क्रमांक CT/ 8/ 0009 /2023 - Sec - 1-05 ( CT) (34) : राज्य सरकार , मध्य प्रदेश माल और सेवा कर अधिनियम, 2017 ( 2017 का 19 ) ( जिसे इसमें इसके पश्चात् उक्त अधिनियम कहा गया है ) की धारा 148 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , परिषद् की सिफारिशों पर, वह वर्णन जिसे इस अधिसूचना से उपाबद्ध अनुसूची के स्तंभ (3 ) में तत्स्थानी प्रविष्टि में निर्दिष्ट किया गया है और यथास्थिति, उक्त अनुसूची स्तंभ (2) में तत्स्थानी प्रविष्टि में यथाविनिर्दिष्ट टैरिफ मद, उप - शीर्ष , शीर्ष या अध्याय के अधीन आती हो, माल के विनिर्माण में लगे किसी रजिस्ट्रीकृत व्यक्ति द्वारा अपनाई जाने वाली निम्नलिखित विशेष प्रक्रिया को अधिसूचित करती है, अर्थात्: -
1. पैकिंग मशीनों का विवरणी
( 1 ) इस अधिसूचना की अनुसूची में उल्लिखित मालों के विनिर्माण में लगे सभी विद्यमान रजिस्ट्रीकृत व्यक्ति सामान्य पोर्टल पर इलेक्ट्रानिक रूप से इस अधिनिसूचना के जारी किए जाने के 20 दिन के भीतर प्ररुप एस.आर.एम.-। में पाउच या कंटेनर को भरने और पैक करने के लिए उपयोग की जा रही पैक करने वाली मशीनों के ब्यौरे को तैयार करेगा, -

(2) कोई भी व्यक्ति जो इस अधिसूचना की अनुसूची में उल्लिखित माल का निर्माण करने का आशय रखता है और जिसे इस अधिसूचना के जारी होने के पश्चात् रजिस्ट्रीकरण प्रदान किया गया है, ऐसी रजिस्ट्रेशन के मंजूरी के पंद्रह दिनों के भीतर सामान्य पोर्टल पर प्ररुप एस.आर.एम.-। में पाउच और कंटेनर को भरने और पैकिंग के लिए उपयोग की जा रही पैकिंग मशीनों के ब्यौरे को पूरा करेगा ।
(3) कारबार के रजिस्ट्रीकृत स्थान में स्थापित की जा रही किसी भी अतिरिक्त भरने और पैकिंग मशीन के ब्यौरे प्ररुप-आईआईए- । में ऐसे अवस्थापन के 24 घंटे के भीतर उक्त रजिस्ट्रीकृत व्यक्ति द्वारा सामान्य पोर्टल पर इलेक्ट्रॉनिक रूप से प्रस्तुत किया जाएगा।
(4) प्ररुप एसआरएम-। या प्ररुप एसआरएम- ॥क में ऐसे ब्यौरे प्रस्तुत करने पर , प्रत्येक मशीन के लिए एक विशिष्ट आईडी तैयार की जाएगी, जिसके ब्यौरे सामान्य पोर्टल पर रजिस्ट्रीकृत व्यक्तियों द्वारा प्रस्तुत किया गया है ।
(5) यदि उक्त रजिस्ट्रीकृत व्यक्ति ने किसी अन्य सरकारी विभाग या किसी अन्य अभिकरण या संगठन को विनिर्माण इकाई या उसकी मशीनों को उत्पादन क्षमता प्रस्तुत या घोषित किया है , उक्त घोषणा या प्रस्तुत करने के पंद्रह दिनों के भीतर सामान्य पोर्टल पर प्ररुप एसआरएम- क में उक्त रजिस्ट्रीकृत व्यक्ति द्वारा प्रस्तुत किया जाएगा:
परंतु जहां उक्त रजिस्ट्रीकृत व्यक्ति ने अपनी विनिर्माण इकाई या उसकी मशीनों की उत्पाद क्षमता को किसी अन्य सरकारी विभाग या किसी अन्य अभिकरण या संगठन को इस अधिसूचना को जारी करने से पूर्व प्रस्तुत या घोषित किया है , इस अधिसूचना के जारी किए जाने के तीस दिन के भीतर सामान्य पोर्टल पर प्ररुप एसआरएम- । क में उक्त रजिस्ट्रीकृत व्यक्ति द्वारा प्रस्तुत किया जाएगा ।

(2 ) तथापि, उक्त रजिस्ट्रीकृत व्यक्ति कारबारं के प्रत्येक स्थान में प्ररुप एस.आर.एम. - ।।। ख में यथाविनिर्दिष्ट एक प्ररुप में मात्रा और मूल्य के निबंधन में मशीन- वार उत्पादन , उत्पाद - वार और ब्रांड- वार अनापत्ति के ब्यौरे के दैनिक शिफ्ट-वार अभिलेख भी रखेगा ।

