मध्यप्रदेश नगरपालिक विधि (संशोधन ) अध्यादेश , 2022
"मध्य प्रदेश राजपत्र (असाधारण)" में दिनांक 26 मई, 2022 को प्रथम बार प्रकाशित किया गया । भारत गणराज्य के तिहत्तरवें वर्ष में राज्यपाल द्वारा प्रख्यापित किया गया ।
मध्यप्रदेश नगरपालिक निगम अधिनियम , 1956 तथा मध्यप्रदेश नगरपालिका अधिनियम , 1961 को और संशोधित करने हेतु अध्यादेश ।
यतः , राज्य के विधान - मंडल का सत्र चालू नहीं है और मध्यप्रदेश के राज्यपाल का यह समाधान हो गया है कि ऐसी परिस्थितियां विद्यमान हैं , जिनके कारण यह आवश्यक हो गया है कि वे तुरंत कार्रवाई करें ;
अतएव, भारत के संविधान के अनुच्छेद 213 के खण्ड (1 ) द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए , मध्यप्रदेश के राज्यपाल निम्नलिखित अध्यादेश प्रख्यापित करते हैं: -
1. इस अध्यादेश का संक्षिप्त नाम मध्यप्रदेश नगरपालिक विधि (संशोधन ) अध्यादेश ,
संक्षिप्त नाम .
2022 है ।
2. इस अध्यादेश के प्रवर्तित रहने की कालावधि के दौरान , मध्यप्रदेश नगरपालिक निगम
मध्यप्रदेश अधिनियम क्रमांक 23 सन् 1956 और अधिनियम क्रमांक 37 सन् 1961 का अस्थाई रूप से संशोधित किया जाना.
अधिनियम, 1956 (क्रमांक 23 सन् 1956) तथा मध्यप्रदेश नगरपालिका अधिनियम, 1961 (क्रमांक 37 सन् 1961 ) धारा 3 और 4 में विनिर्दिष्ट संशोधनों के अध्यधीन रहते हुए प्रभावी होंगे ।

मध्यप्रदेश नगरपालिक निगम अधिनियम, 1956 (क्रमांक 23 सन् 1956) का संशोधन
3. मध्यप्रदेश नगरपालिक निगम अधिनियम, 1956 (क्रमांक 23 सन् 1956) में,-
मध्यप्रदेश अधिनियम क्रमांक 23 सन् 1956 का संशोधन.
(1 ) धारा 9 में, -
(क) उप -धारा ( 1 ) में, खण्ड (क) के स्थानं पर, निम्नलिखित खण्ड स्थापित किया जाए , अर्थात्ः-
"(क) नगरपालिक क्षेत्र से प्रत्यक्ष निर्वाचन द्वारा निर्वाचित महापौर अर्थात् सभापति; ";
(ख) उप-धारा (4 ) के स्थान पर , निम्नलिखित उप - धारा स्थापित की जाए, अर्थात्ः-
"(4) यदि कोई नगरपालिक क्षेत्र महापौर का निर्वाचन करने में असफल रहे या कोई वार्ड पार्षद का निर्वाचन करने में असफल रहे, तो यथास्थिति, ऐसे नगरपालिक क्षेत्र या वार्ड के स्थान को भरने के लिए छह माह के भीतर नई निर्वाचन कार्यवाही प्रारंभ की जाएगी और जब तक उस स्थान को भरा नहीं जाता उसे आकस्मिक रिक्ति समझा जाएगाः
परंतु अधिनियम के अधीन अध्यक्ष या समितियों में से किसी के निर्वाचन की कार्यवाहियां, ऐसे स्थान का निर्वाचन लंबित रहते स्थगित नहीं की जाएंगी । " ।
(2) धारा 10 में, उप- धारा (4) में, प्रथम परन्तुक में, शब्द "दो माह" के स्थान पर, शब्द "छह माह " स्थापित किए जाएं ।

