निःशुल्क और अनिवार्य बाल शिक्षा का अधिकार अधिनियम, 2009 (2009 का 35) की धारा 38 की उप- धारा (1 ) तथा (2) द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए , राज्य सरकार, एतद्वारा निःशुल्क और अनिवार्य बाल शिक्षा का अधिकार नियम, 2011 में निम्नलिखित करती है, अर्थात्ः-

नियम 11 के स्थान पर, निम्नलिखित नियम स्थापित किया जाए , अर्थात्ः-
" 11 स्कूल की मान्यता.
(1 ) केन्द्र सरकार, राज्य सरकार या स्थानीय प्राधिकरण द्वारा स्थापित, उसके स्वामित्व के या उसके नियंत्रणाधीन किसी स्कूल से भिन्न प्रत्येक स्कूल इन

नियमों से संलग्न प्ररूप - एक में आवेदन आयुक्त / संचालक राज्य शिक्षा केन्द्र द्वारा विहित प्रक्रिया अनुसार जिला परियोजना समन्वयक, जो अपनी क्षेत्राधिकारिता की शालाओं को धारा 18 के अधीन स्कूल की मान्यता का प्रमाण पत्र जारी करने के लिए पदाभिहित अधिकारी होगा, को करेगा । आवेदन में स्कूल के पड़ोस की सीमा के विवरण समाविष्ट होंगे जो धारा 12 की उपधारा (1 ) के खण्ड (ग) के उपबंध के अधीन शामिल होंगे । संबंधित ऑनलाइन आवेदन जिला परियोजना समन्वयक को विकासखंड स्त्रोत केन्द्र समन्वयक (बी.आर.सी.सी. ) के माध्यम से ऐसी रीति में प्रस्तुत किया जाएगा जैसी कि आयुक्त/ संचालक, राज्य शिक्षा केन्द्र द्वारा विहित की जाए । स्कूल इस प्रयोजन हेतु राज्य शिक्षा केन्द्र के आरटीई पोर्टल पर जानकारी की प्रविष्टिकरेगा । ऐसी निजी प्राथमिक शाला / माध्यमिक शाला की मान्यता प्राप्त करने के लिए पात्र होंगी, जो मध्यप्रदेश सोसाइटी रजिस्ट्रिकरण अधिनियम, 1973 , सोसायटी पंजीकरण अधिनियम, 1860 , मध्यप्रदेश लोक न्यास अधिनियम, 1951 तथा भारतीय न्यास अधिनियम, 1882 के अधीन रजिस्ट्रीकृत है । सोसायटी/ ट्रस्ट शाला के प्रबंधन हेतु समुचित वित्तीय स्त्रोत रखेंगी और पूर्व वर्ष के आय -व्यय के अंकेक्षित विवरण भी रखेगी । शैक्षणिक सत्र के प्रांरभ होने के पूर्व शाला प्रतिवर्ष बालकों से प्रभारित की जाने वाली फीस ऐसी रीति में अधिसूचित करेगी जो आयुक्त / संचालक राज्य शिक्षा केन्द्र निर्देशित करें ।

2) अशासकीय स्कूल को, मान्यता हेतु स्त्रोत केन्द्र समन्वयक विकासखण्ड (बीआरसीसी) को ऑनलाइन आवेदन करना होगा । यह आवेदन राज्य शिक्षा 14 (1)

