फा. क्र. 10- क- चार निरर्हित- 2022-104.- भारत निर्वाचन आयोग के आदेश क्र. 76- MP-LA- 2018- WS- I - 7895 , दिनांक 04-05-2022 जिसके द्वारा आयोग ने लोक प्रतिधिनियम , 1951 की धारा 10 क के तहत् विधान सभा निर्वाचन 2018 में 27- कोलारस विधान सभा निर्वाचन क्षेत्र जिला शिवपुरी से निर्वाचन लड़ने वाले अभ्यर्थी श्री महेन्द्र सिंह यादव- निर्दलीय को अपने निर्वाचन का कोई भी व्यय लेखा दाखिल न करने के कारण "संसद के किसी भी सदन या संघ राज्य क्षेत्र की विधान सभा अथवा विधान परिषद् के लिए सदस्य चुने जाने या होने के लिए" उक्त आदेश की तारीख से तीन वर्ष तक के लिए निरर्हित घोषित किया है, को सर्वसाधारण की जानकारी के लिए प्रकाशित किया जाना है.

आदेश
यतः , भारत निर्वाचन आयोग द्वारा मध्य प्रदेश राज्य की विधान सभा के साधारण निर्वाचन, 2018 की घोषणा प्रेस नोट संख्या ईसीआई/प्रे.नो./66/2018 दिनांक 06.10.2018 के जरिए की गई थी। कार्यक्रम के अनुसार , मतगणना की तारीख 11.12.2018 थी।
और यतः, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, निर्वाचन लड़ने वाले प्रत्येक अभ्यर्थी को, निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर निर्वाचन व्यय के अपने लेखे की सही प्रति जिला निर्वाचन अधिकारी को दाखिल करनी होती है;
और यतः, संबंधित रिटर्निंग अधिकारी 27 -कोलारस विधान सभा निर्वाचन क्षेत्र के परिणाम 11.12.2018 को घोषित किए गए थे । इस प्रकार, निर्वाचन व्यय के लेखा दाखिल करने की अन्तिम तारीख 10.01.2019 थी ।
और यतः, मुख्य निर्वाचन अधिकारी, मध्य प्रदेश के दिनांक 19.01.2019 के पत्र सं. 10- क/चार/निर्वा.व्यय लेखा/6- शिवपुरी/ 2019 / 856 द्वारा अग्रेषित जिला निर्वाचन अधिकारी, शिवपुरी जिला, मध्य प्रदेश द्वारा दिनांक 15.01.2019 को प्रस्तुत रिपोर्ट के अनुसार श्री महेन्द्र सिंह यादव, मध्य प्रदेश के 27-कोलारस विधान सभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले निर्दलीय अभ्यर्थी, अपने निर्वाचन व्यय का विधि द्वारा अपेक्षित रीति से लेखा दाखिल करने में असफल रहे ।
और यतः , जिला निर्वाचन अधिकारी , शिवपुरी जिला, मध्य प्रदेश की रिपोर्ट के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप नियम (5 ) के अंतर्गत निर्वाचन व्यय प्रस्तुत नहीं करने के लिए श्री महेन्द्र सिंह यादव को कारण बताओ नोटिस दिनांक 21.01.2021 को जारी किया गया था;
और यतः , निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप- नियम ( 6 ) के अनुसार, दिनांक 21.01.2021 के उपर्युक्त कारण बताओ नोटिस के जरिए श्री महेन्द्र सिंह यादव को निदेश दिया गया था किवे इस नोटिस के प्राप्त होने के 20 दिनों के अंदर आयोग में लेखे न प्रस्तुत कर पाने के कारणों को स्पष्ट करते हुए लिखित रूप में अपना अभ्यावेदन प्रस्तुत करें और साथ ही, पूर्ण निर्वाचन व्यय का लेखा संबंधित जिला निर्वाचन अधिकारी को प्रस्तुत करें;

