क्र. 1963-819775-2022 - ए- सोलह - मध्यप्रदेश कारखाना नियम, 1962 में संशोधन का निम्नलिखित प्रारूप , जिसे राज्य सरकार, कारखाना अधिनियम, 1948 ( 1948 का 63 ) की धारा 6 और धारा 112 द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए, बनाना प्रस्तावित करती है, उक्त अधिनियम की धारा 115 द्वारा अपेक्षित किए गए अनुसार, उन समस्त व्यक्तियों की जानकारी के लिए, जिनके कि उससे प्रभावित होने की संभावना है , एतद्वारा प्रकाशित किया जाता है तथा एतद्वारा यह सूचना दी जाती है कि इस सूचना के " मध्यप्रदेश राजपत्र " में प्रकाशन की तारीख से 45 दिन का अवसान होने पर उक्त प्रारूप पर विचार किया जाएगा.
किसी भी ऐसी आपत्ति या सुझाव पर, जो संशोधन के उक्त प्रारूप के संबंध में किसी भी व्यक्ति से ऊपर विनिर्दिष्ट कालावधि का अवसान होने पर या उसके पूर्व प्राप्त हो , राज्य सरकार द्वारा विचार किया जाएगा.
संशोधन प्रारूप
उक्त नियमों में-
1. नियम 5 में, शब्द तथा अंक " उस वर्ष की, जिसके लिए अनुज्ञप्ति मंजूर की गई हो या उसका नवीनीकरण किया गया हो, 31 दिसम्बर तक प्रवृत्त रहेगी . " के स्थान पर शब्द तथा अंक " अनुज्ञप्ति मंजूर किये जाने की तारीख या नवीनीकरण की तारीख से अधिभोगी द्वारा यथा चयनित 01 से 10 वर्ष या अधिक की अवधि के लिए, इस प्रकार आवेदित अनुज्ञप्ति की अवधि के लिए लागू फीस के प्रेषण के अध्यधीन रहते हुये , विधिमान रहेगी " स्थापित किए जाए.
2. नियम 6 में, उप - नियम ( 1 ) में, विद्यमान परंतुक में, पूर्ण विराम के स्थान पर कॉलन स्थापित किया जाए एवं इसके पश्चात् निम्नलिखित परंतुक जोड़ा जाए, अर्थात्ः-
" परंतु यह किसी और कि अनुज्ञप्ति अवधि के प्रत्येक केलेण्डर वर्ष के सापेक्ष अनुपातिक फीस प्रभारित की जाएगी ".

3. नियम 7 में, उप- नियम ( 1 ) ( क ) में, विद्यमान परंतुक में, पूर्ण विराम के स्थान पर कॉलन स्थापित किया जाए एवं इसके पश्चात् निम्नलिखित परंतुक जोड़ा जाए, अर्थात्ः-
" परंतु यह और कि अनुज्ञप्ति अवधि के प्रत्येक केलेण्डर वर्ष के सापेक्ष अनुपातिक फीस प्रभारित की जाएगी".
4. प्रारूप 3 में, शब्द तथा अंक " 31 दिसम्बर, सन् 20. तक प्रवृत्त रहेगी " , के स्थान पर, " दिनांक से दिनांक तक विधिमान्य रहेगी " स्थापित किए जाए.
No. 1963-819775-2022 - A- XVI . The following draft of amendment in the Madhya Pradesh Factories Rules , 1962 which the State Government proposes to make in exercise of the powers conferred by Section 6 and Section 112 of the Factories Act , 1948 (No. 63 of 1948 ) is hereby published as required by Section 115 of the said Act for the information of all persons likely to be affected thereby and notice is hereby given that the said draft shall be taken into consideration on the expiry of 45 days from the date of publication of this notice in the "Madhya Pradesh Gazette " .
Any objection or suggestion , which may be received from any person with respect to the said draft of amendment on or before the expiry of the period specified above shall be considered by the State Government .
AMENDMENT
In the said rules-
1 . In rule 5, for the words and figure " remain in force upto 31st December of the year for which the licence is so granted or renewed " the words and figure " remain valid for a period if 1 to 10 years or more , as chosen by the Occupier from the date of grant of license or date of renewal of licence subject to remittance of fee applicable for the period of licence so applied " shall be substituted.
2. In rule 6, in sub - rule ( 1 ) ] in the existing proviso , for the full stop , the colon shall be substituted and there after the following proviso shall be added, namely :-
"provided further that , proportional fee shall be charged relative to each calender year of period of licence"
3. In rule 7 , in sub- rule ( 1 ) ( a) , in the existing proviso , for the full stop , the colon shall be substituted and there after the following proviso shall be added , namely :-
"provided further that , proportional fee shall be charged relative to each calender year of period of licence" .
4. In form 3 , for the words and figure "remain in force till the 31st day of December, 20 " the words " remain valid from the date .to fate . ." shall be substituted .
