अधि.क. 25 , एफ 1-250 / 2020 / 18-3 - मध्यप्रदेश नगरपालिक निगम अधिनियम, (1956 क्रमांक 23 सन् 1956 ) की धारा 132- क के साथ पठित धारा 433 तथा मध्यप्रदेश नगरपालिका अधिनियम , 1961 (क्रमांक 37 सन् 1961 ) की धारा 127 -ख के साथ पठित धारा 355 एवं 356 द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए , राज्य सरकार, एतद्वारा ,. मध्यप्रदेश नगरपालिका (जल प्रदाय , मलजल तथा ठोस अपशिष्ट प्रबंधन सेवाओं के लिए उपभोक्ता प्रभार) नियम , 2020 में निम्नलिखित संशोधन करती है, अर्थात्ः-

संशोधन

उक्त नियमों में, -

1. नियम 3 के स्थान पर , निम्नलिखित नियम स्थापित किया जाए , अर्थात्ः-

"3. जल प्रदाय , मलजल तथा ठोस अपशिष्ट प्रबंधन सेवाओं के लिए उपभोक्ता प्रभार की दरों का निर्धारणः-

(1 ) प्रत्येक नगरपालिका, मध्य प्रदेश नगरपालिक निगम अधिनियम , 1956 की धारा 132-क तथा मध्य प्रदेश नगरपालिका अधिनियम, 1961 की धारा 127 - ख के उपबंधों के अधीन जल प्रदाय, मलजल तथा ठोस अपशिष्ट प्रबंधन सेवाओं के लिए उपभोक्ता प्रभार की दरें नीचे दिए गए मानदंड के अनुसार निर्धारित करेगी : -

(एक) स्थानीय निधि संपरीक्षक अथवा सनदी लेखाकर (चार्टड एकाउण्टेंट) द्वारा अंकेक्षित, नियम 4 में उल्लिखित मदों पर वास्तविक व्यय के आधार पर जल प्रदाय सेवाओं के लिए उपभोक्ता प्रभार की गणना ऐसी रीति में की जाएगी कि जल प्रदाय सेवाओं के प्रचालन और संधारण पर उपगत वार्षिक व्यय की शत- प्रतिशत वसूली की जा सके;

(दो) नियम 5 में उल्लिखित मदों पर अंकेक्षित वास्तविक व्यय के आधार पर ठोस अपशिष्ट प्रबंधन हेतु उपभोक्ता प्रभार की गणना ऐसी रीति में की जाएगी कि ठोस अपशिष्ट प्रबंधन प्रणाली के प्रचालन और संधारण पर उपगत वार्षिक व्यय की शत- प्रतिशत वसूलीं की जा सके;

(तीन) ऐसी नगरपालिका में जिसमें मलजल सेवाएं उपबंधित हैं, मलजल सेवाओं के उपभोक्ताओं के लिए मलजल सेवाओं के लिए उपभोक्ता प्रभार, जल प्रदाय सेवाओं के लिए उपभोक्ता प्रभार का न्यूनतम चालीस प्रतिशत निर्धारित किया जाएगा ।

(चार) फीकल (मल ) सेप्टेज मैनेजमेंट के लिए उपभोक्ता प्रभार , परिवहन तथा उपचार की वास्तविक लागत के आधार पर निर्धारित किया जाएगा तथा सेप्टिक टैंक के मलत्याग (डेस्लजिंग) पर प्रभारित किया जाएगाः

परन्तु, इन नियमों के लागू होने के परिणामस्वरुप, आवासीय इकाइयों के संबंध में उपभोक्ता प्रभारों की प्रचलित दरें किसी भी वित्तीय वर्ष में पन्द्रह प्रतिशत से अधिक नहीं बढाई जाएंगीः 1044(1)

परन्तु यह भी कि इन नियमों के लागू होने के परिणामस्वरुप , यदि गैर-आवासीय इकाइयों, औद्यौगिक इकाइयों, तथा शासकीय / अर्ध शासकीय इकाईयों के संबंध में उपभोक्ता प्रभारों की प्रचलित दरों में सौ प्रतिशत से अधिक की वृद्धि की जाती है, तो सौ प्रतिशत से अधिक की वृद्धि, चरणों में, ऐसी रीति में लागू की जाएगी , कि तीसरे वर्ष के अन्त तक, उप- नियम (1 ) के खण्ड (एक) एवं (दो) के अनुसार सेवाओं पर उपगत वार्षिक व्यय शत् प्रतिशत वसूल हो जाए ।

टीपः जल प्रदाय सेवाओं के लिए उपभोक्ता प्रभार की गणना उपाबंध -1 में दिए गए उदाहरण के अनुसार की जाएगी ।