केन्द्र द्वारा जारी की गई समय- सारणी विरचित प्रक्रिया अनुसार किया जा सकेगा।
(क) विकास खण्ड स्त्रोत केन्द्र समन्वयक, शाला द्वारा दी गई जानकारी का भौतिक निरीक्षण करेगा तथा आवेदन प्राप्त होने के पन्द्रह दिन के भीतर उसे जिला परियोजना समन्वयक को विचारण के लिए भेजेगा । यदि विकासखण्ड स्त्रोत केन्द्र समन्वयक पन्द्रह दिन के भीतर रिपोर्ट विचारण हेतु नहीं भेजता है, तो यह माना जाएगा कि वह निःशुल्क एवं अनिवार्य बाल शिक्षा का अधिकार अधिनियम , 2009 में वर्णित मानकों तथा शर्तों और अशासकीय शाला अधिकार नियम , 2011 के उपबंधो के अनुसार है । ऐसी स्थिति में , प्रकरण पर विकासखण्ड स्त्रोत केन्द्र समन्वयक (बीआरसीसी) की अनुशंसा मानते हुए यह रिपोर्ट जिला के विचारण हेतु पोर्टल पर स्वमेव ही अग्रेषित हो जाएगी । जिला परियोजना समन्वयक, राज्य शिक्षा केन्द्र द्वारा स्थापित मानदण्ड और मानकों को पूर्ति का समापन करने के लिए शाला का निरीक्षण करवाएगा ।
(ख) ऐसे आवेदन जो (बीआरसीसी) द्वारा भौतिक निरीक्षण के बिना मानी गई अनुशंसा के आधार पर अग्रेषित हुए हो , उनमें जिला परियोजना समन्वयक अनिवार्यतः स्कूल का निरीक्षण करेगा । जांच अधिकारी स्कूल के अभिलेखों का निरीक्षण कर सकेगा ।
(3) यदि जिला परियोजना समन्वयक का यह समाधान हो जाता है कि नियम-19 में विहित सन्नियमों एवं मानकों की पूर्ति करता है, तो वह इन नियमों के अधीन समय - सीमा के भीतर, मान्यता प्रमाणपत्र जारी करेगा अथवा अपूर्ण मानक विनिर्दिष्ट करते हुए 30 दिवस के भीतर आवेदन निरस्त कर सकेगा । यदि जिला परियोजना समन्वयक 30 दिवस के भीतर आवेदन का निराकरण नहीं करता है, तो जिला परियोजना समन्वयक की अनुशंसा मानते हुए पोर्टल से स्वमेव मान्यता प्रमाण पत्र जारी हो जाएगा जो पूर्णतः वैध होगा । ऐसे प्रकरणों में, जहां जिला परियोजना समन्वयक की मानी गई अनुशंसा के आधार पर मान्यता प्रमाण पत्र जारी किया गया हो, कलक्टर प्रमाण पत्र जारी होने के 30 दिवस के भीतर स्कूल का निरीक्षण करेगा । जांच के दौरान किसी मानक अथवा मापदण्ड का उल्लंघन पाए जाने पर मान्यता प्रमाण पत्र निरस्त किया जाएगा ।
(क) यदि किसी स्कूल द्वारा किया गया मान्यता आवेदन जिला परियोजना समन्वयक द्वारा निरस्त किया जाता है तो संबंधित स्कूल प्रबंधन / सोसाइटी / ट्रस्ट द्वारा आवेदन निरस्त किए जाने के 30 दिवस के अंदर कलक्टर को अपील की जा सकेगी । कलक्टर द्वारा अपील का निराकरण अपील प्रस्तुत होने के 30 दिवस के भीतर किया जाएगा ।

(ख) कलक्टर द्वारा निर्धारित समयावधि में अपील पर निर्णय पारित नहीं करने अथवा अपील निरस्त किए जाने की स्थिति में , आयुक्त/ संचालक राज्य शिक्षा केन्द्र के समक्ष 30 दिवस के भीतर द्वितीय अपील की जा सकेगी । द्वितीय अपील में आयुक्त/ संचालक राज्य शिक्षा केन्द्र द्वारा पारित निर्णय अंतिम एवं बंधनकारी होगा ।
(4) (क) जिला परियोजना समन्वयक का समाधान हो जाने पर, कि स्कूल शिक्षा का अधिकार अधिनियम, 2009 की धारा 19 के अधीन विहित सन्नियमों एवं मानकों की पूर्ति करता है, इन नियमों से संलग्न प्ररूप-2 में विहित मान्यता की शर्तों के अध्यधीन रहते हुए मान्यता प्रमाणपत्र जारी किया जाएगा । प्रमाणपत्र तीन वर्ष की अवधि के लिए मान्य होगा तथा मान्यता के लिए आवेदन करने की तारीख से 45 दिन के भीतर जारी किया जाएगा ।
(ख) स्कूल मान्यता प्रमाण पत्र के नवीनीकरण के लिए आवेदन उपनियम (1) में विहित रीति में मान्यता की अवधि की समाप्ति के कम से कम 45 दिन पूर्व करेगा । ऐसे आवेदन की प्राप्ति पर, जिला परियोजना समन्वयक उपनियम (2) और (3) में अधिकथित प्रक्रिया का अनुसरण करते हुए अगले तीन वर्ष के लिए मान्यता का नवीनीकरण कर सकेगा ।
(ग) यदि स्कूल, मान्यता प्रमाण पत्र में विनिर्दिष्ट कालावधि के भीतर और आगे मान्यता हेतु निर्धारित समयावधि में विहित प्रक्रिया अनुसार ऑनलाइन आवेदन नहीं करता है तो स्कूल की मान्यता विहित समयावधि के पश्चात स्वतः ही समाप्त हो जाएगी तथा किसी ऐसे स्कूल को संचालित करना निःशुल्क और अनिवार्य बाल शिक्षा का अधिकार अधिनियम, 2009 (2009 का 35) का उल्लंघन होगा तथा धारा 18 के अधीन दण्डनीय होगा ।
(घ) कलक्टर , किसी भी समय , स्व- प्रेरणा से या आवेदक स्कूल के, आवेदन पर जिला परियोजना समन्वयक के विनिश्चय पर 45 दिन के भीतर , इस बात का निरीक्षण कर सकेगा कि क्या प्राधिकारी ने अपने अधिकार के प्रयोग में अवैधानिकता की है या नहीं या क्या उसके द्वारा गंभीर अनियमितता की गई है, तो जिला परियोजना समन्वयक द्वारा निराकृत किसी प्रकरण के अभिलेख मंगा सकेगा । यदि कलक्टर पता है कि प्रकरण में अवैधानिक रूप से निर्णय किया गया है या उसके निराकरण में गंभीर अनियमितता की गई है, वह जिला परियोजना समन्वयक के निर्णय को उलट देगा या उसे संशोधित करेगा । कलक्टर द्वारा किसी स्कूल के विरूद्ध कोई प्रतिकूल आदेश तब तक पारित नहीं किया जाएगा जब तक कि स्कूल को ऐसे उलटने या संशोधन के पूर्व सुनवाई का युक्तियुक्त अवसर न दे दिया गया हो ।

