आर-1609-2022- सत्रह मेडि - 1.- भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए , मध्यप्रदेश के राज्यपाल , एतद्वारा , मध्यप्रदेश खाद्य एवं औषधि प्रशासन (राजपत्रित) सेवा भर्ती नियम , 1989 क्रमांक 3270-3174-17- मेडि-2-89, दिनांक 27-10-1989 को अतिष्ठित करते हुए निम्नलिखित नियम बनाते हैं, अर्थात्:-
नियम
1. संक्षिप्त नाम और प्रारंभ.-
(1 ) इन नियमों का संक्षिप्त नाम " मध्यप्रदेश खाद्य एवं औषधि प्रशासन (राजपत्रित) सेवा भर्ती नियम, 2021 " है.
(2) ये नियम " मध्यप्रदेश राजपत्र " में इनके प्रकाशन की तारीख से प्रवृत्त होंगे.
2. परिभाषाएं. - इन नियमों में जब तक कि संदर्भ से अन्यथा अपेक्षित न हो ;
"नियुक्तिप्राधिकारी " से अभिप्रेत है, सेवा के संबंध में सरकार; (क)
(ख) " आयोग " से अभिप्रेत है, मध्यप्रदेश लोक सेवा आयोग ;
"आर्थिक रूप से कमजोर वर्ग (ई.डब्ल्यू.एस .) " से अभिप्रेत है, जो संविधान के अनुच्छेद -341 एवं 342 के अन्तर्गत मध्यप्रदेश राज्य के लिए अधिसूचित अनुसूचित जाति एवं अनुसूचित जनजाति को प्रदत्त आरक्षण की परिधि में नहीं आते हैं; (ग)
(घ) "परीक्षा" से अभिप्रेत है , नियम-11 के अधीन भर्ती के लिए आयोजित की गयी प्रतियोगिता परीक्षा;
(2) " भूतपूर्व सैनिक " से अभिप्रेत है , ऐसा व्यक्ति , जो निम्नलिखित प्रवर्गों में से किसी एक प्रवर्ग में रहा हो तथा जो भारत सरकार के अधीन कम से कम छह माह की निरन्तर कालावधि तक सेवा में नियोजित रहा हो तथा जिसकी किसी भी रोजगार कार्यालय में अपना पंजीयन कराने अथवा शासकीय सेवा में नियुक्ति

हेतु अन्यथा आवेदन देने की तारीख से अधिक से अधिक 3 वर्ष पूर्व मितव्ययिता इकाई की सिफारिशों के फलस्वरूप या अथवा स्थापना में सामान्य रूप से कमी किए जाने के कारण छंटनी की गयी हो अथवा जो अतिशेष (सरप्लस) घोषित किया गया हो;
(1 ) ऐसे भूतपूर्व सैनिक जिन्हें सेवा निवृत्ति रियायतों (मस्टरिंग आउट कन्सेशन) के अधीन निर्मुक्त कर दिया गया हो,
(2) ऐसे भूतपूर्व सैनिक, जो देश की सेना में लगातार छह माह से अधिक नियोजित रहे हो और जिन्हें कदाचरण के आधार पर सेवोन्मुक्त न किया गया हो,
(3) ऐसे भूतपूर्व सैनिक , जिन्हें दूसरी बार नामांकित किया गया हो , और
(क) अल्पकालीन वचनबंध अवधि पूर्ण होने पर;
(ख) नामांकन सम्बन्धी शर्तें पूर्ण होने पर
सेवोन्मुक्त किया गया हो,
(4) मद्रास सिविल ईकाई (यूनिट) के भूतपूर्व कार्मिक,
(5) ऐसे अधिकारी , जिन्हें अवकाश रिक्तियों पर छह मास से अधिक समय तक निरन्तर कार्य करने के पश्चात् सेवोन्मुक्त किया गया हो,.
(6) ऐसे भूतपूर्व सैनिक जिन्हें अशक्त होने के कारण या गोली लगने तथा घाव आदि के कारण चिकित्सीय आधार पर सेवा से पृथक् किया गया हो, अथवा अब वे दक्ष सैनिक बनने के योग्य नहीं होने के कारण सेवोन्मुक्त किया गया हो;
(च) "सरकार" से अभिप्रेत है, मध्यप्रदेश सरकार;
(छ) " राज्यपाल" से अभिप्रेत है, मध्यप्रदेश के राज्यपाल;
(ज) " अन्य पिछडा वर्ग" से अभिप्रेत है, राज्य सरकार द्वारा समय- समय पर यथा संशोधित अधिसूचना क्रमांक एफ-8-5- पच्चीस-4-84, दिनांक 26 दिसम्बर, 1984 द्वारा यथा संशोधित नागरिकों के अन्य पिछडे वर्ग;
(झ) "अनुसूची" से अभिप्रेत है, इन नियमों में संलग्न अनुसूचियां;

(ञ) " अनुसूचित जाति" से अभिप्रेत है, कोई जाति, मूलवंश या जनजाति अथवा जाति मूलवंश या जनजाति का भाग या उसमें का यूथ, जिसे भारत के संविधान के अनुच्छेद 341 के अधीन मध्यप्रदेश राज्य के संबंध में अनुसूचित जाति के रूप में विनिर्दिष्ट किया गया हो;
(ट) "अनुसूचित जनजाति" से अभिप्रेत है, कोई जनजाति या जनजाति समुदाय अथवा ऐसी जनजाति या जनजाति समुदाय का भाग या उसमें का यूथ, जिसे भारत के संविधान के अनुच्छेद 342 के अधीन मध्यप्रदेश राज्य के संबंध में अनुसूचित जनजाति के रूप में विनिर्दिष्ट किया गया हो ;
(3) में दर्शित सेवा;
(ठ) " सेवा" से अभिप्रेत है, अनुसूची - दो के कालम
(ड) "छंटनी किए गए शासकीय सेवक" से अभिप्रेत है , ऐसा व्यक्ति जो इस राज्य अथवा संघटक इकाईयों में से किसी भी इकाई का अस्थायी शासकीय सेवा में कम से कम छह माह तक निरन्तर रहा हो, तथा जो रोजगार कार्यालय में अपना पंजीयन कराने अथवा शासकीय सेवा में नियुक्ति हेतु अन्यथा आवेदन- पत्र देने की तिथि से अधिक से अधिक तीन वर्ष पूर्व कर्मचारियों की संख्या में कमी किए जाने के कारण सेवोन्मुक्त किया गया हो;
(ढ़) " राज्य" से अभिप्रेत है, मध्यप्रदेश राज्य ।
3. विस्तार एवं लागू होना.-
मध्यप्रदेश सिविल सेवा (सेवा की सामान्य शर्तें) नियम, 1961 में अंतर्विष्ट उपबंधों की व्यापकता पर प्रतिकूल प्रभाव डाले बिना ये नियम इस सेवा के प्रत्येक सदस्य पर लागू होंगे ।
4. सेवा का गठन.-
सेवा में निम्नलिखित व्यक्ति होंगे, अर्थात्:-
(1 ) वे व्यक्ति , जो इन नियमों के प्रारम्भ होने के समय अनुसूची- एक में विनिर्दिष्ट किसी पद को मूल रूप से या स्थानापन्न रूप से धारण कर रहे हों;
(2) वे व्यक्ति, जो इन नियमों के प्रारम्भ होने से पूर्व सेवा में भर्ती किए गए हों, और
(3) वे व्यक्ति, जो इन नियमों के उपबंधों के अनुसार सेवा में भर्ती किए गए हों ।

