फा. क्र . 10- क- चार- निरर्हित- 2022-110.- भारत निर्वाचन आयोग के आदेश क्र. 76- MP- LA- 2018- WS- I- 8541 , दिनांक 06-05-2022 जिसके द्वारा आयोग ने लोक प्रतिधिनियम , 1951 की धारा 10 क के तहत् विधान सभा सामान्य निर्वाचन 2018 में रायसेन जिले की 143- सिलवानी विधान सभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले 03 अभ्यर्थियों 1. श्री अ. वहीद खा- सपाक्स पार्टी, 2. श्री दिनेश- निर्दलीय , 3. श्री मुन्ना- निर्दलीय , जो कि अपने निर्वाचन का कोई भी व्यय लेखा समय से दाखिल न करने के कारण "संसद के किसी भी सदन या संघ राज्य क्षेत्र की विधान सभा अथवा विधान परिषद् के लिए सदस्य चुने जाने या होने के लिए " उक्त आदेश की तारीख से तीन वर्ष तक के लिए निरर्हित घोषित किया है, को सर्व साधारण की जानकारी के लिए प्रकाशित किया जाना है.

आदेश

यतः , भारत निर्वाचन आयोग द्वारा मध्य प्रदेश राज्य की विधान सभा के साधारण निर्वाचन, 2018 की घोषणा प्रेस नोट संख्या ईसीआई/प्रे.नो./66/2018 दिनांक 06.10.2018 के जरिए की गई थी । कार्यक्रम के अनुसार, मतगणना की तारीख 11.12.2018 थी।

और यतः, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, निर्वाचन लड़ने वाले प्रत्येक अभ्यर्थी को, निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर निर्वाचन व्यय के अपने लेखे की सही प्रति जिला निर्वाचन अधिकारी को दाखिल करनी होती है;

और यतः, संबंधित रिटर्निंग अधिकारी 143 - सिलवानी विधान सभा निर्वाचन क्षेत्र के परिणाम 11.12.2018 को घोषित किए गए थे। इस प्रकार, निर्वाचन व्यय के लेखा दाखिल करने की अन्तिम तारीख 10.01.2019 थी।

और यतः, मुख्य निर्वाचन अधिकारी , मध्य प्रदेश के दिनांक 18.01.2019 के पत्र सं. 10- क/चार/निर्वा.व्यय लेखा/32 - रायसेन / 2019/842 द्वारा अग्रेषित जिला निर्वाचन अधिकारी, रायसेन जिला, मध्य प्रदेश द्वारा दिनांक 17.01.2019 को प्रस्तुत रिपोर्ट के अनुसार श्री अ. वहीद खा , मध्य प्रदेश के 143- सिलवानी विधान सभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले सपाक्स पार्टी के अभ्यर्थी, अपने निर्वाचन व्यय का कोई भी लेखा दाखिल करने में असफल रहे ।

और यतः, जिला निर्वाचन अधिकारी, रायसेन जिला, मध्य प्रदेश की रिपोर्ट के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप नियम (5 ) के अंतर्गत निर्वाचन व्यय प्रस्तुत नहीं करनेके लिए श्री अ. वहीद खा को कारण बताओ नोटिस दिनांक 13.08.2019 को जारी किया गया था;

और यतः , निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप- नियम (6) के अनुसार, दिनांक 13.08.2019 के उपर्युक्त कारण बताओ नोटिस के जरिए श्री अ. वहीद खा को निर्देश दिया गया था कि वे इस नोटिस के प्राप्त होने के 20 दिनों के अंदर आयोग में लेखे न प्रस्तुत कर पाने के कारणों को स्पष्ट करते हुए लिखित रूप में अपना अभ्यावेदन प्रस्तुत करें और साथ ही, पूर्ण निर्वाचन व्यय का लेखा संबंधित जिला निर्वाचन अधिकारी कोप्रस्तुतकरें;

और यतः , उक्त नोटिस उनके द्वारा 29.08.2019 को प्राप्त किया गया था । अभ्यर्थी से प्राप्त पावती रसीद जिला निर्वाचन अधिकारी , रायसेन द्वारा दिनांक 09.09.2019 के पत्र संख्या 2052/ 23 - भा. निर्वा./लेखा/2019 द्वारा आयोग को प्रस्तुत कर दी गई थी;