(3) धारा 14 में,-
(क) उप - धारा (1 ) में, शब्द "पार्षदों " के पश्चात्, शब्द " तथा महापौर " अन्तःस्थापित किए जाएं ;
(ख ) उप-धारा (2 ) में, शब्द " पार्षदों" के पश्चात्, शब्द " तथा महापौर " अन्तःस्थापित किए जाएं ।
(4) धारा 14- क में, उप- धारा (1 ) में, शब्द " पार्षद " के स्थान पर, शब्द " महापौर अथवा पार्षद" स्थापित किए जाएं ।
(5) धारा 14- ख में, शब्द " पार्षद" के स्थान पर, शब्द " महापौर अथवा पार्षद " स्थापित किए जाएं ।
(6) धारा 14 - ग में , शब्द " पार्षद " के पश्चात्, शब्द " या महापौर " अन्तःस्थापित किए जाएं ।
(7) धारा 15 में,-
(क) शब्द " पार्षदों" के पश्चात्, शब्द " या महापौर " अन्तःस्थापित किए जाएं ।
(ख) परंतुक के स्थान पर, निम्नलिखित परंतुक स्थापित किया जाए , अर्थात्ः- "परन्तु कोई भी व्यक्ति यथास्थिति, पार्षदों के किसी निर्वाचन में या महापौर के निर्वाचन में, एक से अधिक बार मतदान नहीं करेगा । " ।

8) धारा 16 में , उप - धारा (3) के पश्चात्, निम्नलिखित उप - धारा जोड़ी जाए , अर्थात् : - " (4) यदि कोई व्यक्ति महापौर और पार्षद् दोनों पदों के लिए निर्वाचित हो जाता है , तो उसे निर्वाचित घोषित किए जाने की तारीख से सात दिन के भीतर किसी एक पद से अपना त्यागपत्र देना होगा । " ।

(9) धारा 17 में, -
(क) पार्श्व शीर्ष में , शब्द " पार्षद " के पश्चात्, शब्द " या महापौर " जोड़े जाएं ;
(ख ) उप- धारा ( 1 ) में,-
(
एक) प्रारंभिक पैरा में, शब्द "पार्षद " के पश्चात्, शब्द "या महापौर " अन्तःस्थापित किए जाएं ;
(दो) खण्ड (ख ख) में , शब्द "पार्षद " के पश्चात्, शब्द " या महापौर " अन्तःस्थापित किए जाएं;
(ग) उप - धारा (2) में, -
(एक) शीर्ष में, शब्द " पार्षद " के पश्चात्, शब्द " या महापौर" जोड़े जाएं ;
(दो) प्रारंभिक पैरा में, शब्द " पार्षद् " के पश्चात्, शब्द " या महापौर " अन्तःस्थापित किए जाएं;

(घ) उप - धारा ( 3) में, शब्द " पार्षद" जहां कहीं भी वह आया हो , के स्थान पर, शब्द "पार्षद या महापौर " स्थापित किए जाएं ।
(10) धारा 17- ख में,-
(क ) पार्श्व शीर्ष में, शब्द " पार्षद" के स्थान पर, शब्द " महापौर तथा पार्षद " स्थापित किए जाएं;
(ख) उप-धारा (1 ) में, प्रारंभिक पैरा में, शब्द " प्रत्येक पार्षद " के स्थान पर, शब्द " महापौर तथा प्रत्येक पार्षद" स्थापित किए जाएं;
(ग) उप-धारा (2 ) में,-
(
एक) प्रारंभिक पैरा में , शब्द " पार्षद " जहां कहीं भी आया है के स्थान पर, शब्द " महापौर या पार्षद " स्थापित किए जाएं;