5. वर्गीकरण , वेतनमान इत्यादि.-
सेवा का वर्गीकरण , उससे संलग्न वेतन तथा सेवा में सम्मिलित पदों की संख्या, अनुसूची- एक में यथा विनिर्दिष्ट उपबंधों के अनुसार होगी तथा वित्त विभाग के उपबंधों के अधीन समयमान वेतनमान की पात्रता होगीः
परन्तु समय - समय पर सरकार, सेवा में सम्मिलित किए गए पदों की संख्या में स्थायी आधार या अस्थायी आधार पर, वृद्धि या कमी कर सकेगी ।
6. भर्ती का तरीका.-
(एक) इन नियमों के प्रारंभ होने के पश्चात् सेवा में भर्ती निम्नलिखित तरीकों में से की जाएगी, अर्थात्:-
(क) आयोग द्वारा आयोजित प्रतियोगी परीक्षा के माध्यम से सीधी भर्ती द्वारा ,
(ख) अनुसूची- चार में यथा दर्शित सेवा के सदस्यों की पदोन्नति द्वारा,
(ग) अन्य सेवाओं से व्यक्तियों के स्थानांतरण द्वारा ।
(दो) उपनियम (एक) के खण्ड (क) या (ख ) के अधीन भर्ती किए गए व्यक्तियों की संख्या अनुसूची- एक में उल्लिखित किए गए पदों की संख्या या अनुसूची- दो में उल्लिखित प्रतिशत से किसी भी समय अधिक नहीं होगी ।
(तीन) इन नियमों के उपबंधों के अध्यधीन रहते हुऐ भर्ती की किसी विशिष्ट कालावधि के दौरान भरे जाने के लिए अपेक्षित सेवा की किसी ऐसी विशिष्ट रिक्ति या रिक्तियों को भरने के प्रयोजन के लिए अपनाया जाने वाला भर्ती का तरीका या तरीके तथा प्रत्येक तरीके द्वारा भर्ती किए जाने वाले व्यक्तियों की संख्या प्रत्येक अवसर पर सरकार / नियुक्ति प्राधिकारी द्वारा अवधारित की जाएगी ।
7. सेवा में नियुक्ति. -
:
इन नियमों के लागू होने के पश्चात् सेवा में समस्त नियुक्तियां, नियुक्ति प्राधिकारी द्वारा की जाएंगी तथा ऐसी कोई भी नियुक्ति नियम-6 में विनिर्दिष्ट भर्ती के तरीकों में से किसी एक तरीके द्वारा चयन करने के पश्चात् ही की जाएगी, अन्यथा नहीं ।
8. सीधी भर्ती हेतु पात्र की शर्तें.-
चयन के लिए पात्र होने हेतु अभ्यर्थी को निम्नलिखित शर्तें पूरी करनी होगी , अर्थात्ः- (क) वह भारत का नागरिक हो ;

(ख) आयु:-
(एक) अभ्यर्थी ने परीक्षा / चयन प्रारम्भ होने की तारीख की आगामी जनवरी के प्रथम दिवस को अनुसूची- तीन के कालम (3) में विनिर्दिष्ट आयु पूरी कर ली हो तथा उक्त अनुसूची के कालम (4) में विनिर्दिष्ट आयु पूरी नहीं की हो,
(दो) यदि अभ्यर्थी अनुसूचित जाति या अनुसूचित जनजाति वर्ग का हो तो उच्चतर आयु सीमा 5 वर्ष तक शिथिलनीय होगी,
(तीन) उन अभ्यर्थियों के संबंध में, जो मध्यप्रदेश सरकार के कर्मचारी हैं अथवा कर्मचारी रह चुके हैं उच्चतर आयु सीमा नीचे दी गई सीमा तक तथा शर्तों के अध्यधीन रहते हुए शिथिलनीय होगी, अर्थात्: -
(क) ऐसा अभ्यर्थी जो स्थायी या अस्थायी कर्मचारी हो, 45 (40+5) वर्ष से अधिक आयु का नहीं होना चाहिए . यह रियायत आकस्मिकता निधि से वेतन पाने वाले कर्मचारियों, कार्यभारित कर्मचारियों तथा परियोजना कार्यान्वयन समिति में कार्यरत कर्मचारियों को भी अनुज्ञेय होगी;
(ख) ऐसा अभ्यर्थी जो छंटनी किया गया शासकीय सेवक हो, अपनी आयु में से उसके द्वारा पूर्व में की गई सम्पूर्ण सेवा की अधिकतम सात वर्ष की सीमा तक की कालावधि भले ही वह कालावधि एक से अधिक बार की गई सेवाओं का योग हो, कम करने के लिए अनुज्ञात किया जाएगा बशर्तें इसके परिणामस्वरूप जो आयु निकले वह उच्चतर आयु सीमा 45 वर्ष से अधिक न हो;
(चार) ऐसे अभ्यर्थी को, जो भूतपूर्व सैनिक हैं अपनी आयु में से उसके द्वारा पूर्व में की गई संपूर्ण प्रतिरक्षा सेवा की कालावधि कम करने के लिए अनुज्ञात किया जाएगा, बशर्ते कि इसके परिणामस्वरूप जो आयु निकले, वह उच्चतर आयु सीमा से 45 वर्ष से अधिक न हो;
(पांच) सीधी भर्ती हेतु महिला अभ्यर्थियों को उच्चतर आयु सीमा 5 वर्ष तक शिथिलनीय होगी;
(छह) तलाकशुदा महिला अभ्यर्थियों के संबंध में उच्चतर आयु सीमा 45 वर्ष तक होगी;
(सात) अनुसूचित जाति, अनुसूचित जनजाति तथा पिछड़े वर्ग कल्याण विभाग के अन्तर्जातीय विवाह प्रोत्साहन कार्यक्रम के अधीन किसी पुरस्कृत दंपत्ति के सवर्ण पति- पत्नी के संबंध में उच्चतर आयु सीमा 5 वर्ष तक शिथिलनीय होगी;

