फा. क्र. 10 - क- चार-निरर्हित- 2022-207 .- भारत निर्वाचन आयोग के आदेश क्र. 76 - MP- PC- 2019 - WS - I - 20273 , दिनांक 08 सितम्बर 2022 जिसके द्वारा आयोग ने लोक प्रतिनिधित्व अधिनियम , 1951 की धारा 10क के तहत् लोकसभा सामान्य निर्वाचन 2019 में 08 - खजुराहो लोकसभा निर्वाचन क्षेत्र जिला पन्ना से निर्वाचन लड़ने वाली अभ्यर्थी श्रीमती मीना/ललित रायकवार- निर्दलीय जो कि अपने निर्वाचन का कोई भी व्यय लेखा समय से दाखिल न करने के कारण " संसद के किसी भी सदन या संघ राज्य क्षेत्र की विधान सभा अथवा विधान परिषद् के लिए सदस्य चुने जाने या होने के लिए " उक्त आदेश की तारीख से तीन वर्ष तक के लिए निरर्हित घोषित किया है को सर्व साधारण की जानकारी के लिए प्रकाशित किया जाता है .

सं. 76- म.प्र. -लो.स. - 2019 - पश्चिम 1.- यतः , भारत निर्वाचन आयोग द्वारा मध्यप्रदेश राज्य की लोक सभा के साधारण निर्वाचन , 2019 की घोषणा प्रेस नोट संख्या ईसीआई/प्रे. नो./23-2019 , दिनांक 10-03-2019 के जरिए की गई थी. कार्यक्रम के अनुसार, मतगणना की तारीख 23-05-2019 थी.
और, यतः , लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार , निर्वाचन लड़ने वाले प्रत्येक अभ्यर्थी को, निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर निर्वाचन व्यय के अपने लेखे की सही प्रति जिला निर्वाचन अधिकारी को दाखिल करनी होती है ;

और, यतः , संबंधित रिटर्निंग अधिकारी 08 - खजुराहो लोक सभा निर्वाचन क्षेत्र के परिणाम 23-05-2019 को घोषित किए गए थे. इस प्रकार, निर्वाचन व्यय के लेखा दाखिल करने की अंतिम तारीख 22-06-2019 थी.
और, यतः , मुख्य निर्वाचन अधिकारी , मध्यप्रदेश के दिनांक 03-07-2019 के पत्र सं. 10-क-लो.स. 2019- चार-निर्वा.व्यय-खजुराहो- 13851 द्वारा अग्रेषित जिला निर्वाचन अधिकारी , पन्ना जिला, मध्यप्रदेश द्वारा दिनांक 29-06-2019 को प्रस्तुत रिपोर्ट के अनुसार श्रीमती मीना/ललित रायकवार, मध्यप्रदेश के 08 - खजुराहो लोक सभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाली निर्दलीय अभ्यर्थी, अपने निर्वाचन व्यय का कोई भी लेखा दाखिल करने में असफल रहीं.
और, यतः , जिला निर्वाचन अधिकारी , पन्ना जिला , मध्यप्रदेश की रिपोर्ट के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम , 1961 के नियम 89 के उपनियम ( 5 ) के अंतर्गत निर्वाचन व्यय प्रस्तुत नहीं करने के लिए श्रीमती मीना/ललित रायकवार, को कारण बताओ नोटिस दिनांक 11-09-2019 को जारी किया गया था;
और, यतः, निर्वाचनों का संचालन नियम , 1961 के नियम 89 के उप- नियम ( 6 ) के अनुसार, दिनांक 11-09-2019 के उपर्युक्त कारण बताओ नोटिस के जरिए श्रीमती मीना/ललित रायकवार को निदेश दिया गया था कि वे इस नोटिस के प्राप्त होने के 20 दिनों के अंदर आयोग में लेखे न प्रस्तुत कर पाने के कारणों को स्पष्ट करते हुए लिखित रूप में अपना अभ्यावेदन प्रस्तुत करें और साथ ही, पूर्ण निर्वाचन व्यय का लेखा संबंधित जिला निर्वाचन अधिकारी को प्रस्तुत करें;
और, यतः , उक्त नोटिस उनके द्वारा दिनांक 21-09-2019 को प्राप्त किया गया था. अभ्यर्थी से प्राप्त पावती रसीद जिला निर्वाचन अधिकारी , पन्ना द्वारा दिनांक 30-09-2019 के पत्र संख्या 3783-निर्वाचन-व्यय-लेखा-2019 द्वारा आयोग को प्रस्तुत कर दी गई थी;
और, यतः , जिला निर्वाचन अधिकारी , पन्ना द्वारा अपने दिनांक 26-07-2022 के पत्र सं. 632/निर्वाचन/ 2022 के तहत प्रस्तुत की गई अनुपूरक रिपोर्ट में यह बताया गया है कि श्रीमती मीना/ललित रायकवार ने आज की तारीख तक अपने निर्वाचन व्यय के सही लेखे का विवरण प्रस्तुत नहीं किया है;
और, यतः , आयोग का यह समाधान हो गया है कि श्रीमती मीना/ललित रायकवार निर्वाचन व्यय का लेखा विधि द्वारा अपेक्षित रीति में दाखिल करने में असफल रहीं हैं ;
और, यतः , लोक प्रतिनिधित्व अधिनियम , 1951 की धारा 10क में अनुबंधित किया गया है कि:-
" यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति-
(क) निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है, दाखिल करने में असफल रहा है ; तथा
(ख) उस असफलता के लिए कोई अच्छा कारण या न्यायोचित्य नहीं रखता है, तो निर्वाचन आयोग शासकीय राजपत्र में प्रकाशित आदेश द्वारा उसको निरर्हित घोषित करेगा और ऐसा व्यक्ति उस आदेश की तारीख से तीन वर्ष की कालावधि के लिए निरर्हित होगा;
अतः , अब लोक प्रतिनिधित्व अधिनियम , 1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग एतद्वारा , मध्यप्रदेश राज्य की लोक सभा के साधारण निर्वाचन , 2019 के 08 - खजुराहो लोक सभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाली निर्दलीय अभ्यर्थी श्रीमती मीना/ ललित रायकवार, निवासी 48 , शांति नगर , हुजूर , आर एस नगर, भोपाल ( म. प्र. ) 462016 को संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य क्षेत्र की विधान सभा अथवा विधान परिषद् के लिए सदस्य चुने जाने अथवा होने के लिए इस आदेश की तारीख से तीन वर्ष की अवधि के लिए निरर्हित घोषित करता है.

