. After section 9 of the principal Act, the following section shall be inserted, Insertion of section 9A. namely:-
"9A. Notwithstanding anything contained in this Act, where the Deemed annulment of
Gram Panchayat or its wards, prospective dellmitation or
division of Pancha5rat alter
or the Janpad Panchayat or its constituencies, or the ZI\a expiry of certain period.

are delimited or divided before the end of the term of such panchayat but the notification of the election to such panchayat is not issued by the state Election commission, for whatever reasons, within a period of one year from the date of publication of such delimitation or division, then the following consequences shall ensue:- (i) The delimitation or division of the Gram panchayats or its wards, or the Janpad Panchayats or its constituencies, or the Zia Parrchayats or its constituencies, so published, shall be deemed to be annulled at the expiry of ttre period of one year from the date on which the said delimitation or division was published;
(it The election to the Gram Panchayats or their ward,s, or the Janpad Panchayats or their constituencies, or the Zlla Panchayats or their constituencies shall be held on the basis of delimitation or division which existed immediately before the end of their respective terms;
(iii) The category to which the Gram Panchayats or their wards, or tlre Janpad Panchayats or their constituencies, or the zira Panchayats or their constituencies shall continue to be reserved for the same category as it was at the end of their respective term:
Provided that tJ'e above consequences shall not be applicable in relation to such Gram Panchayats or their wards or Janpad Panchayats or their constituencies, or the Zlla Panchayats or thea constituencies, which were delimitated or divided due to notifrcation of any urban area after the last election of respective Panchayats.".