(ङ) स्कूल का नाम, स्कूल का पता अथवा स्कूल की समिति का नाम परिवर्तन हेतु जिला परियोजना समन्वयक के माध्यम से निम्नानुसार दस्तावेज राज्य शिक्षा केन्द्र को प्रेषित किए जाएंगेः-
(एक) स्कूल का आवेदन पत्र ।
(दो) समिति का ठहराव प्रस्ताव 100 रूपये के स्टांप पेपर में ।
(तीन) स्कूल की मान्यता की प्रति
(चार) जिला परियोजना समन्वयक द्वारा आयुक्त/ संचालक राज्य शिक्षा केन्द्र को प्रेषित अनुशंसा पत्र ।
(पांच) स्कूल समिति में परिवर्तन हेतु नवीन समिति / सोसायटी सर्वसम्मति से प्रस्ताव पारित करेगी । नवीन समिति को शपथ पत्र कि समिति/ विद्यालय के ऊपर कोई देनदारी नहीं है, आवेदन पत्र के साथ प्रस्तुत करना होगा । पुरानी समिति की अनापत्ति प्रमाण पत्र संलग्न करना होगी । इस हेतु नियम-5 में विहित शुल्क देय होगा ।
(5) (1 ) मान्यता के अधीन विभिन्न गतिविधियों हेतु विहित शुल्क. -
(एक) नवीन स्कूल के लिए प्रत्येक सोसायटी/ स्कूल द्वारा मान्यता शुल्क के रूप में प्राथमिक शाला हेतु 5,000 /- रूपये अथवा माध्यमिक शाला हेतु 7,500 /- रूपये अथवा प्राथमिक- सह- माध्यमिक शाला हेतु 10000 / - रूपये राज्य शिक्षा केन्द्र द्वारा इस संबंध में स्थापित नियमों के अनुसार जमा किया जाएगा ।
(दो) मान्यता नवीनीकरण हेतु प्राथमिक शाला हेतु प्रति वर्ष 2000 /- रूपये अथवा माध्यमिक शाला हेतु 3000 /- रूपये अथवा प्राथमिक- सह-माध्यमिक शाला हेतु 4,000 रूपये एकमुश्त जमा करना होगा ।
(तीन) प्राथमिक से माध्यमिक विधालय में उन्नयन करने की स्थिति में नवीनीकरण के समय प्राधिकारी द्वारा विहित उपबंध अनुसार अपेक्षित प्रक्रिया अपनाई जाएगी । इस हेतु शुल्क रु . 5000 / - जमा किया जाएगा ।
(चार) विहित समय सीमा के भीतर नवीन मान्यता / मान्यता के नवीनीकरण के लिए आवेदन प्रस्तुत करने हेतु सोसायटी / ट्रस्ट के असफल रहने की दशा में विलंब शुल्क के रूप में रू . 5,000 / - की राशि अतिरिक्त जमा की जाएगी, तत्पश्चात् नवीन अनुसूचित तारीख तक आवेदन स्वीकार किया जा सकेगा ।

(पांच) स्कूल का नाम और पता अथवा स्कूल समिति का नाम परिवर्तन हेतु रूपये 5,000/- का शुल्क देय होगा ।
(2) शुल्क जमा करने हेतु प्रकिया. (क) राज्य शिक्षा केन्द्र द्वारा विहित प्रक्रिया अनुसार । आयुक्त/ संचालक राज्य शिक्षा केन्द्र द्वारा गतिविधियों हेतु निर्धारित शुल्क का पुनरीक्षण समय - समय पर आवश्यकतानुसार किया जा सकेगा।
(ख) प्रक्रिया / मान्यता शुल्क के रूप में प्राप्त राशि अथवा उस राशि पर बैंक से प्राप्त ब्याज का उपयोग आयुक्त / संचालक राज्य शिक्षा केन्द्र द्वारा प्राधिकृत अधिकारी द्वारा निम्नलिखित प्रयोजनों के लिए किया जाएगाः-
(एक) शिक्षा की गुणवत्ता सुधार के लिए कार्यशाला, बैठक, संगोष्ठी आदि का आयोजन करने के लिए;
(दो) शिक्षकों को पुरस्कार प्रदान करने तथा चिकित्सा सुविधाएं प्रदान करने हेतु:
(तीन ) शासकीय स्कूलों में खेलकूद / कम्प्यूटर / स्मार्ट कक्षाएं विकसित करने हेतु सामग्री प्रदान करने हेतु,
(चार) स्कूलों में मार्गदर्शन प्रदान करने के लिए राज्य शिक्षा केन्द्र तथा अधीनस्थ कार्यालयों के अधिकारियों तथा सेवानिवृत्त शिक्षकों को मानदेय, यात्रा व्यय आदि देने हेतु ;
(पांच) ऑनलाइन शिक्षण / मार्गदर्शन की व्यवस्था हेतुः
(छह) शिक्षकों के वृतिक विकास के लिए दीर्घ/ अल्पावधि प्रशिक्षण /परीक्षाएं आयोजित करने हेतु;
(सात) छात्रों के शैक्षणिक भ्रमण हेतु;
(आठ) आई सी टी और सी सी ई से संबंधित क्रियाकलापों तथा स्कूल शिक्षा विभाग के अन्य प्रशिक्षण कार्यक्रमों के लिए व्यवस्थाओं हेतुः
(नौ) आयुक्त/ संचालक राज्य शिक्षा केन्द्र द्वारा यथा अनुमोदित किसी अन्य क्रियाकलाप हेतु ।
(6) (क) सुरक्षा निक्षेपः नवीन मान्यता / मान्यता का नवीनीकरण चाहने वाले प्रत्येक स्कूल द्वारा सुरक्षा निधि के रूप में एक मुश्त राशि नीचे दी गई सारणी में वर्णित किये गए अनुसार जमा की जाएगीः- मध्यप्रदेश राजपत्र , दिनांक 6 जनवरी 2023

