क्र. एफ- ए- 3-42-2017-1- पांच (02). मध्यप्रदेश माल और सेवाकर अधिनियम, 2017 (2017 का 19) की धारा 9 की उपधारा (3 ) और उपधारा (4) , धारा 11 की उपधारा (1 ) , धारा 15 की उपधारा (5), और धारा 148 के तहत् प्रदत्त शक्तियों का प्रयोग करते हुए, राज्य सरकार , इस बात से संतुष्ट होते हुए कि ऐसा करना जनहित में आवश्यक है , और जीएसटी परिषद् की सिफारिशों के आधार पर, एतद्वारा, इस विभाग की अधिसूचना क्रमांक एफ ए- 3-42-2017-1- पांच (53) , भोपाल, दिनांक 18 अक्टूबर 2017 में और आगे भी निम्नलिखित संशोधन करती है, यथा:-
उक्त अधिसूचना में, पैराग्राफ 3 में, स्पष्टीकरण में, खण्ड (iv) के बाद, निम्नलिखित खण्ड को अंतःस्थापित किया जाएगा, अर्थात्ः-
"(iva) शंकाओं के निवारण हेतु, यह स्पष्ट किया जाता है कि शैक्षिक संस्थानों में प्रवेश के लिए प्रवेश परीक्षा आयोजित करने के लिए नेशनल टेस्टिंग एजेंसी सहित केंद्र सरकार या राज्य सरकार द्वारा स्थापित किसी भी प्राधिकरण, बोर्ड या निकाय को शिक्षण संस्थानों में प्रवेश के लिए प्रवेश परीक्षा के संचालन के माध्यम से सेवाएं प्रदान करने के सीमित उद्देश्य के लिए शैक्षिक संस्थान माना जाएगा. "
2. यह अधिसूचना 01 मार्च , 2023 से प्रवृत्त हुई मानी जायेगी.

क्र. एफ- ए- 3-42-2017-1- पांच. भारत के संविधान के अनुच्छेद 348 के खण्ड (3 ) के अनुसरण में, इस आशय की अधिसूचना क्रमांक एफ ए 3-42-2017-1- पांच (02 ) , दिनांक13 मार्च, 2023 का अंग्रेजी अनुवाद राज्यपाल के प्राधिकार से एतद्वारा प्रकाशित किया जाता है.
मध्यप्रदेश के राज्यपाल के नाम से तथा आदेशानुसार , आर. पी. श्रीवास्तव, उपसचिव.
Bhopal , the 13th March 2023
No. F A- 3-42-2017-1 - V ( 02 ) . In exercise of the powers conferred by sub - sections ( 3 ) and (4) of Section 9, sub - section ( 1 ) of Section 11 , sub - section (5) of Section 15 and Section 148 of the Madhya Pradesh Goods and Services Tax Act , 2017 ( 19 of 2017) , the State Government, on being satisfied that it is necessary in the public interest so to do, on the recommendations of the Council , hereby makes the following further amend- ments to amend this department's Notification No. F A- 3-42-2017-1 - V (53 ) , dated 30th June 2017 , namely: -
In the said notification , in paragraph 3 , in the Explanation , after clause (iv ) , the following clause shall be inserted, namely :
" ( iva) For removal of doubts , it is clarified that any authority , board or body set up by the Central Government or State Government including National Testing Agency for conduct of en- trance examination for admission to educational institutions shall be treated as an 'educa- tional institution' for the limited purpose of providing services by way of conduct of en- trance examination for admission to educational institutions . " .
2. This notification shall be deemed to have come into effect from the 01st March, 2023 .