(दो) परन्तुक के स्थान पर, निम्नलिखित परन्तुक स्थापित किया जाए, अर्थात्ः-
"परन्तु संभागीय आयुक्त की अनुमति के सिवाय , यदि कोई महापौर या पार्षद्, यथास्थिति, अपने निर्वाचन या नामनिर्देशन के दिनांक से तीन मास के भीतर शपथ नहीं लेता है तो उसका स्थान स्वयंमेव ही रिक्त हुआ समझा जाएगा । " ।
(11 ) धारा 18 में,-
(क) पार्श्व शीर्ष के स्थान पर, निम्नलिखित पार्श्व शीर्ष स्थापित किया जाए , अर्थात्ः- "अध्यक्ष (स्पीकर) का निर्वाचन " ;
(ख) उप-धारा (1 ) के स्थान पर, निम्नलिखित उप- धारा स्थापित की जाए , अर्थात्ः -
"(1 ) निगम का महापौर तथा निर्वाचित पार्षद, धारा 22 के अधीन निर्वाचन की अधिसूचना की तारीख से पन्द्रह दिन के भीतर, विहित रीति में , निर्वाचित पार्षदों में से सम्मिलन में अध्यक्ष निर्वाचित करेंगे जिसे कलक्टर द्वारा बुलाया जाएगा तथा वह उसकी अध्यक्षता करेगा । " ।
(12 ) धारा 20 में , स्पष्टीकरण में, शब्द "तथा महापौर " का लोप किया जाए ।
(13) धारा 23 - क में, -
(
क) पार्श्व शीर्ष में तथा उप - धारा (1 ) में, शब्द " या महापौर " जहां कहीं भी वे आए हों, का लोप किया जाए;
(ख) उप - धारा (2 ) के खण्ड (दो) में, शब्द "अध्यक्ष , महापौर " के स्थान पर , शब्द " महापौर, " स्थापित किया जाए ।
(14) धारा 23 - क के पश्चात् निम्नलिखित धारा अंतःस्थापित की जाए , अर्थात् : - मध्यप्रदेश राजपत्र, दिनांक 26 मई 2022

"24. महापौर का वापस बुलाया जाना.- (1 ) किसी निगम के प्रत्येक महापौर द्वारा
अपना पद तत्काल रिक्त कर दिया गया समझा जाएगा यदि उसे ऐसी प्रक्रिया के अनुसार , जो कि विहित की जाए , निगम क्षेत्र के मतदान करने वाले मतदाताओं की कुल संख्या के आधे से अधिक मतदाताओं के बहुमत द्वारा गुप्त मतदान से वापस बुलाया जाएः
परन्तु वापस बुलाने की ऐसी कोई प्रक्रिया तब तक आरम्भ नहीं की जाएगी जब तक कि निर्वाचित पार्षदों की कुल संख्या के कम से कम तीन चौथाई पार्षदों द्वारा प्रस्ताव पर हस्ताक्षर न कर दिए जाएं और उसे संभागीय आयुक्त को प्रस्तुत न कर दिया जाएः
परन्तु यह और कि ऐसी कोई प्रक्रियाः-
(एक) उस तारीख से , जिसको कि ऐसा महापौर निर्वाचित होता है और अपना पद धारण करता है , दो वर्ष की कालावधि के भीतर; और
(दो) यदि महापौर उप चुनाव में निर्वाचित होता है तो उसकी पदावधि की आधी कालावधि का अवसान न हो गया हो,
आरम्भ नहीं की जाएगीः
परन्तु यह और भी कि महापौर को वापस बुलाए जाने की प्रक्रिया उसकी संपूर्ण पदावधि में एक बार ही आरम्भ की जाएगी ।
(2) संभागीय आयुक्त अपना समाधान कर लेने और यह सत्यापित कर लेने के पश्चात् कि उप - धारा (1 ) में विनिर्दिष्ट तीन चौथाई पार्षदों ने वापस बुलाए जाने के प्रस्ताव पर हस्ताक्षर कर दिए हैं, प्रस्ताव, राज्य सरकार को भेजेगा और राज्य सरकार उसे राज्य निर्वाचन आयोग को निर्देशित करेगी ।

(3) राज्य निर्वाचन आयोग निर्देश प्राप्त होने पर, वापस बुलाए जाने के प्रस्ताव पर, ऐसी रीति में, जैसी कि विहित की जाए , मतदान कराने की व्यवस्था करेगा । " ।
(15) धारा 441 में , उप - धारा (2) में, खण्ड (ख ) में, उप- खण्ड ( तीन) के स्थान पर , निम्नलिखित उप - खण्ड स्थापित किया जाए , अर्थात्ः-
" (तीन) महापौर के निर्वाचन की दशा में, नगरपालिक क्षेत्र के किसी मतदाता द्वारा । " ।