स्पटीकरण
(1 ) अनुसूची में, "टैरिफ मद ", " शीर्ष " , " उपशीर्ष " तथा " अध्याय " से सीमा शुल्क टैरिफ अधिनियम, 1975 ( 1975 का 51) की पहली अनुसूची में यथाविनिर्दिष्ट क्रमशः टैरिफ मद शीर्ष , उपशीर्ष और अध्याय अभिप्रेत है ।
(2 ) उक्त सीमा शुल्क टैरिफ अधिनियम , 1975 की पहली अनुसूची के निर्वचन के लिए नियम जिसके अंतर्गत पहली अनुसूची की धारा तथा अध्याय टिप्पण और साधारण स्पष्टीकारक टिप्पण भी हैं, इस अधिसूचना के निर्वचन में जहां तक वे लागू हैं ।
(3 ) इस अधिसूचना के प्रयोजनों के लिए " ब्रांड नाम" वाक्यांश से ब्रांड नाम या व्यापार नाम चाहे वह रजिस्ट्रीकृत हो अथवा नहीं , जैसाकि कहा जाता है एक नाम या मार्क अभिप्रेत है, जैसे प्रतीक, मोनोग्राम, लेबल , हस्ताक्षर या आविष्कृत शब्द या लिखा जाना , जो चिह्नित करने के प्रयोजन के लिए ऐसे विशिष्ट माल के संबंध में प्रयोग किया जाता है या ऐसे विशिष्ट माल के मध्य व्यापार के अनुक्रम में संबंध को दर्शित करता हो तथा कुछ व्यक्ति ऐसे नाम या चिह्न के साथ या उस व्यक्ति की पहचान के किसी चिह्नांकन के बिना प्रयोग किया जाता हो ।

No. CT/ 8 / 0009 / 2023 - Sec - 1-05 (CT ) ( 34 ) : In exercise of the powers conferred by section 148 of the Madhya Pradesh Goods and Services Tax Act, 2017 (19 of 2017) ( hereinafter referred to as the said Act ), the State Government , on the recommendations of the Council, hereby notifies the following special procedure to be followedby a registered person engaged in manufacturing of the goods , the description of which is specified in the corresponding entry in column (3 ) of the Schedule appended to this notification, and falling under the tariff item, sub- heading, heading or Chapter, as the case may be, as specified in the corresponding entry in column (2 ) of the said Schedule , namely:-

1. Details of Packing Machines
(1) All the existing registered persons engaged in manufacturing of the goods mentioned in Schedule to this notification shall furnish the details of packing machines being used for filling and packing of pouches or containers in FORM SRM - I , within 30 days of issuance of this notification , electronically on the common portal ,-

(2) Any person intending to manufacture goods as mentioned in Schedule to this notification , and who has been granted registration after the issuance of this notification, shall furnish the details of packing machines being used for filling and packing of pouches or containers in FORM SRM - I on the common portal, within fifteen days of grant of such registration.
(3) The details of any additional filling and packing machine being installed in the registered place of business shall be furnished, electronically on the common portal , by the said registered person within 24 hours of such installation in FORM SRM - IIA .
(4) Upon furnishing of such details in FORM SRM - I or FORM SRM - IIA , a unique ID shall be generated for each machine , whose details have been furnished by the registered person , on the common portal .
(5) In case, the said registered person has submitted or declared the production capacity of his manufacturing unit or his machines , to any other government department or any other agency or organization, the same shall be furnished by the said registered person in FORM SRM - IA on the common portal , within fifteen daysof filing said declaration or submission:
Provided that where the said registered person has submitted or declared the production capacity of his manufacturing unit or his machines , to any other government department or any other agency or organization , before the issuance of this notification , the same shall be furnished by the said registered person in FORM SRM - IA on the common portal, within thirty days of issuance of this notification .

2.Additional records to be maintained by the registered persons manufacturing the goods mentioned in theSchedule
(1 ) Every registered person engaged in manufacturing of goods mentioned in Schedule shall keep a daily record of inputs being procured and utilized in quantity and value terms along with the details of waste generated as well as the daily record of reading of electricity meters and generator set meters in a format as specified in FORM SRM - IIIA in each place of business .
(2) Further, the said registered person shall also keep a daily shift - wise record of machine - wise production , product- wise and brand -wise details of clearance in quantity and value termsin a format as specified in FORM SRM- IIIB in each place ofbusiness .

Explanation.-
(1) In this Schedule , " tariff item " , " heading " , " sub -heading " and "Chapter " shall meanrespectively a tariff item , heading , sub - heading and Chapter as specified in the First Schedule totheCustoms Tariff Act , 1975 (51 of1975) .
(2) The rules for the interpretation of the First Schedule to the said Customs Tariff Act, 1975 , including the Section and Chapter Notesand the General Explanatory Notes of theFirstSchedule shall , so far as maybe , applyto theinterpretation ofthisnotification .

2. This notification shall be deemed to have come into force with effect from the 31st day of July , 2023.
