क्रमांक / एफ 0/15-52-14 / 2022 / : - मध्यप्रदेश कृषि उपज मण्डी (एक से अधिक मंडी क्षेत्रों के लिए विशेष अनुज्ञप्ति ) नियम , 2009 में संशोधन का निम्नलिखित प्रारूप , जिसे राज्य सरकार मध्यप्रदेश कृषि उपज मण्डी अधिनियम , 1972 ( क्रमांक 24 सन् 1973 ) की धारा 32- क के साथ पठित धारा 79 की उप- धारा ( 1 ) तथा उप - धारा (2 ) के खण्ड ( छह ) द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए बनाना प्रस्तावित करती है, उक्त अधिनियम की धारा 79 की उप- धारा ( 1 ) द्वारा अपेक्षित किए गए अनुसार उन समस्त व्यक्तियों की, जिनके कि उससे प्रभावित होने की संभावना है, जानकारी के लिए , एतदद्वारा , प्रकाशित किया जाता है और एतदद्वारा , यह सूचना दी जाती है कि उक्त संशोधन के प्रारूप पर , इस सूचना के मध्यप्रदेश राजपत्र में प्रकाशन की तारीख से चौदह दिन का अवसान होने पर विचार किया जाएगा ।
किसी भी ऐसी आपत्ति या सुझाव पर , जो उक्त संशोधन के प्रारूप के संबंध में किसी व्यक्ति से. ऊपर विनिर्दिष्ट कालावधि का अवसान होने के पूर्व प्राप्त हो , राज्य सरकार द्वारा या प्रबंध निदेशक द्वारा यथा निदेशित किए गए अनुसार विचार किया जाएगा ।
प्रारूप संशोधन
1 . नियम 2 में , खण्ड (द ) के पश्चात्, निम्नलिखित खंड अंतः स्थापित किए जाएं , अर्थात्ः-
" ( ध ) " निर्यात " से अभिप्रेत है विदेशी व्यापार ( विकास और विनियमन ) अधिनियम , 1992 ( 1992 का 22 ) के अधीन परिभाषित निर्यात;

(न) " निर्यातक " से अभिप्रेत है विदेशी व्यापार (विकास और विनियमन ) अधिनियम , 1992 ( 1992 का 22 ) एवं विदेशी व्यापार (विनियमन ) नियम , 1993 अंतर्गत परिभाषित निर्यातकर्ता । " ।
2. नियम 4 में , -
(1) उप-नियम ( 1 ) में शब्द " व्यापारी , प्रसंस्करणकर्ता " के स्थान पर , शब्द "व्यापारी , प्रसंस्करणकर्ता , निर्यातक " स्थापित किए जाएं ।
(2) उप - नियम ( 2 ) में विद्यमान परंतुक के स्थान पर , निम्नलिखित परन्तुक स्थापित किया जाए , अर्थात्: -
" परन्तु एक्सचेंज और निर्यातक अनुज्ञप्तिधारक के मामले में उपरोक्त वर्णित उपबंध प्रभावशील नहीं होंगे । " ।
3 . नियम 5 के स्थान पर , निम्नलिखित नियम स्थापित किया जाए , अर्थात्: -
"5. अनुज्ञप्ति फीस विशेष अनुज्ञप्ति के लिए फीस रूपए 20,000 ( रुपए बीस हजार ) होगी , परन्तु निर्यातक के लिए अनुज्ञप्ति फीस रूपए 1,000 ( रुपये एक हजार ) होगी। अनुज्ञप्ति फीस , रेखांकित बैंक ड्राफ्ट , जो प्रबंध संचालक के पक्ष में देय हो , द्वारा देय होगी । " ו
4. नियम 6 में , परन्तुक में पूर्ण विराम के स्थान पर कालन स्थापित किया जाए और उसके पश्चात्, निम्नलिखित परंतुक स्थापित किए जाएं, अर्थात् : -
" परन्तु, निर्यातक अनुज्ञप्तिधारक के मामले में केवल वाणिज्यिक संव्यवहार हेतु अनुज्ञप्ति प्राप्त करने पर प्रतिभूति की आवश्यकता नहीं होगी:
परन्तु यह और भी कि निर्यातक अनुज्ञप्तिधारक द्वारा अधिसूचित मंडी/ उपमंडी प्रांगण और या विनिर्दिष्ट क्रय केन्द्र के माध्यम से कृषकों की कृषि उपज क्रय किए जाने पर अनुज्ञप्तिधारक द्वारा नियमानुसार प्रतिभूति प्रस्तुत की जाएगी । प्रतिभूति की रकम एफ.डी.आर. या बैंक गारंटी के रूप में होगी । एफ.डी. आर . बोर्ड के पक्ष में बन्धक (प्लेज ) की जाएगी । बैंक गारंटी ऐसे अधिसूचित बैंक द्वारा जारी की गयी होनी चाहिए जिसकी शाखा भोपाल (मध्यप्रदेश ) में अवस्थित हो । बैंक गारंटी पूरे पांच वर्ष के लिये होगी। आवेदक द्वारा प्रस्तुत एफ.डी.आर. या बैंक गारंटी बोर्ड मुख्यालय में रखी जाएगी । " ।
5. नियम 7 में , -
(1) उप-नियम ( 1 ) में , शब्द " व्यापारी , प्रसंस्करणकर्ता " के स्थान पर , शब्द" व्यापारी , प्रसंस्करणकर्ता , निर्यातक स्थापित किए जाएं ।
(2) उप-नियम ( 3 ) में , खंड ( तीन ) में शब्द " व्यापारी , प्रसंस्करणकर्ता " के स्थान 376 ( 1 )

