क्र. एफ 23-01-2021- सामा उन्नीस. मध्यप्रदेश राज्य को लागू हुए रूप में भारतीय पथकर अधिनियम, 1851 ( 1851 का 8 ) की धारा 2 के साथ पठित धारा 4 द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए, राज्य सरकार, सारणी में खण्ड 9 में निम्नानुसार दर्शित 9 मार्गों पर मार्ग अथवा उसके भाग ( समरूप भाग ) के लिए प्रति फेरा (ट्रिप ) प्रति यान के आधार पर पथकर संग्रहण अभिकरण की नियुक्ति की तारीख से निम्नलिखित मूल दरों पर पथकर उद्ग्रहीत करने की मंजूरी प्रदान करती है, अर्थात्:-

2. पथकर, मध्यप्रदेश सड़क विकास निगम लिमिटेड द्वारा चयनित उपयोक्ता शुल्क संग्रहण अभिकरण द्वारा संग्रहीत किया जाएगा । प्रत्येक पथकर प्लाजा पर पथकर की दरें , उपरोक्त दरों के आधार पर , मध्यप्रदेश सड़क विकास निगम लिमिटेड द्वारा विनिर्दिष्ट की जाएंगी । पथकर प्लाजा तथा समरूप भाग की भौतिक अवस्थिति मध्यप्रदेश सड़क विकास निगम लिमिटेड द्वारा जारी निविदा के अनुसार होगी ।
3, उपरोक्त पथकर दरें प्रत्येक पथकर प्लाजा पर प्रति वर्ष थोक मूल्य सूचकांक के आधार पर बढ़ाई जाएंगी तथा निकटतम 5 रूपए तक पूर्णाकित की जाएंगी । वृद्धि, 31 मार्च को समाप्त होने वाले वर्ष के लिए थोक मूल्य सूचकांक के आधार पर प्रत्येक वर्ष के 1 सितंबर से प्रभावी की जाएगी। पथकर की मूल दरें दिनांक 01.09.2007 की स्थिति में प्रभावी होने के लिए अधिसूचित दरों के अनुसार होंगी । प्रतिवर्ष पथकर वृद्धि की गणना नीचे दिए गए सूत्र (उदाहरण) के अनुसार की जाएगीः-

गणना सूत्रः
नवीन पथकर दर (01.09.2008 से प्रभावी) = मूल पथकर दर थोक मूल्य सूचकांक (ख) थोक मूल्य सूचकांक (क) आगामी वर्षों के लिए गणना , नवीन वर्षों के लिए नए थोक मूल्य सूचकांक के आधार पर उपरोक्तानुसार की जाएगी । मूल थोक मूल्य सूचकांक 31 मार्च , 2007 को समाप्त होने वाले वर्ष का होगा ।
4. किसी मार्ग या उसके भाग (समरूप भाग) पर पथकर का उद्ब्रहण और संग्रहण उपयोक्ता शुल्क संग्रहण अभिकरण की नियुक्ति की तारीख से प्रारंभ होगा । 960 (1)

