क्र.- एफ-37-9-2020- बीस-3 मध्यप्रदेश माध्यमिक शिक्षा अधिनियम , 1965 (क्रमांक 23 सन् 1965) की धारा 27 द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए , राज्य सरकार, एतद्वारा , मध्यप्रदेश माध्यमिक एवं उच्चतर माध्यमिक शालाओं की मान्यता (संशोधन) नियम, 2017 में निम्नलिखित संशोधन करती है, अर्थात्:-

उक्त नियमों में,-
1. नियम 3 में, उप- नियम (1 ) में,
(1 ) खण्ड (2) के स्थान पर, निम्नलिखित खण्ड स्थापित किए जाए, अर्थात्: -
"(2) अध्यक्ष, माधमक शिक्षा मण्डल,
-सदस्य.".
मध्यप्रदेश द्वारा नामनिर्दिष्ट प्रतिनिधि
(2) खण्ड (5) के स्थान पर, निम्नलिखित खण्ड स्थापित किया जाए, अर्थात्:-
"(5) आयुक्त, लोक शिक्षण द्वारा यथा प्राधिकृत लोक शिक्षण संचालनालय की मान्यता शाखा का कार्य
-सदस्य सचिव." .

2. नियम 5 में, उप- नियम (2) में, -
(1 ) खण्ड (क) में, उप - खण्ड (दो) के स्थान पर, निम्नलिखित उप- खण्ड स्थापित किया जाए, अर्थात्: - "(दो) सोसायटी / ट्रस्ट की नवीन मान्यता हेतु निम्नलिखित सारणी के अनुसार न्यूनतम भूमि क्षेत्र होना चाहिए:-

नोटः- वर्ग (सेक्शन ) की वृद्धि की दशा में , अध्यापन कक्ष आदि के लिए इस नियम में यथा विहित न्यूनतम क्षेत्रफल के मानदण्ड की पूर्ति किया जाना अनिवार्य होगा ।
(2) खण्ड (च) के पश्चात्, निम्नलिखित खण्ड जोड़ा जाए, अर्थात्ः-
"(छ)
विद्यालय परिसर में कोई ऐसी संरचना नहीं होनी चाहिए , जिससे कि विद्यार्थियों को क्षति कारित होना संभावित हो । विद्यालय परिसर से हाई टेंशन लाइन तथा पेट्रोल पंप की दूरी के संबंध में, यह दूरी भारतीय विद्युत नियम, 1956 (यथा संशोधित 2020) तथा केन्द्रीय प्रदूषण मण्डल , नई दिल्ली के ज्ञापन दिनांक 07.01.2020 के अनुसार नियत की जाएगी; " । (3) उप-नियम (20) में,-
(एक) खण्ड (5) के स्थान पर, निम्नलिखित खण्ड स्थापित किया जाए, अर्थात्:-
"(5) यदि शाला में कृषि संकाय है , तो उसे पृथक् से कम से कम एक एकड़ कृषि भूमि की व्यवस्था करनी होगी तथा यदि कृषि भूमि विद्यालय परिसर का भाग नहीं है, तो वह विद्यालय परिसर से 1 कि० मी० से अधिक की दूरी पर नहीं होनी चाहिए । " । 1040(1)

