क्र. एफ 7-12-2016- उन्तीस- 1.- यतः राज्य सरकार की राय में राष्ट्रीय खाद्य सुरक्षा अधिनियम, 2013 ( 2013 का 20 ) के अधीन बनाए गए मध्यप्रदेश खाद्य सुरक्षा नियम , 2017 के नियम 11 में संशोधन किया जाना आवश्यक एवं समीचीन है;
अतएव मध्यप्रदेश खाद्य सुरक्षा नियम, 2017 में संशोधन का निम्नलिखित प्रारूप , जिसे राज्य सरकार राष्ट्रीय खाद्य सुरक्षा अधिनियम , 2013 ( 2013 का 20 ) की धारा 40 की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए बनाना प्रस्तावित है , उक्त अधिनियम की धारा 40 की उपधारा ( 1 ) द्वारा अपेक्षित किए गए अनुसार उन समस्त व्यक्तियों की, जिनके कि उससे प्रभावित होने की संभावना है, जानकारी के लिए एतद्वारा प्रकाशित किया जाता है और एतद्वारा यह सूचना दी जाती है, कि इस सूचना के मध्यप्रदेश राजपत्र में प्रकाशन की तारीख से 15 दिवस का अवसान होने पर संशोधन के उक्त प्रारूप पर विचार किया जाएगा.
किसी भी ऐसी आपत्ति या सुझाव , जो संशोधन के उक्त प्रारूप के संबंध में किसी व्यक्ति से ऊपर विनिर्दिष्ट कालावधि का अवसान होने पर या उसके पूर्व संचालक, खाद्य , नागरिक आपूर्ति एवं उपभोक्ता संरक्षण संचालनालय, प्रथम तल, खण्ड ' घ ' विंध्याचल भवन, भोपाल को प्राप्त हो, पर राज्य शासन द्वारा विचार किया जाएगा .
संशोधन का प्रारूप
नियम 11 में उप नियम ( 2 ) में, खण्ड ( क) के स्थान पर, निम्नलिखित खण्ड स्थापित किए जाएं; अर्थात् . -
" (क) सेवारत/सेवानिवृत्त शासकीय सेवक के खाद्य आयोग अध्यक्ष के रूप में नियुक्त किए जाने की दशा में वह व्यक्ति पात्र माना जाएगा-
जो अखिल भारतीय सेवाओं या संघ या राज्य की किन्हीं अन्य सिविल सेवाओं का सदस्य हो या रहा हो या जो संघ या राज्य के अधीन कोई सिविल पद धारण किए हुए हो और जिन्हें कृषि, सिविल आपूर्ति, पोषण, स्वास्थ्य के क्षेत्र में या किसी संबद्व क्षेत्र में खाद्य सुरक्षा , नीति बनाने और प्रशासन से संबंधित मामलों में ज्ञान एवं अनुभव प्राप्त हो. "

एफ 7-12-2016 - उन्तीस-1.- भारत के संविधान के अनुच्छेद 348 के खण्ड ( 3 ) के अनुसरण में, इस आशय की अधिसूचना क्र. एफ 7-12-2016- उन्तीस -1 , दिनांक 19 जनवरी 2023 का अंग्रेजी अनुवाद राजपाल के प्राधिकार से एतद्वारा प्रकाशित किया जाता है.
मध्यप्रदेश के राज्यपाल के नाम से तथा आदेशानुसार, बी. के. चन्देल , उपसचिव.

NOTICE
No. F 7-12-2016 - XXIX- 1.- WHEREAS , in the opinion of the State Government it is necessary and expledient to amend the rule 11 of the Madhya Pradesh Food Security Rules , 2017 made under the National Food Security Act, 2013 (20 of 2013 ) ;
NOW, THEREFORE , the following draft of amendment in the Madhya Pradesh Food Security Rules , 2017 , which the State Government Proposes to make in exercise of the powers conferred by sub - section ( 1 ) of Section 40 of the National Food Security Act, 2013 ( 20 of 2013 ) is hereby published as required sub- section ( 1 ) of Section 40 of the said Act for the information of all persons likely to be affected thereby and notice hereby given that said draft of amendment shall be taken into consideration on the expiry of 15 days from the date of publication of this notice in the Madhya Pradesh Gazette .
Any objection or suggestion which is received by the Director , Directorate of Food Civil Supplies and Consumer Protection, First Floor Block - D , Vindhyachal Bhawan , Bhopal from any person with respect to the said draft of amendment on or before the expiry of the period specified above shall be considered by the State Government .
DRAFT OF AMENDMENT
In rule 11 , in sub - rule (2) , for clause ( a ) , the following clause shall be substituted , namely :-
"( a) In case of a serving / retired Government servant to be appointed as the Chairperson of the Food Commission, the persons shall be treated eligible :-
Who are or have been member of the All India Services or any other Civil Services of the Union or State or holding a civil post under the Union or State having knowledge and experience in matters relating to food security, policy making and administration in the field of agriculture , civil supplies , nutrition, health or any allied field . "
