सूचना
नियमों का निम्मलिखित प्रारूप जिसे राज्य सरकार , महात्मा गांधी राष्ट्रीय ग्रामीण रोजगार गारंटी अधिनियम , 2005 (2005 का 42) की धारा 7 की उप- धारा ( 1 ) तथा (6) , धारा 15 की उप- धारा (5) के खण्ड ( ख) एवं धारा 32 की उप-धारा (2) के खण्ड (ख) द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए बनाना प्रस्तावित करती है , उक्त अधिनियम की धारा 32 की उप- धारा ( 1 ) द्वारा अपेक्षित किए गए अनुसार उन समस्त व्यक्तियों की जिनके कि उससे प्रभावित होने की संभावना है, जानकारी के लिए एतद् द्वारा प्रकाशित किया जाता है और एतद् द्वारा यह सूचना दी जाती है कि इस सूचना के मध्यप्रदेश राजपत्र में प्रकाशन होने की तारीख से तीस दिन का अवसान होने के पश्चात् उक्त प्रारूप पर विचार किया जाएगा।
किसी भी ऐसी आपत्ति या सुझाव पर, जो उक्त प्रारूप के संबंध में किसी व्यक्ति से ऊपर विनिर्दिष्ट कालावधि का अवसान होने या उसके पूर्व प्राप्त हो , अवर सचिव, पंचायत एवं ग्रामीण विकास विभाग , मंत्रालय, वल्लभ भवन, भोपाल द्वारा विचार किया जावेगा अथवा उसे ई-मेल [email protected] पर प्रेषित किया जा सकेगा।
प्रारूप नियम
1. संक्षिप्त नाम और प्रारंभ.-
(1 ) इन नियमों का संक्षिप्त नाम महात्मा गांधी राष्ट्रीय ग्रामीण रोजगार गारंटी ( बेरोजगारी भत्ते के भुगतान की प्रक्रिया ) मध्यप्रदेश नियम, 2021 है ।

