क्र. एफ- 01-19-2009- तीस. भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए , मध्यप्रदेश के राज्यपाल एतद्वारा, स्वराज संस्थान संचालनालय संस्कृति तृतीय श्रेणी (अराजपत्रित) सेवा भर्ती नियम , 2013 में निम्नलिखित संशोधन करते हैं अर्थात्: -

संशोधन
उक्त नियमों में,
1. नियम 11 के स्थान पर, निम्नलिखित नियम स्थापित किया जाए, अर्थात्:-
" 11. प्रतियोगी परीक्षा द्वारा सीधी भर्ती :
(1 ) सेवा में भर्ती के लिए प्रतियोगिता परीक्षा ऐसे अंतरालों पर संचालित की जाएगी, जैसा कि सरकार द्वारा समय - समय पर बोर्ड / आयोग के परामर्श से विनिश्चित किया जाए तथा परीक्षा ऐसे मानदण्डों के अनुसार संचालित की जाएगी जैसा कि सरकार द्वारा प्रसारित किया जाए ।
(2) मध्यप्रदेश लोक सेवा (अनुसूचित जातियों, अनुसूचित जनजातियों और अन्य पिछड़ा वर्ग के लिए आरक्षण ) नियम, 1998 के अनुसार सीधी भर्ती के लिए 16 प्रतिशत , 20 प्रतिशत तथा 27 प्रतिशत पद क्रमशः अनुसूचित जाति, अनुसूचित जनजाति तथा अन्य पिछड़ा वर्ग के लिए आरक्षित होंगे तथा 10 प्रतिशत पद आर्थिक रूप से कमजोर वर्गों के लिए आरक्षित होंगे । मध्यप्रदेश सिविल सेवा (महिलाओं की नियुक्ति के लिए विशेष उपबंध ) नियम, 1997 के अनुसार महिला अभ्यर्थियों के लिए पद आरक्षित होंगे ।
(3 ) इस प्रकार आरक्षित रिक्तयों को भरते समय अनुसूचित जाति तथा अनुसूचित जनजाति और अन्य पिछड़े वर्ग के अभ्यर्थियों पर नियुक्ति के लिए विचार उसी मध्यप्रदेश राजपत्र, दिनांक 6 जनवरी 2023

नमें किया जाएगा, जिस क्रम में उनके नाम नियम 13 में विनिर्दिष्ट सूची में अहीं, भले ही उनका सापेक्षिक रैंक अन्य अभ्यर्थियों से निम्नतर क्यों न हो ।
उप नियम (3 ) के अधीन प्रशासन में दक्षता बनाए रखने का समुचित ध्यान रखते हुए सेवा में नियुक्ति के लिए बोर्ड / आयोग द्वारा चयनित यथास्थिति अनुसूचित जाति, अनुसूचित जनजाति तथा अन्य पिछड़ा वर्ग के अभ्यर्थी, उनके लिए आरक्षित रिक्तियों के विरूद्ध नियुक्त किए जा सकेंगे ।
(5 ) यदि अनुसूचित जाति, अनुसूचित जनजाति के अभ्यर्थियों की पर्याप्त संख्या, उनके लिए आरक्षित समस्त रिक्तियों को भरने के लिए उपलब्ध न हो , तो वे उस प्रवर्ग, जिसके लिए पद आरक्षित था या थे, से भिन्न व्यक्तियों द्वारा भरे जा सकेंगे । वे किसी भी रीति में अनारक्षित नहीं किए जाएंगे ।
(6) शासन द्वारा दिव्यांगजनों के लिए क्षैतिज आरक्षण की व्यवस्था होगी ।
(7) मध्यप्रदेश शासन, सामान्य प्रशासन विभाग के परिपत्र दिनांक 25 जुलाई , 2018 के अनुसार भर्ती किए जाने वाले पदों का 20 प्रतिशत संविदा पर नियुक्त अधिकारियों / कर्मचारियों के लिए आरक्षित होगा । " ।
2. नियम 14 के स्थान पर, निम्नलिखित नियम स्थापित किया जाए , अर्थात्:-
" 14. पदोन्नति के लिए पात्रता की शर्तें.-
(1 ) उप- नियम (2) के उपबंधों के अध्यधीन रहते हुए, समिति उन समस्त व्यक्तियों के मामलों पर विचार करेगी, जिन्होंने उस वर्ष की जनवरी के प्रथम दिन , उन पदों पर, जिनसे पदोन्नति की जानी है, उतने वर्षों की सेवा पूर्ण कर ली हो, जैसा अनुसूची चार के कालम (4 ) में विनिर्दिष्ट है और जो उप नियम (2 ) के उपबंधों के अनुसार विचारण क्षेत्र में आते हों :
परन्तु सामान्य प्रशासन विभाग के आदेश क्रमांक 2266/1987/1 (3 ) 67 दिनांक 21.10.67 के अनुसार, ऐसे व्यक्ति, जो आपातकालीन सेवाओं / अल्प सेवा कमीशन से सेवानिवृत्त हुए हों और जो संचालनालय की सेवा से संबंद्ध हुए हों, उनकी सेवा की गणना पदग्रहण की तारीख से की जाएगी तथा कनिष्ठ व्यक्ति को हेतु उसकी पदावधि पूर्ण करने के आधार पर अपने से वरिष्ठ से पहले पदोन्नति के लिए विचार नहीं किया जाएगा ।
(2) पदोन्नति के लिए विचारण क्षेत्र सामान्य प्रशासन विभाग द्वारा समय - समय पर जारी अनुदेशों / नियमों के अनुसार होगा ।