और यतः , जिला निर्वाचन अधिकारी , रायसेन द्वारा अपने दिनांक 29.12.2020 के पत्र संख्या 1870/ 23 - भा.निर्वा . /2020 के तहत प्रस्तुत की गई अनुपूरक रिपोर्ट में यह बताया गया है कि श्री अ. वहीद खा ने आज की तारीख तक न तो कोई भी अभ्यावेदन और न ही मूल वाउचरों आदि के साथ विधिवत रूप से हस्ताक्षरित अपने निर्वाचन व्यय के सही लेखे का विवरण प्रस्तुत किया है। इसके अतिरिक्त , उन्होने भारत निर्वाचन आयोग का सम्यक् नोटिस मिलने के उपरांत भी उक्त असफलता के लिए न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है;

और यतः, आयोग का यह समाधान हो गया है कि श्री अ. वहीद खा , निर्वाचन व्यय का लेखा दाखिल करने में असफल रहे हैं और उनके पास इस असफलता के लिए कोई भी उचित कारण अथवा न्यायोचित्य नहीं है;

और यतः , लोक प्रतिनिधित्व अधिनियम , 1951 की धारा 10क में अनुबंधित किया गया है कि: -

"यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति-

(क) निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है, दाखिल करने में असफल रहा है; तथा

(ख) उस असफलता के लिए कोई अच्छा कारण या न्यायोचित्य नहीं रखता है, तो निर्वाचन आयोग शासकीय राजपत्र में प्रकाशित आदेश द्वारा उसको निरर्हित घोषित करेगा और ऐसा व्यक्ति उस आदेश कीतारीख से तीन वर्ष की कालावधिके लिए निरर्हित होगा;

अतः , अब लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10 क के अनुसरण में भारत निर्वाचन आयोग एतद्द्वारा, मध्य प्रदेश राज्य की विधान सभा के साधारण निर्वाचन, 2018 के 143 -सिलवानी विधान सभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले सपाक्स पार्टी के अभ्यर्थी, श्री अ. वहीद खा , निवासी वार्ड क्र -04 मकान न. 352 कस्बा सिलवानी जिला रायसेन (म. प्र. ) को संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य क्षेत्र की विधानसभा अथवा विधान परिषद् के लिए सदस्य चुने जाने अथवा होने के लिए इस आदेश की तारीख से तीन वर्ष की अवधिके लिए निरर्हित घोषित करता है ।

ORDER

WHEREAS, the General Election to the Legislative Assembly of Madhya Pradesh, 2018 was announced by Election Commission of India vide Press Note No ECI/ PN /66/2018 dated 06.10.2018. As per the schedule , the Date of Counting of votes was 11.12.2018 .

AND WHEREAS , as per Section 78 of the Representation of the People Act, 1951 , every contesting candidate has to lodge a true copy of his account of election expenses within 30 days with the District Election Officer , from the date of election of returned candidate;

AND WHEREAS, the result of 143- Silwani Assembly Constituency was declared by the Returning Officer concerned on 11.12.2018. As such the last date for lodging of account ofelection expenses was 10.01.2019.

AND WHEREAS, as per the report dated 17.01.2019 submitted by the District Election Officer , Raisen District , Madhya Pradesh and forwarded by Chief Electoral Officer , Madhya Pradesh vide letter File No 10- क/चार/ निर्वा. व्यय लेखा/ 32 -रायसेन /2019/842 dated 18.01.2019 , Shri Abdul Baheed Khan , contesting candidate of Sapaks Party from 143- Silwani Assembly Constituency of Madhya Pradesh , failed to lodge any account of his election expenses .

AND WHEREAS, on the basis of the report of the District Election Officer, Raisen District, Madhya Pradesh , a Show Cause notice dated 13.08.2019 was issued by the Election Commission of India under Sub Rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 to Shri Abdul Baheed Khan for non submission of accounts of Election expenses ;

AND WHEREAS, as per Sub Rule (6) of Rule 89 of the Conduct of Elections Rules , 1961, through the above said Show Cause Notice dated 13.08.2019 to Shri Abdul Baheed Khan was directed to submit his representation in writing to the Commission explaining the reason for non submission of accounts and also to lodge his complete accounts of election expenses to the District Election Officer concerned within 20 days from the date of receipt ofthe notice;

AND WHEREAS, said notice was received by him on 29.08.2019 . Acknowledgment receipt obtained from the candidate has been submitted to the Commission by District 528(3)

Election Officer , Raisen vide his letter No. 2052 /23- मा. निर्वा / लेखा/2019 dated 09.09.2019 .