(2) ये , मध्यप्रदेश राजपत्र में इनके प्रकाशन की तारीख से प्रवृत्त होंगे।
2. परिभाषाएं.-
(1 ) इन नियमों में , जब तक कि संदर्भ से अन्यथा अपेक्षित न हो -
(क) "अधिनियम" से अभिप्रेत है , महात्मा गांधी राष्ट्रीय ग्रामीण रोजगार गारंटी अधिनियम,2005 (2005 का 42);
(ख) "आवेदक" से अभिप्रेत है, किसी गृहस्थी का प्रमुख या उसके किसी अन्य वयस्क सदस्य जिसने योजना के अधीन रोजगार के लिए आवेदन किया है;
(ग) "परिषद्" से अभिप्रेत है, धारा 12 की उप- धारा (1 ) के अधीन गठित मध्यप्रदेश राज्य रोजगार गारंटी परिषद;
(घ) "जिला कार्यक्रम समन्वयक" से अभिप्रेत है , अधिनियम की धारा 14 की उप-धारा (1 ) के अधीन इस रूप में पदाभिहित एक अधिकारी;
(इ) "गृहस्थी" से अभिप्रेत है, किसी कुटुम्ब के सदस्य जो एक दूसरे से रक्त, विवाह या दत्तक ग्रहण द्वारा संबंधित हैं तथा सामान्यतः एक साथ निवास करते हैं या सम्मिलित रूप से भोजन करते हैं या एक सामान्य राशन कार्ड रखते हैं;
(च) "कार्यान्वयन अभिकरण " से अभिप्रेत है, केन्द्र सरकार या किसी राज्य सरकार का कोई विभाग , कोई जिला पंचायत, मध्यवर्ती स्तर पर पंचायत, ग्राम पंचायत या कोई स्थानीय प्राधिकरण या सरकारी उपक्रम या गैर सरकारी संगठन, जिसे कि योजना के अधीन किए जाने वाले किसी कार्य का कार्यान्वयन करने के लिए केन्द्र सरकार या राज्य सरकार द्वारा प्राधिकृत किया गया है;
(छ) "कार्यक्रम अधिकारी" से अभिप्रेत है , अधिनियम की धारा 15 की उप-धारा ( 1 ) के अधीन नियुक्त कोई अधिकारी;
(ज) "योजना" से अभिप्रेत है, धारा 4 की उप-धारा (1 ) के अधीन राज्य सरकार द्वारा अधिसूचित कोई योजना;
(झ) " ग्राम पंचायत का सचिव" से अभिप्रेत है , मध्यप्रदेश पंचायत राज एवं ग्राम स्वराज अधिनियम, 1993 ( क्रमांक 1 सन् 1994) के अधीन इस रूप में नियुक्त सचिव;
(ञ) "धारा" से अभिप्रेत है, अधिनियम की कोई धारा;
(ट) "राज्य सरकार " से अभिप्रेत हैं, मध्यप्रदेश सरकार ।
(2) उन शब्दों और अभिव्यक्तियों के, जो इन नियमों में प्रयुक्त किए गए हैं किंतु परिभाषित नहीं किए गए हैं , वही अर्थ होंगे जो अधिनियम में उनके लिए समनुदेशित किए गए हैं । 3. बेरोजगारी भत्ते की पात्रता.-
यदि स्कीम के अधीन रोजगार के लिए आवेदन करने वाले किसी आवेदक को, उसके द्वारा रोजगार की वांछा करने वाले उसके आवेदन की तारीख से या उस तारीख से जिसको कि किसी अग्रिम आवेदन की दशा में , रोजगार चाहा गया हो , जो भी पश्चातवर्ती हो, पन्द्रह दिवस के भीतर रोजगार उपलब्ध नहीं कराया जाता है , तो वह दैनिक बेरोजगारी भत्ते का हकदार होगा।
4. बेरोजगारी भत्ता प्राप्त करने के लिए अधिकारहीनता.-
कोई भी आवेदक संदेय बेरोजगारी भत्ते का दावा करने हेतु पात्र नहीं होगा किन्तु अधिनियम के अधीन , किसी भी समय तीन मास की कालावधि के लिए रोजगार प्राप्त करने के लिए पात्र होगा , यदि वह-
(क) इस स्कीम के अधीन उसकी गृहस्थी को उपलब्ध कराए गए रोजगार को स्वीकार नहीं करता है/करती है; या 914(1)