पर , शब्द " व्यापारी , प्रसंस्करणकर्ता , निर्यातक " स्थापित किए जाएं ।
(3 ) खंड (सात) के पश्चात्, निम्नलिखित खंड अंतःस्थापित किए जाएं, अर्थात्: -
" (आठ ) निर्यातक के लिए विदेशी व्यापार ( विकास और विनियमन ) अधिनियम, 1992 ( 1992 का 22 ) के अधीन धारा 7 के अनुसार प्रमाणफ्त्र;
(नौ) निर्यातक के लिए एपीडा/ सक्षम निर्यात प्राधिकरण द्वारा जारी आर.सी.एम.सी. / प्रमाणपत्र । " ।
6. नियम 10 में , उप- नियम ( 5 ) में पूर्ण विराम के स्थान पर कालन स्थापित किया जाए और उसके पश्चात् निम्नलिखित परंतुक स्थापित किया जाए , अर्थात्: -
"परन्तु, निर्यातक अनुज्ञप्तिधारक की दशा में केवल वाणिज्यिक संव्यवहार अथवा मंडी/ उपमंडी प्रांगण से उपज क्रय करने पर क्रय केंद्र स्थापित करने की बाध्यता नहीं होगी । " ।
7 . नियम 12 में, -
(1 ) उप - नियम ( 1 ) में , शब्द " व्यापारी , प्रसंस्करणकर्ता " के स्थान पर , शब्द "व्यापारी , प्रसंस्करणकर्ता , निर्यातक " स्थापित किए जाएं ।
(2 ) उप- नियम ( 5 ) के स्थान पर , निम्नलिखित उप- नियम स्थापित किया जाएं , अर्थात्: -
" ( 5 ) विशेष अनुज्ञप्ति के नवीकरण के निर्णय की सूचना प्राप्त होने के तत्काल पश्चात् आवेदक द्वारा रूपए 20,000/- ( रुपए बीस हजार ) , परन्तु निर्यातक के लिए रूपये 1,000/ - ( रुपये एक हजार ) की, अनुज्ञप्ति फीस बोर्ड मुख्यालय में जमा कराई जाएगी । " ।
8. नियम 13 में , खंड ( ढ ) में पूर्ण विराम के स्थान पर सेमीकालन स्थापित किया जाए और उसके पश्चात् निम्नलिखित खंड स्थापित किया जाए , अर्थात् : -
"(ण ) निर्यातक अनुज्ञप्तिधारी के मामले में अधिसूचित कृषि उपज की न्यूनतम 100 मीट्रिक टन मात्रा का निर्यात नहीं करता है । " ।
9. नियम 17 में , उप- नियम ( 2 ) , में शब्द " क्रेता / व्यापारी / प्रसंस्करणकर्ता / एक्सचेंज " के स्थान पर , शब्द " क्रेता/ व्यापारी / प्रसंस्करणकर्ता / निर्यातक / एक्सचेंज " स्थापित किए जाएं ।

10. नियम 19 में शब्द " क्रेता/ व्यापारी / प्रसंस्करणकर्ता / एक्सचेंज" के स्थान पर , शब्द "क्रेता/ व्यापारी/ प्रसंस्करणकर्ता / निर्यातक/ एक्सचेंज " स्थापित किए जाएं ।
11. नियम 20 में पूर्व विराम के स्थान पर , कालन स्थापित किया जाए और इसके पश्चात् निम्नलिखित परंतुक अंतःस्थापित किया जाए , अर्थात् : -
"परन्तु निर्यातक के मामले में राज्य से खरीदी गयी कृषि उपज पर भुगतान की गई मंडी फीस राज्य सरकार द्वारा समय - समय पर घोषित निर्यात प्रोत्साहन योजना अंतर्गत निर्धारित प्रक्रिया एवं उपबंधों के अनुसार प्रतिपूर्ति योग्य होगी। " ।
12. प्ररूप- सात में , क्रमांक ( 26 ) के पश्चात्, निम्नलिखित क्रमांक स्थापित किया जाए , अर्थात्ः-
"निर्गमन/ विक्रय मात्रा में से निर्यात की गयी मात्रा
(26-अ) । " ।