इस प्रकार , सुरक्षा निधि किसी राष्ट्रीयकृत बैंक में स्कूल समिति के सचिव तथा जिला परियोजना समन्वयक के संयुक्त नाम से फिक्स डिपॉजिट के रूप में जमा की जाएगी ।
(ख) संस्था शाला की मान्यता अभ्यार्पित करती है अथवा मान्यता की अवधि समाप्त होने के उपरांत नवीनीकरण हेतु आवेदन नही करता है तो सुरक्षा राशि से शोध्यों की कटौती करने के पश्चात् यदि कोई हो , जिला राशि वापस कर दी जाएगी । सुरक्षा निक्षेप राषि जिला परियोजना समन्वयक की सहमति के बिना आहरित नहीं की जा सकेगी ।
(7)जहां किन्ही उपबंधों का उल्लंघन किया जाता है तो जिला परियोजना समन्वयक मान्यता प्रदान करने की षर्त के उल्लंघनों के संबंध में स्कूल को कारण बताओ नोटिस जारी करेगा । स्कूल को उत्तर प्रस्तुत करने के लिए कम से कम 15 दिवस का समय दिया जाएगा । संतोषजनक उत्तर न पाए जानेया के निष्चित समयावधि भीतर उत्तर प्राप्त न होने की दषा में, कलक्टर जांच समिति गठित कर स्कूल का निरीक्षण करवासकेगा जो सम्यक् जांच करेगी तथा स्कूल को चालू रखने या मान्यता वापस ले ली जाए के संबंध में अपनी सिफारिष करेगी और रिपोर्ट कलक्टर को सौपेगी । समिति की रिपोर्ट के आधार पर कलक्टर मान्यता प्रत्याहित करने कोआदेश पारित कर सकेगा । मान्यता प्रत्याहरण लेने का कोई आदेश राज्य शासन के पूर्व अनुमोदन के बिना पारित नहीं किया जाएगा ।
(8) कलक्टर द्वारा पारित मान्यता प्रत्याहरण का आदेष ठीक उत्तरवर्ती शैक्षणिक वर्ष से प्रभावी होगा तथा उसमें आसपास के उन स्कूलों के नाम विनिर्दिष्ट होंगे जिनमें उस स्कूल के बालकों को प्रवेष दिया जाएगा ।
(9) स्कूल की मान्यता के बारे में सूचना स्थानीय प्राधिकारी जैसे कि नगरीय क्षेत्र में स्कूल की दषा में नगरीय स्थानीय निकाय को तथा ग्रामीण क्षेत्र में स्कूल की दषा में ग्राम पंचायत और जनपद पंचायत यंत्र को भेजी जाएगी ।

4. यह प्रमाणित किया जाता है कि स्कूल व्दारा शिक्षा का अधिकार अधिनियम के क्रियान्वयन से संबंधित अभिलेख जिला परियोजना समन्वयक व्दारा प्राधिकृत किसी अधिकारी या समुचित अधिकारी को निरीक्षण के लिए किसी भी समय दिए जाएंगे तथा स्कूल , यथास्थिति संसद, राज्य की विधानसभा के प्रति जवाबदेही या कर्तव्य के निर्वहन के लिए केन्द्र और राज्य सरकार/स्थानीय प्राधिकारी या प्रशासन को समस्त ऐसी जानकारियां जो कि आवश्यक हों प्रस्तुत करेगा ।
5. यह प्रमाणित किया जाता है कि शाला के समस्त शैक्षणिक कर्मचारीवृन्द तथा अशैक्षणिक कर्मचारिवृन्द के विरूद्व लैंगिग अपराधों से बालको का संरक्षण अधिनियम , 2012 ( 2012 को 32) तथा किशोर न्याय ( बालको की देखरेख तथा संरंक्षण) अधिनियम , 2000 (2000 का 56 ) के अधीन कोई भी मामला पंजीकृत नही है।
6. प्रमाणित किया जाता है कि बच्चों के अध्ययन हेतु उपयोग किया जा रहा भवन , भवन संहिता के अनुसार पूर्णतः सुरक्षित है।
7. स्कूल, भारत की राष्ट्रीय भवन संहित - भाग 4( नेशनल बिल्डिग कोड आफ इंडिया पार्ट-4 ) के अधीन विनिर्दिष्ट सन्नियमों के अनुरूप अग्निशामक यंत्र एवं अन्य सुरक्षा उपायों की व्यवस्था बनाये रखेगा।