(दो) उप- नियम (20) के पश्चात्, निम्नलिखित उप- नियम जोड़ा जाए, अर्थात्:-
"(21 ) ऐसी सोसायटियां / ट्रस्ट, जो छात्रों को आवासीय सुविधा उपलब्ध करा रही हैं या उपलब्ध कराना चाहती हैं, नवीन मान्यता मांगते समय या मान्यता के नवीनीकरण या उन्नयन के समय आवासीय सुविधा के संबंध में यथा वांछित समस्त सुसंगत जानकारी एम पी आनलाईन पोर्टल पर अपलोड करेंगी । आवासीय सुविधाएं उपलब्ध कराने वाली सोसायटी / ट्रस्ट बाल अधिकारों के संरक्षण हेतु राष्ट्रीय आयोग द्वारा जारी दिशा निर्देशों तथा केन्द्र / राज्य सरकार एवं आपदा प्रबंधन संस्थान द्वारा समय- समय पर जारी निदेशों का अनिवार्यतः पालन करेंगी । " ।
3. नियम 6 में, उप- नियम (12) के पश्चात्, निम्नलिखित उप- नियम अन्तःस्थापित किए जाएं, अर्थात्:-
"(13) ऐसी संस्थाएं, जिनके पास हाईस्कूल स्तर तक की मान्यता है तथा जो हायर सेकेण्डरी स्तर तक के उन्नयन के लिए आवेदन करते हैं, तो ऐसे प्रकरणों में, आवेदन मान्यता के उन्नयन के रूप में माना जाएगा ।
(14) ऐसी सोसायटी/ ट्रस्ट जो उनकी मान्यता के नवीनीकरण के लिए आवेदन करते हैं तथा यदि मान्यता के लिए मानदण्डों की पूर्ति न होने के कारण उनका नवीनीकरण आवेदन रद्द किया जा रहा है, तो ऐसे प्रकरणों में , उनके नवीनीकरण आवेदन को आगामी दो वर्षों के लिए मान्यता के नवीनीकरण की श्रेणी में समझा जाएगा । " ।
4. नियम 10 में, उप- नियम (1 ) में, खण्ड (छ) के पश्चात्, निम्नलिखित खण्ड जोड़ा जाए, अर्थात्ः-
"(ज) यदि सोसायटी / ट्रस्ट नवीन मान्यता हेतु आवेदन करता है और आवेदन अमान्य हो जाता है, तो जमा की गई मान्यता फीस की रकम, प्रक्रिया फीस के लिए रूपए 5000/- (रूपए पांच हजार) की कटौती के पश्चात् वापस की जाएगी । " ।
5. नियम 11 में , उप- नियम (2) के स्थान पर, निम्नलिखित उप- नियम स्थापित किया जाए , अर्थात्:-
" (2) यदि कोई कारण बताओ सूचना पत्र जारी किया जाता है तथा यदि सोसायटी / ट्रस्ट से प्राप्त उत्तर से संभागीय संयुक्त संचालक का समाधान नहीं होता है, तो संबंधित को सुनवाई का अवसर प्रदान करने के पश्चात्, संयुक्त संचालक अधिकतम् रूपए 1,00,000 /- (रूपए एक लाख) की शास्ति अधिरोपित करेगा । ऐसे प्रकरणों में, जहां विद्यालय की मान्यता को रद्द किया जाना प्रस्तावित है, ऐसे आदेश को क्रियान्वित करने के पूर्व आयुक्त, लोक शिक्षण का अनुमोदन प्राप्त करना संयुक्त संचालक के लिए अनिवार्य होगा । ऐसे विद्यालय के लिए जहां मान्यता रद्द करने का विनिश्चिय किया जा रहा है, संबंधित जिला शिक्षा अधिकारी यह सुनिश्चित करेंगे , कि विद्यालय में अध्ययनरत् विद्यार्थियों को निकटवर्ती शासकीय विद्यालयों में प्रवेश दिया जाए । " । मध्यप्रदेश राजपत्र, दिनांक 28 दिसम्बर 2021

6. नियम 12 में,-
) उप-नियम (1 ) के स्थान पर, निम्नलिखित उप - नियम स्थापित किया जाए , अर्थात्ः- (1
"(1 ) मान्यता के रद्द किए जाने अथवा शास्ति अधिरोपित किए जाने की दशा में, यदि सोसायटी / ट्रस्ट संभागीय संयुक्त संचालक के आदेश से संतुष्ट नहीं है , तो सोसायटी/ ट्रस्ट संभागीय संयुक्त संचालक के आदेश पारित किए जाने की तारीख से 30 दिवस के भीतर आयुक्त, लोक शिक्षण को प्रथम अपील प्रस्तुत कर सकेगा । आयुक्त, ऐसी अपील पर 30 दिवस की कालावधि के भीतर आदेश जारी करेगा । यदि सोसायटी/ ट्रस्ट आयुक्त, लोक शिक्षण के आदेश से असंतुष्ट है, तो वह 30 दिवस की कालावधि के भीतर मान्यता समिति के समक्ष द्वितीय अपील प्रस्तुत कर सकेगा । मान्यता समिति का विनिश्चिय अंतिम एवं बंधनकारी होगा । " । (2) उप-नियम (2) के पश्चात्, निम्नलिखित उप- नियम जोड़ा जाए, अर्थात्ः-
"(3) सोसायटी / ट्रस्ट द्वारा प्रत्येक अपील के लिए, चाहे वह आयुक्त, लोक शिक्षण के * समक्ष अथवा राज्य स्तरीय मान्यता समिति के समक्ष, प्रस्तुत की गई हो रूपए 5,000/- (रूपए पांच हजार ) की प्रक्रिया फीस अपील आवेदन के साथ देय * होगी । " ।
No.F - 37-9-2020 - XX - 3.- In exercise of the powers conferred by Section 27 of the Madhya Pradesh Secondary Education Act, 1965 (No. 23 of 1965) , the State Government , hereby, makes the following amendments in the Madhya Pradesh Recognition of Secondary and Higher Secondary School (Amendment) Rules, 2017 , namely :-
AMENDMENTS
In the said rules , -
1. In rule 3 , in sub - rule ( 1 ) , -
(1 ) for clause (2) , the following clause shall be substituted , namely : -
" (2) Representative nominated by the Chairman , Board of Secondary Education , Madhya Pradesh Member ." .
(2) for clause ( 5) , the following clause shall be substituted , namely : -
" ( 5) Officer not below the rank of Joint Director looking after the work of recognition section of directorate of Public Instruction , as authorized by Commissioner , Public Instruction for the task Member - Secretary . " .
2 . In rule 5, in sub - rule ( 2 ) , -
(1 ) in clause ( a) , for sub - clause ( ii ) , the following sub - clause shall be substituted, namely: - 1040(3)