Bhopal , the 29th April 2022
No.F -15-52-14/2022/: - The following draft ofamendment in the with Section 32-A Madhya Pradesh Krishi Upaj Mandi ( Special Licence for more than one market area) Rules , 2009 , which the State Government proposes to make in exercise of the powers conferred by sub- section ( 1 ) and clause ( vi) of sub - section (2) of Section 79 read of the Madhya Pradesh Krishi Upaj MandiAdhiniyam , 1972 ( No. 24 of 1973 ) is hereby published as required by sub- section ( 1 ) of Section 79 of the said Adhiniyam for the information of all persons likely to be affected thereby and notice is hereby given that the said draft of amendments shall be taken into consideration on the expiry of fourteen days from the date of publication of this notice in the Madhya Pradesh Gazette .
Any objection or suggestion which may be received from anyperson with respect to the said draft of amendment on or before the expiry of the period specified above shall be considered by the State Government or the Managing Director .
DRAFT OF AMENDMENT
1. In rule 2 , after clause ( r) , the following clausesshall be inserted , namely : -
" ( s ) 'Export ' means export as defined in Foreign Trade (Development and Regulation ) Act , 1992 ( 22 of 1992) ;

(t) 'Exporter ' means Exporter as defined in Foreign Trade (Development and Regulation ) Act , 1992 (22 of 1992) and Foreign Trade ( Development and Regulation ) Rules , 1993. " .
2 . In rule 4, -
(1) in sub - rule ( 1 ) , for the words " trader , processor " , the words "trader, processor , exporter " shall be substituted .
(2) in sub - rule ( 2 ) , for the existing proviso , the following proviso shall be substituted , namely: -
" Provided that in case of an exchange and exporter licensee the above mentioned provision shall not apply . " .
3 . For rule 5 , the following rule shall be substituted , namely : - " 5. License Fees . The fee for special license shall be Rupees 20,000/- (Twenty Thousands) . Provided in case ofExporter fee for special license shall be Rupees 1,000/ - (One Thousand) The license fee shall be payable throughaccountpayee demand draft drawn in favour of Managing Director at the time of application . " .
4. In rule 6 , in the proviso , for the full stop , the colon shall be substituted and thereafter the following provisos shall be inserted , namely : -
"Provided further that in case of exporter licensee , security shall not be required on obtaining license for commercial transaction only :
Provided also that on purchase of agricultural produce of the farmers through the notified market / sub - market yards and / or specified purchase centre by the exporter licensee , the security shall be 376 ( 5 )

furnished by the licensee as per rules . , The amount of security shall be in the form of Fixed Deposit Receipt or Bank Guarantee . Fixed Deposit Receipt shall be pledged in favour of Board . The Bank Guarantee must have to be issued by such Scheduled Bank whose branch should be located at Bhopal (Madhya Pradesh ) . The bank guarantee shall be for full five years . The Fixed Deposit Receipt or Bank Guarantee furnished by the applicant shall be kept at the Board headquarter . " .
5 . In rule 7 , -
(1) in sub - rule ( 1 ) , for the words " trader , processor " , the words " trader , processor , exporter " shall be substituted (2) in sub - rule (3 ) , in clause ( iii ) , for the words " trader , processor " , the words " trader , processor , exporter" shall be substituted .
( 3) after clause ( vii ) , the following clauses shall be inserted , namely: -
"( viii ) certificate for exporter in accordance with section 7 under the Foreign Trade (Development and Regulation ) Act , 1992 (22 of1992) ;
( ix) RCMC / Certificate issued by APEDA/ Competent Export Authority to the exporter . " .
6 . In rule 10 , in sub - rule (5) , for the full stop , the colon shall be substituted and thereafter the following proviso shall be inserted , namely: -
" Provided that in case of exporter licensee , only for commercial transaction or purchase of produce मध्यप्रदेश राजपत्र , दिनांक 29 अप्रैल 2022

from market / sub - market yards there shall be no compulsion to establish purchase centre . " .
7 . In rule 12 , -
(1) in sub - rule ( 1) , for the words " trader , processor " , the words "trader, substituted . processor, exporter" shall be
(2) for sub - rule (5) , the following sub - rule shall be substituted , namely : -
" ( 5) The license fee of Rs.20,000 / - ( Rupees Twenty Thousands) but for exporter Rs.1,000 / - ( Rupees One Thousand) shall be deposited by the applicant in the Board Headquarter immediately after receiving the information about the decision of renewal of the special licence . " .
8. In rule 13 , in clause (n) , for the colon , the semi- colon shall be substituted and thereafter the following clause shall be inserted , namely : -
" ( o) in case ofexporterlicensee , does not export minimum 100 MT quantity of notified agricultural produce ." .
9. In rule 17, in sub - rule (2) , for the words " trader / processor / exchange " , the words " trader/ processor / exchange / exporter " shall be substituted .
10. In rule 19 , for the words " purchaser trader , processor or an exchange " , the words " purchaser trader , processor , exporter or an exchange " shall be substituted .
11. In rule 20 , for the full stop , the colon shall be substituted and thereafter , the following proviso shall be inserted , namely: - 376 ( 7)

"Provided that in case of exporter , the market fee paid on the agricultural produce purchased from the State shall be reimbursable as per the prescribed procedure and provisions under the export promotion scheme declared by the State Government from time to time . " .
12. In Form- VII , after serial number (26 ) , the following serial number and heading shall be inserted , namely : -
"Quantity exported outof dispatch / sale quantity
(26 -A) . " .
