क्रमांक 816 / 3600 / 2022 / नियम / चार , भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए, मध्यप्रदेश के राज्यपाल, एतद् द्वारा, मध्यप्रदेश सिविल सेवा (पेंशन ) नियम , 1976 में निम्नलिखित और संशोधन करते हैं, अर्थात्: -
संशोधन
उक्त नियमों में , नियम 64 के स्थान पर, निम्नलिखित नियम स्थापित किय जाए , अर्थात्ः-
"64. अनंतिम पेंशन, जहां विभागीय या न्यायिक कार्यवाहियां लम्बित हों.
(1 ) (क ) नियम 9 के उप - नियम (4 ) में निर्दिष्ट शासकीय सेवक के संबंध में, कार्यालय प्रमुख , शासकीय सेवक की सेवानिवृत्ति की तारीख तक या यदि वह सेवानिवृत्ति की तारीख को निलंबन के अधीन था, तो उस तारीख तक, जो उस तारीख के ठीक पूर्व की थी, जिसको कि उसे निलंबन के अधीन रखा गया था अर्हकारी सेवा के आधार पर अनुज्ञेय अधिकतम पेंशन के समतुल्य अनंतिम पेंशन अधिकृत करेगा ।

(ख ) अनंतिम पेंशन स्थापना वेतन देयक पर आहरित की जाएगी और कार्यालय प्रमुख द्वारा सेवानिवृत्ति की तारीख से प्रारंभ होकर उस तारीख तक तथा उस तारीख को सम्मिलित करते हुए , जिसको कि विभागीय या न्यायिक कार्यवाहियां समाप्त होने के पश्चात् सक्षम प्राधिकारी द्वारा अंतिम आदेश पारित किए गए , सेवानिवृत्त शासकीय सेवक को भुगतान की जाएगी ।
(ग ) विभागीय या न्यायिक कार्यवाहियां समाप्त होने और उन पर अंतिम आदेश जारी होने तक शासकीय सेवक को किसी उपदान का भुगतान नहीं किया जाएगा :
परन्तु जहां विभागीय कार्यवाहियां मध्यप्रदेश सिविल सेवा ( वर्गीकरण नियंत्रण तथा अपील ) नियम, 1966 के नियम 16 के अधीन , उक्त नियमों के नियम 10 के खण्ड (एक ) , (दो ) तथा (चार ) में विनिर्दिष्ट शास्तियों में से कोई शास्ति अधिरोपित करने के लिए संस्थित की गई हैं, वहां शासकीय सेवक को नियमों के अधीन अनुज्ञेय उपदान के 90% तक अनंतिम उपदान का भुगतान किया जाने को भी प्राधिकृत किया जाएगा ।
(2) अनंतिम उपदान स्थापना वेतन देयक पर आहरित किया जाएगा और कार्यालय प्रमुख द्वारा लेखा संपरीक्षा कार्यालय को सूचित करते हुए , नियम 60 के उप - नियम ( 2 ) में उल्लेखित बकायों को समायोजित करने के पश्चात् सेवानिवृत्त शासकीय सेवक को भुगतान किया जाएगा । उप - नियम ( 1 ) के अधीन किए गए अनंतिम पेंशन/ उपदान के भुगतान, ऐसी कार्यवाहियों के समापन पर ऐसे शासकीय सेवक को स्वीकृत अंतिम सेवानिवृत्ति लाभों के विरुद्ध समायोजित किए जाएंगे, किन्तु जहां अंतिम रूप से स्वीकृत पेंशन / उपदान अनंतिम पेंशन / उपदान से कम है या पेंशन / उपदान को कम किया जाता है अथवा या तो स्थायी रूप से या विनिर्दिष्ट कालावधि के लिए रोक लगाई जाती है, वहां वसूली नहीं की जाएगी ।
टिप्पण : विभागीय या न्यायिक कार्यवाहियां जारी रहने पर भी नियम 64 के अधीन अनंतिम पेंशन प्रदान किया जाना अनिवार्य है ।
2. यह संशोधन 12 दिसम्बर , 1990 से प्रवृत्त हुआ समझा जाएगा ।

R.N. 816 / 3600 / 2022 / RULE /IV In exercise of the powers conferred by the proviso to article 309 of the Constitution of India , the Governor of Madhya Pradesh , hereby makes the following further amendment in the Madhya Pradesh Civil Services (Pension) Rules , 1976, namely:-
AMENDMENT
In the said rules , for rule 64 , the following rule shall be substituted namely : -
"64. Provisional pension , where departmental or judicial proceedings may be pending : -
(1) (a) In respect of a Government servant referred to in sub - rule (4) of rule 9, the Head of office shall authorize the provisional pension equal to the maximum pension which would have been admissible on the basis of qualifying service upto the date of retirement of the Government servant , or if he was under suspension on the date of retirement upto the date immediately preceding the date on which he was placed under suspension ;
The provisional pension shall be drawn on establishment pay bill and (b) paid to the retired Government servant by the Head of office during the period commencing from the date of retirement upto and including the date on which, after the conclusion of departmental or judicial proceedings , final orders are passed by the competent authority;
(c) No gratuity shall be paid to the Government servant until the conclusion of the departmental or judicial proceedings and issue of final orders thereon ;
provided that where departmental proceedings have been instituted under rule 16 of the Madhya Pradesh Civil Services ( Classification Control and Appeal ) Rules , 1966, for imposing any of the penalties specified in clause (i) , ( ii) and (iv) of rule 10 of the said rules , the payment of provisional gratuity to the extent of90% of the gratuities admissible under the rules shall also be authorized to be paid to the Government servant .

(2) Provisional gratuity shall be drawn on establishment pay bill and paid to the retired Government servant by the Head of office after adjusting dues mentioned in sub - rule (2) of rule 60 under intimation to audit office . Payment of provisional pension / gratuity made under sub - rule ( 1 ) shall be adjusted against final retirement benefits sanctioned to such Government servant upon conclusion of such proceedings , but recovery shall not be made where the pension/gratuity finally sanctioned is less than the provisional pension/gratuity or the pension/gratuity is reduced or withheld either permanently or for a specified period .
Note : Grant of provisional pension under rule 64 is mandatory even if departmental or judicial proceedings is continued . " .
2. This amendment shall be deemed to have been come into force form 12th December , 1990 .
