THE MADHYA PRADESH VYAVSAYIK PARIKSHA MANDAL ( SANSHODHAN ) VIDHEYAK , 2022
A Bill to amend the Madhya Pradesh Vyavsayik Pariksha Mandal Adhiniyam , 2007 .
Be it enacted by the Madhya Pradesh Legislature in the seventy - third year of the Republic of India as follows :-
Short title and commencement .
1. ( 1 ) This Act maybe called the Madhya Pradesh Vyavsayik Pariksha Mandal ( Sanshodhan ) Adhiniyam , 2022 .
(2) It shall come into force from the date of its publication in the Madhya Pradesh Gazette .
Amendment of citation and Section 1 .
2. In the citation and sub - section ( 1 ) of Section 1 of the Madhya Pradesh Vyavsayik Pariksha Mandal Adhiniyam , 2007 ( No. 24 of 2007 ) ( hereinafter referred to as the principal Act) , for the words "Vyavsayik Pariksha Mandal " , the words "Employees Selection Board " shall be substituted .
3. Throughout the principal Act , for the words " Professional Examination Board " , wherever they occur , the words "Employees Selection Board " shall be substituted .
Amendment of certain words throughout the principal Act.
4. In Section 4 of the principal Act , in sub -section ( 1 ) ,-
Amendment of Section 4.
(i) clause ( a) shall be renumbered as clause ( aa) and before clause ( aa ) as so renumbered , the following clause shall be inserted , namely:-
"( a) Additional Chief Secretary or Principal Secretary or Secretary, Government of Madhya Pradesh , General Administration Department; " ;
(ii) in clause ( aa) , for the words "Technical Education and Training Department " , the words "Technical Education , Skill Development and Employment " shall be substituted;
(iii) in clauses ( aa) to ( f) , before the words "Principal Secretary " , the words "Additional Chief Secretary or " shall be inserted .
5. In Section 19 of the principal Act , in sub - section ( 1 ) ,-
Amendment of Section 19 .
(i) clause (b) shall be renumbered as clause ( ba ) and before clause ( ba ) as so renumbered, the following clause shall be inserted, namely:-
"(b) Additional Chief Secretary or Principal Secretary or Secretary , Government of Madhya Pradesh , General Administration Department; " ;
(ii) in clause (ba) , for the words "Technical Education and Training Department " , the words " Technical Education , Skill Development and Employment " shall be substituted;

(iii) in clauses (ba) to ( d ) , before the words " Principal Secretary " , the words "Additional Chief Secretary or " shall be inserted.
6. For Section 25 of the principal Act , the following section shall be substituted, namely:-
Substitution of Section 25 .
"25. As from the date of commencement of the Madhya Pradesh Vyavsayik Pariksha Mandal ( Sanshodhan ) Adhiniyam , 2022 under sub- section ( 2) of Section 1 , the following consequences shall ensue , namely:-
Consequences to ensue on cominencement of Amendment Act.
(a) the Madhya Pradesh Professional Examination Board, existing immediately before the date aforesaid , shall be merged in the Madhya Pradesh Employees Selection Board;
(b) all assets and liabilities of the existing Madhya Pradesh Professional Examination Board of the State Government shall vest in the Madhya Pradesh Employees Selection Board;
(c) all the employees belonging to or under the control of the existing the Madhya Pradesh Professional Examination Board shall be deemed to be the employees of the Madhya Pradesh Employees Selection Board established under Section 3 :
Provided that the terms and conditions of service of such employees shall not be modified in such a manner that it is less favorable to them;
(d) all the records and papers of the existing the Madhya Pradesh Professional Examination Board shall vest in the Madhya Pradesh Employees Selection Board;
(e) any action or process in motion under the existing the Madhya Pradesh Professional Examination Board shall vest in the Madhya Pradesh Employees Selection Board ." .
STATEMENT OF OBJECTS AND REASONS
The Madhya Pradesh Professional Examination Board was constituted to conduct entrance examinations for technical courses , mainly medical and engineering courses . With efflux of time the entrance processes for these courses changes . Currently , Professional Examination Board conducts competitive exams for vacancies in various Government departments and organizations . Considering the changes in the activities and work of the Board the name of the Board is proposed to be changed to "Employees Selection Board".
2. Since the administrative control of the Professional Examination Board has been handed over to General Administrative Department , the ex- officio members of the Board have to be from General Administrative Department also as well as from Technical Education , Skill Development and Employment. In continuation of this , the Additional Chief Secretary must be added to the ex - officio members , other than the Principal Secretary or Secretary of the concerned department also . Therefore , suitable amendments are proposed in the Madhya Pradesh Vyavsayik Pariksha Mandal Adhiniyam , 2007 ( No. 24 of 2007) .