(2) ऐसी नगरपालिका जिसने इन नियमों के अधिसूचित किए जाने के पूर्व जलप्रदाय तथा ठोस अपशिष्ट प्रबंधन सेवाओं के लिए उपभोक्ता प्रभार निर्धारित नहीं किए हैं या ऐसी नगरपालिका जो इन नियमों के अधिसूचित किए जाने के पश्चात् अस्तित्व में आई हो, उक्त सेवाओं के लिए राज्य सरकार द्वारा विहित मानदंड के अनुसार उपभोक्ता प्रभार की दरें निर्धारित करेगीः

परंतु राज्य सरकार सामान्य या विशेष आदेश द्वारा , विशेष परिस्थितियों के अधीन, उपभोक्ता प्रभार की दरें निर्धारित कर सकेगी और राज्य सरकार द्वारा इस प्रकार निर्धारित दरें नगरपालिकाओं पर बंधनकारी होंगी ।

(3) उपभोक्ता प्रभार के अतिरिक्त नगरपालिकाएं, यथास्थिति, मध्य प्रदेश नगरपालिक निगम अधिनियम , 1956 की धारा 132- क की उप- धारा (2) के खण्ड (दो) तथा मध्य प्रदेश नगरपालिका अधिनियम, 1961 की धारा 127- ख की उप-धारा (2) के खण्ड (दो) के उपबंधों के अधीन उनमें निहित शक्तियों को प्रयोग में लाते हुए , सम्पत्ति कर का निश्चित प्रतिशत अतिरिक्त प्रभार के रुप में अधिरोपित कर सकेंगीः 2. नियम 12 में, उप- नियम (3 ) के पश्चात्, निम्नलिखित उप - नियम अंतःस्थापित किया जाए, अर्थात्ः-

" (3-क) उपभोक्ता प्रभार के लिए बिल की गई रकम को निकटतम दस रुपए में पूर्णांकित किया जाएगा । " । मध्यप्रदेश राजपत्र, दिनांक 29 दिसम्बर 2021

3. उपाबंध -1 के स्थान पर, निम्नलिखित उपाबंध स्थापित किया जाए , अर्थात्: -

"उपाबंध-1

(नियम 3 देखिए)

जल प्रदाय तथा मलजल सेवाओं के लिए उपभोक्ता प्रभार का निर्धारण उदाहरणः वित्तीय वर्ष 2021-2022 के लिए उपभोक्ता प्रभार की दरों के निर्धारण के लिए प्रक्रिया

(1 ) अनुमापी (वाल्यूमेट्रिक) जल प्रदाय के लिए उपभोक्ता प्रभार

क = वित्तीय वर्ष 2019-2020 के दौरान नियंम 4 मे उल्लिखित सभी सुसंगत मदों पर अंकेक्षित तथा विहित प्राधिकारी द्वारा सम्यक् रुप से अनुमोदित व्यय । ख = वित्तीय वर्ष 2019-2020 के लिए नगरपालिका द्वारा मीटरीकृत संयोजन को प्रदाय किए गए कुल जल की मात्रा (किलोलीटर में) ।

ग = वित्तीय वर्ष 2019-2020 के लिए प्रति किलोलीटर व्यय = क / ख

घ = वित्तीय वर्ष 2020-2021 के लिए प्रति किलोलीटर व्यय = ग + ग का 5% ङ = वित्तीय वर्ष 2021-2022 के लिए प्रति किलोलीटर व्यय = घघ का 5% (2) गैर-अनुमापी (नॉन- वाल्यूमेट्रिक) जल प्रदाय के लिए उपभोक्ता प्रभारः

क = वित्तीय वर्ष 2019-2020 के दौरान नियम 4 में उल्लिखित सभी सुसंगत मदों पर अंकेक्षित तथा विहित प्राधिकारी द्वारा सम्यक् रुप से अनुमोदित व्यय ।

ख = वित्तीय वर्ष 2019-2020 के दौरान नगरपालिका में गैर- मीटरीकृत संयोजनों की कुल संख्या

ग = वित्तीय वर्ष 2019-2020 के लिए प्रति उपभोक्ता वार्षिक व्यय = क / ख घ = वित्तीय वर्ष 2020-2021 के लिए प्रति उपभोक्ता वार्षिक व्यय = ग ग का 5% ङ = वित्तीय वर्ष 2021-2022 के लिए प्रति उपभोक्ता व्यय = घ + घ का 5% 1044(3)

टीप: -1: किसी नगरपालिका में मीटरीकृत एवं गैर- मीटरीकृत संयोजन होने की दशा में, सुंसगत उपभोक्ताओं के लिए उपभोक्ता प्रभार की गणना उपरोक्त 1 एवं 2 के अनुसार पृथक् पृथक् रुप से की जाएगी ।

