क्र. 893388-2022- बी-4- दो.- भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए, मध्यप्रदेश के राज्यपाल, एतद्वारा , मध्यप्रदेश लोक अभियोजन ( राजपत्रित ) सेवा भरती नियम, 1991 में निम्नलिखित संशोधन करते हैं, अर्थात्:-
संशोधन
उक्त नियमों में , नियम 18 के पश्चात् निम्नलिखित नवीन नियम अंतःस्थापित किया जाए, अर्थात्:-
" 18 - क. नियम 17 में यथाउपबंधित चयन सूची की अनुपलब्धता की दशा में एवं रिक्त उच्च पदों के कारण विभाग की कार्यदक्षता पर पड़ने वाले विपरीत प्रभाव के निवारण एवं राज्य के दण्ड न्यायालयों में उत्तरदायित्वपूर्ण अभियोजन के संचालन को सुनिश्चित किए जाने हेतु महानिदेशक अभियोजन, शासन की पूर्व अनुमति से, किसी पात्र उप- संचालक को संयुक्त संचालक का प्रभार, किसी पात्र जिला लोक अभियोजन अधिकारी को उप-संचालक का प्रभार एवं किसी पात्र सहायक जिला लोक अभियोजन अधिकारी को जिला लोक अभियोजन अधिकारी / अतिरिक्त जिला लोक अभियोजन अधिकारी का प्रभार प्रदान किए जाने का आदेश , निम्न शर्तों के अधीन प्रदान कर सकेंगे , अर्थात्:-
(1) कार्यवाहक संयुक्त संचालक या उप संचालक या जिला लोक अभियोजन अधिकारी या अतिरिक्त जिला लोक अभियोजन अधिकारी के रूप में ऐसा अधिकारी , ऐसे पद पर, जिस पर कि उसके पास कार्यवाहक प्रभार है, वरिष्ठता या वेतन या भत्ते का दावा नहीं करेगा .
(2) संचालक, लोक अभियोजन , ऐसे कार्यवाहक प्रभारी अधिकारी को, किसी भी समय, बिना कोई कारण बताए, उसके मूल पद पर भेज सकेगा . जैसे ही उक्त रैंक का अधिकारी उपलब्ध हो, ऐसे कार्यवाहक प्रभारी अधिकारी को उसके मूल पद पर वापस कर दिया जाएगा.

(3) कार्यवाहक अभियोजन अधिकारी ऐसे उच्च कार्यवाहक पद की समस्त प्रशासनिक एवं वित्तीय शक्तियों का प्रयोग कर सकेगा.
(4) कार्यवाहक अभियोजन अधिकारी पदोन्नति के लिए विचारण के समय विशेष वरीयता का दावा नहीं करेगा. "
No. 893388-2022 - B - 4 - II . In exercise of the powers conferred by the proviso to Article 309 of the Constitution of India , the Governor of Madhya Pradesh , hereby, makes the following amendments in the Madhya Pradesh Public Prosecution (Gazetted ) Services Recruitment Rules , 1991 , namely :-
AMENDMENTS
In the said rules , after rule 18 , the following new rule shall be inserted , namely :-
" 18 - A . In the event of non - availability of the select list as provided in rule 17 and to prevent the adverse impact on the efficiency of the department due to vacant higher posts and to ensure conduct of responsible prosecution in the criminal courts of the State , the Director General of Prosecution, with prior permission of the Government may order to grant the charge of Joint Director to an eligible Deputy Director, charge of Deputy Director to an eligible District Public Prosecution Officer and the charge of District Prosecution Officer/ Additional District Prosecution Officer to an eligible Assistant District Public Prosecution Officer , under the following conditions , namely : -
(1) Such Officer as an Officiating Joint Director or Deputy Director or District Public Prosecution Officer or Additional District Public Prosecution Officer shall not claim seniority or salary or allowances on the post on which he shall have officiating charge .
(2) The Director, Public Prosecution may send such Officiating Incharge Officer to his original post at any time without assigning any reason. As soon as the officer of the said rank is available, such an officiating Incharge Officer shall be returned to his original post .
(3) The Officiating Prosecution Officer may exercise all the administrative and financial powers of such higher officiating post .
(4) The Officiating Prosecution Officer shall not claim special preferences at the time of consideration for promotion . "