ORDER
No. 76 - MP - PC - 2019 - WS - I . WHEREAS , the General Election to Lok Sabha from Madhya Pradesh , 2019 was announced by Election Commission of India vide Press Note No. ECI/PN /23 /2019 dated 10-03-2019 . As per the schedule , the Date of Counting of votes was 23-05-2019 .
AND, WHEREAS , as per Section 78 of the Representation of the People Act , 1951 , every contesting candidate has to lodge a true copy of his account of election expenses within 30 days with the District Election Officer , from the date of election of returned candidate ;
AND, WHEREAS , the result of 08 - Khajuraho Parliamentry Constituency was declared by the Returning Officer concerned on 23-05-2019 . As such the last date for lodging of account of election expenses was 22-06-2019 .
AND , WHEREAS , as per the report dated 29-06-2019 submitted by the District Election Officer , Panna District , Madhya Pradesh and forwarded by Chief Electoral Officer , Madhya Pradesh vide letter No. 10-क/लो.स. 2019 / चार/निर्वा.व्यय /खजुराहो/ 13851 , dated 03-07-2019 , Smt. Meena/Lalit Raikwar , Independent contesting candidate from 08 - Khajuraho Parliamentry Constituency of Madhya Pradesh , failed to lodge any account of her election expenses.
AND, WHEREAS , on the basis of the report of the District Election Officer, Panna District , Madhya Pradesh , a Show Cause Notice dated 11-09-2019 was issued by the Election Commission of India under Sub Rule (5) of Rule 89 of the Conduct of Elections Rules , 1961 to Smt . Meena/ Lalit Raikwar for non submission of accounts of Election expenses ;
AND , WHEREAS , as per Sub Rule ( 6 ) of Rule 89 of the Conduct of Elections Rules , 1961 , through the above said Show Cause Notice dated 11-09-2019 , Smt. Meena/Lalit Raikwar was directed to submit her representation in writing to the Commission explaining the reason for non submission of accounts and also to lodge her complete accounts of election expenses to the District Election Officer concerned within 20 days from the date of receipt of the notice;
AND, WHEREAS , the said notice was received by her on 21-09-2019 . Acknowledgment receipt obtained from the candidate have been submitted to the Commission by District Election Officer , Panna vide his letter No. 3783 निर्वाचन/व्यय-लेखा/ 2019 , dated 30-09-2019 .
AND, WHEREAS , in the supplementary report submitted by District Election Officer , Panna vide his letter No. 632/निर्वाचन/2022 dated 26-07-2022 it has been stated that Smt. Meena/Lalit Raikwar, has not submitted correct account of her election expenses , as manner required by law till date .
AND, WHEREAS , Commission is satisfied that Smt . Meena/Lalit Raikwar, has failed to lodge an account of election expenses as manner required by law;
AND, WHEREAS , Section 10A of the Representation of the People Act , 1951 stipulates that :-
" If the Election Commission is satisfied that a person-
(a) has failed to lodge an account of election expenses within the time and in the manner required by law or under this Act ; and
(b) has no good reason or justification for the failure, the Election Commission shall by order published in the Official Gazette , declare him to be disqualified and any such person shall be disqualified for a period of three years from the date of the order ;

NOW THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951 , the Election Commission of India hereby declares Smt . Meena/ Lalit Raikwar, resident of 48 , Shanti Nagar, Huzur , RS Nagar / Bhopal (M. P. ) 462016, Independent contesting candidate for the General Election to Lok Sabha from Madhya Pradesh , 2019 from 08- Khajuraho Parliamentary Constituency, to be disqualified for being chosen as and for being a member of either House of Parliament or the Legislative Assembly or Legislative Council of a State or Union Territory for a period of three years from the date of this order.
