फा. क्र . 10 - क- चार निरर्हित- 2022-66.- भारत निर्वाचन आयोग के आदेश क्र. 76- म.प्र.वि.स. 2018- पश्चिम-1 दिनांक 28 मार्च, 2022 जिसके द्वारा आयोग ने लोक प्रतिधिनियम , 1951 की धारा 10 क के तहत विधान सभा निर्वाचन 2018 में 23- करैरा विधान सभा निर्वाचन क्षेत्र जिला शिवपुरी से निर्वाचन लड़ने वाले अभ्यर्थी श्री अर्जुन लाल-आम आदमी पार्टी को अपने निर्वाचन का कोई भी व्यय लेखा दाखिल न करने के कारण " संसद के किसी भी सदन या संघ राज्य क्षेत्र की विधान सभा अथवा विधान परिषद् के लिए सदस्य चुने जाने या होने के लिए " उक्त आदेश की तारीख से तीन वर्ष तक के लिए निरर्हित घोषित किया है को सर्वसाधारण की जानकारी के लिये प्रकाशित किया जाना है.

आदेश
सं. 76- म.प्र.- वि.स. 2018-पश्चिम- I.- यतः, भारत निर्वाचन आयोग द्वारा मध्यप्रदेश राज्य की विधान सभा के साधारण निर्वाचन, 2018 की घोषणा प्रेस नोट संख्या ईसीआई - प्रे.नो. 66-2018 दिनांक 6 अक्टूबर 2018 के जरिए की गई थी . कार्यक्रम के अनुसार, मतगणना की तारीख 11 दिसम्बर 2018 थी.
और, यतः, लोक प्रतिनिधित्व अधिनियम , 1951 की धारा 78 के अनुसार , निर्वाचन लड़ने वाले प्रत्येक अभ्यर्थी को निर्वाचित अभ्यर्थी की तारीख से 30 दिनों के भीतर निर्वाचन व्यय के अपने लेखे की सही प्रति जिला निर्वाचन अधिकारी को दाखिल करनी होती है;

और, यतः, संबंधित रिटर्निंग अधिकारी 23 - करैरा विधान सभा निर्वाचन क्षेत्र के परिणाम 11 दिसम्बर 2018 को घोषित किए गए थे. इस प्रकार निर्वाचन व्यय के लेखा दाखिल करने की अंतिम तारीख 10 जनवरी 2019 थी.
और, यतः, मुख्य निर्वाचन अधिकारी, मध्यप्रदेश के दिनांक 15 जनवरी 2019 के पत्र सं. 10- क- चार- निर्वा .व्यय लेखा-6- शिवपुरी-2019-856 द्वारा अग्रेषित जिला निर्वाचन अधिकारी , शिवपुरी जिला , मध्यप्रदेश द्वारा दिनांक 19 जनवरी 2019 को प्रस्तुत रिपोर्ट के अनुसार श्री अर्जुन लाल मध्यप्रदेश के 23- करैरा विधान सभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले आम आदमी पार्टी के अभ्यर्थी अपने निर्वाचन व्यय का कोई भी लेखा दाखिल करने में असफल रहे.
और, यतः, जिला निर्वाचन अधिकारी शिवपुरी जिला, मध्यप्रदेश की रिपोर्ट के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम , 1961 के नियम 89 के उपनियम (5) के अंतर्गत निर्वाचन व्यय प्रस्तुत नहीं करने के लिए श्री अर्जुन लाल को कारण बताओ नोटिस दिनांक 13 अगस्त 2019 जारी किया गया था;
और , यतः, निर्वाचनों का संचालन , 1961 के नियम 89 के उपनियम (6) के अनुसार, दिनांक 13 अगस्त 2019 के उपर्युक्त कारण बताओ नोटिस के जरिए श्री अर्जुन लाल को निदेश दिया गया था कि वे इस नोटिस के प्राप्त होने के 20 दिनों के अंदर आयोग में लेखे न प्रस्तुत कर पाने के कारणों को स्पष्ट करते हुए लिखित रूप में अपना अभ्यावेदन प्रस्तुत करें और साथ ही, पूर्ण निर्वाचन व्यय का लेखा संबंधित जिला निवार्चन अधिकारी को प्रस्तुत करें;
और, यतः, उक्त नोटिस श्री अर्जुन लाल द्वारा दिनांक 26 अगस्त 2019 को प्राप्त किया गया था. अभ्यर्थी से प्राप्त पावती रसीद जिला निर्वाचन अधिकारी , जिला शिवपुरी के दिनांक 6 जुलाई 2020 के पत्र संख्या सा. निर्वा.-व्यय लेखा- 2020-198 द्वारा आयोग को प्रस्तुत कर दी गई है;
और, यतः, जिला निर्वाचन अधिकारी, शिवपुरी द्वारा अपने दिनांक 6 जुलाई 2020 के पत्र संख्या सा. निर्वा.-व्यय लेखा-2020-198 के तहत प्रस्तुत की गई अनुपूरक रिपोर्ट में यह बताया गया है कि श्री अर्जुन लाल ने आज की तारीख तक न तो कोई अभ्यावेदन और न ही मूल वाउचरों आदि के साथ विधिवत रूप से हस्ताक्षरित अपने निर्वाचन व्यय के सही लेखे का विवरण प्रस्तुत किया है . इसके अतिरिक्त, उन्होंने भारत निर्वाचन आयोग का सम्यक नोटिस मिलने के उपरांत भी उक्त असफलता के लिए न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है;
और, यतः, आयोग का यह समाधान हो गया है कि श्री अर्जुन लाल निर्वाचन व्यय का लेखा दाखिल करने में असफल रहे हैं और उनके पास इस असफलता के लिए कोई भी उचित कारण अथवा न्यायोचित्य नहीं है;
और, यतः लोक प्रतिनिधित्व अधिनियम , 1951 की धारा 10 क में अनुबंधित किया गया है कि:-
"यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति
(क) निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है, दाखिल करने में असफल रहा है ; तथा
(ख) उस असफलता व्ययों के लिए कोई अच्छा कारण या न्यायोचित्य नहीं रखता है, तो निर्वाचन आयोग शासकीय राजपत्र में प्रकाशित आदेश द्वारा उसको निरर्हित घोषित करेगा और ऐसा व्यक्ति उस आदेश की तारीख से तीन वर्ष की कालावधि के लिए निरर्हित होगा;
अतः, अब, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10 क के अनुसरण में भारत निर्वाचन आयोग एतद्वारा , मध्यप्रदेश राज्य की विधान सभा के साधारण निर्वाचन , 2018 के 23- करैरा विधान सभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले आम आदमी पार्टी अभ्यर्थी श्री अर्जुन लाल, निवासी 24, वार्ड क्र. 04- रानी अवंती बाई नरवर, तहसील नरवर, जिला शिवपुरी, मध्यप्रदेश को संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य क्षेत्र की विधान सभा अथवा विधान परिषद् के लिए सदस्य चुने जाने अथवा होने के लिए इस आदेश की तारीख से तीन वर्ष की अवधि के लिए निरर्हित घोषित करता है.