महोदय/महोदया,
आपके आवेदन पत्र दिनांक पश्चात्वर्ती पत्र व्यवहार/ निरीक्षण के संदर्भ में, मैं आपके तथा इस संबंध में स्कूल से --(स्कूल का नाम विकासखंड कक्षा से तक के लिए दिनांक से तक तीन वर्ष की कालावधि एवं पता) स्कूल आईडी-- कक्षा के लिए मान्यता प्रदान करता हूं।
उपरोक्त स्वीकृति निम्नलिखित शर्तों की पूर्ति के अध्यधीन होगीः-
1. मान्यता विस्तारित नहीं होगी तथा कक्षा 8 से आगे की मान्यता की कोई बाध्यता किसी भी रूप में विवक्षित नहीं होगी ।
2 . स्कूल निःशुल्क और अनिवार्य बाल शिक्षा का अधिकार अधिनियम, 2009 तथा निःशुल्क और अनिवार्य बाल शिक्षा का अधिकार नियम , 2011 के उपबंधों का पालन करेगा।
3. स्कूल , अपने पड़ोस की सीमा के वंचित समूह तथा कमजोर वर्ग के बालकों को स्कूल की प्रथम प्रवेशित कक्षा में 25 प्रतिशत प्रवेश देगा। उस दशा में, स्कूल यदि 14 (12)

सहायता प्राप्त स्कूल है तो इसमे प्रवेशित बालकों को उस अनुपात में निःशुल्क और अनिवार्य प्रारंभिक शिक्षा देगा जिस रूप में उसके वार्षिक आवर्ती व्यय को पूरा करने हेतु इस प्रकार वार्षिक आवर्ती सहायता या अनुदान प्राप्त होता है।
4. पैरा 3 में निर्दिष्ट बालकों के लिए स्कूल को अधिनियम की धारा 12 की उपधारा (2) के अनुसार व्यय की प्रतिपूर्ति की जाएगी तथा ऐसी प्रतिपूर्ति प्राप्त करने के लिए स्कूल को पृथक् से बैंक खाता उपलब्ध कराना होगा।
5. सोसाइटी/स्कूल कोई भी कैपिटेशन फीस का संग्रह नहीं करेगा तथा बालक या उसके पालक या अभिभावक के साथ किसी छानबीन प्रक्रिया को नहीं अपनाएगा।
6. स्कूल किसी भी बालक को प्रवेश देने से इंकार नहीं करेगा-
(क) आयु के सबूत के अभाव में;
(
ख) यदि प्रवेश के लिए विहित की गई विस्तारित कालावधि के पश्चात् ऐसा प्रवेश चाहा गया है ; और
(ग) धर्म , जाति या मूलवंश, जन्मस्थान या इनमें से किसी भी आधार पर ।
7. स्कूल सुनिश्चित करेगा कि-
(क) प्रायमरी स्कूल में किसी प्रवेशित बालक को स्कूल में प्रारम्भिक शिक्षा पूर्ण होने तक निष्कासित नहीं किया जाएगा;
(ख ) प्रारंभिक शिक्षा पूर्ण होने तक बालक को कक्षा 5 एवं 8 को छोड़कर अन्य कक्षाओं में बाधा रहित कक्षोन्नति प्रदान की जायेगी;
(ग) किसी बालक को शारीरिक दण्ड या मानसिक रूप से प्रताड़ित नहीं किया जाएगा;
(घ) नियम 19 के अधीन प्रारंभिक शिक्षा पूर्ण करने वाले प्रत्येक बालक को प्रमाण पत्र दिया जाएगा;
(ड. ) अधिनियम के उपबंधों के अनुसार दिव्यांग/ विशेष आवश्यकता वाले बालकों को समाहित किया जाएगा;
(च) अधिनियम की धारा 23 की उप- धारा (1 ) के अधीन निर्धारित योग्यता अनुसार शिक्षक ही कार्यरत रखे जाये। स्कूल में अधिनियम की धारा 19 एवं 25 में उल्लेखित मापदंड़ों के पूर्ति करते हुये मान्यता अवधि तक शिक्षको की नियुक्ति की व्यवस्था बनाए रखी जाएगी ।
(
छ) शिक्षको को अधिनियम की धारा 24 की उपधारा ( 1 ) के अधीन विनिर्दिष्ट उसके कर्तव्यों का पालन करना होगा;
(
ज) प्रायवेट शिक्षण की गतिविधियों में शिक्षक स्वयं भाग नहीं लेंगे/लेंगी ।