(आठ) विक्रम पुरस्कार धारक अभ्यर्थियों के लिए भी उच्चतर आयु सीमा 5 वर्ष तक शिथिलनीय होगी;
(नौ) ऐसे अभ्यर्थियों के संबंध में , जो मध्यप्रदेश राज्य, निगम / मंडल के कर्मचारी हैं, उच्चतर आयु सीमा अधिकतम 5 वर्ष तक शिथिलनीय होगी;
(दस) नगर सेना (होमगार्डस) के स्वयं सेवी नगर सैनिकों तथा नान कमीशंड् अधिकारियों को उनके द्वारा पूर्व में की गई नगर सेना सेवा की संपूर्ण कालावधि के लिए उच्चतर आयु सीमा शिथिलनीय होगी किन्तु किसी भी दशा में उनकी आयु 45 वर्ष से अधिक नहीं होगी;
(ग्यारह) ऊपर दिए गए एक या अधिक आधारों के आधार पर आयु में छूट का लाभ प्राप्त करने के वाद भी अधिकतम आयु सीमा 45 वर्ष से अधिक नहीं बढ़ाई जाएगी;
(बारह) सामान्य प्रशासन विभाग द्वारा आयु सीमा निर्धारण के संबंध में समय- समय पर जारी किए जाने वाले दिशा निर्देश प्रभावी होंगे;
टिप्पणीः- ऐसे अभ्यर्थी जिन्हे उपर्युक्त उपखण्ड (तीन) (क) में उल्लिखित आयु संबंधी रियायतों के अधीन परीक्षा / चयन के लिए पात्र पाया गया हो, यदि आवेदन पत्र प्रस्तुत करने के पश्चात् परीक्षा/ चयन के पहले अथवा बाद में सेवा से त्याग पत्र दे दे तो नियुक्ति के पात्र नहीं होंगे . तथापि 'यदि आवेदन पत्र भेजने के पश्चात् उनकी सेवा अथवा पद से छंटनी की जाए तो वे नियुक्ति के पात्र बने रहेंगे . किसी भी अन्य मामले में आयु सीमाएं शिथिल नहीं की जाएगी. विभागीय उम्मीदवार को चयन हेतु उपस्थित होने के लिए नियुक्ति प्राधिकारी से पूर्व अनुमति प्राप्त करनी होगी ।
(ग) शैक्षणिक अर्हताएं .-
अभ्यर्थी के पास अनुसूची- तीन में दर्शाई गई सेवा / पद के लिए विहित शैक्षणिक अर्हता एवं अन्य अर्हताएं होनी चाहिए ।
(घ) शुल्क.-
सीधी भर्ती के लिए प्रतियोगी परीक्षा में सम्मिलित होने हेतु अभ्यर्थियों को नियुक्ति प्राधिकारी / आयोग द्वारा विहित शुल्क का भुगतान करना होगा ।

9. निरर्हता.-
(1) अभ्यर्थी की ओर से अपनी अभ्यर्थिता के लिए किसी भी साधन से समर्थन अभिप्राप्त करने के किसी भी प्रयास को आयोग द्वारा उनके परीक्षा / चयन में बैठने के संबंध में निरर्हता के रूप में माना जाएगा ।
(2) कोई भी अभ्यर्थी, जिसकी दो से अधिक जीवित संतान हों, जिसमें से एक का जन्म 26 जनवरी , 2001 को या उसके पश्चात हुआ हो , किसी सेवा या पद पर नियुक्ति के लिए पात्र नहीं होगाः
परन्तु कोई भी अभ्यर्थी, जिसकी पहले से एक जीवित संतान है तथा अगला प्रसव 26 जनवरी , 2001 को या उसके पश्चात हुआ हो, जिसमें दो या दो से अधिक संतानों का जन्म होता है, किसी सेवा या पद पर नियुक्ति के लिए निरर्हित नहीं होगा ।
(3) कोई भी अभ्यर्थी जिसे महिलाओं के विरूद्ध किसी अपराध का सिद्ध- दोष ठहराया गया हो , किसी सेवा या पद पर नियुक्ति के लिए पात्र नहीं होगाः
परन्तु जहां किसी अभ्यर्थी के विरूद्ध न्यायालय में ऐसे मामले लंबित हों, वहां उसकी नियुक्ति का मामला आपराधिक मामले का अंतिम विनिश्चय होने तक लंबित रखा जाएगा ।
(4) कोई भी अभ्यर्थी, जिसकी एक से अधिक जीवित पत्नियाँ हों और कोई भी महिला अभ्यर्थी जिसने ऐसे व्यक्ति से विवाह किया है, जिसकी पहले से ही एक जीवित पत्नी हो, सेवा के लिए निरर्हित होगाः
परन्तु यदि शासन का इस बात से समाधान हो जाए कि ऐसा करने के विशेष कारण हैं, तो वह ऐसे अभ्यर्थी को इस नियम के प्रवर्तन से छूट दे सकेगा ।
10. पात्रता के सम्बन्ध में विनिश्चय -
परीक्षा / चयन के लिए किसी अभ्यर्थी की पात्रता या अन्यथा के सम्बन्ध में नियुक्ति प्राधिकारी / आयोग का विनिश्चय अंतिम होगा और ऐसे अभ्यर्थी को जिसे प्रवेश प्रमाण-पत्र जारी नहीं किया गया है, परीक्षा के लिए अनुज्ञात नहीं किया जाएगा।
11. प्रतियोगिता परीक्षा द्वारा सीधी भर्ती.-
(1) सेवा में भर्ती के लिए प्रतियोगिता परीक्षा ऐसे अन्तरालों से आयोजित की जाएगी , जैसा कि आयोग समय- समय पर अवधारित करे ।
(2) सीधी भर्ती के लिए मध्यप्रदेश लोक सेवा (अनुसूचित जातियों, अनुसूचित जनजातियों और अन्य पिछड़े वर्गों के लिए आरक्षण ) नियम, 1998 के अनुसार मध्यप्रदेश राजपत्र, दिनांक 30 मई 2022

16% पद अनुसूचित जातियों, 20% पद अनुसूचित जनजातियों तथा 27% पद अन्य पिछडे वर्गों और 10% पद आर्थिक रूप से कमजोर वर्गों के अभ्यर्थियों के लिए आरक्षित रखे जाएंगे । मध्यप्रदेश सिविल सेवा (महिलाओं की नियुक्ति के लिए विशेष उपबंध) नियम , 1997 के अनुसार महिला अभ्यर्थियों के लिए पद आरक्षित रखे जाएंगे ।
(3) इस प्रकार आरक्षित रिक्तियों को भरते समय , उन अभ्यर्थियों पर, जो अनुसूचित जाति, अनुसूचित जनजाति, अन्य पिछड़े वर्ग एवं आर्थिक रूप से कमजोर वर्ग (ई.डब्ल्यू.एस. ) के सदस्य हैं, नियुक्ति के लिए विचार उसी क्रम में किया जाएगा, जिस क्रम में उनके नाम विनिर्दिष्ट सूची में आए हों, चाहे अन्य अभ्यर्थियों की तुलना में उनका सापेक्षित रैंक कुछ भी क्यों न हो ।
(4) अनुसूचित जाति, अनुसूचित जनजाति, अन्य पिछड़े वर्ग एवं आर्थिक रूप से कमजोर वर्ग (ई.डब्ल्यू.एस.) से संबधित अभ्यर्थियों को, जिन्हें प्रशासन में दक्षता बनाए रखने का सम्यक् ध्यान रखते हुए, सेवा में नियुक्ति के लिए उपयुक्त पाया जाए, यथास्थिति, अनुसूचित जाति, अनुसूचित जनजाति, अन्य पिछड़े वर्ग एवं आर्थिक रूप से कमजोर वर्ग (ई.डब्ल्यू.एस.) के अभ्यर्थियों के लिए आरक्षित रिक्तियों पर उप- नियम (2) के अध्यधीन नियुक्त किया जा सकेगा ।
:
(5) यदि अनुसूचित जाति, अनुसूचित जनजाति से संबधित अभ्यर्थी सभी आरक्षित रिक्तियों को भरने के लिए उपलब्ध न हों, तो शेष रिक्तियां सरकार की पूर्व अनुमति प्राप्त किए बिना अन्य अभ्यर्थियों से नहीं भरी जाएगीं और अनुसूचित जाति, अनुसूचित जनजाति से संबंधित अभ्यर्थियों के लिए आगामी चयन तक आरक्षित रखी जाएगीं ।
(6) महिला अभ्यर्थियों के लिए मध्यप्रदेश सिविल सेवा (महिलाओं की नियुक्ति के लिए विशेष उपबंध) नियम, 1997 के उपबंधों के अनुसार पद आरक्षित रखें जाएंगे !
: (7) शासन के निर्देशानुसार, दिव्यांगजनों के लिए 6% क्षैतिज आरक्षण होगा ।
12. परिवीक्षा.-
सेवा में सीधे भर्ती किया गया प्रत्येक व्यक्ति सामान्य प्रशासन विभाग , मध्यप्रदेश द्वारा समय- समय पर यथा अधिसूचित कालावधि के लिए परिवीक्षा पर नियुक्त किया जाएगा ।

