THE MADHYA PRADESH KASHTHA CHIRAN ( VINIYAMAN ) SANSHODHAN VIDHEYAK , 2022
A Bill further to amend the Madhya Pradesh Kashtha Chiran ( Viniyaman ) Adhiniyam, 1984 .
Be it enacted by the Madhya Pradesh Legislature in the seventy- third year of the Republic of India as follows :-
Short title .
1. This Act may be called the Madhya Pradesh Kashtha Chiran ( Viniyaman ) Sanshodhan Adhiniyam , 2022 .
Amendment of Section 13 .
2. In section 13 of the Madhya Pradesh Kashtha Chiran (Viniyaman ) Adhiniyam , 1984 (No. 13 of 1984) , in sub- section (2) , for the words " he shall be punishable with imprisonment for a term which may extend to six months or with fine which may extend to six thousand rupees , or with both" , the words " he shall be punishable with penalty of ten thousand rupees in case of first offence and twenty thousand rupees in case of second or subsequent offence " shall be substituted .
STATEMENT OF OBJECTS AND REASONS
Ease of doing business is an important factor that helps in the faster economic growth of the nation and state . In view of this , acts involving financial losses only should be decriminalized. Therefore , it is being proposed to amend Section 13 (2) of the Madhya Pradesh Kashtha Chiran ( Viniyaman ) Adhiniyam , 1984 (No. 13 of 1984) suitably so that punishment of imprisonment is removed and only punishment of penalty is proposed in case a person do not keep or provide books accounts , records , declarations , returns or any other document as required by the Act.
