क्रमांक.- एफ- 19-5-2015- बारह-1-पार्ट. खान एवं खनिज ( विकास तथा विनियमन) अधिनियम , 1957 ( 1957 का 67) की धारा 9 बी की उपधारा ( 1 ) , (2) एवं (3 ) द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए , राज्य सरकार , एतद्वारा मध्यप्रदेश जिला खनिज प्रतिष्ठान नियम , 2016 में निम्नलिखित संशोधन करती है , अर्थात्: -
:: संशोधन::
उक्त नियमों में ,
1. नियम 2 में , उप- नियम ( 1 ) में , खण्ड (छ) का लोप किया जाए।
2. नियम 5 में , उपनियम ( 1 ) में ,
(1) खण्ड ( एक) के स्थान पर, निम्नलिखित खण्ड स्थापित किया जाए , अर्थात्ः-
" (एक) जिले का कलक्टर, जो इसका अध्यक्ष होगा । " ।
(2) खण्ड (दो) का लोप किया जाए ।
(3) खण्ड ( पांच) के स्थान पर , निम्नलिखित खण्ड स्थापित किया जाए , अर्थात्ः-
" (पांच) लोक सभा का सदस्य, मध्यप्रदेश विधान सभा का सदस्य, राज्य सभा का सदस्य ।

राज्य सभा का सदस्य किसी एक जिले में मण्डल के सदस्य के रूप में सम्मिलित किया जाएगा। उनके द्वारा चयनित जिले की सूचना प्रमुख सचिव, खनिज साधन विभाग को दी जाएगी जिसे संबंधित जिले के कलक्टर को अवगत कराया जाएगा ।
परन्तु यह कि यदि किसी जिले का भाग एक से अधिक संसदीय क्षेत्र में आता हो तो उन संसदीय क्षेत्र के लोक सभा सदस्य मण्डल के सदस्य होंगे । " ।
3. नियम 5 में , उप-नियम (5) का लोप किया जाए।
4. नियम 7 में , उप-नियम (2) में , खण्ड (च) का लोप किया जाए।
5. नियम 12 में , उप-नियम ( 1 ) में , खण्ड (चार) के पश्चात्, निम्नलिखित खण्ड स्थापित किया जाए , अर्थात्: -
" ( पांच) राज्य का समस्त भू- भाग खनन प्रभावित क्षेत्र मान्य होगा। " ।
6. नियम 13 में , उप- नियम (2) में , खण्ड (ड. ) के स्थान पर, निम्नलिखित खण्ड स्थापित किया जाए , अर्थात्ः-
" (ड. ) (एक) किसी भी जिला खनिज प्रतिष्ठान में वार्षिक रूप से प्राप्त रकम निम्नलिखित दो भागों में संधारित की जाएगी । भाग-क की रकम का उपयोग संबंधित जिले के कार्यों के लिए किया जाएगा। भाग-ख की रकम का उपयोग खनन से प्रभावित अन्य जिलों में भी किया जा सकेगा ।

दो) किसी भी जिला खनिज प्रतिष्ठान में भाग-क की अधिकतम रकम 50 करोड़ होगी , इससे अधिक रकम होने की दशा में भाग - ख की रकम के रूप में शामिल की जाएगी ।

(तीन) जिला खनिज प्रतिष्ठान अंतर्गत जमा की गई संपूर्ण रकम जिलों में बैंक खातों में ही रखी जाएगी एवं इन नियमों के अंतर्गत व्यय की जाकर लेखाओं का संधारण किया जाएगा। जिला खनिज प्रतिष्ठान की प्राप्ति एवं व्यय को केवल लेखांकन की दृष्टि से दर्शाने हेतु खनिज संसाधन विभाग के अन्तर्गत सुसंगत योजनाओं एवं लेखा शीर्ष में प्रावधान रखा जाकर राज्य की संचित निधि में अंतरण प्रविष्टी, सुसंगत लेखा शीर्ष में प्राप्तियों में दर्शायी जाएगी ।
उदाहरण: - यदि किसी जिला खनिज प्रतिष्ठान को किसी वित्तीय वर्ष में कुल प्राप्तियां 200 करोड़ रुपये हैं तब उस रकम का संधारण निम्नानुसार होगा: -