13. आयोग द्वारा अनुशंसित अभ्यर्थियों की सूची. -
(1) आयोग , योग्यता क्रम में उन अभ्यर्थियों की एक सूची, जो ऐसे मानकों से अर्हित हुए हैं जैसा कि आयोग अवधारित करे तथा अनुसूचित जातियों तथा अनुसूचित जनजातियों तथा अन्य पिछड़े वर्ग से संबंध रखने वाले वर्गों उन अभ्यर्थियों की सूची, जो यद्यपि उस मानक से अर्ह नहीं हैं, जिन्हें आयोग द्वारा प्रशासन में दक्षता बनाए रखने का सम्यक् ध्यान रखते हुए , सेवा में नियुक्ति के लिए उपयुक्त घोषित किया गया है, शासन / नियुक्ति प्राधिकारी को अग्रेषित करेगा । यह सूची सर्वसाधारण की जानकारी के लिए भी प्रकाशित की जाएगी ।
(2) इन नियमों तथा मध्यप्रदेश सिविल सेवा (सेवा की सामान्य शर्तें) नियम, 1961 के उपबंधों के अध्यधीन रहते हुए, उपलब्ध रिक्तियों पर नियुक्ति के लिए , अभ्यर्थियों पर उसी क्रम में विचार किया जाएगा, जिसमें कि उनके नाम सूची में आए हों ।
(3) सूची में किसी अभ्यर्थी का नाम सम्मिलित किए जाने से ही उसे नियुक्ति का कोई अधिकार तब तक प्राप्त नहीं होता है, जब तक कि नियुक्ति प्राधिकारी का, ऐसी जांच करने के पश्चात्, जैसी कि वह आवश्यक समझे, इस बात का समाधान नहीं हो जाता, कि अभ्यर्थी सेवा में नियुक्ति के लिए सभी प्रकार से उपयुक्त है ।
(4) चयन सूची की विधिमान्यता की कालावधि आयोग द्वारा जारी किए जाने की तारीख से एक वर्ष तक की होगी , जिसे चयन समिति / आयोग परामर्श के पश्चात् 6 माह की कालावधि के लिए बढाया जा सकेगा ।
14. पदोन्नति द्वारा नियुक्ति.-
(1) पात्र अभ्यर्थियों को पदोन्नति हेतु चयन करने के लिए अनुसूची- चार में उल्लिखित सदस्यों से मिलकर बनने वाली एक समिति का गठन किया जाएगा । समिति में अनुसूचित जाति/ अनुसूचित जनजाति से संबंधित राजपत्रित अधिकारी की श्रेणी के सदस्यों को नामनिर्दिष्ट किया जाएगा ।
(2) समिति की बैठक वर्ष में कम से कम एक बार होगी ।
(3) पदोन्नति में आरक्षण से संबंधित ऐसे उपबंध लागू होंगे , जो सामान्य प्रशासन विभाग मध्यप्रदेश द्वारा समय- समय पर जारी किए जाएं ।
(4) अनारक्षित / आरक्षित रिक्तियों में पदोन्नति किए जाने के लिए प्रक्रिया , शासन के सामान्य प्रशासन विभाग द्वारा समय- समय पर जारी अनुदेशों के अनुसार की जाएगी ।

15. पदोन्नति के लिए पात्रता की शर्तें.-
समिति, उन सभी व्यक्तियों के मामलों पर विचार करेगी , जिन्होंने उस वर्ष की पहली जनवरी को उन पदों पर, जिनसे कि पदोन्नति की जानी है, या तो स्थानापन्न या मौलिक रूप में उतने वर्ष की सेवा पूर्ण कर ली हो, जो अनुसूची- चार में विनिर्दिष्ट है और जो विचार क्षेत्र में आते होंः
परन्तु किसी कनिष्ठ व्यक्ति केवल उसके द्वारा विहित सेवा पूर्ण कर लिए जाने के आधार पर हो चयन श्रेणी/ पदोन्नति के लिए अपने से वरिष्ठ व्यक्ति पर अधिमान देकर विचार नहीं किया जाएगा ।
16. उपयुक्त अभ्यर्थियों की सूची तैयार किया जाना.-
(1 ) समिति, ऐसे व्यक्तियों की एक सूची तैयार करेगी , जो नियम 15 में विहित शर्त को पूरा करते हों तथा जो समिति द्वारा सेवा में पदोन्नति/ स्थानान्तरण के लिए उपयुक्त समझ जाएं । चयन सूची तैयार किए जाने की तारीख से एक वर्ष के दौरान सेवानिवृत्ति तथा पदोन्नति के कारण प्रत्याशित रिक्तियों को पूरा करने के लिए अनपेक्षित रिक्तियों को भरने के लिए सम्मिलित व्यक्तियों की संख्या के 25% से मिलकर बनने वाली एक आरक्षित सूची भी तैयार की जाएगी ।
(2) ऐसी सूची में नाम सम्मिलित करने के लिए चयन, वरिष्ठता का सम्यक् रूप से ध्यान रखते हुए , योग्यता तथा सभी दृष्टि से उपयुक्तता पर आधारित होगा ।
(3) सूची में सम्मिलित अभ्यर्थियों के नाम ऐसी चयन सूची की तैयार किए जाते समय अनुसूची- चार में यथाविनिर्दिष्ट सेवा या पदों में वरिष्ठता के कम में रखे जाएंगे ।
स्पष्टीकरण- ऐसे किसी व्यक्ति का, जिसका नाम चयन सूची में सम्मिलित किया गया हो, किन्तु जो सूची को विधिमान्यता के दौरान पदोन्नत न किया गया हो, केवल उसके पूर्वोतर चयन के तथ्य से ही, उन लोगों पर, जिन पर पश्चात्वर्ती चयन में विचार किया गया है, वरिष्ठता का दावा नहीं रहेगा ।
(4) इस प्रकार तैयार सूची का प्रत्येक वर्ष पुनर्विलोकन तथा पुनरीक्षण किया जाएगा ।
(5) यदि चयन पुनर्विलोकन अथवा पुनरीक्षण की प्रक्रिया में, सेवा के किसी सदस्य का अधिक्रमण किया जाना प्रस्तावित हो, तो समिति, प्रस्तावित अधिक्रमण के सम्बन्ध में अपने कारण को लेखबद्ध करेगी ।
17. आयोग से परामर्श.-
विभागीय पदोन्नति समिति की सिफारिश के सम्बन्ध में यह समझा जाएगा, कि संविधान के अनुच्छेद 320 के खण्ड (3) के उप- खण्ड (ख) के अधीन आयोग से परामर्श करने संबंधी अपेक्षा का अनुपालन किया गया है तथा आयोग से पृथक परामर्श आवश्यक नहीं होगा ।