मध्यप्रदेश नगरपालिका अधिनियम, 1961 (क्रमांक 37 सन् 1961 )का संशोधन
4. मध्यप्रदेश नगरपालिका अधिनियम , 1961 (क्रमांक 37 सन् 1961 ) में,-

37 सन् 1961 का संशोधन.
(1 ) धारा 29 में, उप- धारा (4 ) में , प्रथम परन्तुक में, शब्द " दो माह " के स्थान पर, शब्द "छह माह " स्थापित किए जाएं ।
(2) धारा 55 के स्थान पर, निम्नलिखित धारा स्थापित की जाए , अर्थात्ः-
"55. (1 ) मुख्य नगरपालिका अधिकारी , विहित प्राधिकारी के अनुमोदन से, प्रत्येक आम
निर्वाचन के पन्द्रह दिन के भीतर, एक उपाध्यक्ष आम निर्वाचन के पश्चात् प्रथम
सम्मिलन.
का निर्वाचन करने के प्रयोजन
के लिए निर्वाचित पार्षदों का सम्मिलन बुलाएगा ।
(2) उप -धारा (1 ) के अधीन बुलाए गए परिषद् के प्रथम सम्मिलन की अध्यक्षता कलक्टर द्वारा नियुक्त किए गए ऐसे अधिकारी द्वारा , जो नगरपालिका परिषद् के मामले में डिप्टी कलक्टर की पद श्रेणी से निम्न पद श्रेणी का न हो तथा नगर परिषद् के मामले में तहसीलदार की पद श्रेणी से निम्न पद श्रेणी का न मध्यप्रदेश राजपत्र, दिनांक 26 मई 2022

हो, की जाएगी और इस अध्याय में अंतर्विष्ट वे समस्त उपबंध जो परिषद् के सम्मिलनों के बारे में है , यथाशक्य ऐसे सम्मिलन के संबंध में लागू होंगेः
परन्तु अध्यक्षता करने वाले अधिकारी को ऐसे सम्मिलन में मत देने का अधिकार नहीं होगा और मतों के बराबर होने की दशा में परिणाम का विनिश्चय लॉट द्वारा किया जाएगा । " ।

ADHYADESH , 2022
First published in the " Madhya Pradesh Gazette ( Extra - ordinary ) " , dated the 26th May , 2022.
Promulgated by the Governor in the seventy - third year of the Republic of India.
An Ordinance further to amend the Madhya Pradesh Municipal Corporation Act , 1956 and the Madhya Pradesh Municipalities Act , 1961 .
Whereas , the State Legislature is not in session and the Governor of Madhya Pradesh is satisfied that circumstances exist which render it necessary for him to take immediate action ;
Now, therefore , in exercise of the powers conferred by clause ( 1 ) of article 213 of the Constitution of India , the Governor of Madhya Pradesh is pleased to promulgate the following Ordinance : -
1. This Ordinance may be called the Madhya Pradesh Nagarpalik Vidhi Short title .
(Sanshodhan) Adhyadesh , 2022.
2. During the period of operation of this Ordinance , the Madhya Pradesh Municipal
Madhya Pradesh Act No. 23 of 1956 and Act No. 37 of 1961 to be temporarily amended .
Corporation Act , 1956 (No. 23 of 1956) and the Madhya Pradesh Municipalities Act, 1961 ( No. 37 of 1961 ) shall have effect subject to the amendments specified in section 3 and 4 .

AMENDMENT TO THE MADHYA PRADESH MUNICIPAL CORPORATION ACT , 1956 ( NO . 23 OF 1956 )
3. In the Madhya Pradesh Municipal Corporation Act , 1956 ( No. 23 of 1956 ) , -
( 1 ) In section 9 , -
Amendment to the Madhya Pradesh
Act No. 23 of 1956 .
(a) in sub - section ( 1 ) , for clause (a) , the following clause shall be substituted , namely : -
" ( a) a Mayor that is chairperson elected by direct election from the municipal area ; " ;
(b) for sub - section (4 ) , the following sub - section shall be substituted , namely : -
" (4) If any municipal area fails to elect a Mayor or any ward fails to elect a Councillor , fresh election proceedings shall be commenced for such Muicipal area or ward , as the case may be , within six months to fill the seat , and until the seat is filled it shall be treated as casual vacancy:
Provided that proceedings of election of Speaker , or any of the Committee under the Act shall not be stayed , pending the election of such seat ." .
(2) In section 10, in sub - section (4 ) , in the first proviso , for the words " two months " , the words " six months " shall be substituted .

