क्र. - एफ 7-1-2019- बत्तीस - 3.- जल (प्रदूषण निवारण तथा नियंत्रण) अधिनियम , 1974 ( 1974 का 6) की धारा 64 की उप -धारा (2) के खण्ड (ड.) द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए , राज्य सरकार, एतद्वारा , मध्यप्रदेश प्रदूषण नियंत्रण बोर्ड (अध्यक्ष की अर्हताएं तथा सेवा के अन्य निबंधन तथा शर्तें) नियम, 2019 में निम्नलिखित और संशोधन करती है , अर्थात्:-
संशोधन
उक्त नियमों में,-
1. नियम 3 में,-
(एक) खण्ड (क) के स्थान पर, निम्नलिखित खण्ड स्थापित किया जाए , अर्थात्:-
"(क) किसी मान्यता प्राप्त विश्वविद्यालय या संस्थान से पर्यावरण विज्ञान / पर्यावरण अभियांत्रिकी / पर्यावरण नियोजन एवं प्रबंधन में स्नातकोत्तर उपाधि एवं विशेष रूप से औद्योगिक प्रदूषण का उपमशमन, दूषित जल शोधन, वायु प्रदूषण नियंत्रण एवं उपचार तथा परिसंकटमय अपशिष्ट, जैव-चिकित्सा अपशिष्ट, ठोस अपशिष्ट , प्लास्टिक अपशिष्ट में विशेषतः पर्यावरण संरक्षण से संबंधित पन्द्रह वर्षों का व्यवहारिक अनुभव रखता हो; ".
(दो) खण्ड (ख ) के स्थान पर , निम्नलिखित खण्ड स्थापित किया जाए , अर्थात्:-

"(ख) वह भारत सरकार या राज्य सरकार के नियंत्रण के अधीन भारत सरकार / राज्य सरकार / सार्वजनिक उपक्रम / सांविधिक निकाय के अधीन ऐसा अधिकारी हो, और,-
(एक) पैतृक संवर्ग अथवा विभाग में नियमित आधार पर सदृश पद धारण करता हो; अथवा पैतृक संवर्ग अथवा विभाग में वेतनमान ( रूपये 1,41,800-2,14,700) में नियमित आधार पर नियुक्ति के पश्चात् इस ग्रेड में तीन वर्ष की नियमित सेवा की हो; और ( दो) खंड ( क) में विनिर्दिष्ट अर्हताएं तथा अनुभव रखता हो . " . (तीन) खण्ड (ग) एवं इसके स्पष्टीकरण का लोप किया जाए .
2. नियम 6 एवं इसके स्पष्टीकरण के स्थान पर, निम्नलिखित नियम स्थापित किया जाए, अर्थात्:-
"6 . पद की अवधि. - अध्यक्ष , तीन वर्ष की कालावधि के लिए पद घारण करेगा तथा अधिकतम आयु 65 वर्ष के अध्यधीन रहते हुए कुल अधिकतम छह वर्ष की अधिक अवधि के साथ एक अतिरिक्त अवधि के लिए पुनः नामनिर्दिष्ट किया जा सकता है. ".

नियम 7 के स्थान पर, निम्नलिखित नियम स्थापित किया जाए , अर्थात्:-
"7 . भर्ती का तरीका. - अध्यक्ष , पर्यावरण विभाग द्वारा नियुक्त किए जाने वाले निम्नलिखित सदस्यों से मिलकर बनने वाली जांच सह- चयन समिति की अनुशंसा पर मध्यप्रदेश शासन द्वारा नियुक्त किया जाएगा, अर्थात्: -
-अध्यक्ष
(एक) मुख्य सचिव/ अपर मुख्य सचिव (मुख्य सचिव द्वारा नामनिर्दिष्ट किए जाएंगे)
-सदस्य
(दो) प्रमुख सचिव / औद्योगिक नीति एवं निवेश सवंर्धन/ खान एवं खनिज विभाग / नगरीय प्रशासन एवं विकास विभाग.
-सदस्य
(तीन) पर्यावरण विभाग द्वारा नामनिर्दिष्ट किए गए , पर्यावरण एवं प्रदूषण नियंत्रण के क्षेत्र में अनुभव रखने वाले दो विशेषज्ञ सदस्य.
-संयोजक. ".
(चार) प्रमुख सचिव , पर्यावरण विभाग
4. नियम 9 के स्थान पर, निम्नलिखित नियम स्थापित किया जाए , अर्थात्:-
"9. चयन प्रक्रिया.-
(1) पर्यावण विभाग , मध्यप्रदेश शासन, प्रमुख समाचार- पत्रों ( हिन्दी तथा अंग्रेजी) में पद का विज्ञापन करेगा तथा इसे राज्य शासन / प्रदूषण नियंत्रण बोर्ड की वेबसाइट पर 30 दिवस की आवेदन अवधि के साथ पोस्ट करेगा .
(2) प्रमुख सचिव , मध्यप्रदेश शासन, पर्यावरण विभाग, अध्यक्ष के पद के लिए प्राप्त आवेदनों की छटनी हेतु एक उप-समिति गठित करेगा तथा तत्पश्चात् उप- समिति अर्हित आवेदकों की सूची तैयार करेगा. सूची, जांच- सह-चयन समिति के समक्ष रखी जाएगी, जो साक्षात्कार के लिए पात्र आवेदकों की अल्प सूची तैयार करेगी. जांच -सह- चयन समिति शॉर्टलिस्टिंग के लिए पहले से मानदंड नियत करेगी.
(3) जांच- सह- चयन समिति साक्षात्कार के पश्चात् शासन को अधिकतम तीन आवेदकों के पैनल को अनुशंसित करेगी. शासन, जांच- सह- चयन समिति की अनुशंसा पर अध्यक्ष नामनिर्दिष्ट किया जाएगा. " .

