सं. 576/3/ईवीएम/2023/एसडीआर/खण्ड- I.- यतः, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 61 क में यह उपबंध किया गया है कि ऐसे निर्वाचन क्षेत्र या निर्वाचन क्षेत्रों में वोटिंग मशीनों द्वारा मतदान और मतों के अभिलेखन की यथाविहित ऐसी रीति अपनाई जाए, जैसी कि भारत निर्वाचन आयोग प्रत्येक मामले की परिस्थितियों को ध्यान में रखते हुए विनिर्दिष्ट करे; और
2. यतः निर्वाचनों का संचालन नियम, 1961 के नियम 49 क के परन्तुक के अनुसार भारत निर्वाचन आयोग द्वारा यथाअनुमोदित ऐसे डिजाइन वाला ड्राप बॉक्स युक्त एक प्रिंटर, ऐसे निर्वाचन क्षेत्र या निर्वाचन क्षेत्रों या उसके भागों में मत के पेपर ट्रेल के मुद्रण के लिए मतदान मशीन के साथ भी जोड़ा जाए जैसा कि भारत निर्वाचन आयोग द्वारा निदेश दिया जाए;

3. यतः निर्वाचन आयोग ने दिनांक 9 अक्टूबर, 2023 के प्रेस नोट संख्या ईसीआई/प्रे .नो /57/2023 के तहत् घोषित मिजोरम, छत्तीसगढ़ , मध्यप्रदेश , राजस्थान और तेलंगाना की विधान सभाओं के चालू साधारण निर्वाचन और आयोग के दिनांक 9 अक्टूबर , 2023 के प्रेस संख्या ईसीआई/प्रे.नो./58/2023 के तहत् घोषित नागालैण्ड के 43 - तापी ( अ.ज.जा. ) विधानसभा निर्वाचन क्षेत्र के उप निर्वाचन की परिस्थितियों पर निर्वाचन आयोग ने विचार किया है , और वह इस बात से संतुष्ट है कि विधानसभा निर्वाचन क्षेत्र( त्रों ) में मतदान के लिए पर्याप्त संख्या में इलेक्ट्रॉनिक वोटिंग मशीनें ( ईवीएम ) और पेपर ट्रेल [ वोटर वेरिफिएबल पेपर ऑडिट ट्रेल ( वीवीपीएटी ) प्रिंट करने के लिए प्रिंटर उपलब्ध हैं, मतदान कर्मियों को ईवीएम और ' वीवीपीएटी प्रिंटर ' के कुशल संचालन में अच्छी तरह से प्रशिक्षित है और मतदाता भी ईवीएम और वीवीपैट प्रिंटर के संचालन से पूरी तरह परिचित हैं.
4. अतः अब , भारत निर्वाचन आयोग, लोक प्रतिनिधित्व अधिनियम, 1951 की उक्त धारा 61 क तथा निर्वाचनों का संचालन नियम, 1961 के नियम 49क के अंतर्गत अपनी शक्तियों का प्रयोग करते हुए एतद्वारा दिनांक 13-10-2023 , 21-10-2023, 30-10-2023 , और 03-11-2023 को अधिसूचित/अधिसूचित होने वाले मिजोरम, छत्तीसगढ़ , मध्यप्रदेश, राजस्थान और तेलंगाना की सभी विधान सभा निर्वाचन क्षेत्रों एवं नागालैण्ड के 43 - तापी ( अ.ज.जा. ) विधानसभा निर्वाचन क्षेत्र को, ऐसे निर्वाचन क्षेत्रों के रूप में विनिर्दिष्ट करता है , जिनमें निर्वाचनों का संचालन नियम, 1961 और इस विषय पर निर्वाचन आयोग द्वारा समय - समय पर जारी किए गए अनुपूरक अनुदेशों के अंतर्गत विहित तरीके से इलेक्ट्रॉनिक वोटिंग मशीनों तथा वीवीपैट प्रिंटर के माध्यम से मत डाले और रिकॉर्ड किए जाएंगे .
5. निर्वाचन आयोग, भारत इलेक्ट्रॉनिक्स लिमिटेड, बंगलोर तथा इलेक्ट्रॉनिक्स कार्पोरेशन ऑफ इण्डिया लिमिटेड, हैदराबाद द्वारा विकसित किए गए इलेक्ट्रॉनिक वोटिंग मशीनों और वीवीपैट प्रिंटरों, जिन्हें सभी निर्वाचन क्षेत्रों में मत डालने और रिकॉर्ड करने के लिए उक्त मशीनों से जोड़ा जाएगा, के डिजाइन को भी एतद्वारा अनुमोदित करता है.