5. उपयोक्ता शुल्क संग्रहण अभिकरण परियोजना राजमार्ग के प्रवेश स्थल के समीप और प्रत्येक पथकर प्लाजा के समीप , दोनों ओर , परियोजना राजमार्ग के दोनों तरफ से आने वाले उपयोक्ताओं की जानकारी के लिए लागू पथकर प्रभार हिन्दी और अंग्रेजी दोनों भाषा में प्रदर्शित करेंगे ।
6. अप्राधिकृत संग्रहणः-
( 1 ) यदि उपयोक्ता शुल्क संग्रहण अभिकरण किसी व्यक्ति से धन की ऐसी राशि संग्रहीत करता है जो यहां इसके अधीन शोध्य और देय नहीं है , तो उपयोक्ता शुल्क संग्रहण अभिकरण ऐसे व्यक्ति को इस प्रकार संग्रहीत रकम के साथ संग्रहण की तारीख से वापसी की तारीख तक प्रत्येक दिन के लिए , इस प्रकार संग्रहीत रकम के 3 % (तीन प्रतिषत) की दर से संगणित रकम तुरंत नुकसानी के रूप में वापस करने का उत्तरदायी होगा । यथा पूर्वोक्त रीति में संगणित नुकसान के साथ ऐसी रकम के किसी भी कारण से ऐसे व्यक्ति को संदत्त न होने की स्थिति में, वह ऐसे संग्रहण की तारीख से 15 (पन्द्रह) दिनों की कालावधि के भीतर , मध्यप्रदेश सड़क विकास निगम के पास निक्षिप्त की जाएगी ।
(2) उप - खण्ड 6 ( 1 ) के अधीन उपयोक्ता शुल्क संग्रहण अभिकरण द्वारा देय रकम से संबंधित कोई विवाद परियोजना राजमार्ग पर अधिकारिता रखने वाले संभागीय प्रबंधक, मध्यप्रदेश सड़क विकास निगम, भोपाल द्वारा , लिखित में आदेश द्वारा , निपटाया जाएगा और ऐसे आदेश के विरूद्ध अपील , यदि कोई हो , परियोजना राजमार्ग पर अधिकारिता रखने वाले प्रमुख अभियंता, मध्यप्रदेश सड़क विकास निगम, को होगी ।
(3 ) पथकर के संग्रहण के संबंध में व्यथित कोई व्यक्ति, परियोजना राजमार्ग पर अधिकारिता रखने वाले संभागीय प्रबंधक , मध्यप्रदेश सड़क विकास विभाग निगम को शिकायत दर्ज करा सकेगा। संभागीय प्रबंधक , ऐसी शिकायत पर पन्द्रह दिन की कालावधि के भीतर आदेश पारित करेगा और ऐसे आदेश के विरूद्ध अपील , यदि कोई हो, मध्यप्रदेश राजपत्र , दिनांक 8 दिसम्बर 2021

परियोजना राजमार्ग पर अधिकारिता रखने वाले मुख्य अभियंता , मध्यप्रदेश सड़क विकास निगम को होगी ।
7. यह अधिसूचना उपयोक्ता शुल्क संग्रहण अभिकरण की नियुक्ति तारीख से 05 वर्ष की प्रारंभिक अवधि के लिए प्रभावी समझी जाएगी , जिसे और 05 वर्षों के लिए आगे बढ़ाया जा सकता है ।
8. राज्य सरकार यह और घोषणा करती है कि यान की निम्नलिखित श्रेणियों को इन मार्गों को पार करते समय पथकर के भुगतान से छूट प्राप्त होगीः- i . भारत सरकार तथा मध्यप्रदेश सरकार से संबंधित समस्त यान तथा वे यान जो शासकीय कर्तव्य पर हों;
ii . माननीय सांसद तथा विधायक से संबंधित यान;
iii . भारतीय सेना से संबंधित समस्त यान;
एम्बुलेंस ; iv .
V. फायर बिग्रेड;
vi . भारतीय डाक तथा तार विभाग से संबंधित यान;
vii . कृषि प्रयोजन के लिए उपयोग की जाने वाली ट्रैक्टरट्राली- ;
viii . आटो रिक्शा , दुपहिया तथा बैलगाड़िया;
ix . स्वतंत्रता संग्राम सेनानी एवं अधिमान्य पत्रकार;
x. भूतपूर्व सांसद एवं विधायक से संबंधित यान ।
टिप्पणीः- पथकर के भुगतान से इस प्रकार छूट प्राप्त यान/वैन का चालक (ड्राइवर) अपना नाम, रैंक तथा उस कर्तव्य (ड्यूटी) , जिसमें वह लगा हुआ है , बताएगा । मध्यप्रदेश राजपत्र , दिनांक 8 दिसम्बर 2021

No. F - 23-01 /2021 /Gen/ 19, In exercise of the powers , conferred by Section - 2 read with Section -4 of the Indian Tolls Act, 1851 (No . VIII of 1851 ) in its application to the State of Madhya Pradesh , the State Government is pleased to grant sanction for levying toll on the following Basic Rates on the road shown as below in clause 9, in the table on a per trip per vehicle basis for road or part thereof (Homogeneous Section) with effect from appointment of user fee Collection Agency , namely : -