No.F - 7-1-2019 - XXXII - 3.- In exercise of the powers conferred by clause ( e) of sub- section ( 2) of Section 64 of the Water (Prevention and Control of Pollution) Act, 1974 ( No. 6 of 1974) , the State Government, hereby makes the following further amendment in the Madhya Pradesh Pollution Control Board (Qualifications and other terms and conditions of service of chairman) Rules , 2019, namely : -
AMENDMENTS
Inthe said rules , -
1. In rule3,-
(i) For clause (a) , the follwing clause shall be substituted , namely : -
"(a) He possesses Master's Degree in environmental science/ environmental engineering/ envi ronmental planning and managment from a recognized university or institute and fifteen years practical experience relating to the environment protection specially in industrial pollution mitigation , waste water treatment , air pollution control and treatment and disposal ofhazardous waste , bio - medical waste , solid waste , e - waste and plastic waste . " .
(ii) For clause (b) , the following clause shall be substituted . namely: -
" (b) He is an officer under Government of India / State Governments/ public sector under takings / statutory bodies under the control of the Government of India or State Governments and-
(i) holds an analogous post on regular basis III in the parent cadre or department ; or has three years of regular service in the grade rendered after appointment, thereto , on regular basis in the pay scale (Rs 141,800-214,700) in the parent cadre or department ; and
(ii) possesses the qualifications and experience specified in clause (a) . " .
(Ⅲ) Clause (c) and its explanation , shall be omitted .
2. Forrule 6 and its explanation , the following rule shall be substituted, namely : -
"6. Tenure of Post.- The Chairman will hold the post for a period of three years and can be re -nominated for one more additional term with maximum tenure of six years in total subject to the maximum age of 65 years . " .
3. Forrule 7, the following rule shall be substituted , namely : -
"7. Mode of recruitment.- The Chairman shall be appointed by the Government of Madhya Pradesh on the recommendations of a search - cum -Selection Committee consisting ofthe following members to be appointed by the Environment Department , namely : - मध्यप्रदेश राजपत्र , दिनांक 1 अगस्त 2022

Chairman (i) Chief Secretary/Additional Chief- Secretary (to be nominated by Chief Secretary) .
- Member (ii) Principal Secretary, Department of Industrial Policy and Investment Promotion/Department of Mines and Minerals / Urban Administration and Development Department .
Member (iii) Two expert members having experience in the field of Environment and pollution control , to be nominated by the Environment Department .
Convener ." .
(iv) Principal Secretary, Environment Department.
4. For rule 9 , the following rule shall be substituted , namely
"9. Selection Process.-
(1) The Environment Department, Government of Madhya Pradesh , shall advertise the post in the leading newspapers (Hindi and English ) and post the same in the State Government/ Pollution Control Board website with application period of 30 days .
(2) The Principal Secretary, Environrment Department , Government of Madhya Pradesh, shall constitute a Sub - Committee for scrutinizing the applications received for the post of Chair man and thereafter the Sub - Committee shall prepare a list of qualified candidates . The list will be placed before the Search - Cum- Selection Committee , which will shortlist eligible candi dates for interviews . The Search- Cum - Selection Committee will fix the criteria for shortlisting in advance .
(3) After interview the Search- Cum- Selection Committee shall recommend a panel of maximum ofthree candidates to the Government . The Government shall nominate the Chairman on the recommendations of the Search - Cum- Selection Committee . " .