Note: In case of increase of section , it shall be mandatory to fulfill the criteria of minimum area as prescribed in this rule for teaching room etc.

(2) after clause ( f) , the following clause shall be added , namely : -
" (g) There should be no such structure in the premises of school which is likely to cause harm to the students . With respect to the distance of High Tension Line and Petrol Pump from the school premises , this distance shall be fixed as per the Indian Electricity Rules , 1956 ( as amended 2020) and Memorandum of Central Pollution Board , New Delhi dated 07.01.2020 ; " .
(3) in sub- rule (20) , -
( i) for clause ( 5) , the following clause shall be substituted , namely : -
" (5) If school has agriculture stream , it shall have to separately arrange at least one acre of agricultural land and if the agricultural land is not a part of the school premises , then it should not be more than 1 k.m. away from the school premises . " .
(ii) after sub - rule (20) , the following sub - rule shall be added , namely : -
" (21 ) Such Societies / Trusts which are providing or wish to provide residential facility to the students shall be uploaded all the relevant information regarding the residential facility as desired on the MP Online मध्यप्रदेश राजपत्र, दिनांक 28 दिसम्बर 2021
1040(5) portal at the time of seeking new recognition or renewal of recognition or up - gradation . The Society/ Trust providing residential facilities , shall mandatorily follow the guidelines issued by the National Commission for the Protection of Child Rights and the instructions issued by the Central/ State Government and Disaster Management Institute from time to time . " .
3. In rule 6 , after sub - rule ( 12) , the following sub - rules shall be inserted , namely : -
"( 13) The institutions having recognition up to High School standard and applies for up - gradation up to Higher Secondary standard, then in such cases , the application shall be treated as up - gradation of the recognition . " .
( 14) The Society/ Trust , who applies for the renewal of their recognition and in case due to non - fulfillment of the parameters for recognition , their renewal application is being rejected, in such cases their renewal application shall be deemed in the category of renewal of recognition for the next two years . " .
4. In rule 10 , in sub - rule ( 1 ) , after clause ( g) , the following clause shall be added , namely : -
" (h) In case the Society / Trust applying for new recognition and the application is rejected , then the amount of recognition fee deposited shall be refunded after the deduction of Rs . 5,000 / - ( Rupees Five thousand ) for the process fee ." .

5. In rule 11 , for sub - rule (2) , the following sub - rule shall be substituted , namely : -
an "(2) In case any Show Cause Notice is issued and if the Divisional Joint Director is not satisfied with the reply received from the Society/ Trust , then after giving opportunity of hearing to the concerned , Joint Director would impose a penalty of Rs . 1,00,000 / - ( Rupee one lakh ) maximum . In such cases where the cancellation of recognition is proposed , before executing such order , it would be mandatory for Joint Director to get due approval of the Commissioner , Public Instruction . For such schools where the decision of cancellation of recognition is being taken, the concerned District Education Officer shall ensure that the students studying in these schools are admitted in the nearby Government schools . " .
6. In rule 12 , -
(1) For sub - rule ( 1 ) , the following sub - rule shall be substituted , namely: -
"(1) In case of cancellation of recognition or imposed penalty , if the Society/ Trust is not satisfied with the order of the Divisional Joint Director , the Society/ Trust may file first appeal to the Commissioner, Public Instructions within 30 days from the date of passing of the order of Divisional Joint director . The Commissioner shall issue an order on such appeal within a time period of 30 days. If Society/ Trust is dissatisfied with the order of the Commissioner , Public Instruction , it may file a second appeal before the Recognition Committee within a period of 30 days . The decision of the Recognition Committee shall be final and binding. " .
(2) After sub- rule (2 ) , the following sub- rule shall be added , namely : -
" (3) For every appeal by the Society /Trust , whether it is presented before the Commissioner , Public Instruction or the State Level Recognition Committee , a process fee of Rs . 5,000 / - ( Rupees five thousand) shall be payable alongwith the appeal application . " .
