मध्यप्रदेश नगरपालिक विधि ( संशोधन ) अधिनियम , २०२३
[ दिनांक १८ अप्रैल , २०२३ को राज्यपाल की अनुमति प्राप्त हुई; अनुमति " मध्यप्रदेश राजपत्र ( असाधारण ) " में दिनांक १ ९ अप्रैल , २०२३ को प्रथमबार प्रकाशित की गई. ]
मध्यप्रदेश नगरपालिक निगम अधिनियम, १ ९ ५६ तथा मध्यप्रदेश नगरपालिका अधिनियम , १ ९६१ को और संशोधित करने हेतु अधिनियम.
भारत गणराज्य के चौहत्तरवें वर्ष में मध्यप्रदेश विधान - मंडल द्वारा निम्नलिखित रूप में अधिनियमित हो :-
संक्षिप्त नाम.
१. इस अधिनियम का संक्षिप्त नाम मध्यप्रदेश नगरपालिक विधि ( संशोधन ) अधिनियम, २०२३ है.
भाग-एक
मध्यप्रदेश नगरपालिक निगम अधिनियम , १ ९ ५६ ( क्रमांक २३ सन् १ ९ ५६ ) का संशोधन
२. मध्यप्रदेश नगरपालिक निगम अधिनियम, १ ९ ५६ ( क्रमांक २३ सन् १ ९५६ ) में,
(१ ) धारा १ ९५ में उपधारा ( ५ ) के स्थान पर, निम्नलिखित उपधारा स्थापित की जाए, अर्थात्ः- मध्यप्रदेश अधिनियम क्रमांक २३ सन् १९५६ का संशोधन.
" ( ५ ) यदि किसी भवन या भूमि का स्वामी या अधिभोगी इस धारा के अधीन सूचना या आदेश की तामील के बावजूद उसमें उल्लिखित कार्य , यथास्थिति, उस सूचना या आदेश में विनिर्दिष्ट कालावधि के भीतर करने में असफल रहता है, तो आयुक्त, जुर्माना, जो पांच हजार रुपये तक का हो सकेगा और सूचना में उल्लिखित कार्य पूर्ण नहीं होने तक और अतिरिक्त जुर्माना, जो दो सौ रुपए प्रतिदिन तक का हो सकेगा , अधिरोपित करेगाः
परन्तु इस धारा के उल्लंघन के संबंध में जुर्माने के लिए कार्यवाहियां करने के अधिकार पर प्रतिकूल प्रभाव डाले बिना, आयुक्त अपने अभिकरण के माध्यम से उक्त कार्य करवा सकेगा और बारहवें अध्याय में उपबंधित रीति में, यथास्थिति, उसके स्वामी या अधिभोगी से, इससे संबंधित उपगत व्यय वसूल कर सकेगा. "
(२ ) धारा २९ ० का लोप किया जाए.
(३ ) धारा ३६० का लोप किया जाए.
(४) धारा ३६२ का लोप किया जाए.
भाग-दो
मध्यप्रदेश नगरपालिका अधिनियम , १ ९ ६१ ( क्रमांक ३७ सन् १ ९ ६१ ) का संशोधन
३. मध्यप्रदेश नगरपालिका अधिनियम, १ ९ ६१ ( क्रमांक ३७ सन् १ ९ ६१ ) में, -
(१ ) धारा २०८ में, उपधारा ( ५ ) के स्थान पर, निम्नलिखित उपधारा स्थापित की जाए, अर्थात्ः- मध्यप्रदेश अधिनियम क्रमांक ३७ सन् १९६१ का संशोधन.

मध्यप्रदेश के राज्यपाल के नाम से तथा आदेशानुसार, राजेश यादव , अतिरिक्त सचिव.

THE MADHYA PRADESH NAGARPALIK VIDHI ( SANSHODHAN ) ADHINIYAM, 2023
[Received the assent of the Governor on the 18th April , 2023 ; assent first published in the " Madhya Pradesh Gazette (Extra - ordinary ) " dated the 19th April, 2023. ]
An Act further to amend the Madhya Pradesh Municipal Corporation Act, 1956 and the Madhya Pradesh Municipalities Act, 1961 .
Be it enacted by the Madhya Pradesh Legislature in the Seventy-fourth year of the Republic of India as follows :-
1. This Act may be called the Madhya Pradesh Nagarpalik Vidhi ( Sanshodhan ) Adhiniyam , 2023. Short title.
PART- I
AMENDMENT TO THE MADHYA PRADESH MUNICIPAL CORPORATION ACT, 1956
(NO . 23 OF 1956 )
2. In the Madhya Pradesh Municipal Corporation Act , 1956 (No. 23 of 1956 ) ,-
Amendment to theMadhya Pradesh Act No. 23 of 1956 .
(1) In Section 195, for sub - section (5) , the following sub - section shall be substituted , namely:-
"( 5) If the owner or occupier of a building or land in spite of service of notice or order under this section fails to carry out the work mentioned therein within the period specified in the notice or order , as the case may be , the Commissioner shall impose a fine which may extend to five thousand rupees and further additional fine which may extend to two hundred rupees per day till the work mentioned in the notice is not complete:
Provided that without prejudice to the right to take proceedings for fine in respect of the contravention of this section , the Commissioner may get the said work done through his agency and recover the cost incurred in connection therewith , from the owner or occupier thereof, as the case maybe . in the manner provided in Chapter XII . " .

AMENDMENT TO THE MADHYA PRADESH MUNICIPALITIES ACT, 1961
(NO . 37 OF 1961 )
3. In the Madhya Pradesh Municipalities Act , 1961 (No. 37 of 1961 ) ,—
Amendment to theMadhya Pradesh Act No. 37 of 1961 .
( 1) In Section 208 , for sub- section (5) , the following sub - section shall be substituted , namely:-