14 (13) (झ ) भारत की राष्ट्रीय भवन संहिता भाग-4 के अधीन विनिदिष्ट सन्नियमों के अनुरूप अग्नि सुरक्षा की व्यवस्था स्थापित हो।
(ञ) प्रतिवर्ष बच्चों से प्रभारित की जाने वाली फीस ऐसी रीति में अधिसूचित की जाए जो आयुक्त राज्य शिक्षा केन्द्र द्वारा शैक्षणिक सत्र के प्रारंभ होने के पूर्व निर्देशित की जाए तथा इसकी सूचना शैक्षणिक सत्र के प्रारंभ होने के पूर्व जिला शिक्षा अधिकारी को भी दी जाए। मध्यप्रदेश निजी विधालय विनियमन बोर्ड के नियमों के अनुसार ही फीस में बढोत्तरि की जा सकती है ।
8. स्कूल समुचित प्राधिकारी व्दारा निर्धारित पाठ्यचर्या का अनुसरण करेगा।
9 स्कूल अधिनियम की धारा 19 में विहित किए गए अनुसार स्कूल में उपलब्ध सुविधाओं के अनुपात में बालकों का नामांकन करेगा ।
10. स्कूल व्दारा अधिनियम की धारा 19 में विनिर्दिष्ट स्कूल के मानक एवं मापदण्ड बनाए रखे जाएंगे। अंतिम निरीक्षण के समय स्कूल में उपलब्ध सुविधाएं निम्नानुसार पाई गयीं-

11. लेखे संपरीक्षित किए जाएंगे तथा चार्टड एकाउन्टेंट व्दारा सत्यापित होंगे और उचित लेखा विवरण नियमों के अनुसार तैयार होगा । प्रत्येक लेखाओं के विवरणों की एक प्रति प्रतिवर्ष जिला शिक्षा अधिकारी को भेजी जाएगी ।
12. आपके स्कूल को आवंटित मान्यता कोड नम्बर है । इस कार्यालय के साथ किसी भी पत्राचार में यह कोड नम्बर संदर्भित किए जाएं ।
13 . स्कूल ऐसी रिपोर्ट और जानकारी प्रस्तुत करेगा , जोस्कूल शिक्षा विभाग/राज्य शिक्षा केन्द्र/जिला परियोजना समन्वयक द्वारा समय -समय पर अपेक्षित की जाए , और स्कूल राज्य सरकार/स्थानीय प्राधिकारी के ऐसे अनुदेशो का पालन करेगा, जैसा कि स्कूल के संचालन की कमियों को दूर करने के लिए अथवा मान्यता की शर्तों की निरन्तर पूर्ति सुनिश्चित करने हेतु जारी किए जाएं ।
14. यदि कोई स्कूल उसके छात्रों को वाहन की सुविधा उपलब्ध कराती है तो उसे सुनिश्चित करना होगा कि वाहन हेतु सरकार द्वारा यथा विहित सुरक्षा सन्नियमों का पालन हो रहा है । शाला को स्कूल बसों में महिला कंडक्टर की उपलब्धता के संबंध में समय - समय पर परिवहन विभाग द्वारा जारी निर्देशों का पालन करना होगा।
15.
सोसायटी/न्यास , के पंजीयन का नवीकरण किया जाएगा ।
16. अधिनियम एवं नियम के उपबंधों और मान्यता की शर्तों का उल्लंघन पाए जाने तथा सिद्ध हो जाने पर मान्यता वापस ले ली जाएगी ।

In exercise of the powers conferred by sub - section ( 1) and (2) of Section 38 of the Right of Children to Free and Compulsory Education , Act , 2009 ( No. 35 of 2009 ) , the State Government , hereby , makes the following amendments in the Right of Children to Free and Compulsory Education Rules , 2011 , namely: -
AMENDMENTS
For rule 11 , the following rule shall be substituted , namely : -
" 11. School Recognition.-
( 1) Every school , other than a school established , owned or Government , State controlled by the Central Government or the Local Authority , shall make an application to the District Project Co- ordinator who is the authorised officer to issue the recognition certificate under section 18 to the schools of his jurisdiction , in accordance with the procedure laid down by the Commissioner / Director Rajya Shiksha Kendra in Form- 1 appended to these rules . The application shall consist of the details of boundaries of the neighbourhood that shall be covered under the provision of clause ( c) of sub section ( 1 ) of section 12. The respective online application shall be submitted to the District Project Co- ordinator through the Block Resource Centre Co- ordinator ( BRCC ) in the manner preseribed by the Commissioner/ Director , Rajya Shiksha Kendra . Such private primary schools / middle schools shall be eligible for recognition , as are registered under the Madhya Pradesh Societies Registration Act , 1973 , Societies Registration Act , 1860 , the Madhya Pradesh Public Trust Act , 1951 and the Indian Trusts Act , 1882 . The Society /Trust shall keep proper financial resources for the management of the school and shall also keep the audited statement of income and expenditure of the previous year. The school shall before the commencement of the academic session notify the fees to be charged from the children every year in the manner as the Commissioner / Director of the Rajya Shiksha Kendra may direct .
(2) Non - Government schools shall have to apply to the Block Resource Centre Co- ordinator ( BRCC ) online . This application can be made only according to the time table process laid down by the Rajya Shiksa Kendra .
(a) Block Resource Centre Co - ordinator ( BRCC) shall physically inspect the information given by the school and send it to the District Project Co- ordinator for consideration , within fifteen days of receipt of the application . If the Block Resource Centre Co - ordinator ( BRCC) does not send the report for consideration within fifteen days , then it shall be assumed that it is according to the मध्यप्रदेश राजपत्र, दिनांक 6 जनवरी 2023