और यतः , उक्त नोटिस उनकी पुत्री द्वारा 17.02.2021 को प्राप्त किया गया था । अभ्यर्थी से प्राप्त पावती रसीद जिला निर्वाचन अधिकारी, शिवपुरी द्वारा दिनांक 09.03.2021 के पत्र सं. क्र ./सा.निर्वा. /वि.स. 2018/निर्वा . व्यय नोटिस 2021/120 द्वारा आयोग को प्रस्तुत कर दी गई थी;
और यतः , जिला निर्वाचन अधिकारी , शिवपुरी द्वारा अपने दिनांक 09.03.2021 के पत्र सं. क्र. /सा.निर्वा . /वि.स . 2018 / निर्वा. व्यय नोटिस 2021/120 के तहत प्रस्तुत की गई अनुपूरक रिपोर्ट में यह बताया गया है कि श्री महेन्द्र सिंह यादव ने आज की तारीख तक न तो कोई भी अभ्यावेदन और न ही मूल वाउचरों आदि के साथ विधिवत रूप से हस्ताक्षरित अपने निर्वाचन व्यय के सही लेखे का विवरण प्रस्तुत किया है । इसके अतिरिक्त, उन्होने भारत निर्वाचन आयोग का सम्यक् नोटिस मिलने के उपरांत भी उक्त असफलता के लिए न तो कोईकारण बताया है और न ही कोई स्पष्टीकरण दिया है;
और यतः , आयोग का यह समाधान हो गया है कि श्री महेन्द्र सिंह यादव, निर्वाचन व्यय का लेखा दाखिल करने में असफल रहे हैं और उनके पास इस असफलता के लिए कोई भी उचित कारण अथवा न्यायोचित्य नहीं है;
और यतः , लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में अनुबंधित किया गया है कि: -
"यदि निर्वाचन आयोग का समाधान हो जाता है किकोई व्यक्ति-
(क) निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है, दाखिल करने में असफल रहा है; तथा
(ख ) उस असफलता के लिए कोई अच्छा कारण या न्यायोचित्य नहीं रखता है, तो निर्वाचन आयोग शासकीय राजपत्र में प्रकाशित आदेश द्वारा उसको निरर्हित घोषित करेगा और ऐसा व्यक्ति उस आदेश कीतारीख से तीन वर्ष की कालावधि के लिए निरर्हित होगा;
अतः , अब लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग एतद्द्वारा , मध्य प्रदेश राज्य की विधान सभा के साधारण निर्वाचन , 2018 के 27- कोलारस विधान सभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले निर्दलीय अभ्यर्थी, श्री महेन्द्र सिंह यादव, निवासी म.क्र. 25 मांगरोल बरखेड़ाखुर्द, तहसील बदरवास , जिला शिवपुरी (म. प्र. ) को संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य क्षेत्र की विधानसभा अथवा विधान परिषद् के लिए सदस्य चुने जाने अथवा होने के लिए इस आदेश की तारीख से तीन वर्ष की अवधिके लिए निरर्हित घोषित करता है ।

ELECTION COMMISSION OF INDIA

ORDER
WHEREAS , the General Election to the Legislative Assembly of Madhya Pradesh , 2018 was announced by Election Commission of India vide Press Note No ECI / PN / 66 /2018 dated 06.10.2018. As per the schedule , the Date of Counting of votes was 11.12.2018 .
AND WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate has to lodge a true copy of his account of election expenses within 30 days with the District Election Officer , from the date of election of returned candidate;
AND WHEREAS, the result of 27- Kolaras Assembly Constituency was declared by the Returning Officer concerned on 11.12.2018 . As such the last date for lodging of account ofelection expenses was 10.01.2019.
AND WHEREAS, as per the report dated 15.01.2019 submitted by the District Election Officer, Shivpuri District , Madhya Pradesh and forwarded by Chief Electoral Officer , Madhya Pradesh vide letter File No. 10 - A/Four/Elec . Expenditure Account/6- Shivpuri / 2019 /856 dated 19.01.2019 , Shri Mahendra Singh Yadav, the contesting Independent candidate from 27- Kolaras Assembly Constituency of Madhya Pradesh , failed to lodge any account of his election expenses as manner required by law.
AND WHEREAS , on the basis of the report of the District Election Officer, Shivpuri District , Madhya Pradesh, a Show Cause notice dated 21.01.2021 was issued by the Election Commission of India under Sub Rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 to Shri Mahendra Singh Yadav for non submission of accounts of Election expenses ;
AND WHEREAS , as per Sub Rule ( 6) of Rule 89 of the Conduct of Elections Rules , 1961, through the above said Show Cause Notice dated 21.01.2021 to Mahendra Singh Yadav was directed to submit his representation in writing to the Commission explaining the reason for non submission of accounts and also to lodge his complete accounts of election expenses to the District Election Officer concerned within 20 days from the date of receipt of the notice;
And WHEREAS , the said notice was received by his daughter on 17.02.2021 . Acknowledgment receipt obtained from the candidate has been submitted to the 522(3)

Commission by District Election Officer, Shivpuri vide his letter No./Gen.Elec./L.A. 2018/ Elec . Expenditure Notice /2021 / 120 dated 09.03.2021 .
AND WHEREAS, in the supplementary report submitted by District Election Officer , Shivpuri vide his letter No./Gen.Elec./L.A. 2018 / Elec. Expenditure Notice / 2021 / 120 dated 09.03.2021 , it has been stated that Shri Mahendra Singh Yadav has not submitted any representation or a statement of correct account of his election expenses, duly signed along with original vouchers etc. till date . Further, he has neither furnished any reason nor explanation for the said failure even after receipt of the due notice to the Election Commission of India as well ;
AND WHEREAS , Commission is satisfied that Shri Mahendra Singh Yadav has failed to lodge an account of election expenses and has no good reason or justification for the failure;
AND WHEREAS, Section 10A of the Representation of the People Act , 1951 stipulates that: -
"Ifthe Election Commission is satisfied that a person-
(a) has failed to lodge an account of election expenses within the time and in the manner required by law or under this Act; and
(b) has no good reason or justification for the failure, the Election Commission shall by order published in the Official Gazette , declare him to be disqualified and any such person shall be disqualified for a period of three years from the date of the order;
NOW THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Shri Mahendra Singh Yadav, resident of House No. 25 Mangrol Barkheda Khurd , Tehsil Badarwas , Distt Shivpuri (M.P. ) , the contesting Independent candidate for the General Election to the Legislative Assembly of Madhya Pradesh, 2018 from 27- Kolaras Assembly Constituency, to be disqualified for being chosen as and for being a member of either House of Parliament or the Legislative Assembly or Legislative Council of a State or Union Territory for a period of three years from the date of this order .
