क्र. एफ 04-44-2021-अठारह 1.- मध्यप्रदेश नगरपालिक निगम अधिनियम , 1956 ( क्रमांक 23 सन् 1956 ) की धारा 58 की उपधारा ( 1 ) के साथ पठित धारा 433 द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए, राज्य सरकार, एतद्वारा , मध्यप्रदेश नगरपालिक निगम (अधिकारियों तथा सेवकों की नियुक्ति तथा सेवा की शर्तें ) नियम , 2000 में निम्नलिखित प्रविष्टी प्रतिस्थापित करती है , अर्थात् : -
संशोधन
उक्त नियमों में, नियम 8 ख में पूर्ण विराम के स्थान पर कॉलन स्थापित किया जाए तथा उसके पश्चात् निम्नलिखित परंतुक जोड़ा जाए, अर्थात्:-
" परन्तु निगम, राज्य सरकार के परामर्श से चयन हेतु अन्य एजेंसी नियुक्त कर सकेगी " .
No. F - 04-44-2021 - XVIII - 1 . In exercise of the powers conferred by Section 433 read with sub - section ( 1 ) of Section 58 of the Madhya Pradesh Municipal Corporation Act, 1956 ( No. 23 of 1956 ) , the State Government , hereby , makes the following amendment in the Madhya Pradesh Municipal Corporation (Appointment and Service of Officers and Servants ) Rules , 2000 , namely :-
AMENDMENT
In the said rules , in rule 8B , for full stop , colon shall be substituted and thereafter the following proviso shall be added, namely : --
"Provided that the Corporation may, in consultation with the State Government , appoint any other agency for selection. "

क्र. 6266-856055-2022- अठारह 1.- मध्यप्रदेश नगरपालिका अधिनियम , 1961 ( क्रमांक 37 सन् 1961 ) की धारा 94 तथा धारा 95 के साथ पठित धारा 355 तथा 256 द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए, राज्य सरकार, एतद्वारा , मध्यप्रदेश नगरपालिका कर्मचारी ( भर्ती तथा सेवा की शर्तें ) नियम , 1968 में निम्नलिखित संशोधन करती है, अर्थात् : -
संशोधन
उक्त नियमों में , नियम 51 के स्थान पर, निम्नलिखित नियम स्थापित किया जाए, अर्थात्ः-
" 51. अनुशासनिक प्राधिकारी-
(1) अधिनियम तथा इन नियमों के उपबंधों के अध्यधीन रहते हुए नगरपालिक परिषद् को अधिनियम की धारा 94 की उपधारा ( 3 ) में उल्लिखित पद धारण करने वाले किसी भी नगरपालिका कर्मचारी पर नियम 49 में उल्लिखित शास्तियों में से कोई शास्ति आरोपित करने की शक्ति होगी तथा अन्य नगरपालिका कर्मचारियों के मामले में प्रेसिडेन्ट- इन-काउन्सिल को उक्त शास्तियों में से कोई शास्ति आरोपित करने की शक्ति होगी :
(2) उपधारा ( 1 ) के अधीन यथाविहित , परिषद् तथा प्रेसिडेन्ट - इन - काउन्सिल में निहित समस्त शक्तियां, आयुक्त, संचालनालय , नगरीय प्रशासन एवं विकास संचालनालय, में भी निहित होंगीः
परन्तु आयुक्त, नगरीय प्रशासन एवं विकास संचालनालय द्वारा , उपरोक्त उपनियम ( 2 ) के अधीन निहित शक्तियों का प्रयोग करते हुए पारित कोई आदेश , नगरपालिका परिषद् अथवा प्रेसिडेन्ट - इन - काउन्सिल द्वारा पुनरीक्षित नहीं किया जा सकेगा. "
No. 6266-856055-2022 - XVIII - 1.-In exercise of the powers conferred by Section 355 and 256 read with Section 94 and Section 95 of the Madhya Pradesh Muncipalities Act , 1961 ( No. 37 of 1961 ) , the State Government , hereby , makes the following further amendments in the Madhya Pradesh Municipal Employees ( Recruitment and Conditions of Service) Rules , 1968, namely :-
AMENDMENTS
In the said rules , for rule 51 , the following rule shall be substituted , namely :-
" 51. Disciplinary Authorities.-
(1) Subject to the provisions of the Act and these rules , the Municipal Council shall have the powers to impose any of the penalties specified in rule 49 on any municipal employee holding post specified in sub - section (3 ) of Section 94 of the Act and in the case of other municipal employees , the President - in- Council shall have the power to impose any of the said penalties on him .
(2) All the powers vested with Council and President- in- Council , as prescribed under sub- section ( 1 ) , shall also be vested with Commissioner , Directorate of Urban Administration and Development :
Provided that , any orders passed by the Commissioner , Directorate of Urban Administration and Development , in exercise of powers vested under sub - rule ( 2 ) above , cannot be revised by the Municipal Council or President in Council . "