AND WHEREAS, in the supplementary report submitted by District Election Officer, Raisen vide his letter No. 1870/ 23- भा. निर्वा./2020 dated 29.12.2020 it has been stated that Shri Abdul Baheed Khan has not submitted any representation or a statement of correct account of his election expenses, duly signed along with original vouchers etc. till date. Further, he has neither furnished any reason nor explanation for the said failure even after receipt of the due notice to the Election Commission of India as well ;

AND WHEREAS, Commission is satisfied that Shri Abdul Baheed Khan has failed to lodge an account of election expenses and has no good reason or justification for the failure;

AND WHEREAS, Section 10A of the Representation of the People Act, 1951 stipulates that:-

" If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses within the time and in the manner required by law or under this Act; and

(b) has no good reason or justification for the failure , the Election Commission shall by order published in the Official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of three years from the date of the order;

NOW THEREFORE , in pursuance of Section 10A of the Representation of the People Act, 1951 , the Election Commission of India hereby declares Shri Abdul Baheed Khan, resident of Ward no 4, Makan no 352 , Kasba Silwani , Jila Raisen (M.P. ) the contesting Candidate of Sapaks Party for the General Election to the Legislative Assembly ofMadhya Pradesh, 2018 from 143- Silwani Assembly Constituency, to be disqualified for being chosen as and for being a member of either House of Parliament or the Legislative Assembly or Legislative Council of a State or Union Territory for a period of three years from the date of this order .

और यतः , उक्त नोटिस उनके पिता द्वारा 04.03.2020 को प्राप्त किया गया था । अभ्यर्थी से प्राप्त पावती रसीद जिला निर्वाचन अधिकारी, रायसेन द्वारा दिनांक 06.03.2020 के पत्र संख्या क्यू/ 25 /निर्वा/ 2020 / 297 द्वारा आयोग को प्रस्तुत कर दी गई थी;

और यतः, मुख्य निर्वाचन अधिकारी , मध्य प्रदेश के दिनांक 18.01.2019 के पत्र सं. 10- क/चार/निर्वा.व्यय लेखा/ 32 - रायसेन / 2019 / 842 द्वारा अग्रेषित जिला निर्वाचन अधिकारी , रायसेन जिला , मध्य प्रदेश द्वारा दिनांक 17.01.2019 को प्रस्तुत रिपोर्ट के अनुसार श्री मुन्ना, मध्य प्रदेश के 143-सिलवानी विधान सभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले निर्दलयी अभ्यर्थी, अपने निर्वाचन व्यय का कोई भी लेखा दाखिल करने में असफल रहे ।

और यतः, जिला निर्वाचन अधिकारी , रायसेन जिला, मध्य प्रदेश की रिपोर्ट के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप नियम (5 ) के अंतर्गत निर्वाचन व्यय प्रस्तुत नहीं करने के लिए श्री मुन्ना को कारण बताओ नोटिस दिनांक 13.08.2019 को जारी किया गया था;

और यतः , निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप- नियम (6) के अनुसार, दिनांक 13.08.2019 के उपर्युक्त कारण बताओ नोटिस के जरिए श्री मुन्ना को निर्देश दिया गया था कि वे इस नोटिस के प्राप्त होने के 20 दिनों के अंदर आयोग में लेखे न प्रस्तुत कर पाने के कारणों को स्पष्ट करते हुए लिखित रूप में अपना अभ्यावेदन प्रस्तुत करें और साथ ही, पूर्ण निर्वाचन व्यय का लेखा संबंधित जिला निर्वाचन अधिकारी को प्रस्तुत करें;

और यतः , उक्त नोटिस उनके द्वारा 20.03.2020 को प्राप्त किया गया था । अभ्यर्थी से प्राप्त पावती रसीद जिला निर्वाचन अधिकारी, रायसेन द्वारा दिनांक 15.05.2020 के पत्र संख्या क्रमांक 218 / 23- भा. निर्वा . / 2020 द्वारा आयोग को प्रस्तुत कर दी गई थी;

और यतः , जिला निर्वाचन अधिकारी , रायसेन द्वारा अपने दिनांक 29.12.2020 के पत्र संख्या 1870 / 23 - भा.निर्वा . / 2020 के तहत प्रस्तुत की गई अनुपूरक रिपोर्ट में यह बताया गया है कि श्री मुन्ना ने आज की तारीख तक न तो कोई भी अभ्यावेदन और न ही मूल वाउचरों आदि के साथ विधिवत रूप से हस्ताक्षरित अपने निर्वाचन व्यय के सही लेखे का विवरण प्रस्तुत किया है। इसके अतिरिक्त, उन्होने भारत निर्वाचन आयोग का सम्यक् नोटिस मिलने के उपरांत भी उक्त असफलता के लिए न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है;