18. चयन- सूची.-
(1 ) नियुक्ति प्राधिकारी / शासन द्वारा अन्तिम रूप से अनुमोदित सूची, अनुसूची-चार में दर्शाए अनुसार सेवा के सदस्यों की पदोन्नति के लिए चयन सूची होगी ।
(2) चयन सूची सामान्यतः तब तक प्रवृत्त रहेगी जब तक कि नियम 16 के उप-नियम (4) के अनुसार उसका पुनर्विलोकन या पुनरीक्षण नहीं किया जाए , किन्तु ऐसी सूची की विधिमान्यता उसके तैयार किए जाने के तारीख से 12 मास की कालावधि के लिए प्रवृत्त रहेगी , किन्तु सूची की विधिमान्यता 6 माह से अधिक के लिए नहीं बढ़ाई जाएगी ।
(3) चयन सूची में सम्मिलित व्यक्तियों की, सेवा में संवर्ग के पदों पर नियुक्ति उसी कम में की जाएगी , जिस क्रम में उनके नाम चयन सूची में आए होंः
परन्तु चयन सूची में सम्मिलित किसी व्यक्ति की ओर से आचरण या कर्तव्यों के निर्वहन में गंभीर चूक होने की दशा में, यदि उचित समझें तो, शासन की प्रेरणा पर, चयन सूची का एक विशेष पुनर्विलोकन किया जा सकेगा और ऐसे व्यक्ति का नाम चयन सूची से हटाया जा सकेगा ।
19. परिवीक्षा.-
सेवा में पदोन्नत प्रत्येक अभ्यर्थी, दो वर्ष के परिवीक्षा के लिए नियुक्त किया जाएगा ।
20. निर्वचन. -
यदि इन नियमों के निर्वचन के संबंध में कोई प्रश्न उद्भूत हो, तो वह सरकार को निर्दिष्ट किया जाएगां, जिस पर उसका विनिश्चिय अंतिम होगा ।
21. शिथिलीकरण. -
इन नियमों में दी गयी किसी भी बात का यह अर्थ नहीं लगाया जाएगा कि वह किसी ऐसे व्यक्ति के सम्बन्ध में, जिस पर ये नियम लागू होते हैं, राज्यपाल की, ऐसी रीति में, जो उसे उचित और न्यायसंगत प्रतीत होती हो, कार्यवाही करने की शक्ति को सीमित या कम करती हैं, परन्तु मामला किसी ऐसी रीति से नहीं निपटाया जाएगां , जो कि इन नियमों में उपबंधित रीति की अपेक्षा उसके लिए कम अनुकूल हो ।
22. निरसन तथा व्यावृत्ति.-
इन नियमों के तत्स्थानी और इनके प्रारंभ होने के ठीक पहले लागू सभी नियम इन नियमों के अंतर्गत आने वाले विषयों के संबंध में निरसित किए जाने हैं ।
उक्त नियमों के निरसित होते हुए भी, उक्त नियमों के अधीन किया गया कोई कार्य या की गई कोई कार्रवाई इन नियमों के तत्स्थानी उपबंधों के अधीन किया गया कार्य या की गई कार्रवाई समझी जाएगी ।

या रसायनज्ञ संस्था (भारत ) द्वारा खाद्य विश्लेषक परीक्षा उत्तीर्ण करके रसानज्ञ संस्था ( भारत) का कोई सहयुक्तहो
या ऐसे प्रयोजनों के लिए केन्द्रीय सरकार द्वारा मान्यताप्राप्त और अधिसूचित कोई अन्य समतुल्य अर्हता रखता हो । और खाद्य विश्लेषण में कम से कम तीन वर्ष का अनुभव हो,
और खाद्य सुरक्षा और मानक प्राधिकरण भारत सरकार द्वारा नियुक्त और अधिसूचित किसी बोर्ड द्वारा खाद्य विश्लेषक के रूप में नियुक्त किए जाने के लिए अर्हित घोषित किया गया हो या किसी व्यक्ति को खाद्य अपमिश्रण निवारण अधिनियम , 1954 के अधीन गठित बोर्ड द्वारा लोक विश्लेषक के लिए नियुक्ति के लिए अर्हित घोषित किया गया है ।

उप-संचालक, (खाद्य एवं औषधि)
ऐसे व्यक्ति को नियुक्त खाद्य उपसंचालक नहीं किया जाएगा जिसका औषधि/ कॉस्मेटिक / पदार्थ के विनिर्माण, आयात या बिकी में कोई वित्तीय हित हो ।
औषधि एवं प्रसाधन सामग्री नियम, 1945 के उपबंधों के अधीन शासकीय विश्लेषक/ औषधि निरीक्षक के रूप में नियुक्ति के लिए विहित अर्हता होनी चाहिए और उस औषधि निरीक्षक/ औषधि विश्लेषक का 7 वर्षों का अथवा औषधि एवं प्रसाधन अधिनियम , 1940 तथा नियम 1945 के अधीन अनुमोदित प्रयोगशाला में औषधि परीक्षण का 7 वर्षों का अनुभव होना चाहिए ।
या खाद्य सुरक्षा और मानक नियम, 2011 के उपबंधों के अधीन खाद्य विश्लेषक/ खाद्य सुरक्षा अधिकारी के रूप में नियुक्ति के लिए अर्हता होनी चाहिए , और उसे खाद्य विश्लेषक/ खाद्य सुरक्षा अधिकारी के रूप में 7 वर्षों का अथवाFSSAI (भारतीय खाद्य संरक्षा एवं मानक प्राधिकरण) द्वारा अधिसूचित प्रयोगशाला में खाद्य परीक्षण का 7 वर्षों का अनुभव होना चाहिए ।
स्पष्टीकरण
1. शासकीय विश्लेषक के पास निम्नानुसार अर्हता होनी चाहिए:- (क) आयुर्विज्ञान या विज्ञान या फार्मेसी या फार्मास्यूटीकल केमिस्ट्री की स्नातक डिग्री (भारत में विधि द्वारा स्थापित विश्वविद्यालय या ऐसे प्रयोजनों के लिए केन्द्रीय सरकार द्वारा मान्यताप्राप्त और अधिसूचित कोई अन्य समतुल्य अर्हता) और औषधि परीक्षण का कम से कम पांच वर्षों का स्नातकोत्तर अनुभव ऐसी प्रयोगशाला का हो , जिसका नियंत्रण
(एक) अधिनियम, के अधीन नियुक्त शासकीय विश्लेषक, या मध्यप्रदेश राजपत्र, दिनांक 30 मई 2022

