क्रमांक/एफ-15 / 04 / 2022 /14-2 : - मध्यप्रदेश कृषि उपज मण्डी अधिनियम , 1972 ( क्रमांक 24 सन् 1973 ) की धारा 69 द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए राज्य सरकार , एतद्वारा , इस विभाग अधिसूचना क्रमांक/ एफ-15/04/2022/14-2 दिनांक 7 अप्रैल , 2022 में निम्नलिखित संशोधन करती है, अर्थातः-
संशोधन
उक्त अधिसचूना में , निबंधन तथा शर्तें में, -
1. शर्त क्रमांक 2 के स्थान पर , निम्नलिखित शर्त स्थापित की जाए , अर्थातः-
" 2. अधिनियम के उपबंधों के अधीन निर्यात के प्रयोजन के लिए मध्यप्रदेश राज्य के किसी भी कृषि उपज मंडी क्षेत्र में क्रय की गई अधिसूचित कृषि उपज " गेंहू" को मंडी शुल्क की प्रतिपूर्ति के लाभ के लिए विचार में लिया जाएगा । निर्यातक को एक वचनपत्र प्रस्तुत करना होगा कि निर्यात की गई मात्रा मध्यप्रदेश राज्य का उत्पाद है। " ।

2. शर्त क्रमांक 3 के स्थान पर , निम्नलिखित शर्त स्थापित की जाए , अर्थातः-
"3. मंडी शुल्क की यह प्रतिपूर्ति दिनांक 01.04.2022 से 30.06.2022 की अवधि के दौरान भुगतान पत्रक के माध्यम से खरीदे गए तथा दिनांक 31.03.2023 तक निर्यातित ( " मध्यप्रदेश मूल के गेंहू" के रूप में निर्यातित ) अधिसूचित कृषि उपज " गेंहू" की मात्रा पर प्रदान की जाएगी । " ।
3. शर्त क्रमांक 4 के स्थान पर , निम्नलिखित शर्त स्थापित की जाए , अर्थातः-
"4. संबंधित निर्यातक को मंडी शुल्क की ऊपर उल्लिखित प्रतिपूर्ति केवल राज्य से क्रय की गई एवं मध्यप्रदेश मूल के उत्पाद के रूप में निर्यात की गई अधिसूचित कृषि उत्पाद की मात्रा पर ही प्रदान की जाएगी । ऐसे मंडी शुल्क की प्रतिपूर्ति उस अधिसूचित कृषि उत्पाद पर नहीं की जाएगी, जिसे देश के अन्य राज्यों से किसी वाणिज्यिक संव्यवहार में या इस अधिसूचना में विहित नियमों तथा शर्तों के उल्लंघन में खरीदा और बेचा गया है । " ।
4. शर्त क्रमांक 9 के स्थान पर , निम्नलिखित शर्त स्थापित की जाए , अर्थातः-
" 9 मंडी शुल्क की प्रतिपूर्ति के लिए आवेदन, संबंधित दस्तावेजों के साथ , प्रबंध निदेशक , मध्यप्रदेश राज्य कृषि विपणन बोर्ड , भोपाल को शर्त क्रमांक 3 के अनुसार निर्यात की विहित अंतिम तिथि 31.03.2023 से 60 दिनों के भीतर अर्थात् 31.05.2023 तक जमा किया जा सकेगा। उपरोक्त उल्लिखित कालावधि के पश्चात् विलंब से प्राप्त आवेदनों पर विचार नहीं किया जाएगा । " ।
5. शर्त क्रमांक 12 के स्थान पर, निम्नलिखित शर्त स्थापित की जाए , अर्थातः-
" 12 मण्डी शुल्क प्रतिपूर्ति का भुगतान मध्यप्रदेश राज्य कृषि विपणन बोर्ड के बजट प्रावधानों के निर्यात प्रोत्साहन शीर्ष से जारी किया जाएगा । "
2. यह संशोधन इस अधिसूचना के मध्यप्रदेश राजपत्र में प्रकाशन की तारीख से प्रवृत्त, होगा ।

क्र. एफ 15-04-2022- चौदह -2.- भारत के संविधान के अनुच्छेद 348 के खण्ड ( 3 ) के अनुसरण में, इस विभाग के समसंख्यक आदेश दिनांक 24 मई 2023 का अंग्रेजी अनुवाद राज्यपाल के प्राधिकार से एतद्वारा प्रकाशित किया जाता है .
मध्यप्रदेश के राज्यपाल के नाम से तथा आदेशानुसार, अशोक बर्णवाल , अपर मुख्य सचिव.
Bhopal , the 24th May 2023
No.F-15 /04/2022/ 14-2 : - In exercise of the powers conferred by section 69 of the Madhya Pradesh Krishi Upaj Mandi Adhiniyam , 1972 (No. 24 of 1973 ) , the State Government , hereby, makes the following amendments in this department's Notification No.F- 15 /04 / 2022 / 14-2 dated 7th April , 2022 , namely:-
AMENDMENTS
In the said notification , In Terms and conditions, -
1. For condition number 2, the following condition shall be substituted , namely:-
" 2. The notified agricultural produce " wheat " purchased in any Krishi Upaj Mandi area of the Madhya Pradesh State for the purpose of export under the provisions of the Act shall be considered for the benefit of reimbursement of mandi fees . The exporter has to submit an undertaking that the quantity exported is the product of Madhya Pradesh State . " .
2. For condition number 3, the following condition shall be substituted, namely: -
" 3. This reimbursement of mandi fees shall be provided on the quantity of notified agricultural produce " wheat " purchased via Bhugtan Patrak during the period 01.04.2022 to 30.06.2022 and exported upto 31.03.2023 ( exported as "wheat of Madhya Pradesh origin " ) . " .
3. For condition number 4 , the following condition shall be substituted , namely: -
"4. The above mentioned reimbursement of market fees shall be provided to concerned exporter only on the quantity of notified agricultural produce purchased from the State and exported as a product of Madhya Pradesh origin . Such market fees shall not be reimbursed on those notified 334 ( 2)

agricultural produce which has been purchased and sold in a commercial transaction from other States of the country or in contravention of the terms and conditions prescribed in this notification . " .
4. For condition number 9 , the following condition shall be substituted , namely : -
" 9. Application for reimbursement of market fees , alongwith relevant documents shall be submitted to the Managing Director, Madhya Pradesh State Agricultural Marketing Board, Bhopal within 60 days from the prescribed last date of export 31.03.2023 as per condition number 3 i.e. 31.05.2023 . Delayed applications received after the above mentioned period shall not be considered . " .
5. For condition number 12, the following condition shall be substituted , namely:
" 12. The payment of market fees reimbursement shall be issued from the export incentive head of Madhya Pradesh State Agricultural Marketing Board'sbudget provisions . " .
2. This amendment shall come into force from the date of publication of this notification in the Madhya Pradesh Gazette .