(ख ) रोजगार के लिए रिपोर्ट करने हेतु कार्यक्रम अधिकारी या कार्यान्वयन अभिकरण द्वारा अधिसूचित किए जाने के पन्द्रह दिन के भीतर कार्य के लिए उपस्थित नहीं होता है; या
(ग) संबंधित कार्यान्वयन अभिकरण से कोई अनुज्ञा प्राप्त किए बिना एक सप्ताह से अधिक की कालावधि के लिए कार्य से लगातार अनुपस्थित रहता है या किसी मास में एक सप्ताह से अधिक की कुल कालावधि के लिए अनुपस्थित रहता है।
5. बेरोजगारी भत्ते की दर.-
किसी गृहस्थी के किसी आवेदक को संदेय बेरोजगारी भत्ते का भुगतान उस वित्तीय वर्ष के दौरान गृहस्थी की हकदारी के अध्यधीन रहते हुए प्रथम तीस दिन के लिए , स्कीम की प्रचलित मजदूरी की एक चौथाई के बराबर दर से किया जाएगा तथा उस वित्तीय वर्ष की बची हुई कालावधि हेतु मजदूरी दर के आधे के बराबर की दर से भुगतान किया जाएगा ।
6. बेरोजगारी भत्ता का दावा दाखिल करने के लिए प्रक्रिया.-
(1 ) किसी भी व्यथित आवेदक को कार्यक्रम अधिकारी को उन दिनों की संख्या का सीधे तौर पर स्पष्ट कथन करते हुए जिनके लिए बेरोजगारी भत्ते का दावा किया जा रहा है , लिखित रूप से आवेदन-पत्र प्रस्तुत करना होगा।
(2) कार्यक्रम अधिकारी लिखित आवेदन प्राप्त करेगा और तत्पश्चात् उसे अभिलिखित करेगा तथा उसे प्रमाणित करेगा तथा आवेदक को ऐसे आवेदन पत्र की पावती देगा। (3) बेरोजगारी भत्ता के दावा के लिए कोई भी आवेदन नियम 3 के अनुसार आवेदक के बेरोजगारी भत्ता हेतु हकदार होने के दिवस से पन्द्रह दिनों के भीतर प्रस्तुत किया जा सकेगा ।
(4) आवेदक, निरीक्षण हेतु कार्य की मांग के लिए दिए गए अपने आवेदन की मूल पावती तथा रोजगार पत्र (जॉब- कार्ड) की मूल पावती के साथ अपना दावा प्रस्तुत करेगा जो इस दावे के विनिश्चय के तत्काल पश्चात् उसे वापस कर दिए जाएंगे। 7. दावों का सत्यापन के लिए प्रक्रिया.-
(1 ) कार्यक्रम अधिकारी, दावे की प्राप्ति के सात दिन के भीतर , बेरोजगारी भत्ते के दावे हेतु प्राप्त आवेदन को समुचित अन्वेषण के पश्चात् मंजूर या रद्द करेगा तथा वह बेरोजगारी भत्ते के आवेदन की मंजूरी या उसे रद्द किए जाने के कारणों को अभिलिखित करेगा जो आवेदक को लिखित में संसूचित किए जाएंगे ।
(2) कार्यक्रम अधिकारी जॉब-कार्ड तथा उपस्थिति रजिस्टरों की पुष्टि के माध्यम से व्यथित आवेदक के दावे का सत्यापन करेगा तथा सूचना प्रबंधन प्रणाली के अधीन संधारित अभिलेखों से भी दावे का सत्यापन करेगा। वह, उन दिनों की, जिनके लिए बेरोजगारी भत्ता दिया जाना है, गणना करते हुए , दिनों की वास्तविक संख्या प्रमाणित करेगा। मध्यप्रदेश राजपत्र, दिनांक 23 नवम्बर 2021

