क्रमांक:- एफ-19-2-2019- बारह - 1 - पार्ट-5.- खान एवं खनिज (विकास तथा विनियमन) अधिनियम , 1957 ( 1957 का 67) की धारा 9 - ख की उपधारा ( 1 ) , (2) एवं ( 3 ) द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए , राज्य सरकार , एतद्वारा, मध्यप्रदेश जिला खनिज प्रतिष्ठान नियम , 2016 में निम्नलिखित और संशोधन करती है , अर्थात् : -

उक्त नियम में, -
1. नियम 13 में, उप- नियम ( 1 ) में , खण्ड (आ) में ,
(1) उप-खण्ड (क) के स्थान पर निम्नानुसार उप- खण्ड प्रतिस्थापित किया जाए , अर्थात्: -
" (क) भौतिक अवसंरचना अपेक्षित भौतिक अवसंरचना और उसका अनुरक्षण उपलब्ध करना , जैसे सड़क , सेतु, रेल्वे, जलमार्ग , वायुमार्ग एवं अन्य परिवहन के माध्यमों संबंधी अधोसंरचनाएँ , पर्यटन संबंधी अधोसंरचना सामुदायिक महत्व तथा अन्य जन उपयोगी अधोसंरचना। "

(2 ) उप-खण्ड ( ग) के स्थान पर निम्नानुसार उप - खण्ड प्रतिस्थापित किया जाए, अर्थात्: -
"(ग) ऊर्जा एवं वाटरशेड विकास ऊर्जा के वैकल्पिक स्त्रोतों तथा वर्षा जल संग्रहण प्रणाली का विकास, बागों , समेकित खेती एवं आर्थिक वनोद्योग , जल संग्रहण का प्रत्यावर्तन तथा विद्युतीकरण । "
2. नियम 14 में , उप - नियम ( 1 ) के स्थान पर निम्नानुसार उप - नियम प्रतिस्थापित किया जाए , अर्थात्: -
" ( 1 ) संबंधित जिले के जिला खनिज प्रतिष्ठान द्वारा नियम 13 (2) (ड. ) में विनिर्दिष्ट किए गए अनुसार विनिर्दिष्ट रकम के भाग- क का उपयोग निम्नानुसार किया जाएगा: -
(क) जिला खनिज प्रतिष्ठान के द्वारा वार्षिक कार्य योजना संलग्न परिशिष्ट अनुसार पोर्टल पर दर्ज की जाएगी ।
(ख) पोर्टल पर दर्ज कार्ययोजना का अनुमोदन प्रशासकीय विभाग द्वारा किया जाएगा।
(ग) (एक) जिला स्तर पर कार्यों के प्रस्ताव / परियोजना जिला खनिज़ प्रतिष्ठान द्वारा तैयार की जाएगी ।
(दो) जिला खनिज प्रतिष्ठान द्वारा तैयार प्रस्ताव राज्य सरकार द्वारा विनिर्दिष्ट पोर्टल पर दर्ज किये जाऐंगे ।
(तीन) पाँच करोड़ से कम के मूल्य की परियोजना जिला खनिज प्रतिष्ठान द्वारा विभागीय पोर्टल के माध्यम से संबंधित विभाग को प्रेषित की जाएगी। संबंधित विभाग के अभिमत अनुसार एवं सक्षम प्राधिकारी की तकनीकी स्वीकृति प्राप्त कर कलेक्टर एवं अध्यक्ष, जिला खनिज प्रतिष्ठान प्रशासकीय स्वीकृति आदेश जारी करेगा ।

खनिज पाँच करोड़ से अधिक के मूल्य की परियोजना जिला
प्रतिष्ठान द्वारा विभागीय पोर्टल के माध्यम से संबंधित विभाग को प्रेषित की जाएगी। संबंधित विभाग के अभिमत अनुसार एवं सक्षम प्राधिकारी की तकनीकी स्वीकृति प्राप्त कर राज्य शासन के अनुमोदन उपरान्त कलेक्टर एवं अध्यक्ष , जिला खनिज प्रतिष्ठान प्रशासकीय स्वीकृति आदेश जारी करेगा । "
No. F - 19-2-2019 - XII - 1 - Part- 5.- In exercise of powers conferred by sub- sections ( 1 ) , (2) and (3) of Section 9B of the Mines and Minerals (Development and Regulation) Act , 1957 ( 67 of 1957) , the State Government hereby , makes the following amendments in the Madhya Pradesh District Mineral Foundation Rules , 2016 , namely: -

In said rules ,
1. In rule 13 , in sub - rule ( 1 ) , in clause (B) , -
(1) for sub - clause ( a) , the following sub- clause shall be substituted , namely-
"(
a) Physical infrastructure
providing required infrastructure and its maintenance such as roads , bridges , railways , waterways , airways and other transport medium related infrastructures , tourism related infrastructure , and other public utility infrastructure of community importance . "
(2) for sub - clause ( c) , the following sub- clause shall be substituted , namely-
" ( c) Energy and watershed development development of alternate sources of energy and development of rain water harvesting system , orchards , integrated farming and economic forestry , restoration of water harvesting and electrification . " मध्यप्रदेश राजपत्र, दिनांक 30 मई 2023

2. In rule 14 , for sub - rule ( 1 ) , the following sub - rule shall be substituted , namely-
" ( 1) the amount of Part - A specified in clause (e) of sub- rule (2) of rule 13 shall be utilised by the District Mineral Foundation of concerned District in the following manner : -
(a) annual work plan as per enclosed Appendix shall be entered in the portal by the District Mineral Foundation.
(b) work plan entered in the portal shall be approved by the administrative department .
(c) (i) District Mineral Foundation shall prepare proposal of the works/ projects at the district level .
( ii) proposal prepared by District Mineral Foundation shall be entered in the specified portal by the State Government .
( iii ) the project cost less than five crores shall be sent by the District Mineral Foundation to the concerned department through the departmental portal . The Collector and Chairperson of the District Mineral Foundation shall accord administrative approval after getting opinion of concerned department and technical sanction from the competent authority .
(iv) the project cost more than five crores shall be sent by the District Mineral Foundation to the concerned department through the departmental portal . The Collector and Chairperson of the District Mineral Foundation shall accord administrative sanction after getting approval of State Government , as per opinion of the concern department and technical sanction from the competent authority .