7. नियम 14 के स्थान पर , निम्नलिखित नियम स्थापित किया जाए , अर्थात्-
" 14. जिला खनिज प्रतिष्ठान की निधि का उपयोग (1 ) संबंधित जिले के जिला खनिज प्रतिष्ठान द्वारा नियम 13(2) (ड. ) में विनिर्दिष्ट किए गए अनुसार विनिर्दिष्ट रकम के भाग-क का उपयोग निम्नानुसार किया जाएगा : -

क) (एक) जिला स्तर पर कार्यों के प्रस्ताव / परियोजना जिला खनिज प्रतिष्ठान द्वारा तैयार किए जाएंगे।

(दो) जिला खनिज प्रतिष्ठान द्वारा तैयार प्रस्ताव , राज्य सरकार द्वारा विनिर्दिष्ट पोर्टल पर संबंधित विभाग को भेजे जाएंगे। राज्य स्तर के संबंधित विभाग द्वारा प्राप्त प्रस्ताव का परीक्षण , जिले की प्राथमिकता , विभाग के अंतर्गत चल रहे कार्यों के साथ अभिसरण तथा कार्यों का दोहराव तो नहीं है, के आधार पर किया जाएगा ।
(तीन) संचालक (प्रशासन एवं खनिकर्म) संबंधित विभाग की रिपोर्ट के आधार पर, विभागवार रकम का आवंटन कर कार्य योजना तैयार करेगा ।
(ख ) विभागवार रकम के आवंटन से संबंधित कार्य योजना का अनुमोदन प्रशासकीय विभाग द्वारा दिया जाएगा ।
(ग ) विभागवार कोष के आवंटन के लिए कार्य योजना की जानकारी पैरा (क) में यथा उल्लिखित विनिर्दिष्ट पोर्टल को प्रेषित की जाएगी ।
(घ) एक करोड़ से कम की परियोजना के लिए प्रशासकीय स्वीकृति संबंधित जिला खनिज प्रतिष्ठान द्वारा दिया जाएगा। एक करोड़ से अधिक के मूल्य की परियोजना / कार्यों के संबंध में जिला खनिज प्रतिष्ठान द्वारा प्रकरण , संबंधित विभाग को प्रेषित किया जाएगा। संबंधित प्रशासकीय विभाग , वित्त विभाग के लागू निर्देशों के अनुसार , आवश्यक स्वीकृतियां प्राप्त कर जिला खनिज प्रतिष्ठान को कार्य स्वीकृत करने की अनुमति प्रदान करेगा ।
(ड. ) जिला खनिज प्रतिष्ठान पैरा ( घ) के अनुसार समस्त अनुमतियां / परियोजना रिपोर्ट / तकनीकी स्वीकृति आदि प्राप्त कर प्रशासकीय स्वीकृति का आदेश जारी करेगा ।
(2) नियम 13 (2) (ड. ) में यथा विनिर्दिष्ट भाग- ख की रकम के उपयोग की प्रक्रिया निम्नानुसार होगी: -
(क) जिला स्तर पर कार्यों के प्रस्ताव । परियोजना जिला खनिज प्रतिष्ठान द्वारा तैयार की जाएगी ।

(ख ) राज्य शासन द्वारा तैयार किए गए विनिर्दिष्ट पोर्टल में प्रस्ताव/परियोजना की प्रविष्टी की जाएगी तथा जिसे राज्य स्तर के संबंधित विभाग द्वारा प्राप्त की जाएगी । राज्य स्तर के संबंधित विभाग द्वारा इस प्रकार प्राप्त प्रस्ताव के लिए जिले की प्राथमिकता , विभाग के अंतर्गत चल रहे कार्यों के साथ अभिसरण तथा कार्यों का दोहराव के आधार पर टीप उपलब्ध कराएंगे ।
(ग) विभाग प्रमुख द्वारा विनिर्दिष्ट पोर्टल में प्राप्त परीक्षण टीप को निम्नलिखित समिति के समक्ष खनिज साधन विभाग द्वारा प्रस्तुत किया जाएगा: -

