कमांक एफ-2 (अ ) 45 / 2021 / बी-4 / दो,::- भारत के संविधान के अनुच्छेद -309 के परन्तुक द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुये, मध्यप्रदेश के राज्यपाल , एतदद्वारा मध्यप्रदेश नगर सेना (राजपत्रित) सेवा भरती नियम-1991 में निम्नलिखित संशोधन करते है, अर्थात: -

उक्त नियमों में, अनुसूची - चार में, कॉलम (2) में, अनुक्रमांक (3) के सामने कॉलम (7 ) में निम्नलिखित प्रविष्ट अंतःस्थापित की जाए , अर्थात:-
"नियम-13 (1 ) के अधीन गठित पदोन्नति हेतु समिति की बैठक न होने की दशा में अथवा पर्याप्त मात्रा में जिला सेनानी (डिस्ट्रिक्ट कमाण्डेंट) स्तर के अधिकारी उपलब्ध न होने पर जिला सेनानी (डिस्ट्रिक्ट कमाण्डेंट) का पद रिक्त होने के कारण विभाग की कार्यक्षमता पर पड़ने वाले विपरीत प्रभाव के निवारण हेतु महानिदेशक, 'होमगार्डस , शासन की पूर्व अनुमति से निम्नलिखित शर्तों के अधीन रहते हुए उपयुक्त कम्पनी कमाण्डर को आगामी आदेश तक कार्यवाहक जिला सेनानी (डिस्ट्रिक्ट कमाण्डेंट) के रूप में कार्य करने हेतु आदेशित कर सकेगें:-
(1) कार्यवाहक जिला सेनानी (डिस्ट्रिक्ट कमाण्डेंट) के रूप में पद पर कार्य करने वाले कम्पनी कमाण्डर पद पर वरिष्ठता या वेतन या भत्ते का दावा नही करेगा । जैसे ही जिला सेनानी (डिस्ट्रिक्ट कमाण्डेंट) के अधिकारी उपलब्ध होगें , उन्हें मूल पद पर वापिस कर दिया जाएगा ।

(2) कार्यवाहक जिला सेनानी (डिस्ट्रिक्ट कमाण्डेंट) जिला सेनानी पद श्रेणी की वर्दी धारण कर सकेगें ।
(3) कार्यवाहक जिला सेनानी (डिस्ट्रिक्ट कमाण्डेंट) जिला सेनानी पद की समस्त प्रशासनिक व वित्तीय शक्तियों का प्रयोग करेगें ।
(4) कार्यवाहक जिला सेनानी (डिस्ट्रिक्ट कमाण्डेंट) को कार्यवाहक पद का वेतनमान प्राप्त नही होगा अपितु पूर्व से स्वीकृत पद पर वेतनमान प्राप्त होगा । कार्यवाहक पदस्थापना प्राप्त होने वाले अधिकारी को स्वमेय पदोन्नति कार्यवाहक पद पर नही होगी ।
NO . F - 2 (A) 45/2021/B -4/II, :: - In exercise of the powers conferred by the proviso to Article 309 of the Constitution of India, the Governor of Madhya Pradesh , hereby , makes the following amendment to the Madhya Pradesh Nagar Sena (Gazetted) Service Recruitment Rules , 1991 , namely: -
AMENDMENTS
In the said rules , in Schedule - IV, in column (2 ) , against serial number (3 ) , in column (7) the following entry shall be inserted, namely: -
"In case of non conduct of the meeting of the committee for promotion , constituted under rule 13 (1 ) or non - availability of District Commandant level officers in sufficient number, for redressal of adverse effect on the efficiency of the departments due to vacancy of the post of district commandant, the Director General, Home Guards may, with the prior permission of the Government , order suitable Company Commander to work as officiating District Commandant till further orders under the following conditions : -
as Officiatting District Commandant shall not claim seniority or salary or allowances on the post . As soon as the officers of District Commandant rank become available , they will be returned to the original post. (1) The Company Commander serving on
(2) The officiating District Commandant will be able to wear the uniform of the rank of District Commandant .
(3) Officiating District Commandant shall exercise all administrative and financial powers of the post of District Commandant.
(4) Officiating District Commandant will not get the pay scale of the officiating post, but will get the pay scale of the post already approved. The officer getting the officiating posting will not be automatically promoted to the District Commandant post " .
