क्र. एफ - ए-3-43-2017-1- पांच- ( 89 ) .- मध्यप्रदेश माल एवं सेवाकर अधिनियम, 2017 ( 2017 का 19 ) की धारा 9 की उपधारा (5 ) के तहत प्रदत्त शक्तियों का प्रयोग करते हुए, राज्य सरकार, परिषद् की सिफारिशों के आधार पर , एतद्वारा , इस विभाग की अधिसूचना क्रमांक एफ ए 3-43-2017-1- पांच ( 55 ) , भोपाल दिनांक 7 दिसम्बर , 2018 में और आगे भी निम्नलिखित संशोधन करती है, अर्थात्:-
1. उक्त अधिसूचना में, प्रथम पैराग्राफ में,-
(i) उपवाक्य ( i ) में , शब्दों " और मोटर साइकिल " के स्थान पर, शब्दों और प्रतीक ", मोटर साईकिल , ओमनिबस या अन्य मोटर यान को प्रतिस्थापित किया जाएगा;
(ii) उपवाक्य ( iii ) के बाद, निम्नलिखित को अंतःस्थापित किया जाएगा, यथाः-
" ( iv ) विशिष्ट परिसर में स्थित रेस्तरां , इटिंग ज्वाइंटस आदि द्वारा आपूर्ति की जाने वाली रेस्तरां सेवाओं के अलावा रेस्तरां सेवा की आपूर्ति
2. स्पष्टीकरण में, -
( 1 ) मद ( ख ) में, शब्दों, प्रतीकों, अंकों और कोष्ठकों " और " मोटर साईकिल " का वही अर्थ होगा जो उनका क्रमशः मोटरयान अधिनियम , 1988 ( 1988 का 59 ) की धारा 2 के खंड ( 22 ) , खंड ( 25 ) और ( 26 ) में है " के स्थान पर, प्रतीकों, शब्दों, अंकों और कोष्ठकों मोटर साईकिल, " मोटरयान " और " ओमनिबस " का वही अर्थ होगा जो मोटरयान अधिनियम, 1988 ( 1988 का 59 ) की धारा 2 के क्रमशः खंड ( 22 ) , ( 25 ) , ( 27 ) , ( 28 ) और ( 29 ) में दिया गया है " को प्रतिस्थापित किया जाएगा;
(2 ) मद ( ख ) के बाद, निम्नलिखित अंतःस्थापित किया जाएगा, यथाः-

(ग) विशिष्ट परिसर से अभिप्राय ऐसे परिसरों से है , जो ऐसे ' होटल की व्यवस्था' की सेवाएं प्रदान करते हैं जिनका ठहरने की एक इकाई का घोषित टैरिफ सात हजार पांच सौ रुपए प्रति इकाई प्रतिदिन से अधिक या समतुल्य हो.
2. यह अधिसूचना 01 जनवरी , 2022 से लागू होगी.

क्र. एफ-ए- 3-43-2017-1- पांच.- भारत के संविधान के अनुच्छेद 348 के खण्ड ( 3 ) के अनुसरण में , इस आशय की अधिसूचना क्रमांक एफ - ए- 3-43-2017-1- पांच- (89 ) , दिनांक 16 दिसम्बर 2021 का अंग्रेजी अनुवाद राज्यपाल के प्राधिकार से एतद्वारा प्रकाशित किया जाता है.
मध्यप्रदेश के राज्यपाल के नाम से तथा आदेशानुसार, आर. पी. श्रीवास्तव, उपसचिव.
Bhopal , the 16th December , 2021
No. F-A- 3-43-2017-1 - V ( 89 ) . In exercise of the powers conferred by sub- section ( 5 ) of Section 9 of the Madhya Pradesh Goods and Services Tax Act, 2017 ( 19 of 2017 ) , the State government , on the recommendations of the Council , hereby makes the following amendments further to amend in this department's Notification No. FA- 3-43- 2017-1 -V (55 ) dated the 30th June , 2017, namely:-
1. In the notification ,-
(i) in clause (i ) , for the words " and motor cycle; " , the words " , notor cycle , omnibus or any other motor vehicle; " shall be substituted;
(ii) after clause (iii ) , the following clause shall be inserted , namely:-
"( iv) supply of restaurant service other than the services supplied by restaurant, eating joints etc. located at specified premises . "
2. In the said notification , in Explanation ,-
(i) in item (b) , for the words , brackets , numbers and figures " and "motor cycle " shall have the same meanings as assigned to them respectively in clauses ( 22) , (25 ) and (26 ) of Section 2 of the Motor Vehicle Act, 1988 ( 59 of 1988 ) . " , the words , brackets , numbers and figures , " motor cycle , motor vehicle and omnibus shall have the same meanings as assigned to them respectively in clauses (22 ) , (25) , (27) , (28 ) and (29) of Section 2 of the Motor Vehicle Act , 1988 (59 of 1988 ) . " shall be substituted;
( ii) after item (b) , the following shall be inserted namely,-
"(c) Specified premises means premises providing hotel accommodation service having declared tariff of any unit of accommodation above seven thousand five hundred rupees per unit per day or equivalent. "
2. This notification shall come into force with effect from the 1st day of January , 2022 .