(दो) नियुक्ति प्राधिकारी द्वारा इस उद्देश्य के लिए अनुमोदित प्रयोगशाला या संस्थान का प्रमुख [या केन्द्रीय औषधि प्रयोगशाला से अनुसूची-ग, में वर्णित वस्तु सहित औषधियों के परीक्षण में दो वर्ष का प्रशिक्षण पूर्ण किया हो],
या (ख) आयुर्विज्ञान या विज्ञान या फार्मेसी या फार्मास्यूटीकल केमिस्ट्री की स्नातकोत्तर डिग्री (भारत में विधि द्वारा स्थापित विश्वविद्यालय या ऐसे प्रयोजनों के लिए केन्द्रीय सरकार द्वारा मान्यता प्राप्त और अधिसूचित कोई अन्य समतुल्य अर्हता) या इंस्टीट्यूशन ऑफ केमिस्ट ( इण्डिया) से एनालिसिस ऑफ ड्रग्स और फार्मास्यूटिकल के विषय के साथ एसोसिएटशिप डिप्लोमा की परीक्षा उत्तीर्ण की हो और उपरोक्त स्नातकोत्तर डिग्री या डिप्लोमा के बाद कम से कम तीन वर्ष का औषधि परीक्षण का अनुभव ऐसी प्रयोगशाला का हो, जिसका नियंत्रण
(एक) औषधि एवं प्रसाधन अधिनियम, 1940 के तहत नियुक्त शासकीय विश्लेषक या
(दो) नियुक्ति प्राधिकारी द्वारा इस उद्देश्य के लिए अनुमोदित प्रयोगशाला या संस्थान का प्रमुख [या केन्द्रीय औषधि प्रयोगशाला से अनुसूची- सी, में वर्णित विषय सहित औषधियों के परीक्षण में दो वर्ष का प्रशिक्षण पूर्ण किया हो ] ,
या (2) औषधि निरीक्षक के पास निम्नानुसार अर्हता होनी चाहिए:- भारत में विधि द्वारा स्थापित विश्वविद्यालय से औषधि-निर्माण विज्ञान या औषधि विज्ञान या नैदानिक भैषजगुण विज्ञान में

या ऐसे प्रयोजनों के लिए केन्द्र सरकार द्वारा मान्यताप्राप्त और अधिसूचित कोई अन्य समतुल्य अर्हता खाद्य विश्लेषक में कम से कम तीन वर्ष का अनुभव रखता हो; और
भारत के खाद्य सुरक्षा और मानक प्राधिकरण द्वारा नियुक्त और अधिसूचित किसी बोर्ड द्वारा खाद्य विश्लेषक के रूप में नियुक्त किए जाने के लिए अर्हित घोषित किया गया हो या किसी व्यक्ति को खाद्य अपमिश्रण निवारण अधिनियम, 1954 के अधीन गठित बोर्ड द्वारा लोक विश्लेषक के रूप में नियुक्ति के लिए अर्हित घोषित किया गया है ।

भारत में विधि द्वारा स्थापित विश्वविद्यालय से फार्मेसी या फार्मास्यूटीकल कैमिस्ट्री या फार्माकोलोजी क्लिनिकल विशेषज्ञता संहित मेडिसिन या सूक्ष्म जीव विज्ञान में उपाधि ।
ऐसे व्यक्ति को जिसका औषधि/ कॉस्मेटिक विनिर्माण, आयात या में बिकी में कोई वित्तीय हित हो । वरिष्ठ औषधि निरीक्षक नियुक्त नहीं कियाजाएगा

औषधि विश्लेषक
ऐसे व्यक्ति को औषधि विश्लेषक नियुक्त नहीं किया जाएगा जिसका औषधि/ कॉस्मेटिक विनिर्माण, आयात या बिकी में कोई वित्तीय हित हो ।
(क) आयुर्विज्ञान या विज्ञान या फार्मेसी या फार्मास्यूटीकल केमिस्ट्री में स्नातक [ भारत में विधि द्वारा स्थापित विश्वविद्यालय या ऐसे प्रयोजन के लिए केन्द्रीय सरकार द्वारा मान्यताप्राप्त और अधिसूचित कोई समकक्ष अर्हता और औषधि परीक्षण में कम से कम 5 वर्षों का स्नातकोत्तर अनुभव, ऐसी प्रयोगशाला का हो, जिसका
नियंत्रण,- (एक) अधिनियम (औषधि एवं प्रसाधन अधिनियम, 1940) के अधीन नियुक्त शासकीय विश्लेषक या
(दो) नियुक्ति प्राधिकारी द्वारा इस प्रयोजन के लिए अनुमोदित संस्थान या प्रयोगशाला का प्रमुख [या केन्द्रीय औषधि प्रयोगशाला में अनुसूची- सी, में वर्णित विषय सहित औषधियों के परीक्षण में दो वर्ष का प्रशिक्षण पूर्ण किया हो] ,
या
(ख) आयुर्विज्ञान या विज्ञान या फार्मेसी या फार्मास्यूटीकल केमिस्ट्री मध्यप्रदेश राजपत्र , दिनांक 30 मई 2022

द्वितीय श्रेणी के साथ माइक्रोबॉयोलॉजी में स्नातकोत्तर उपाधि एवं औषधि एवं प्रसाधन अधिनियम, 1940 एवं नियम 1945 के अधीन अनुमोदित प्रयोगशाला में औषधि परीक्षण का 02 वर्ष का अनुभव होना चाहिए ।

भारत के खाद्य सुरक्षा और मानक प्राधिकरण द्वारा नियुक्त और अधिसूचित किसी बोर्ड द्वारा खाद्य विश्लेषक के रूप में नियुक्ति के लिए अर्हित घोषित किया गया हो या किसी व्यक्ति को खाद्य अपमिश्रण निवारण अधिनियम, 1954 के अधीन गठित बोर्ड द्वारा लोक विश्लेषक की नियुक्ति के लिए अर्हित घोषित किया गया है अथवा
एफ एस एस ए आई (भारतीय खाद्य संरक्षा एवं मानक प्राधिकरण ) से अधिसूचित प्रयोगशाला में खाद्य परीक्षण का 4 वर्षों का अनुभव होना चाहिए ।

