No. F 3/3/a/ooog/2023/Sec-2-05(CT) (6) In exercise of the powers conferred by sub section (¹) of Section ²⁷ of the Madhya Pradesh Excise Act, 1915 (No. ttof 1915)and in supersession of this Department's Notification No. F-B-L-16-2021-2-V-(08), dated 07 September 2021, the State Government, hereby, prescribes the annual license fee for B-3 (Brewery license) issued under Madhya Pradesh beer and wine rules as, Rs. 2O,AO,OOO/- (Rupees twenty lakh; per year for production capacity up to 05 lakh hecto liters per year, Rs. 30,00,000/- (Rupees thirty lakh) per year for production capacity 05 lakh to 10 lakh hecto liters pcr year and Rs. 40,O0,OOO/- (Rupees forty lakh) per year for production capacity more than 10lakh hecto liters per year.

AMENDMENTS

In the said rules.

l- After sub rule (³) of rule 4 the following sub rule shall be inserted :- "(³-a) A beer manufacturing unit operating in the state can be given on lease f-or its unutilized capacity to any registered company who is having annual turnover above the limit as may be notifred by the State Government.".

2- This notification shall be deemed to have come into force from 1't April, 2022.

Explanation- 1 Foreign liquor (Spirit) includes Whisky, Brandy, Rum, Gin, Vodka, Liquor, Cordial, Bitter and their mixtures and other preparations, containing spirit as main ingredient.

Malt liquor includes Beer, Ale, Stout, Porter and Cider etc. "Defence services personnel" shall mean defence service personnel receiving foreign liquor through the Defence Carrteen Organization and includes the personnel of the Border Securitr, Force, Indo-Tibetian Border Police and Central Industrial Security Force, receiving foreign liquor through the respective authorized whole sale military canteens."

(2) Any shop for the sale of liquor (whether consumption of liquor therein is permitteci or not) shall not be situated up to a distance of 100 metres from religious institution, recognized middle school, high school, college and government girls hostel.

Provided that the provisions of sub-rule (2) shall not be applicable to such Bar licence which is situated at the present site at a distanoe sf 100 meters or less from the religious Institution, recognized middle school, high school, college and government girls hostel since prior to 22"d February,2023.

(3) After the start of operations of licensed liquor shop at any place, it shall not be deemed to be situated within prohibited distance referred to in sub-rule Q), rt any religious lnstitution, recognized middle school, high school, college and government girls hostel come into existence at a distance less than 100 meters.

Explanation For the purposes of this rule-

(a) "Educational institution" means any middle school, high school, college and government girls hostel, managed or recognized by any local authority or the state government or the central government.

(b) "Religious institution" means an institution for the promotion of any religion and includes temple, math, mosque, church or other place of public religious worship which is managed or owned by a public trust registered under the Madhya Pradesh Public Trusts Act, 1951 or any other enactment for the time being in force and shall include such other religious institutions as the State Government may by order specify in this behalf.

(c) The distance referred to in sub-rule (2) shall be measured from the midpoint of the entrance of the shop along the nearest path by which a pedestrian ordinarily reaches at the, midpoint of the nearest gate of the institution if there is a boundary wall and if there is no boundary wall then the midpoint of the nearest entrance of the institution.

2. This notification shall come into force from lotApril, 2023.