ORDER
No.76 - MP - LA - 2018 - WS - I.- WHEREAS , the General Election to the Legislative Assembly of Madhya Pradesh , 2018 was announced by Election Commission of India vide Press Note No ECI - PN - 66-2018 dated 6th October 2018 As per the schedule , the Date of Counting of votes was 11th December 2018 .
AND, WHEREAS , as per Section 78 of the Representation of the People Act , 1951 , every contesting candidate has to lodge a true copy of his account of election expenses within 30 days with the District Election Officer , from the date of election of returned candidate ;
AND , WHEREAS, the result of 23 - Karera Assembly Constituency was declared by the Returning Officer concerned on 11th December 2018 As such the last date for lodging of account of election expenses was 10th January 2019 .
AND , WHEREAS , as per the report dated 15th January 2019 submitted by the District Election Officer, Shivpuri District , Madhya Pradesh and forwarded by Chief Electoral Officer , Madhya Pradesh vide letter No.10- A-Four- Elec.Expenditure Account- 6- Shivpuri - 2019-856 , dated 19th January 2019 Shri Arjuna Lal , Aam Aadmi Party contesting candidate from 23 - Karera Assembly Constituency of Madhya Pradesh , failed to lodge any account of his election expenses as required by law .
AND , WHEREAS , on the basis of the report of the District Election Officer, Shivpuri District , Madhya Pradesh , a Show Cause notice dated 13th August 2019 was issued by the Election Commission of India under Sub Rule (5 ) of Rule 89 of the Conduct of Elections Rules , 1961 to Shri Arjuna Lal for non submission of accounts of Election expenses ;
AND, WHEREAS, as per sub - rule( 6) of Rule 89 of the Conduct of Elections Rules , 1961 , through the above said Show Cause Notice dated 13th August 2019 , Shri Arjuna Lal was directed to submit his representation in writing to the Commission explaining the reason for non submission of accounts and also to lodge his complete accounts of election expenses to the District Election Officer concerned within 20 days from the date of receipt of the notice ;
AND , WHEREAS, the said notice was received by Shri Arjuna Lal on 26st August 2019 Acknowledgment receipt obtained from the candidate have been submitted to the Commission by District Election Officer, Shivpuri vide his letter No. Gen. Election - Expenditure - 2020-198-2021 , dated 06th July 2020.
AND, WHEREAS , in the supplementary report submitted by District Election Officer , Shivpuri vide his letter No. Gen. Election -2020-198 , dated 06th July 2020, dated it has been stated that Shri Arjuna Lal has not submitted any representation or a statement of correct account of his election expenses , duly signed along with original vouchers etc. till date . Further, he has neither furnished any reason nor explanation for the said failure even after receipt of the due notice to the Election Commission of India as well ;

AND, WHEREAS , Commission is satisfied that Shri Arjuna Lal has failed to lodge an account of election expenses and has no good reason or justification for the failure ;
AND , WHEREAS , Section 10A of the Representation of the People Act , 1951 stipulates that : -
"If the Election Commission is satisfied that a person-
(a) has failed to lodge an account of election expenses within the time and in the manner required by law or under this Act ; and
(b) has no good reason or justification for the failure , the Election Commission shall by order published in the Official Gazette , declare him to be disqualified and any such person shall be disqualified for a period of three years from the date of the order ;
NOW , THEREFORE , in pursuance of Section 10A of the Representation of the People Act , 1951 , the Election Commission of India hereby declares Shri Arjuna Lal resident of 24 , Ward No. 04 , Rani Avanti Bai Narwar , Tehsil - Narwar , District- Shivpuri the contesting candidate of Aam Admi Party for the General Election to the Legislative Assembly of Madhya Pradesh, 2018 from 23 - Karera Assembly Constituency, to be disqualified for being chosen as and for being a member of either House of Parliament or the Legislative Assembly or Legislative Council of a State or Union Territory for a period of three years from the date of this order .