(3) विभागीय पदोन्नति समिति या चयन समिति उन अभ्यर्थियों की एक सूची तैयार करेगी , जो शर्तों को पूरा करते हों और उस समिति द्वारा सेवा में चयन के लिए उपयुक्त समझे गए हों । यह सूची चयन सूची तैयार किए जाने की तारीख से एक वर्ष के दौरान सेवानिवृत्ति या पदोन्नति के कारण होने वाली प्रत्याशित रिक्तियों को भरने के लिये पर्याप्त होगी ।
(4) सूची में सम्मिलित अभ्यर्थियों के नाम, सेवा या पदों में वरिष्ठता के क्रम में रखे जाएंगे ।
स्पष्टीकरण- कोई व्यक्ति, जिसका नाम चयन सूची में सम्मिलित किया गया हो , किन्तु जिसे सूची की विधिमान्यता के दौरान पदोन्नत नहीं किया गया हो , उसका केवल उसके पूर्वतर चयन के आधार पर उन व्यक्तियों पर, जिन पर पश्चात्वर्ती चयन में विचार किया गया हो, वरिष्ठता का कोई दावा नहीं होगा ।
(5) चयन सूची, जब तक कि नियम 15 के उप नियम (4 ) के अनुसार उसका पुनर्विलोकन या पुनरीक्षण नहीं कर लिया जाता, साधारणः एक वर्ष के लिए प्रवृत्त रहेगी, किन्तु उसकी विधिमान्यता उसे तैयार किये जाने की तारीख से 18 मास की कुल कालावधि के परे नहीं बढ़ाई जाएगीः
परंतु चयन सूची में सम्मिलित किसी व्यक्ति की ओर से आचरण या कर्तव्य के पालन में गंभीर चूक की दशा में नियुक्ति प्राधिकारी के अनुरोध पर चयन सूची का विशेष पुनर्विलोकन किया जा सकेगा और विभागीय पदोन्नति समिति, यदि वह उचित समझे, तो ऐसे व्यक्ति का नाम चयन सूची से हटा सकेगी । " ।
3. नियम 16 के स्थान पर, निम्नलिखित नियम स्थापित किया जाए , अर्थात्ः-
" 16. परिवीक्षा.-
सेवा में सीधी भर्ती द्वारा भर्ती किया गया प्रत्येक व्यक्ति तीन वर्ष की कालावधि के लिए परीवीक्षा पर नियुक्त किया जाएगा । उक्त अवधि के दौरान उस पद के वेतनमान के न्यूनतम का 70 प्रतिशत प्रथम वर्ष में , 80 प्रतिशत द्वितीय वर्ष में एवं 90 प्रतिशत तृतीय वर्ष में स्टायपेंड के रूप में देय होगा । परिवीक्षावधि सफलतापूर्वक पूर्ण किए जाने पर वेतनमान में वेतन प्रारम्भ होगा ।

उपरोक्त कम्प्यूटर डिप्लोमा के अलावा किसी मान्यताप्राप्त संस्थान से निम्नलिखित अर्हता भी विधिमान्य हैं ।