( a) in sub - section ( 1 ) , after the word " Councillors " , the words " and Mayors " shall be inserted ;

(4) In section 14 - A, in sub - section ( 1 ) , for the word " Councilor " , the words "Mayor or Councillor " shall be substituted .
(5) In section 14 - B , for the word " Councillor " , the words " Mayor or Councillor " shall be substituted .

" (4) If a person is elected for the Office of Mayor and Councillor both , he shall have to resign from one of the office within seven days from the date on which he is elected . " .

"Provided that except with the permission of the Divisional Commissioner, if any Mayor or Councillor , as the case may be , does not take an oath within three months from the date of his election or nomination , as the case may be , his seat shall be deemed to have been vacant ipso facto . " .
(11 ) In section 18, -
( a) for the marginal heading , the following marginal heading shall be substituted , namely: -
"Election of Speaker " ;
(b) for sub - section ( 1 ) , the following sub- section shall be substituted , namely: -
" ( 1 ) The Mayor and the elected Councillors of the Corporation shall , within fifteen days from the date of the notification of the election under section 22 , in the prescribed manner , elect Speaker from the elected Councillors in a meeting , which shall be called and presided over by the Collector . " .
( 12) In section 20 , in the Explanation , the words " and the Mayor " shall be omitted .
( 13) In section 23 - A, -
(a) in the marginal heading and in sub- section ( 1 ) , the words " or Mayor " wherever they occur shall be omitted;

(b) in clause ( ii ) of sub - section (2 ) , for the words " Speaker , Mayor " , the word "Mayor " shall be substituted .
( 14) After section 23 - A , the following section shall be inserted , namely-
"24. Recalling of Mayor.- ( 1 ) Every Mayor of Corporation shall forthwith be deemed to have vacated his office if he is recalled through a secret ballot by a majority of more than half of the total number of voters of the Corporation area casting the vote in accordance with the procedure as may be prescribed :
Provided that no such process of recall shall be initiated unless a proposal is signed by not less than three fourth of the total number of the elected Councillors and presented to the Divisional Commissioner :
Provided further that no such process shall be initiated: -
(i) within a period of two years from the date on which such Mayor is elected and enters his office;
(ii) if half of the period of tenure of the Mayor elected in a by - election has not expired :
Provided also that process for recall of the Mayor shall be initiated once in his whole term .
(2) The Divisional Commissioner , after satisfying himself and verifying that the three fourth of the Councillors specified in sub- section ( 1 ) have signed the proposal of recall , shall send the proposal to the State Government and the State Government shall make a reference to the State Election Commission .
(3) On receipt of the reference , the State Election Commission shall arrange for voting on the proposal of recall in such manner as may be prescribed . " .

( 1 ) In section 29 , in sub - section (4) , in the first proviso , for the words "two months " , the words " six months " shall be substituted .
( 2) For section 55 , the following section shall be substituted , namely: -
"55.First meeting after general election- ( 1 ) The Chief Municipal Officer shall , with the approval of the prescribed authority , within fifteen days of every gerneral election , call a meeting of the elected Councillors for the purpose of electing a Vice - President .
(2) The first meeting of the Council called under sub- section ( 1 ) shall be presided over by such officer not below the rank of Deputy Collector in the case of Municipal Council and not below the rank of Tehsildar in the case of Nagar Parishad , appointed by the Collector and all provisions contained in this Chapter regarding meetings of the Council , shall , as far as may be , apply in respect of such meeting :
Provided that the presiding officer shall not have right to vote at such meeting and in case of equality of votes , the result shall be decided by lot . " .
