क्रमांक- 330 / 1174/ 2021 /तीन/जेल : कारागार अधिनियम, 1894 की धारा 59 की उपधारा ( 12 ) द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए , राज्य सरकार एतद्वारा , सिद्धदोष व्यक्तियों के संबंध में , जीविकोपार्जन हेतु कौशल विकास प्रशिक्षण , बंदियों के पुनर्वास तथा जेल उद्योग के विनियमन हेतु निम्नलिखित नियम बनाती है, अर्थात : -
नियम
1. संक्षिप्त नाम , विस्तार और प्रारंभ.-
( 1 ) इन नियमों का संक्षिप्त नाम जेल उद्योग ( सिद्धदोष व्यक्तियों का नियोजन और बंदी पुनर्वास ) नियम, 2021 है।

(2) ये नियम मध्यप्रदेश राज्य में स्थित समस्त जेलों पर लागू होंगे । (3) ये नियम मध्यप्रदेश राजपत्र में इनके प्रकाशन की तारीख से प्रवृत्त होंगे ।
2. परिभाषाएं.-
इन नियमों में, जब तक सन्दर्भ से अन्यथा अपेक्षित न हो, -
(1 )
(क) ' अधिनियम' से अभिप्रेत है, कारागार अधिनियम, 1894 ( सन् 1894 का 18) ;
(ख) ' सक्षम प्राधिकारी' से अभिप्रेत है, जेल मुख्यालय स्तर पर महानिदेशक और जेल स्तर पर संबंधित जेल अधीक्षक;
(ग) 'जेल उत्पाद' से अभिप्रेत है, जेल में स्थापित उद्योग में नियोजित बंदियों द्वारा निर्मित की जाने वाली सामग्री तथा जिसमें औद्यानिकी और कृषि संक्रियाओं के उत्पाद सम्मिलित हैं;
' निधि' से अभिप्रेत है, नियम 3 के अधीन गठित निधि;
(घ)
(ड) 'जेल उद्योग' से अभिप्रेत है, सिद्धदोष व्यक्तियों के नियोजन और जीविकोपार्जन हेतु कौशल विकास प्रशिक्षण हेतु जेल में स्थापित अनुसूची - एक में उल्लेखित उद्योग;
(च) 'कच्चा माल' से अभिप्रेत है, जेल में स्थापित उद्योग में जेल उत्पाद निर्मित करने हेतु प्रयुक्त कच्चा माल;
(छ) 'पारिश्रमिक' से अभिप्रेत है, नियोजित बंदियों को देय पारिश्रमिक। (ज ) ' पर्यवेक्षण शुल्क' से अभिप्रेत है , अन्य विभागों/संस्थानों से ली गई तकनीकी सेवाओं के बदले में प्रशिक्षकों व विशेषज्ञों को देय मानदेय;

(2 ) वे शब्द और अभिव्यक्तियॉ जो इन नियमों में प्रयुक्त किये गये हैं किंतु और परिभाषित नहीं किये गये हैं किन्तु अधिनियम में परिभाषित किये गये हैं, के वही अर्थ होंगे जो अधिनियम में उनके लिए समनुदेशित किये गये हैं ।
3. निधि का गठन.-
जेल उद्योग के लिए निम्न से मिलकर निधि का गठन किया जाएगा
(1) राज्य सरकार द्वारा अनुदान;
(2) जेल उत्पाद के विक्रय से प्राप्त आय ।
4. वित्तीय प्रबंधन.-
जेल उद्योग संचालन हेतु नियम 3 के अधीन गठित निधि का विनियमन निम्नानुसार किया जाएगा, अर्थात्: -
(1 ) बैंक खाता महानिदेशक, जेल एवं सुधारात्मक सेवाएं के नाम से संधारित किया जाएगा । जेल उद्योग संचालन हेतु राज्य सरकार द्वारा आवंटित बजट राशि/ अनुदान उक्त बैंक खाते में जमा किया जाएगा। किसी जेल के सक्षम प्राधिकारी द्वारा जेल उद्योग संचालन , संधारण तथा विकास हेतु अनुमानित व्यय की मांग की जाने पर महानिदेशक जेल एवं सुधारात्मक सेवाएं उक्त खाते से निधि जारी कर सकेंगे ।
(2 ) जेल उद्योग संचालन हेतु जेल अधीक्षक के नाम से भी बैंक खाता संधारित किया जाएगा , जिसमें उप नियम ( 1 ) में यथा विहित जारी राशि के साथ-साथ जेल उद्योग में उत्पादित माल के विक्रय से प्राप्त आय राशियों और कृषि, औद्यानिकी से प्राप्त आय की राशि को जमा किया जाएगा । उक्त जमा राशि का उपयोग जेल उद्योग हेतु कच्चे माल/सामग्री पर होने वाले व्यय का भुगतान करने, स्थापित उद्योग का विस्तार या नवीन उद्योग की स्थापना करने एवं बंदियों के कल्याण एवं पुनर्वास हेतु किया जा सकेगा। मध्यप्रदेश राजपत्र, दिनांक 17 फरवरी 2022