No. F - 01-19 / 2009/ 30 : In exercise of the powers conferred by the proviso to Article 309 of the Constitution of India, the Governor of Madhya Pradesh, hereby makes the following amendments of the Swaraj Sansthan Sanchalanalaya Culture Department Class - III (Non- Gazetted) Services Recruitment Rules , 2013 namely: -
AMENDMENTS
In the said rules , -
1. For rule 11 , the following rule shall be substituted , namely : - " 11. Direct Recruitment through competitive Examination .
(1) The competitive examination for recruitment to the service shall be conducted at such intervals as may be decided by the Government in consultation with the Board/ Commission from time to time and the examination shall be conducted in accordance with such norms as may be propagated by the Government .
(
2) According to the Madhya Pradesh Public Service (Reservation for Scheduled Castes , Scheduled Tribes and Other Backward Classes) Rules , 1998 for direct recruitment , 16 percent , 20 percent, 27 percent posts Shall be reserved for the Scheduled Castes , Scheduled Tribes and Other Backward Classes respectively and 10 percent posts shall be reserved for the Economically weaker Sections . According to the Madhya Pradesh Civil Services (Special Provision for the Appointment of Women) Rules , 1997, posts will be reserved for women candidates .

(3) While filling up the vacancies so reserved , the candidates belonging to the Scheduled Castes , Scheduled Tribes and Other Backward Classes shall be considered for appointment according to their names appearing in the list specified in rule 13 , even if their relative rank is somewhat lower than that of other candidates .
(4) Candidates belonging to the Scheduled Castes , Scheduled Tribes and Other Backward Classes selected by the Board / Commission to be suitable for appointment to the service with due regard to the maintenance of efficiency of administration under sub - rule ( 3 ) , as the case may be , appointed against the vacancies reserved for them .
(5) If sufficient numbers of candidates belonging to the Scheduled Castes or the Scheduled Tribes are not available to fill all the vacancies reserved for them , they may be filled by persons other than the category for which the post or posts are reserved . They will not be de- reserved in any manner .
(6) There shall be a system of horizontal reservation for the handicapped by the Government .
(7) According to the circular dated 25th July , 2018 of the Government of Madhya Pradesh , General Administration Department , 20 percent of the posts to be recruited shall be reserved for the officers / employees appointed on contract . ".

2. " For rule 14 , the following rule shall be substituted , namely : - " 14. Conditions of Eligibility for Promotion.-
(1 ) Subject to the provisions of sub - rule (2) the Committee shall consider the cases of all persons , who on the 1st day of January of that year have completed such number of year of service on the posts from which promotion is to be made as specified in column ( 4) of Schedule IV and are within the zone of consideration in accordance with the provision of sub - rule ( 2 ) :
Provided that vide General Administration Department's Order No. 2266/1987/1 (3 )67 , dated 21.10.67 , the persons who have retired from emergency services / short service commission and join the services of the directorate , their services shall be counted from the joining date and junior candidates shall not be considered for promotion before his senior , on the basis of completion of his tenure for promotion .
(2) The zone of consideration for promotion shall be in accordance with the instructions / rules issued by General Administrative Department from time to time .
(3) The Departmental Promotion Committee or Selection Committee shall prepare a list of persons who fulfill the conditions and held by the committee to be suitable for selection . The list shall be sufficient to cover the anticipated vacancies on account of retirements and promotion during the course of one year from the date of preparations of the select list .
(4) The names of the persons included in the list shall be arranged in order of seniority in the service or posts .

Explanation : A person whose name is included in the select list but who is not promoted during the validity of the list , shall have no claim to seniority over those considered in subsequent selection merely by the fact of his earlier selection .
(5) The select list shall ordinarily be in force for one year until it is reviewed or revised in accordance with sub - rule (4) of rule 15 but its validity shall not be extended beyond a total period of 18 months from the date of its preparation:
Provided that , in the event of a grave lapse in the conduct of performance of duties on the part of any person included in the select list a special review of the select list may be made at the instance of the appointing authority and the departmental promotion committee may if it thinks fit , remove the name of such person from the select list . " .
3. For rule 16 , the following rule shall be substituted , namely : - " 16.Probation.-
Every person recruited into the Service by direct recruitment shall be appointed on probation for a period of three years . During the said period , 70 percent of the minimum of the pay scale of that post in the first year , 80 percent in the second year and 90 percent in the third year shall be payable as stipend . On successful completion of the probationary period , the pay shall be started in the pay scale . " .