टीप- उपरोक्त समिति जिला खनिज प्रतिष्ठान के भाग-क के अंतर्गत किये जाने वाले कार्यों के लिए भी सलाह दे सकेगी ।
(घ ) समिति , प्रस्ताव/परियोजना के लिए सलाह देगी , जो उसके द्वारा स्वीकृत की जा सकती है और संबंधित जिले के कलक्टर द्वारा किस अभिकरण द्वारा कार्यान्वित किया जाना है ।
(ड. ) एक करोड़ से कम की परियोजना की प्रशासकीय स्वीकृति संबंधित जिला खनिज प्रतिष्ठान द्वारा दी जाएगी। यदि कार्य / परियोजना की लागत एक करोड़ से अधिक है तो मामला जिला खनिज प्रतिष्ठान द्वारा संबंधित विभाग को प्रेषित किया जाएगा । संबंधित प्रशासकीय विभाग , वित्त विभाग के लागू निर्देशों के अनुसार , आवश्यक स्वीकृतियां प्राप्त कर जिला खनिज प्रतिष्ठान को कार्य की स्वीकृति के लिए अनुमति प्रदान करेगा ।

( च) जिला खनिज प्रतिष्ठान द्वारा कार्य स्वीकृति आदेश जारी किया जाएगा । परियोजना लागत अनुसार 30 , 30 , 30 तथा 10 प्रतिशत के आधार पर चार किश्तों में रकम जारी की जाएगी ।
(छ) यदि किसी परियोजना की लागत एक जिले के जिला खनिज प्रतिष्ठान से पूरी नहीं होती है, तो राज्य शासन जिला खनिज प्रतिष्ठान को प्रशासकीय /वित्तीय स्वीकृति की रकम जारी करने के लिये अन्य जिला खनिज प्रतिष्ठान को निर्देश जारी कर सकेगी ।
(ज) भाग - ख से प्राप्त रकम के उपयोग के संबंध में संबंधित जिला खनिज प्रतिष्ठान अथवा विभाग अथवा उपक्रम द्वारा पृथक लेखा संधारित किया जाएगा ।
(झ) उपयोग की गई रकम, किए गए कार्य की संबंधित जानकारी एवं जिला खनिज प्रतिष्ठान द्वारा चाही गई अन्य जानकारी , विभाग अथवा उपक्रम के कार्यान्वित अभिकरण द्वारा विनिर्दिष्ट पोर्टल में प्रस्तुत की जाएगी।
(ञ) जिला खनिज प्रतिष्ठान के भाग-क अथवा भाग - ख में भेजे गए प्रस्ताव, भारत सरकार द्वारा जारी गाईडलाईन एवं राज्य सरकार द्वारा बनाए गए नियमों के अनुसार हैं , यह जिला खनिज प्रतिष्ठान का कर्तव्य होगा ।
( 3) भाग-ख की राशि का उपयोग नियम 13 में विनिर्दिष्ट कार्यों के लिए किया जाएगा ।
(4 ) इस अधिसूचना के पूर्व , राज्य खनिज निधि में जमा रकम भाग -ख की रकम के अनुसार उपयोग किया जाएगा।

No. - F - 19-5-2015 -XII - 1 - Part.- In exercise of powers conferred by sub - sections (1) , (2) and (3) of Section 9B of the Mines and Minerals ( Development and Regulation ) Act, 1957 (67 of 1957) , the State Government , hereby , makes the following amendments in the Madhya Pradesh District Mineral Foundation Rules , 2016 , namely: -
:: Amendments ::
In said rules ,
1. In rule 2 , in sub - rule ( 1 ) , clause (g) shall be omitted .
2 . In rule 5 , in sub - rule ( 1 ) , -
(1) for clause ( i ) , the following clause shall be substituted , namely : -
" (i) The Collector of the district , who shall be the chairperson . " ,
clause ( ii) shall be omitted . (2)
(3) for clause (v) , the following clause shall be substituted , namely: -
" (v) The Member of Lok Sabha , Member of Madhya Pradesh Legislative assembly , Member of Rajya Sabha .
Member of Rajya Sabha shall be included as member in board of any one district . The information regarding selection of the district shall be given by him to Principal Secretary , Mineral Resources Department . Which shall be informed to Collector of concerned district :
Provided that if part of any district falls in more than one parliamentary constituency than the member of Lok Sabha of those constituencies shall be the member of board .
3. In rule 5 , sub - rule (5) shall be omitted .
4. In rule 7 , in sub - rule (2) , clause ( f) shall be omitted .
5. In rule 12 , in sub - rule ( 1) , after clause ( iv) , the following clause shall be inserted , namely : -
"(v) Entire area of the State shall be accepted as mining effected area . " .

" (e) ( i) The amount received annually in any District Mineral Foundation shall be maintained in two parts as follows . The amount of part - A shall be utilized for the works of concerned district . The amount of part - B may also be utilized in other mining effected districts .