(3) उत्पादन, विक्रय , आय - व्यय से संबंधित लेखाओं का संधारण उप जेल अधीक्षक से अनिम्न श्रेणी के अधिकारी द्वारा किया जाएगा। लेखाओं की प्रविष्टियों की शुद्धता के लिए जेल अधीक्षक उत्तरदायी होगा। (4 ) वार्षिक लेखा संपरीक्षण जेल मुख्यालय एवं महालेखाकार ग्वालियर द्वारा किया जाएगा ।
(5) सक्षम प्राधिकारी , प्रतिवर्ष संपरीक्षित लेखा प्रतिवेदन महानिदेशक जेल एवं सुधारात्मक सेवाएं को प्रेषित करेगा ।
(6 ) महानिदेशक, जेल एवं सुधारात्मक सेवाएं लेखा संबंधी प्राप्त वार्षिक प्रतिवेदन राज्य शासन को प्रेषित करेगा।
5. कच्चे माल की आपूर्ति.-
सक्षम प्राधिकारी निम्नलिखित के लिए उत्तरदायी होगा -
(1 ) जेल उद्योग के लिए प्रत्येक वित्तीय वर्ष में आकलित खपत के आधार पर अपेक्षित कच्चा माल क्रय करना ;
(2) प्रतिस्पर्धी कीमतों पर कच्चे माल के क्रय हेतु समयबद्धता के साथ- साथ मितव्ययिता , पारदर्शिता की अपेक्षा की जाएगी ।
(3 ) कच्चे माल प्रदायकर्ता के देयकों का भुगतान नगद या चेक अथवा ई- पेमेन्ट के माध्यम से किया जा सकेगा ।
(4) कच्चे माल के क्रय हेतु भण्डार क्रय एवं सेवा उपार्जन नियम 2015 , जेल पूर्ति नियम , 1968 और राज्य शासन द्वारा समय - समय पर जारी आदेशों व निर्देशों का पालन सुनिश्चित किया जाएगा । 172(3)

6. औद्योगिक ईकाई की स्थापना व विस्तार.-
(1 ) महानिदेशक, जेल एवं सुधारात्मक सेवाएं की अध्यक्षता एवं अपर सचिव/उप सचिव/अवर सचिव मध्य प्रदेश शासन , जेल विभाग की सदस्यता में मुख्यालय पर एक उद्योग संवर्धन समिति गठित की जाएगी। समिति निधियों के विनियमन करने, जेल उद्योग के संवर्धन के लिए योजना बनाने, योजनाओं के क्रियान्वयन का नियंत्रण करने के लिए अधिकृत होगी।
(2) महानिदेशक , जेल एवं सुधारात्मक सेवाएं किसी जेल में कोई नवीन औद्योगिक ईकाई स्थापित करने हेतु स्वीकृति प्रदान करने हेतु सक्षम प्राधिकारी होंगे , किन्तु ऐसे प्रकरणों में, जेल विभाग , मध्यप्रदेश शासन का अनुमोदन आवश्यक होगा ।
(3) सक्षम अधिकारी द्वारा किसी स्थापित जेल उद्योग के विस्तार की सूचना महानिदेशक, जेल एवं सुधारात्मक सेवाएं को यथा- शीघ्र दी जाएगी।
7. उत्पाद विनियमन.-
(1 ) जेल उद्योग में , सामान्यतया जेलों के साथ -साथ अन्य शासकीय विभागों, शासकीय /अर्द्धशासकीय/ निजी संस्थाओं की मांग के अनुसार ही वस्तुओं/सामग्री का उत्पादन किया जाएगा अन्यथा नहीं ।
(2) जेल उद्योग में उत्पादित वस्तुओं/सामग्री का उपयोग बंदियों और जेलों की आवश्यकताओं की पूर्ति के लिए किया जाएगा । अधिशेष वस्तुओं/सामग्री का विक्रय शासकीय विभागों, शासकीय/ अर्द्धशासकीय /निजी संस्थाओं और व्यक्तियों को किया जा सकेगा ।
(3 ) जेल उद्योग में उत्पादित वस्तुओं/सामग्री की लागत दर जेल अधीक्षक की अध्यक्षता में गठित समिति द्वारा वास्तविक पूंजीगत व्यय , पारिश्रमिक भुगतान, पर्यवेक्षण व्यय के आधार पर नियत की जाएगी। (4 ) उत्पादित वस्तुओं/सामग्री की लागत दर का स्वयं उपयोग के लिए उपनियम ( 3 ) के अनुसार विहित लागत दर पर और अन्य जेलों के लिए लागत दर पर 10 प्रतिशत लाभ पर तथा शासकीय विभागों, मध्यप्रदेश राजपत्र, दिनांक 17 फरवरी 2022