standards and conditions mentioned in the Right to Free and Compulsory Child Education Act , 2009 and the provisions of the Right to Non - Government School Education Rules , 2011. In this situation , considering the recommendation of the Block Resource Centre Co - ordinator ( BRCC) on the case , this report shall automatically be forwarded to the District's portal for consideration . The District Project Co - ordinator shall get the school inspected to verify the fulfilment of the norms and standards set by the Rajya Shiksha Kendra .
(b ) Applications as are forwarded by the ( BRCC) on the basis of the recommendation considered without physical inspection , the District Project Co- ordinator shall compulsorily inspect the school .
The Inquiry Officer can inspect the records of the school .
(3) If the District Project Co- ordinator is satisfied that the school fulfils the norms and standards prescribed in rule 19 he shall , within a time limit , issue the recognition certificate under these rules or can reject the application specifying incomplete standard , within 30 days . If the District Project Co - ordinator does not resolve the application within 30 days , then the recognition certificate shall be automatically issued from the portal considering the recommendation of the District Project Co - ordinator , which shall be fully valid .

In cases , where the recognition certificate has been issued on the basis of the deemed recommendation of the District Project Co-ordinator , the Collector shall inspect the school within 30 days from the date of issue of the certificate . The recognition certificate shall be cancelled , if any standard or parameter is found violated during the inspection .
(a) If the recognition application made by a school is rejected by the District Project Co- ordinator , then an appeal can be made by the concerned school management/ society / trust to the Collector , within a period of 30 days from the rejection of the application . The Disposal of the appeal shall be made by the Collector within 30 days from the date of submission of appeal .
(b) In the event of Collector not passing the decision on the appeal within the prescribed time period or in the case of rejection of the appeal , a second appeal can be made before the Commissioner/ Director , Rajya Shiksha Kendra , within 30 days . The decision passed by the Commissioner/ Director , Rajya Shiksha Kendra for the second appeal shall be final and binding .
(4) ( a) On the satisfaction of the District Project Co - ordinator . that the school fulfils the norms and standards prescribed under Section 19 of the Right to Education Act , 2009 , a Recognition Certificate in Form - 2 appended to these rules shall be issued , subject to the मध्यप्रदेश राजपत्र, दिनांक 6 जनवरी 2023

conditions prescribed for recognition . The certificate shall be valid for a period of three years and shall be issued within 45 days from the date of application for recognition .
(b) The school shall apply for the renewal of the certificate of recognition in the manner prescribed in sub - rule ( 1 ) at least 45 days before the expiry of the period of recognition . On receipt of such application , the District Project Co- ordinator shall be able to renew the recognition for the next three years following the procedure laid down in sub - rule (2) and (3) .
(c) If the school does not apply online as per the prescribed procedure within the period specified in the Recognition Certificate and within the time period prescribed for further recognition , the recognition of the school shall be terminated automatically after the prescribed time period and running any such school shall be a violation of the Right of Children To Free And Compulsory Education Act , 2009 ( 35 of 2009 ) and shall be punishable under section 18 .
(d) The Collector may , at any time , on his own motion or on the application of the school , on the decision of the District Project Co - ordinator , within 45 days , investigate whether the authority has committed illegality in the exercise of its powers or not , or serious irregularity has been committed by him , may call for the record of any case resolved by the District Project Co- मध्यप्रदेश राजपत्र, दिनांक 6 जनवरी 2023

If the Collector finds that the case has been decided illegally or that serious irregularities have been committed in its disposal , he shall reverse or modify the decision of the District Project Co - ordinator . The Collector shall not pass any adverse order against any school unless the school has been given a reasonable opportunity of hearing.
(e) For the change in the name of the school , address of the school or the name of the committee of the school , the following documents shall be sent to the Rajya Shiksha Kendra through the District Project Co - ordinator-
( i) application Form of the school ;
(ii) retention proposal of the committee on Rs - 100 stamp paper ;
( iii) copy of school recognition ;
(iv) recommendation letter sent by District Project Co - ordinator to Commissioner / Director of Rajya Shiksha Kendra;
(v) The proposal for change in school committee shall be passed unanimously by the new committee / society . The new committee has to submit an application alongwith an affidavit , that there is no obligation on the society/ school . No Objection Certificate of the old committee shall also be attached . For this purpose , the fee prescribed in rule - 5 shall be payable .