(3) उप-नियम (2 ) के अनुसार बेरोजगारी भत्ते के दावे या दावों के सत्यापन के पश्चात् कार्यक्रम अधिकारी , जिला कार्यक्रम समन्वयक को बेरोजगारी भत्ते के भुगतान हेतु सिफारिश के साथ रिपोर्ट प्रस्तुत करेगा ।
(4) जिला कार्यक्रम समन्वयक , उप- नियम (3 ) के अनुसार रिपोर्ट प्राप्त होने पर दावे या दावों की वैधता तथा उनके सत्यापन के बारे में अपना समाधान हो जाने के पश्चात्, मध्यप्रदेश राज्य रोजगार गारंटी परिषद् को बेरोजगारी भत्ते की रकम हेतु अध्यपेक्षा भेजेगा । जिला कार्यक्रम समन्वयक द्वारा उप- नियम (3 ) के अधीन रिपोर्ट प्राप्त होने के सात दिन के भीतर यह कार्रवाई पूर्ण की जाएगी ।
8. रोजगार उपलब्ध न कराने के लिए सरकारी अधिकारियों की जिम्मेदारी नियत करना - उन समस्त मामलों में, जहां कि बेरोजगारी भत्ते का संदाय किया जाना है, जिला कार्यक्रम समन्वयक आवेदक को उसका आवेदन प्राप्त होने की तारीख से नियम 7 के उप- नियम (3) में उल्लिखित समय -सीमा के भीतर रोजगार न उपलब्ध कराने वाले , यथास्थिति पंचायत के अधिकारी तथा कर्मचारी की जिम्मेदारी नियत करेगा तथा बेरोजगारी भत्ते की वसूली तथा उन जिम्मेदार व्यक्ति (व्यक्तियों) के विरू ) कार्रवाई करने का एक प्रस्ताव सक्षम प्राधिकारी अथवा मध्यप्रदेश राज्य रोजगार गारंटी परिषद् द्वारा इस प्रयोजन के लिए नामनिर्दिष्ट अधिकारी को भेजेगा।
9. बेरोजगारी भत्ते के भुगतान के लिए प्रक्रिया.-
(1 ) नियम 7 के उप- नियम (4 ) के अनुसार बेरोजगारी भत्ते की रकम की मांग के प्राप्त होने पर, मध्यप्रदेश राज्य रोजगार गारंटी परिषद् सात दिन के भीतर रकम जारी करेगी ।
(2) बेरोजगारी भत्ते का भुगतान उसी रीति में किया जाएगा जिसमें कि सामान्यतया स्कीम में दैनिक मजदूरी का भुगतान किया जाता है ।
10. बेरोजगारी भत्ते के किसी दावे का समाप्त होना.-
किसी वित्तीय वर्ष के दौरान किसी गृहस्थी को बेरोजगारी भत्ते का भुगतान करने का राज्य सरकार का दायित्व उसी समय समाप्त हो जाएगा, जैसे ही-
(एक) आवेदक को या तो स्वयं या उसकी गृहस्थी के कम से कम एक वयस्क सदस्य को ग्राम पंचायत या कार्यक्रम अधिकारी द्वारा कार्य पर उपस्थित होने के लिए निदेशित किया जाता है , या
(दो) वह कालावधि, जिसके लिए कि नियोजन चाहा गया हो, समाप्त हो जाती है और आवेदक की गृहस्थी का कोई सदस्य रोजगार पर उपस्थित नहीं होता है, या
(तीन) गृहस्थी के वयस्क सदस्यों या आवेदक ने वित्तीय वर्ष के दौरान कम से कम कुल सौ दिन का रोजगार प्राप्त कर लिया है , या 914(3)

'(चार ) आवेदक की गृहस्थी ने मजदूरी और बेरोजगारी भत्ता दोनों को मिलाकर या अलग-अलग उतना उपार्जित कर लिया है, जो वित्तीय वर्ष के दौरान सौ दिन के कार्य की मजदूरी के बराबर है ।
11. बेरोजगारी भत्ते के भुगतान के लिये समय-सीमा.-
नियम 3 के अधीन बेरोजगारी भत्ते का प्रत्येक भुगतान , उस तारीख से, जिससे कि वह भुगतान हेतु शोध्य हो जाता है, तीस दिन के अपश्चात् किया जाएगा या किए जाने के लिए प्रस्तावित किया जाएगा ।
12. राज्य सरकार की विशेष शक्ति.-
राज्य सरकार को , इन नियमों के उपबंधों को प्रभावी करने तथा उनके सुचारू क्रियान्वयन के प्रयोजन के लिए स्पष्टीकरण जारी करने तथा संबंधित अधिकारियों को समय - समय पर ऐसे आदेश , निदेश जारी करने और सुझाव देने की शक्ति होगी, जो कि अधिनियम तथा इन नियमों के विरुद्ध न हों ।
13. निर्वचन.-
यदि इन नियमों के किन्हीं उपबंधों के निर्वचन से संबंधित कोई प्रश्न उद्भूत होता है तो मामला राज्य सरकार को निर्दिष्ट किया जाएगा और उस पर उसका विनिश्चय अंतिम होगा । 14. लेखा और लेखा परीक्षण.-
बेरोजगारी भत्ते के लेखे ऐसे प्ररूप में तथा ऐसी रीति में संधारित किए जाएंगे , जैसा कि राज्य सरकार द्वारा विहित किया जाए। यह अभिलेख सदैव ही अंकेक्षण हेतु उपलब्ध होगा।