शासकीय/अर्द्धशासकीय संस्थाओं के लिए 20 प्रतिशत लाभ पर और निजी संस्थाओं व व्यक्तियों के लिए 30 प्रतिशत लाभ पर विक्रय की जाएगी ।
8. कार्यकरण परिस्थितियां एवं उत्पाद की गुणवत्ता.-
(1) सक्षम प्राधिकारी यह भी सुनिश्चित करेगा कि कर्मकारों के लिए समुचित स्वास्थ्य एवं कार्यकरण परिस्थितियों के साथ अपेक्षित बुनियादी सुविधाएं उपलब्ध करायी जाएं ।
( 2) सक्षम प्राधिकारी जेल उद्योग के उत्पाद की उच्च गुणवत्ता सुनिश्चित करने के लिए उत्तरदायी होगा । उद्योग में कार्यरत अधिकारी और कर्मचारी नियमित रूप से और मांगे जाने पर सक्षम प्राधिकारी को उत्पाद की गुणवत्ता के संबंध में जानकारी प्रदाय करेंगे ।
9. तकनीकी विशेषज्ञों की सेवाएं.-
(1 ) जेल उद्योग के विकास , उत्पादन क्षमता और उत्पाद की गुणवत्ता में सुधार और बंदियों को कौशल विकास प्रशिक्षण के प्रयोजन से अन्य विभागों/संस्थाओं के तकनीकी प्रशिक्षकों/विशेषज्ञों की सेवाएं ली जा सकेंगीः
परन्तु मानदेय आधार पर अन्य विभागों/संस्थाओं के तकनीकी प्रशिक्षकों/विशेषज्ञों की सेवाएं लेने से पूर्व महानिदेशक, जेल एवं सुधारात्मक सेवाएं से स्वीकृति प्राप्त करनी होगी ।
(2) प्रशिक्षकों/विशेषज्ञों को मानदेय का भुगतान मानदेय हेतु उपलब्ध बजट से किया जाएगा।
(3) अधिकारियों, कर्मचारियों और कौशल उन्नयन हेतु कर्मकारों के प्रशिक्षण देने के संबंध में मध्य प्रदेश जेल कौशल विकास एवं व्यावसायिक प्रशिक्षण बोर्ड के मार्गदर्शन /अनुशंसाओं का पालन किया जाएगा।
10. निरीक्षण एवं भौतिक सत्यापन.-
( 1 ) कच्चे माल, जेल उत्पाद , मशीनरी संयंत्र, उपकरण , औजार व अन्य संबद्ध वस्तुओं की देख - रेख , भण्डारण तथा पर्यवेक्षण के लिए जेल अधीक्षक 172(5)

