क्र. एफ 24-01-2022 - एक -10.- यतः, राज्य सरकार की यह राय है कि , की जाने वाली जांच की प्रकृति तथा मामले की अन्य परिस्थितियों को ध्यान में रखते हुए, जांच आयोग अधिनियम, 1952 ( 1952 का 60 ) की धारा 5 की उपधारा ( 2 ) , ( 4 ) तथा ( 5 ) के समस्त उपबन्ध इस विभाग की समसंख्यक अधिसूचना क्र. 24-01-2022- एक-10 , दिनांक 23 अगस्त, 2022 के अधीन नियुक्त आयोग को लागू होने चाहिए.
अतएव, उक्त धारा की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए, राज्य सरकार, एतद्वारा यह निर्देश देती है कि उक्त धारा की उपधारा ( 2 ) , ( 4 ) तथा ( 5 ) के समस्त उपबन्ध उक्त आयोग को लागू होंगे.
No. F. 24-01-2022 - I - 10.- WHEREAS , the State Government is of the opinion that , having regard to the nature of inquiry to be made and other circumstances of the case , all the provisions of sub - sections (2 ) , (4) and ( 5 ) of Section 5 of the Commission of Inquiry Act , 1952 (60 of 1952) should be made applicable to the Commission under this Department's Notification F 24-01-2022-1-10 , dated 23rd August , 2022.
NOW, THEREFORE , in exercise of the powers conferred by sub - section ( 1 ) of Section 5 of the said Act , the State Government , hereby, directs that all the provisions of sub - section ( 2) , (4 ) and (5 ) of Section 5 shall apply to the Commission .

क्र. एफ 24-01-2022- एक-10 .- यतः, दिनांक 09 अगस्त, 2022 की रात्रि में वन परिक्षेत्र , लटेरी ( दक्षिण ) ग्राम खटयापुरा, जिला विदिशा के क्षेत्र में वन अमले एवं अनुसूचित जनजाति के ग्रामीणजनों के बीच हुई मुठभेड़ की घटना में गोली लगने से एक व्यक्ति की मृत्यु हुई है तथा 04 अन्य व्यक्ति घायल हुए हैं .

2. और, यतः , राज्य सरकार की यह राय है कि सार्वजनिक महत्व के निम्नलिखित बिन्दुओं की जांच के प्रयोजन से जांच आयोग गठित किया जाना आवश्यक है:-
(1) वे परिस्थितियां जिसमें घटना हुई ?
(2) क्या वनकर्मियों द्वारा जो बल प्रयोग किया गया, वह घटना की परिस्थितियों को देखते हुए उपयुक्त था या नहीं ? यदि नहीं, तो इसके लिए दोषी व्यक्ति?
(3) भविष्य में इस प्रकार की घटनाओं की पुनरावृत्ति न हो , इस हेतु आवश्यक सुझाव;
(4) ऐसे अन्य विषय , जो जांच के अधीन मामले में आवश्यक या आनुषांगिक समझे जाएं.
3. अतएव , जांच आयोग अधिनियम, 1952 ( 1952 का 60 ) की धारा 3 द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए, राज्य सरकार , एतद्वारा , माननीय उच्च न्यायालय के सेवानिवृत्त न्यायमूर्ति श्री व्ही. पी . एस . चौहान की अध्यक्षता में एकल सदस्य जांच आयोग सार्वजनिक महत्व के उपर्युक्त विषयों की जांच करने हेतु नियुक्ति करती है.
4. जांच आयोग का मुख्यालय भोपाल होगा.
5. जांच आयोग , इस अधिसूचना के मध्यप्रदेश राजपत्र में प्रकाशन की तारीख से तीन माह के भीतर अपनी जांच पूरी करेगा और अपनी रिपोर्ट राज्य सरकार को प्रस्तुत करेगा.
No. F. 24-01-2022-1-10 .- WHEREAS , the encounter which took place between forest staff and the villagers belonging to scheduled tribes in Van Parikshatra ( South ) Village Khatyapura , District Vidisha in the night of 9th August , 2022. Causing death to one person and injury to four persons in the said incident .
2. AND , WHEREAS , the State Government is of the opinion that it is necessary to make a Commission for the purpose of inquiry into the following points of public importance:-
Under what circumstances the said incident took place ? (1)
Whether the force used by the forest personnel was appropriate in view of the circumstances of the incident or not ? If not , who is to blame for this ? (2)
(3) Necessary suggestions for such incidents not to be repeated in future ;
(4) Such other matters as may by necessary or incidental to the case under inquiry.
3. NOW , THEREFORE , in exercise of the powers conferred by Section 3 of the Commission of Inquiry Act , 1952 (60 of 1952 ) , the State Government , hereby , appoints a Single Member Inquiry Commission headed by Shri V. P. S. Chauhan to investigate the said incident .
4. The headquarters of the Commission of Inquiry will be Bhopal .
5. The Commission of Inquiry shall complete its inquiry within three months from the date of publication of this notification in the Madhya Pradesh Gazette and submit its report to the State Government .