NOTICE
The following draft of rules , which the State Government proposes to make in exercise of the powers conferred by sub- section ( 1 ) and ( 6) of section 7 , clause ( b ) of sub - section (5) of section 15 and clause (b) of sub- section (2 ) of section 32 of the Mahatma Gandhi National Rural Employment Guarantee Act , 2005 (No. 42 of 2005 ) , is hereby , published as required by sub- section ( 1 ) of Section 32 of the said Act for the information of all persons , likely to be affected thereby and notice is , hereby , given that the said draft of rules shall be taken into consideration on the expiry of thirty days from the date of publication of this notice in the Madhya Pradesh Gazette .
Any objection or suggestion , which may be received from any person with respect to the said draft on or before the expiry of the period specified above shall be considered by the Under Secretary , Government of Madhya Pradesh , Panchayat and Rural Development Department , Mantralaya , VallabhBhawan , Bhopal or by e - mail to [email protected] .
DRAFT OF RULES
Short title and commencement.-
1.
(1 ) These rules may be called the Mahatma Gandhi National Rural Employment Guarantee ( Procedure for payment of Unemployment Allowance ) Madhya Pradesh Rules , 2021 .
(2) They shall come into force from the date of their publication in the Madhya Pradesh Gazette .

2. Definitions.-
( 1) In these rules , unless the context otherwise requires , -
(a) "Act" means the Mahatma Gandhi National Rural Employment Guarantee Act , 2005 (42 of 2005) ;
(b) " Applicant" means the head of a household or any its other adult member who has applied for employment under the scheme;
(c) State "Council" means the Madhya Pradesh Employment Guarantee Council constituted under sub - section (1 ) of section 12 ;
(d) "District Programme Coordinator" means an officer designated as such under sub- section ( 1 ) of section 14 ofthe Act;
(e) " Household" means the members of a family related to each other by blood , marriage or adoption and normally residing together or sharing meals or holding a common ration card;
(f) " Implementation agency" means any department of the or a a State Government , Central Government ZilaPanchayat , Panchayat at intermediate level , Gram Panchayat or any local authority or Government undertaking or non- governmental organization authorised by the Central Government or the State Government to undertake the implementation of any work taken up under the scheme ;
(g) " Programme officer " means an officer appointed under sub - section ( 1 ) of section 15 of the Act ;

(h) " Scheme" means a scheme notified by the State Government under sub - section ( 1 ) of section 4 ;
(i) " Secretary of the Gram Panchayat " means secretary as such appointed under the Madhya Pradesh Panchayat Raj Evam Gram SwarajAdhiniyam , 1993 ( No. 1 of 1994);
" Section" means a section of the Act ;
(j )
k) " State " means the State of Madhya Pradesh .
(
(2) Words and expressions used but not defined in these rules shall have the same meaning as assigned to them in the Act .
3. Entitlement of unemployment allowance.-
If an applicant who has applied for employment under the scheme is not provided such employment within fifteen days of receipt of his application for seeking employment from the date on which the employment has been sought or in the case of an advance application whichever is later , he/she shall be entitled to a daily unemployment allowance .
4. Disentitlement to receive unemployment allowance.- An applicant shall not be eligible to claim unemployment allowance payable , but shall be eligible to seek employment under the Act at any time for a period of three months , if he/she-
(a) does not accept the employment provided to his household under the scheme ;
(b) does not report for work within fifteen days of being notified by the programme officer or the implementing agency to report for the work ; or 914(7)