In exercise of the powers conferred by the proviso to Article 309 of the Constitution of India and in supersession of this departments notification No. 3270-3174-17- Medi - 2-89 , dated 27.10.1989 , the Governor of Madhya Pradesh , hereby , makes the following Rules for regulating the recruitment to the Madhya Pradesh Food and Drugs Administration Service ( Gazetted) Service , namely , -
RULES
1. Short title and Commencement.-
(1 ) These Rules may be called the Madhya Pradesh Food and Drug Administration Recruitment Rules , 2022 . (Gazetted) service (2) They shall come into force from the date of their publication in the Madhya Pradesh Gazette .
2. Definitions- In these rules , unless the context otherwise requires , -
( a) "Appointing Authority " in respect of the Service means the Government;
(b) Commission " means the Madhya Pradesh Public Service Commission ;
(c) "Economically weaker Section ( EWS ) " means a citizen who does not come under any reserve category such as Scheduled Castes and Scheduled Tribes as per General Administration Department's circular No. ' F- 07-11/2019/ आ.प्र./ one dated 2nd July , 2019 ;
( d) "Examination" means a competitive examination organized for recruitment under rule -11 ;
1 ( e) "Ex -Serviceman " means a person who belongs to any of the following categories and who was employed under the Government of India for a continuous period ofnot less than six months and who was retrenched or declared surplus as a result of the recommendation of मध्यप्रदेश राजपत्र, दिनांक 30 मई 2022

the economy unit or due to normal reduction in establishment not more than 3 years before the date of his registration at any Employment Exchange or of application made otherwise for employment in Government Service-
( 1 ) ex- serviceman released under mustering concession; out
(2) ex- serviceman who was employed more than six months continuously in army of country and not released due to any misconduct ;
(3) ex- serviceman enrolled for the second time and discharged on-
(a) completion of short term engagement ;
(b) fulfilling the conditions of enrollment ;
(4) ex-personnel of Madras Civil Units ;
(5) officer discharged after working for more than six months continuously against leave vacancies ;
(6) ex- serviceman who are medically boarded out on account of gunshot , wounds etc or they are unlikely to become efficient soldiers .
( f) "Government " means the Government of Madhya Pradesh;
(g) "Governor " means the Governor of Madhya Pradesh ;
(h ) " Other Backward Classes " means the Other Backward Classes of citizens as specified by the State Government vide Notification F- 8-5 - XXV - 4-84 , dated 26 December , 1984 , as amended from time to time .
"Schedule " means Schedules appended to these Rules; (i)
(j ) "Scheduled Castes " means any caste , race or tribe or part of or group within caste , race or tribe specified as Scheduled Caste which respect to the State of Madhya Pradesh under Article 341 of the Constitution of India ;

(k ) " Scheduled Tribes " means any tribe or tribal community or part of or group within tribe or tribal community specified as Scheduled Tribe with respect to the State of Madhya Pradesh under Article 342 of the Constitution of India;
(1) "Service " means the service shown in column (3) of the Schedule - II ;
(m) " State" means the State of Madhya Pradesh ;
( n) " Retrenched Government Servant " means a person who was in temporary Government Service of this State or of any of constituent units , for a continuous period of not less than six months and who was discharged because of reduction in establishment not more than 3 years prior to the date of his registration at the Employment Exchange or an application made otherwise for employment in Government Service .
3. Scope and Application.-
Without prejudice to the generality of the provisions contained in the Madhya Pradesh Civil Services ( General Conditions of Service ) Rules , 1961 these Rules shall apply to every member of this Service .
4. Constitution of the service.-
The service shall consist of the following persons , namely , - (i ) persons who at the commencement of these rules are holding substantively or in an officiating capacity the posts specified in Schedule - I ;
( ii ) persons recruited to the service before the commencement of these Rules ; and
( iii ) persons recruited to the service in accordance with the provisions of these Rules .
5. Classification , Scale of Pay etc.-
The classification of the service , the scale of pay attached thereto , and the number of the posts included in the service shall be in accordance with provisions contained in 564(25)

Schedule- I , and shall be eligible for time pay scale under the provisions of the Finance Department :
Provided that the Government may from time to time , add to or reduce the number of posts included in the service , either in a permanent or temporary basis .
Method of recruitment.-
6.
(i) Recruitment to the service , after the commencement of these Rules shall be by the following methods viz- (a) by direct recruitment through competitive examination , organized by the Commission ;
(b) by promotion of the member of the service as shown in Schedule - IV;
(c) by transfer of persons from other services .
(ii) The number of persons recruited under clause (a) or (b) of sub - rule ( i) shall not at any time exceed the number of posts shown in Schedule- I and the percentage shown in Schedule- II .
( iii) Subject to the provision of these Rules , the method of recruitment to be adopted for the purpose of filling any particular vacancy or vacancies in the service as may be required to be filled during any particular period of recruitment and the number of persons to be recruited by each method, shall be determined on each occasion by the Government /Appointing Authority .
Appointment to the service.-
7.
All appointment to the service after the commencement of these Rules shall be made by the Government and no such appointment shall be made except after selection by one of the methods of recruitment specified in rule- 6 .
8. Conditions of eligibility for direct recruitment.-
In order to be eligible to be selection , a candidate must satisfy the following conditions , viz , -
(a) A citizen of India;
(b) Age .

(i) he must have attained the age as shown in column (3) of Schedule - III and not attained the age as shown in column (4) of the said Schedule on the first day of January next following date of commencement of the examination / selection;
(ii) the upper age limit shall be relaxable up to a maximum 5 years , if a candidates belongs to a scheduled castes or Scheduled tribes ;
( iii ) the upper age limit shall be relaxable to the candidates , who are or have been employees of the Madhya Pradesh Government to the extent and subject to the conditions specified below , namely: -
(a) A candidates holding a post temporarily and applying for another post should not be more than 45 (40 + 5) years of age . This concession shall also be available to the contingency paid employees and work - charged employees and ofproject implementation committee;
(b) A candidate , who " retrenched Government Servant " shall be allowed to deduct from his age the period of all temporary service previously rendered by him up to maximum limit of seven years even if it represents more than one spell , provided that the resultant age does not exceed the upper age limit of 45 years;
(iv) A candidate who is an ex- serviceman will be allowed to deduct from his age the period of all defence service previously rendered by him , provided that the resultant age does not exceed the upper age limit of 45 years ;
(v) For direct recruitment the upper age limit shall be relaxable up to a maximum of 5 years for women candidates ;
(vi) In case of divorce women the upper age limit shall be relaxable up to upper limit of 45 years ;
(vii) The upper age limit shall be relaxable up to 5 years in respect of couple awarded superior caste under the Inter- caste marriage incentive programme of the Tribal and Scheduled Castes मध्यप्रदेश राजपत्र, दिनांक 30 मई 2022

and Other Department ; Backward Classes Welfare (viii ) The upper age limit shall be relaxable up to a maximum of 5 years in case of holder of "Vikram Award";
(ix) The upper age limit shall be relaxable up to a maximum of 5 years in respect of candidates who are the employees of M.P. Government/ Corporation / Board;
(x) The upper age limit shall be relaxable to the Swayam Sevi Nagar Sainik and Non- commissioned officers of Nagar Sena (Home Guards) for the services rendered by them but in any case their age should not exceed to 45 years ;
(xi) The maximum upper age limit shall not increase to 45 years even after availing the benefit of age relaxation on the basis of one or more ground as above;
(xii ) Instruction regarding age limit issued from time to time by the General Administration Department , Madhya Pradesh shall remain applicable .
Note: The candidates who are admitted to the selection under the relaxation mentioned in clause ( iii) above shall not be eligible for appointment , if after submitting the application the resignation from service either before or after selection . They will, however continue to be eligible if they are retrenched from the service or post after submitting the application . Age limit shall not be relaxed in any other case . departmental candidate has to obtain prior permission from his Appointing authority to proceed for selection .
( c) Educational Qualification.-
He must possess the educational qualification prescribed for the service /post as shown in the Schedule - III .