द्वारा नामनिर्दिष्ट उप अधीक्षक/सहायक अधीक्षक या अन्य अधिकारी/कर्मचारी उत्तरदायी होगा ।
(2) जिला कलेक्टर या जिला कलेक्टर द्वारा नामनिर्दिष्ट कोई अतिरिक्त जिला मजिस्ट्रेट/ अतिरिक्त कलेक्टर , अतिरिक्त पुलिस अधीक्षक , कलेक्टर द्वारा तकनीकी शिक्षा तथा कौशल विकास विभाग का नामनिर्दिष्ट कोई अधिकारी , जिला उद्योग केन्द्र का महाप्रबंधक तथा संबंधित जेल अधीक्षक सुनिश्चित करेंगे कि कम से कम छह माह में एक बार कच्चे माल, जेल उत्पाद , मशीनरी संयंत्र, उपकरण , औजार व अन्य संबद्ध वस्तुओं का भौतिक सत्यापन किया गया है।
(3) जेल अधीक्षक द्वारा उप- नियम (1 ) के अधीन नामनिर्दिष्ट अधिकारी/कर्मचारी कर्तव्यों की उपेक्षा या लापरवाही के कारण कच्चे माल , जेल उत्पाद, मशीनरी संयंत्र, उपकरण , औजार व अन्य संबद्ध वस्तुओं के संबंध में हुए किसी दुर्विनियोग, हानि या क्षति के लिए व्यक्तिगत रूप से उत्तरदायी होगा ।
11. नियमों का अध्यारोही प्रभाव न होना. ये नियम कारागार अधिनियम के तत्स्थानी उपबंधों तथा उनके अधीन बने नियमों एवं जेल निर्देशिका पर अध्यारोही प्रभाव के बिना, अनुपूरक नियम होंगे।
12. निरसन तथा व्यावृति.- इन नियमों द्वारा विनियमित विषयों के संबंध में जारी समस्त आदेश तथा निदेश एतद्वारा निरसित किए जाते है:
उक्त नियमों का निरसन होते हुए भी, इस प्रकार निरसित आदेशों और निदेशों के अधीन की गई कोई बात या की गई कोई कार्रवाई इन नियमों के अधीन की गई बात या की गई कार्रवाई समझी जाएगी । मध्यप्रदेश राजपत्र, दिनांक 17 फरवरी 2022

No. 330 / 1174 / 2021 / Three / Jail : In exercise of the powers conferred by sub- section ( 12 ) of section 59 of the Prisons Act , 1894 , the State Government , hereby , makes the following rules regarding convicted person's skill development training to earn livelihood , rehabilitation of prisoners and regulation of the prison industry , namely:
RULES
1. Short title , Extent and Commencement.-
( 1 ) These rules may be called the Madhya Pradesh Jail Industries (Engagement of convicted Persons and Rehabilitation of Prisoners ) Rules , 2021 .
(2) They shall apply to all the jails located in the State of Madhya Pradesh .
(3) They shall come into force from the date of their publication in the Madhya Pradesh Gazette .
2. Definitions.-
( 1) In these rules , unless the context otherwise requires , —
(a) "Act " means the Prisons Act , 1894 ( 18 of 1894 ) ;
(b) " competent authority " means the Director General at the Jail Headquarters level and the concerned Jail Superintendent at the Jail level ;

(C) "Jail products " means goods being manufactured by prisoners engaged in industry established in Jail and include products of horticultural and agricultural activities;
(d) " fund" means the fund constituted under rule 3 ;
(e) " prison industry " means the industries mentioned in Schedule - I established in jails for engagement and skill development training for livelihood of the convicted persons ;
(f) " raw material " means the raw material that is used in the industry established in jail for the manufacture of jail products;
(g) " remuneration " means the remuneration payable to engaged prisoners .
(h) " supervision fee " means the honorarium payable to the trainers and experts in lieu of the technical services taken from other departments / institutions ;
(2) Words and expressions used and not defined in these rules butdefined in the Act shall have the same meanings assigned to them in the Act .
3. Constitution of Fund . A fund for the Jail industry shall be constituted consisting of-
( 1) grant by the State Government ;
(2) income by sale of jail products .
4. Financial Management . The fund constituted under rule 3 for the operation of the jail industry shall be regulated as follows , namely : -
( 1 ) A bank account shall be operated in the name of Director General , Prisons and Correctional Services . The budget 172(9)

amount / grant allocated by the State Government for operating the jail industry shall be deposited in the said bank account . The Director General , Prisons and Correctional Services may release the amount from the said account on being demanded by competent authority the estimated expenditure for operation , maintenance and development of the jail industry .
(2) A bank account shall also be operated in the name of the Jail Superintendent for the operation of the jail industry in which the proceeds from the sale of goods produced in the jail industry and amount receipt from agriculture , horticulture along with the amount released as prescribed in sub - rule ( 1 ) shall be deposited . The said credited amount may be utilized to pay the expenditures incurring on the purchase of raw materials for the jail industry , expansions of the established industry or establishment of new industries and for welfare and rehabilitation of the prisoners .
(3 ) Accounts relating to production , sale , income and expenditure shall be maintained by an officer not below the rank of the Deputy Jail Superintendent . The Jail Superintendent shall be liable for the correctness of the entries in the account .
(4) Annual audit shall be made by jail headquarters and Accountant General Gwalior .
(5) The competent authority shall send the audit report annually to the Director General of Prisons and Correctional Services .
(6) The Director General , Prisons and Correctional Services shall send the annual report received regarding accounts to the State Government .