(c) continuously remains absent from work , without obtaining permission from the concerned implementing agency for a period more than one week in any month .
5. Rate of unemployment allowance.-
The unemployment allowance payable shall be paid to the applicant of a household subject to the entitlement of the household at a rate equal to one- fourth of the prevailing wage of the scheme for the first thirty days during financial year and at a rate equal to half of the wage rate for the remaining period of the financial year .
6. a Procedure for filling claim of unemployment allowance.-
a written (1) the aggrieved applicant shall submit application before the programme officer directly clearly stating the number of days for which the unemployment allowance is being claimed ;
a written (2) the programme officer shall receive application and thereafter the same shall be recorded and he shall certify it and shall give acknowledgment of such application to the applicant ; an (3) an application for the claim of unemployment allowances can be filed within fifteen days from the day on which the applicant becomes entitled for unemployment allowance according to rule 3 ;
(4) applicant shall file his claim with the original acknowledgement of his application of demand of work and original copy of his job card for inspection which shall be returned to him immediately after decision of this claim .

7. Procedure for Verification of claim.-
( 1) The Programme Officer within seven days of receipt of claim, shall sanction or reject the application received for claim of unemployment allowance after appropriate investigation and he shall record the reasons for sanction or rejection of unemployment allowance , which shall be communicated to the applicant in writing.
(2) The Programme Officer shall perform through cross verification of the job card and muster rolls to verify the claim of the aggrieved applicant and shall also verify the claim with the records maintained under the management information system . He shall certify the actual number of days by calculating those days for which unemployment allowance has to be paid .
(3) After verification of the claim or claims of unemployment allowance according to sub- rule (2 ) , the Programme officer shall submit a report along with a recommendation for payment of unemployment allowance to the District Programme Co - ordinator .
(4) The District Programme Coordinator upon receiving of the report according to sub -rule ( 3) after satisfying himself as to the legitimacy of claim or claims and verification thereof, shall send a requisition for amount of unemployment allowance to the Madhya Pradesh State Employment Guarantee Council . This action shall be completed by District Programme Coordinator within seven days of receipt of the report under sub- rule(3) .

914(9) 8. Fixing Responsibility of the Government officials for not providing employment.-
In all cases where Unemployment allowance is to be paid , the District Programme Coordinator shall fix the responsibility of panchayat's officer and employee as the case may be , for not providing employment to the applicant within the time limit mentioned in sub- rule ( 3) of rule 7 , from the date of receiving his application and shall send a proposal for recovery of unemployment allowance amount and taking action against those responsible person (s) to the competent authority or the officer designated for this purpose by the Madhya Pradesh State Employment Guarantee Council .
9. Procedure for payment of unemployment allowance.- ( 1) The Madhya Pradesh State Employment Guarantee Council on receiving the requisition for amount of unemployment allowance according to sub - rule (4) of rule 7 , shall release the amount within seven days .
(2) The Payment of unemployment allowance shall be made in the same manner , which is normally used to pay daily wages in the scheme .
10. Ceasing a claim of unemployment allowance.-
The liability of the State Government to pay unemployment allowance to a household during any financial year shall cease as soon as-
(i) the applicant directed by the Gram panchayat or the Programme officer to report for work either by himsel or depute at least one adult member of his household or 914 (10)

(ii) the period for which employment is sought comes to an end and no member of the household of the applicant had turned up for employment ; or
( iii) the adult members of the household or the applicant have received in total at least one hundred days of work within the financial year; or
(
iv) the household of the applicant has earned as much from the wages and unemployment allowance taken together or separately which is equal to the wage for one hundred days of work during the financial year .
11. Time Limit for payment of unemployment allowance.-
Every payment of unemployment allowance under rule 3 shall be made or offered not later than thirty days from the date from which it becomes due for payment .
12. Special power of the State Government.-
The State Government shall have the power to issue clarification of these rules for the purpose of giving effect and smooth implementation of the provisions of these rules and to issue such order , instructions and suggestions to the concerned officials which are not against the Act and these rules , from time to time .
13. Interpretation.-
If any question arises relating to the interpretation of any provisions of these rules , the matter shall be referred to the State Government and its decision thereon shall be final .
Accounting and Auditing.-
14.
Accounts of unemployment allowance shall be maintained in such form and in such manner as may be prescribed by the State Government . This record shall always be available for audit .