2. The toll shall be collected by User Fee Collection agency selected by Madhya Pradesh Road Development Corporation Ltd. The rates oftoll on each toll plaza shall be specified by Madhya Pradesh Road Development Corporation Ltd. on the basis of above Rates . The physical location of toll plaza and of homogeneous section shall be as per the tender issued by Madhya Pradesh Road Development Corporation Ltd ..
3. The above rates shall increase on every toll plaza every year on the basis of Wholesale Price Index and shall be rounded off to the nearest five rupees . The increase shall be made effective from 1st September every year, based on the Wholesale Price Index for the year ending 31st March. The Basic Toll Rates shall be as per the rates notified to be effective as on 01.09.2007 . 960 ( 5) Basic Wholesale Price Index
WPI (A) (For the year ending 31st March , 2007)
WPI (B) Wholesale Price Index for the year Ending 31st March , 2008 .
Formula for calculation :
New Toll Rate ( w.e.f. 01.09.2008 ) = Basic Toll Rate x WPI (B )
WPI (A) For the coming years, the calculations shall be done as per the above based on new Wholesale Price Index for new years . Basic Wholesale Price Index shall be of the year ending 31st March, 2007 .
4 Levy and collection of toll on the road or part thereof (Homogeneous Section) shall commence upon date of appointment of User Fee Collection Agency .
5 The User Fee Collection agency , shall be near the entry point of the Project Highway and near each Toll Plaza on both sides , prominently display the applicable toll charges for information of users approaching from either side of the Project Highway in both Hindi & English .
6. Unauthorized Collection.-
(1) In the event that a User Fee Collection agency collects from any person a sum of money not due and payable hereunder , the User Fee Collection agency shall be liable to refund to such person forthwith the amount so collected along with a sum computed @ 3% (three percent) of the amount so collected, for each day from the date of collection till the date of refund, by way of damages . In the event that such amount together with damages computed in the manner as aforesaid is not paid to such person for any reason whatsoever, the same shall be deposited with MPRDC within a period of 15 (fifteen) days from the date of such collection .

(2) Any dispute relating to amounts payable by the User Fee Collection agency under clause 6 ( 1 ) shall be settled by the Divisional Manager , MPRDC having Jurisdiction over the Project Highway, by an order in writing and appeal , if any, against such order shall lie with the Chief Engineer , MPRDC having jurisdiction over the Project Highway .
(3) Any person aggrieved in connection with collection of the toll may lodge a complaint to the Divisional Manager , MPRDC having jurisdiction over the Project Highway . The Divisional Manager shall pass order on such complaint within a period of 15 ( fifteen) days and appeal , if any , against such order shall lie with the Chief Engineer , MPRDC having jurisdiction over the Project Highway.
7 . This notification shall be deemed to be effective from the date of appointment of User Fee Collection Agency for an initial period of 05 years which can be further increased for another 05 years
8. The State Government further declares that following categories of vehicle shall be exempted from payment of toll while crossing these roads.
(i) All vehicles belonging to the Government of India, Government of Madhya Pradesh and those on Government duty;
( ii) Vehicle belonging to the Hon'ble Member of Parliament and Member of Legislative Assembly ;
(iii) All vehicles belonging to the Indian Army on duty ;
(iv) Ambulances ;
(v) Fire Brigades ;
(
vi) Vehicles belonging to the Indian Posts and Telegraph Department;
(vii) Tractor - Trolleys used for agriculture purpose ;
(viii) Auto Rickshaws , Two wheeler and bullock carts ;
(ix) Freedom fighters and Accredited Journalists ;

(x) In addition to the above, passenger vehicle like Bus , Car/Jeep etc. shall be coming under the category of exempted vehicle for payment of toll .
Note : The driver of the vehicle/van so exempted from payment of toll shall state his name , rank and name of duty on which he is engaged .