Supply of Raw Material . The Competent Authority shall be 5.
responsible for the following-
( 1) procurement of the raw materials required for the jail industry on the basis of estimated consumption in each financial year ;
(
2) procurement of raw materials at competitive prices , economy , transparency along with timeliness shall be expected ;
(
3) payment of bills of raw material supplier may be made in cash or by check or through e - payment ;
(4) to ensure compliance of the Store Purchase and Service Procurement Rules , 2015 , Jail Supply Rules , 1968 and the orders and instructions issued by the State Government from time to time for the procurement of raw materials .
6. Establishment and expansion of industrial unit.-
( 1) An Industry Promotion Committee having Additional Secretary / Deputy Secretary / Under Secretary , Jail Department , Government of Madhya Pradesh as member and Director General , Prisons and Correctional Services as chairman shall be constituted at the Headquarters . The committee shall be empowered to regulate the funds , to make the plans for the promotion of the Jail industry and to control the implementation of the schemes .
(2) The Director General , Prisons and Correctional Services shall be the competent authority to grant approval for the establishment of a new industrial unit in a jail but in such cases the approval of the Jail Department , Government of Madhya Pradesh shall be necessary .
(3) The information of the expansion of any established jail industry shall be given to the Director General , Prisons and 172 ( 11 )

Correctional Services , as soon as may be , by the competent authority.
7 . Product Regulation.-
(1) In jail industry , generally goods / materials shall be produced only according to the demand of jails along with other government departments , government / semi- government/ private institutions otherwise not .
(2) The goods / materials produced in the jail industry shall be used for meeting the needs of prisoners and jails . The surplus goods / materials may be sold to government departments , government / semi- government /private individuals . institutions and (3) The cost rate of the goods / materials produced in the jail industry shall be fixed by the committee constituted under the chairmanship of the Jail Superintendent on the basis of actual capital expenditure , supervision expenditure . remuneration payment, (4) The produced goods / materials shall be sold , at the cost rate for self- use , at 10 percent profit on cost rate prescribed in sub - rule (3 ) to other jails and at 20 percent profit on cost rate to government departments , government/ semi- government institutions and 30 percent profit on cost rate prescribed in sub - rule (3 ) to private institutions and individuals .
8. Working conditions and product quality.-
(1 ) The competent authority shall also ensure the workers to make available suitable health and working conditions along with required basic amenities .

(2) The competent authority shall be responsible for ensuring high quality of the products of jail industry . Information regarding the quality of the product shall be given regularly and on demand to the competent authority by officers and employees working in the industry .
9. Services of Technical Experts.-
( 1 ) The services of technical trainers / experts from other departments / institutions may be hired for the purpose of development of jail industry , improvement of production efficiency and product quality and skill development training ofprisoners:
Provided that before hiring the services of technical on trainers / experts of other departments / institutions honorarium basis , approval of the Director General , Prisons and Correctional Services has to be obtained .
(2) The honorarium to the trainers / experts shall be paid from the budget available for the honorarium .
(3) Regarding imparting training to officers , employees and workers for skill up-gradation , the guidelines/ recommendations of the Madhya Pradesh Jail Skill Development and Vocational Training Board shall be adhered .
10. Inspection and Physical Verification.-
( 1 ) The Deputy Superintendent / Assistant Superintendent or any other officer / employee designated by the Jail Superintendent shall be liable for the maintenance , storage and supervision of raw materials , jail products , machinery plants , equipment , tools and other related articles .

or an (2) District Collector Additional District Magistrate / Additional Collector nominated by District Collector , Additional Police Superintendent , an officer nominated by the Collector of the Technical education and skill development department , General manager of district industry center and the respective Jail Superintendent shall make sure that the physical verification of raw materials , prison products , machinery plant , equipment , tools and other related articles is done at least once in six months .
(3) The officer / employee designated by the Jail Superintendent under sub - rule ( 1 ) shall be personally liable for any misappropriation , loss or damage in respect of raw materials , jail products , machinery plant , equipment , tools and other related articles due to negligent or neglect of duties .
11. Rules not to be Overridden.- These rules shall be supplementary to the corresponding provisions of the Prisons Act , 1894 and the rules made there under and the jail manual without overriding effect.
12. Repeal . All orders and directions issued in relation to the matters regulated by these rules are hereby repealed :
Provided that anything done or any action taken under the orders and directions so repealed shall be deemed to have been done or taken under these rules .
