क्रमांक एफ ए 3-47 / 2017 / 1 /पांच (47 ) : मध्यप्रदेश माल और सेवा कर अधिनियम, 2017 क्रमांक ( 2017 का 19 ) की धारा 9 की उप धारा ( 3 ) के तहत प्रदत्त शक्तियों का प्रयोग करते हुए , राज्य सरकार , जीएसटी परिषद की सिफारिशों के आधार पर , एतदद्वारा , इस विभाग की अधिसूचना क्रमांक एफ ए- 3-47/ 2017/ 1 / पांच/ ( 59 ) दिनांक 07 दिसम्बर , 2018 , में और आगे भी निम्नलिखित संशोधन करती है , यथा : -
उक्त अधिसूचना में , सारणी में, -
1) क्रम संख्या 1 के समक्ष, कॉलम ( 2 ) में, -
(क) शब्द, अंक और प्रतीक " जिसने 6 प्रतिशत की दर से राज्य कर का का भुगतान नहीं किया है" को निरसित किया जाएगा ;
(ख ) परंतुक के बाद निम्नलिखित परंतुक को अंतः स्थापित किया जाएगा, यथाः- "बशर्ते और भी कि इस प्रविष्टि में निहित कोई भी बात वहां लागू नहीं होगी , जहां , - I. आपूर्तिकर्ता ने मध्यप्रदेश जीएसटी अधिनियम , 2017 के अंतर्गत पंजीकरण कराया हो और फॉरवर्ड चार्ज के तहत अपने द्वारा आपूर्त किए गए माल के

परिवहन के संबंध में जीटीए की सेवाओं पर कर का भुगतान करने के विकल्प का प्रयोग किया हो ,और
II . आपूर्तिकर्ता ने प्राप्तकर्ता को लागू दरों पर राज्य कर लगा कर इनवॉयस जारी किया हो , और अपने द्वारा जारी ऐसे इनवॉयस के बारे में अनुबंध III में यथानिर्धारित घोषणा की हो । " ,
2) क्रम संख्या 5 के समक्ष , कॉलम ( 2 ) में , उपवाक्यव ( 2 ) , मद ( i) को शब्द और प्रतीक " ( i ) डाक विभाग द्वारा उपलब्ध कराइ जाने वाली सेवाएं " से प्रति स्थापित किया जायेगा । "
3) क्रमांक 5क और उससे संबंधित प्रविष्टियों के पश्चात , निम्नलिखित क्रम संख्या और प्रविष्टियां को अंतःस्थापित किया जाएगा , यथा : -

किसी पंजीकृत व्यक्ति को आवासीय भवनों को किराए पर व्यक्ति देने के माध्यम से दी गई सेवा।
4 ) अनुलग्नक II के बाद , निम्नलिखित अनुलग्नक को अन्तः स्थापित किया जाएगा, यथाः-

मैंने / हमने मध्यप्रदेश जीएसटी अधिनियम , 2017 के तहत पंजीकरण करा लिया है और फॉरवर्ड चार्ज के तहत वित्तीय वर्ष के दौरान अपने द्वारा आपूर्ति किए गए माल के परिवहन के संबंध में जीटीए की सेवाओं पर कर के भुगतान के विकल्प का प्रयोग किया है। ".
2. यह अधिसूचना 18 जुलाई, 2022 से प्रवृत्त मानी जायेगी ।

क्र. एफ-ए-3-47-2017-1-पांच. भारत के संविधान के अनुच्छेद 348 के खण्ड (3 ) के अनुसरण में, इस आशय की अधिसूचना क्र. एफ-ए- 3-47-2017-1-पांच (47) , दिनांक 26 जुलाई 2022 का अंग्रेजी अनुवाद राज्यपाल के प्राधिकार से एतद्वारा प्रकाशित किया जाता है.

No. F A - 3-47 / 2017 / 1 /V ( 47) : In exercise of the powers conferred by sub - section (3 ) of section 9 of theMadhya Pradesh Goods and Services Tax Act , 2017 ( 19 of 2017 ) , the State Government , on the recommendations of the Council , hereby makes the following further amendments in this department notification No. F A- 3-47 / 2017 / 1 / V ( 59 ) dated the 30th June , 2017, namely: -
In the said notification , in the Table , -
(1 ) against serial number 1 , in column (2) , -
(a) the words , figures and symbols " who has not paid State tax at the rate of 6 % , " shall be omitted ;
(b) after the proviso the following proviso shall be inserted , namely : -
" Provided further that nothing contained in this entry shall apply where , - i. the supplier has taken registration under the MPGST Act , 2017 and exercised the option to pay tax on the services of GTA in relation to transport of goods supplied by him under forward charge ; and
ii. the supplier has issued a tax invoice to the recipient charging State Tax at the applicable rates and has made a declaration as prescribed in Annexure III on such invoice issued by him . " ;
(2) against serial number 5, in column (2) , in the sub - clause (2 ) , in item (i ) , the words " by way of speed post , express parcel post , life insurance , and agency services provided to a person other than Central Government , State Government or Union territory or local authority " shall be omitted;
(3) after serial number 5A and the entries relating thereto , the following serial number and entries shall be inserted , namely: -

Declaration
I/we have taken registration under the MPGST Act , 2017 and have exercised the option to pay tax on services of GTA in relation to transport of goods supplied by us during the Financial Year under forward charge ." .
2. This notification shall be deemed to have come into force with effect from 18th day of July, 2022