14 (21 ) (5) ( 1 ) Fees prescribed for various activities under recognition- (i) an amount of Rs . 5000/ - for primary school or Rs . 7500 / - for middle school or Rs . 10,000 / - for primary cum - middle school shall be deposited by each society / school as recognition fee for new schools as per the rules established by the Rajya Shiksha Kendra in this regard .
(ii) a lump sum deposit of Rs . 2000 / - for primary school or Rs . 3000/ - for middle school or Rs . 4000 / - for primary- -cum- middle school has to be deposited , per year , for the renewal of recognition ;
(iii ) in case of upgrading from primary to middle school , the process required as per the provision prescribed by the Authority shall be done at the time of renewal . For this , fee Rs.5000 /- shall be deposited.
(iv) in case of failure of the Society/Trust to submit the application for fresh recognition / renewal of recognition within the prescribed time limit , an additional amount of Rs.5,000 /- shall be deposited as late fee , thereafter the application can be accepted till the new scheduled date .
(v) a fee of Rs.5000 / - shall be payable for changing the name and address of the school or the name of the school committee .
(2) Process for fee deposit.-

revised from time to time by the Commissioner /Director , Rajya Shiksha Kendra as and when required , (b) The amount received as processing /recognition fee or the interest received from the bank on that amount , shall be used by the officer authorized by the Commissioner / Director , Rajya Shiksha Kendra for the following purposes , namely: -
(i) for organizing workshops , meetings , seminars etc. for improving the quality of education ;
(ii) for rewarding and for providing medical facilities to the teachers ;
( iii ) for providing materials for the development of sports / computer/ smart classes in Government schools;
(iv) for giving honorarium , travel expenses etc. to the officers and retired teachers of the Rajya Shiksha Kendra and subordinate offices for providing guidance to the schools ;
(v) for arranging online teaching/ guidance ;
(vi ) to organize long/ short term training / examinations for professional development of teachers ;
(vii ) for educational tour of students ;
(viii) for activities related to information and communication technology and continuous and comprehensive evaluation and for making arrangements for other training programs of School Education Department ;

(ix) for any other activity as approved by the Commissioner / Director , Rajya Shiksha Kendra.
(6) (a) Security Deposit.- Every school seeking fresh recognition / renewal of recognition shall deposit a lump sum amount as security deposit as mentioned in the table given below:

Thus , the security amount shall be deposited in a Nationalized Bank as a fixed deposit in the joint names of the Secretary of the School Committee and the District Project Co - ordinator .
(b) If the institution withdraws the recognition of the school or does not apply for the renewal after the expiry of period of recognition , the amount shall be returned after deducting the balance amount from the security deposit , if any . The amount of security deposit cannot be withdrawn without the consent of the District Project Co- ordinator .
(7) Where any of the provisions are violated , the District Project Co - ordinator shall issue a show cause notice to the school , 14 (24)

in respect of which the condition of grant of recognition has been violated . At least 15 days' time shall be given to the school to submit the reply . In case of not getting a satisfactory answer or not getting the answer within the stipulated period of time , the Collector can inspect the school by constituting an inquiry committee , which shall recommend either to continue the school after proper investigationor withdrawal of the recognition and hand over the report to the Collector . On the basis of the report of the committee , the Collector shall be able to pass an order to withdraw the recognition . No order of withdrawal of recognition shall be passed without the prior approval of the State Government .
(8) The order of withdrawal of recognition passed by the Collector shall be effective from the immediately following academic year and shall specify the names of schools in the vicinity to which the children of that school shall be admitted .
(9) Information about the recognition of the school shall be sent to the local authority , such as Urban Local Body in case of school located in urban area and Gram Panchayat and Janpad Panchayat area in case of school located in rural area .

3. The School shall give 25 percent admission in the first admitted class of the school to the children belonging to the underprivileged group and weaker sections of its neighbourhood. In that case, if it is an aided school , shall provide free and compulsory elementary education to the children admitted in it in proportion to the annual recurring aid or grant so received to meet its annual recurring expenditure .
4. For the children referred to in para 3 , the school shall be reimbursed the expenditure as per sub - section (2) of section 12 of the Act and the school shall have to provide a separate bank account for receiving such reimbursement .
5. The Society/ School shall not collect any capitation fee and shall not undertake any screening process with the child or his parent or guardian .
The school shall not refuse admission to any child , - 6.
(a) in the absence of proof of age ;
(b) if such admission has been sought after the extended period prescribed for admission ; and
(c) on grounds of religion , race or caste , place of birth or any of them .
7. The school shall ensure that , -
(a) no child admitted to a primary school shall be expelled from the school till the completion of primary education ;

Fulfilling the criteria mentioned in section 19 and 25 of the Act in the school and the system of appointment of teachers , shall be maintained till the recognition period ;
(g) teachers shall perform their duties as specified under the provisions of sub - section ( 1 ) of section 24 of the Act;
(h) the teacher himself shall not participate in the activities of private tuition .
(i) the arrangement of fire safety shall be established in accordance with the norms specified under the National Building Code of India , Part - IV .

11. The accounts shall be audited and verified by a Chartered Accountant and proper statement of accounts shall be prepared as per rules . A copy of each statement of accounts shall be sent to the District Education Officer every year .
12. The recognition code number allotted to your school is This code number shall be referred to in any correspondence with this office .
13. The school shall submit such reports and information , as may be required from time to time by the RajyaShiksha Kendra /District Project Co- ordinator , and the school shall comply with such instructions issued by the State Government/ Local Authority , as may be necessary to remove the problems in the operation of the school or to ensure continued fulfilment of the conditions of recognition .