(ii) The maximum amount of Part-A in any District Mineral Foundation shall be 50 crore , and in case of the amount more than , it that shall be included in the amount of Part - B .
(iii) The entire amount deposited under the District Mineral Foundation shall be kept in the bank accounts in the districts only and the accounts shall be maintained by spending under these rules . In order to show the receipt and expenditure of District Mineral Foundation only from the accounting point of view , the transfer entry to the Consolidated Fund of the State by keeping the provision in the relevant plans and head of account under the Mineral Resources Department , shall be shown in the receipts in the relevant account head .

7. For Rule 14 , the following rule shall be substituted , namely-
" 14. Utilization of fund of District Mineral Foundation- ( 1 ) Process of utilization of amount of part - A as specified in Rule 13 (2) ( e ) , by the District Mineral Foundation of concerned district , shall be as follows: -
(a) ( i ) Proposal / Project of works shall be prepared by the District Mineral Foundation at district level .
( ii) The proposals prepared by the District Mineral Foundation shall be sent to the concerning department on the portal specified by the State Government . The examination of the proposals received by the concerned department at State level shall be made available the comments on the basis of priority of district , convergence with ongoing works of department and non - repeation of works .
( iii) The Director (Administration and Mining) on the basis of report of concerning department , shall prepare a work plan by allocating the amount department wise .
(b) The approval of work plan related to department wise allocation of amount , shall be given by administrative department .
(c) The information of work plan for department wise allocation of fund , shall be send to the specified portal as mentioned in para (a) .
(d) The administrative sanctions for the projects of less than one crore shall be given by concerned District Mineral Foundation . In respect of the project/ works having value of more than one crore , the District Mineral Foundation shall send such case to the concerned Department. The concerning administrative Department after obtaining required sanctions as per the applicable directions of the Finance Department accord the permission of work to concerned District Mineral Foundation .
(e) The District Mineral Foundation shall issue the order of administrative approval by getting all permissions / project report/ technical sanction etc. according to the para (d) .

(2) Process of utilization of amount of part - B as specified in Rule 13 ( 2 ) ( e) shall be as follows: -
(a) Proposal / Project of works shall be prepared by District Mineral Foundation at district level .
(b) Entry of proposal / project shall be made in the specified portal prepared by the State Government and shall be received by the concerning department of state level . The concerning department of state level shall make available the comments on the basis of priority of district , convergence with ongoing works of department and non - repeation of works , for proposal so received .
(c) The examination comments received in specified portal by the of head of the department shall be submitted by the Mineral Resources Department before the following committee-
Chairmen (i) Chief Minister , Government of Madhya
Pradesh
Member ( ii) Minister , Mineral Resources Department
Member ( iii ) Chief Secretary , Government of Madhya Pradesh
Member (iv) Principal Secretary , Finance Department
(v) Principal Secretary , Mineral Resources Department

Note : - The above committee may also advise for the work to be carried out from Part -A of District Mineral Foundation .
(d) The committee shall advise for the proposal / project which may be sanctioned by him and by whom agency it is to be implemented to the Collector of concerned district .
(e) The administrative sanctions for the projects below the one crore shall be given by concerning District Mineral Foundation . If the value of the work/ project is more than one crore , then the case shall be sent to the concerning department by the District Mineral Foundation . The concerning administrative department shall give the permission for sanction of the work to the District Mineral Foundation by obtaining required sanctions according to the prevailing instructions of Finance Department .
(f) Sanction order of the work shall be issued by District Mineral Foundation . According to the cost of project the amount shall be issued in four installments on the basis of 30% , 30 % , 30% and 10 % .

(g) If the cost of any project is not fulfilled by District Mineral Foundation of one district , the State Government may issue instructions to the other District Mineral Foundation to issue the amount to the administrative / financial sanction to District Mineral Foundation ,.
(h) Separate account shall be maintained by the concerned District Mineral Foundation or Department or Undertaking in respect of utilization of amount received from part- B .
(i) The information regarding utilized amount , carried out work and any other information required by District Mineral Foundation shall be submitted in specified portal by implementing agency of the Department or Undertaking.
(j ) It shall be the duty of the District Mineral Foundation that the proposals sent by the District Mineral Foundation for Part -A and Part - B are in accordance to the guideline issued by Government of India and the Rules framed by State Government .
(3) Utilization of amount of part - B shall be made for the works specified in Rule 13 .
(4) Prior to this notification , the amount deposited in State Mineral Funds shall be utilized according to the amount of part - B.