( d) Fees.-
He must pay the fees prescribed by the Appointing Authority/ Commission .
9. Disqualification.-
(1) Any attempt on the part of a candidate to obtain support for his candidature by any means may be held disqualification by the Commission for as examination/ selection .
(2) Any candidate who have more than two children , one of them born on or after 26th January , 2001 , shall be not be qualified for appointment on any post or service:
Provided that no candidate shall be disqualified for appointment to a service or post who has already one living child and next delivery takes place on or after the 26th day of January , 2001 in which two or more than two children are born .
(3) Any candidate who was convicted for any offence against women, shall be disqualified for service:
Provided that if such cases are pending in a court against a candidate his case of appointment shall be kept pending till the final decision of the Criminal Case.
(4) Any candidate who has more than one living wives and any female candidate who married such a person who already has a living wife , shall be disqualified for service:

Provided that the Government may , if satisfied that there are special grounds for doing so , exempt any candidate from the operation of this rule .
10 Decision about eligibility.-
The decision of the Appointing Authority / Commission as to the eligibility or otherwise of a candidate for examination/ selection shall be final and no candidate to whom a certificate of admission has not been issued shall be permitted for examination .
11 Direct recruitment by competitive examination.-
(1) Competitive examination for recruitment to the service shall be held at such intervals as the commission may , from time to time determine .
(2) In accordance with the Madhya Pradesh Public Service (Reservation for Scheduled castes , Scheduled Tribes and Other Backward Classes) Rules , 1998 , 16% posts for Scheduled castes , 20% posts for Scheduled Tribes , 27% posts for Other Backward Classes and 10 % post for the Economically Weaker Sections Candidate shall be reserved. For female candidates the posts shall be reserved in accordance with the Madhya Pradesh Civil Services ( Special Provisions for Appointment of Women) Rules , 1997 .
(3) In filling up the vacancies so reserved , candidates who are members of the Scheduled caste , Scheduled Tribe , Other Backward Class and Economically Weaker Section ( EWS ) shall be considered for appointment in the order in which their names appear in the specified list irrespective of their relative rank as compared with other candidates .

(4) Candidates belonging to the Scheduled caste , Scheduled Tribe , Other Backward Class and Economically Weaker section (EWS) who are found suitable for appointment to the service with due regard to the maintenance of efficiency of the administration may be appointed subject to sub - rule (2) as the case may be , to the vacancies reserved for the candidates of the Scheduled caste , Scheduled Tribe , Other Backward Class and Economically Weaker Section .
(5) If the candidates belonging to the Scheduled caste , Scheduled Tribe are not available for filling up all the reserved posts , the remaining vacancies shall not be filled by other candidates without obtaining prior sanction of the Government and shall be reserved till next selection for the candidates belonging to the Scheduled caste , Scheduled Tribe .
(6) For woman candidates the post shall be reserved according to the provisions of M.P. Civil Services (Special Provision for Appointment of Women) Rule , 1997.
(7) According to Government Instructions , there shall be 6% horizontal reservation for disabled persons .
12. Probation.-
Every person directly recruited in the service shall be appointed on probation for a period as notified , time to time, by General Administration Department , Madhya Pradesh .
13 List of candidates recommended by the Commission.-
(1) The Commission shall forward to the Government a list arranged in order of merit of the candidates who have qualified by such standards as the Commission may determine and of the candidates belonging to the Scheduled Castes , Scheduled Tribes and Other Backward Classes who though not qualified by that standard are declared by the Commission to be suitable for appointment to the service with due regard 564(31)

(2) Subject to the provisions of these Rules and of the Madhya Pradesh Civil Services (General Conditions of Services) Rules , 1961 , candidates will be considered for appointment to the available vacancies in the order in which their names appeared in the list .
( 3) The inclusion of candidate's name in the list confers no right to appointment unless the Government is satisfied , after such enquiry as may be considered necessary that the candidate is suitable in all respects for appointment of the service .
(4 ) The duration of validity of selection list shall be one year from the day of issue by the Commission , it may be extended by 6 months after consultation with selection committee / Commission .
14 Appointment by Promotion.-
( 1 ) There shall be constituted a committee consisting the members mentioned in Schedule - IV in the committee the members belonging to Schedule Caste/ Schedule Tribe of the rank of Gazetted officer will be nominated .
(2) The committee shall meet at least once in a year .
(3) Provisions relating to reservation in promotion shall be applicable which are issued by the General Administration Department of Madhya Pradesh from time to time .
(4) Procedure of making promotion in the unreserved/ reserved vacancies shall be made in accordance with the instruction issued by the General Administration Department of the Government from time to time .
15 Conditions of eligibility for promotion.-

specified in Schedule - IV and are within zone of consideration:
Provided that any junior person shall not be considered for selection grade / promotion in preference to the person senior to him only on the basis of his completing the prescribed period of service .
16. Preparation of list of suitable candidates.-
(1 ) The committee shall prepare a list of such persons as satisfy the condition prescribed in rule- 15 and as are held by the committee to be suitable for promotion/ transfer to the service . A reserve list shall also be prepared to cover the anticipated vacancies on account of retirement and promotion during the course of one year from the date of preparation of the select list , consisting of 25% of the numbers of persons included to meet the unforeseen vacancies .
(2 ) The selection for inclusion in such list shall be based on merit and suitability in all respect with due regard to seniority.
(3) The name of the candidates included in the list shall be arranged in order or seniority in the service or posts as specified in Schedule - IV at the time of preparation of such select list .
Explanation : - A person whose name is included in the select list but who is not promoted during the validity of the list , shall have no claim to seniority over these considered in a subsequent selection merely by the fact of his earlier selection .
(4) A list so prepared shall be reviewed and revised every year .

committee shall record it's reason for the proposed supersession .
17 Consultation with the Commission.-
The recommendation of the departmental promotion committee shall be deemed to be compliance of the requirement of the consultation with the commission under sub - clause (b) of clause (3) of Article 320 of the Constitution and a separate consultation with the Commission shall not be necessary .
18! Select List.-
(1 ) The list as finally approved by the Appointing Authority / Government shall form the select list for promotion of the members of the service as shown in Schedule - IV .
(2) The select list shall ordinarily be in force until it is reviewed or revised in accordance with sub - rule (4) of rule - 16 but validity of the list will remain in force for 12 months from the date it is prepared but the validity of the list will not be extended for more than 6 months .
(3) The persons included in select list shall be appointed on the posts of cadre in service , in the order as appeared in select list:
Provided that in the event of grave lapse in the conduct or performance of duties on the part of any person included in the select list , a special review of the select list may be made at the instance of the Government and, if it thinks fit , remove the name of such person from the select list .

Every candidate promoted in service shall be appointed for two years on probation .
20 Interpretation.-
If any question arises relating to the interpretation of these Rules , it shall be referred to Government whose decision thereon , shall be final .
21 Relaxation.-
Nothing in these Rules shall be construed to limit or abridge the power of the Governor to deal with the case of any person to whom these Rules apply in such manner as may appear to it to be just and suitable , provided that the case shall not be dealt within any manner less favourable to him than that provided in these Rules .
22 Repeal and Saving.-
All rules corresponding to these rules and in force immediately before their commencement are hereby repealed in respect of matters covered by these rules:
Provided that any order made or any action taken under the said rules so repealed shall be deemed to have been done or taken under the corresponding provisions of these rules .