टीप: -2: गैर-अनुमापी संयोजनों (नान वाल्यूमेट्रिक कनेक्शन) के लिए बल्क संयोजनों के लिए उपभोक्ता प्रभार की दरें, नगरपालिका द्वारा फेरुल साईज तथा प्रदाय किए गए जल की मात्रा पर विचार करते हुए निर्धारित की जाएंगी । " ।

Noti . No.25 , F 1-250/ 2020/18-3- In exercise of the powers conferred by section 132 -A read with section 433 of the Madhya Pradesh Municipal Corporation Act, 1956 (No. 23 of 1956) and section 127-B read with section 355 and 356 of the Madhya Pradesh Municipalities Act, 1961 (No. 37 of 1961) , the State Government, hereby , makes the following amendments in the Madhya Pradesh Municipality (User Charges for Water Supply, Sewerage and Solid Waste Management Services ) Rules , 2020, namely: -

AMENDMENTS

In the said rules , -

1. For rule 3 , the following rule shall be substituted, namely: -

" 3.Determination of rates of User Charges for Water Supply , Sewerage and Solid Waste Management Services.-

(1 )Every Municipality shall determine rates of User Charges for Water Supply , Sewerage and Solid Waste Management services under the provisions of section 132 -A of the Madhya Pradesh Municipal Corporation Act, 1956 and section 127-B of the Madhya Pradesh Municipalities Act, 1961 as per the criteria given below : -

(i) based on the actual expenditure on the items mentioned in rule 4, audited by Local Fund Auditor or Chartered Accountant, the calculation of user charges for water supply services shall be done मध्यप्रदेश राजपत्र, दिनांक 29 दिसम्बर 2021

1044(5) in such manner that annual expenditure incurred on operations and maintenance of water supply services can be recovered cent percent;

(ii) based on the audited actual expenditure on the items mentioned in rule 5, the calculation of user charges for solid waste management shall be done in such manner that annual expenditure incurred on operations and maintenance of solid waste management system can be recovered cent percent ;

(iii ) in the municipality in which sewerage services are provided, the user charges for sewerage services for the users of sewerage services , shall be determined minimum forty percent of user charges for water supply services;

(iv) user charges for Fecal Septage Management shall be determined based on actual cost of transportation and treatment and shall be charged on desludging of septic tank:

Provided that , as a result of application of these rules , the prevalent rates of user charges in respect of residential units , shall not be increased by more than fifteen percent in a financial year :

Provided further that in case , as a result of application of these rules , the prevalent rates of user charges in respect of Non- Residential Units , Industrial Units and Government/Semi Government unit get increased by more than hundred percent , then the increase in excess of hundred percent shall be applied in phases , in such a manner that by end of the third year the annual expenditure incurred on the services as per sub -clause (i ) and (ii ) of sub - rule (1 ) is recovered cent percent .

Note : The calculation of user charges for water supply services shall be done as per example given in Annexure- 1 .

(2) The municipality which has not determined user charges for Water Supply , Sewerage and Solid Waste Management Services prior to. notification of these rules , or the municipality which has come into existence after notification of these rules , shall determine the rates of user charges for said services according to the criteria prescribed the State Government :

Provided that the State Government by general or special orders , under special circumstances , may determine the rates of user charges and the rates so determined by the State Government shall be binding on the municipalities .

(3) In addition to the user charges , municipalities may impose certain percentage of property tax as additional charges in exercise of the powers vested with them under the provisions of clause ( ii) of sub- section (2) of section 132 -A of the Madhya Pradesh Municipal Corporation Act , 1956 and clause ( ii) of sub - section (2) of section 127-B of the Madhya Pradesh Municipalities Act , 1961 , as the case may be .

2. In rule 12 , after sub - rule (3 ) following sub - rule shall be inserted , namely: -

" (3 -A) The amount billed for user charges shall be rounded off to the nearest ten rupees ." .

3. For Annexure- 1 , the following Annexure shall be substituted, namely : -

Determination of User Charges of Water Supply and Sewerage Services Example : Procedure for determining rates of user charges for the financial year 2021-2022

(1) User Charges for Volumetric Water Supply

A = Audited expenditure during financial year 2019-20 on all the relevant items mentioned in rule 4 and duly approved by the Prescribed Authority .

B = Quantity of total water supplied (in kilolitres) to the metered connections by Municipality for the financial year 2019-2020 .

C = Per Kilolitre expenditure for the financial year 2019-2020 = A/B PerKilolitre expenditure for the financial year 2020-2021 = C + 5 % D = of C

E = Per Kilolitre expenditure for the financial year 2021-2022= D+ 5% ofD