और यतः, आयोग का यह समाधान हो गया है कि श्री मुन्ना , निर्वाचन व्यय का लेखा दाखिल करने में असफल रहे हैं और उनके पास इस असफलता के लिए कोई भी उचित कारण अथवा न्यायोचित्य नहीं है;

और यतः , लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में अनुबंधित किया गया है कि: -

"यदिनिर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति-

(ख) उस असफलता के लिए कोई अच्छा कारण या न्यायोचित्य नहीं रखता है, तो निर्वाचन आयोग शासकीय राजपत्र में प्रकाशित आदेश द्वारा उसको निरर्हित घोषित करेगा और ऐसा व्यक्ति उस आदेश कीतारीख से तीन वर्ष की कालावधि के लिए निरर्हित होगा;

अतः , अब लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10 क के अनुसरण में भारत निर्वाचन आयोग एतद्द्वारा , मध्य प्रदेश राज्य की विधान सभा के साधारण निर्वाचन, 2018 के 143 -सिलवानी विधान सभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले निर्दलयी अभ्यर्थी, श्री मुन्ना, निवासी ग्राम सेवड़ा, चुग्गी टेक के ऊपर, दतिया तहसील व जिला दतिया (म. प्र . ) , को संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य क्षेत्र की विधानसभा अथवा विधान परिषद् के लिए सदस्य चुने जाने अथवा होने के लिए इस आदेश की तारीख से तीन वर्ष की अवधि के लिए निरर्हित घोषित करता है ।

ORDER

WHEREAS , the General Election to the Legislative Assembly of Madhya Pradesh , 2018 was announced by Election Commission of India vide Press Note No ECI/PN/66/2018 dated 06.10.2018. As per the schedule, the Date of Counting of votes was 11.12.2018 .

AND WHEREAS , the result of 143- Silwani Assembly Constituency was declared by the Returning Officer concerned on 11.12.2018 . As such the last date for lodging of account of election expenses was 10.01.2019.

AND WHEREAS, as per the report dated 17.01.2019 submitted by the District Election Officer, Raisen District, Madhya Pradesh and forwarded by Chief Electoral Officer , Madhya Pradesh vide letter File No 10 -क/चार/निर्वा. व्यय लेखा/32-रायसेन/ 2019/ 842 dated 18.01.2019 , Shri Munna, contesting independent candidate from 143- Silwani Assembly Constituency of Madhya Pradesh, failed to lodge any account of his election expenses .

AND WHEREAS, on the basis of the report of the District Election Officer , Raisen District , Madhya Pradesh, a Show Cause notice dated 13.08.2019 was issued by the Election Commission of India under Sub Rule (5) of Rule 89 of the Conduct of Elections Rules , 1961 to Shri Munna for non submission of accounts of Election expenses ;

AND WHEREAS , as per Sub Rule (6) of Rule 89 of the Conduct of Elections Rules , 1961 , through the above said Show Cause Notice dated 13.08.2019 to Shri Munna was directed to submit his representation in writing to the Commission explaining the reason for non submission of accounts and also to lodge his complete accounts of election expenses to the District Election Officer concerned within 20 days from the date of receipt of the notice;

AND WHEREAS , said notice was received by him on 20.03.2020 . Acknowledgment receipt obtained from the candidate has been submitted to the Commission by District Election Officer , Raisen vide his letter क्रमांक 218 / 23 - भा. निर्वा ./2020 dated 15.05.2020.

Munna has not submitted any representation or a statement of correct account of his election expenses , duly signed along with original vouchers etc. till date . Further , he has neither furnished any reason nor explanation for the said failure even after receipt of the due notice to the Election Commission of India as well ;

AND WHEREAS , Commission is satisfied that Shri Munna has failed to lodge an account of election expenses and has no good reason or justification for the failure;

that:- AND WHEREAS , Section 10A of the Representation of the People Act , 1951 stipulates " If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses within the time and in the manner required by law or under this Act ; and

(b) has no good reason or justification for the failure, the Election Commission shall by order published in the Official Gazette , declare him to be disqualified and any such person shall be disqualified for a period of three years from the date of the order;

NOW THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951 , the Election Commission of India hereby declares Shri Munna, resident of Gram Sewda, Chuggi Tek Ke Upar , Teh Datiya , Jila Datiya ( M.P. ) the contesting Independent Candidate for the General Election to the Legislative Assembly of Madhya Pradesh, 2018 from 143- Silwani Assembly Constituency, to be disqualified for being chosen as and for being a member of either House of Parliament or the Legislative Assembly or Legislative Council of a State or Union Territory for a period of three years from the date of this order .