No.576/3 /EVM/2023 /SDR - Vol -I.-WHEREAS , Section 61A of the Representation of the People Act , 1951 , provides that the giving and recording of votes by voting machines in such manner as may be prescribed; may be adopted in such constituency or constituencies as the Election Commission of India may, having regard to the circumstances of each case, specify;
2. WHEREAS , as per the proviso to Rule 49A of the Conduct of Elections Rules , 1961. a printer with a drop box of such design , as may be approved by the Election Commission of India, may also be attached to voting machine for printing a paper trial of the vote , in such constitutency or constituencies or parts thereof as the Election Commission of India may direct ;
3. WHEREAS, the Election Commission has considered the circumstances in current general elections to the Legislative Assemblies of Mizoram, Chhattisgarh , Madhya Pradesh, Rajasthan & Telangana announced vide the Election Commisson's Press Note No. ECI/PN/57/2023 dated 9th October, 2023 and bye - election in 43 -Tapi ( ST) Assembly Constituency of Nagaland announced vide the Election Commission's Press Note No. ECI/PN / 58 / 2023 dated 9th October, 2023 , and is satisfied that sufficient number of Electronic Voting Machines (EVMs ) and Printers for printing Paper Trail [Voter Verifiable Paper Audit Trail (VVPAT) ] are available for taking the poll in the Assembly Constituency (ies ) , the polling personnel are well trained in efficient handling of EVMs and ' VVPAT Printer' and the electors are also fully conversant with the operation of the EVMs and the VVPAT Printers ;

4. NOW, THEREFORE , the Election Commission of India, in exercise of its powers under the said Section 61A of the Representation of the People Act , 1951 , and Rule 49A of the Conduct of Elections Rules , 1961 , hereby specifies all the Assembly Constituencies of Mizoram, Chhattisgarh, Madhya Pradesh, Rajasthan & Telangana and 43- Tapi (ST) Assembly Constitutency of Nagaland, notified/ to be notified on 13-10-2023, 21-10-2023, 30-10-2023 & 03-11-2023 , as the constituencies in which the votes , shall be given and recorded by means of EVMs and VVPAT printers in the manner prescribed, under the Conduct of Elections Rules , 1961 , and the supplementary instructions issued by the Election Commission from time to time on the subject .
5. The Election Commission also hereby approves the design of EVMs and VVPAT Printers as developed by the Bharat Electronics Ltd. , Bangalore and Electronics Corporation of India Ltd. , Hyderabad, which shall be attached to the said machines , to be used for the giving and recording of votes in all the Constituencies .

सं. 3/4/आईडी/2023/एसडीआर/खण्ड- I.-( 1 ) यतः, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 61 में यह उपबंधित है कि निर्वाचकों के प्रतिरूपण का निवारण करने की दृष्टि से, ताकि उक्त अधिनियम की धारा 62 के अधीन वास्तविक निर्वाचकों का उनके मत देने के अधिकार को और अधिक प्रभावी बनाया जा सके, मतदान के समय निर्वाचकों की पहचान सुनिश्चित करने के साधन के रूप में निर्वाचकों के लिए निर्वाचक फोटो पहचान पत्र के उपयोग हेतु नियमों के द्वारा उपबंध किए जा सकते हैं , तथा
(2) यतः निर्वाचकों का रजिस्ट्रीकरण नियम , 1960 का नियम 28 निर्वाचन आयोग को, इस दृष्टि से कि निर्वाचकों के प्रतिरूपण का निवारण हो सके तथा मतदान के समय उनकी पहचान को सरल बनाया जा सके, निर्वाचकों को राज्य की लागत पर फोटोयुक्त निर्वाचक फोटो- पहचान- पत्र जारी करने के लिए निदेश देने की शक्ति प्रदान करता है ; तथा
(3 ) यतः, निर्वाचनों का संचालन नियम, 1961 के नियम 49 ज( 3 ) और 49 ट( 2 ) ( ख ) में यह उपबंधित है कि जहाँ किसी निर्वाचन क्षेत्र के निर्वाचकों को निर्वाचक रजिस्ट्रीकरण नियम, 1960, के नियम 28 के उक्त उपबंधों के अधीन निर्वाचक फोटो पहचान- पत्र दिए गए हैं, वहां निर्वाचकों को मतदान केन्द्र में अपना निर्वाचक फोटो पहचान पत्र दिखाना होगा,तथा उत्तकी ओर से उत्त निर्वाचक फोटोः प्रहचान पत्रों को नहीं दिखाए जाने या दिखाने में असमर्थ होने पर उन्हें मत डालने की अनुमति देने से इन्कार किया जा सकता है; तथा
4. यतः, उक्त अधिनियम, और नियमों के उपर्युक्त उपबंधों को मिलाकर एवं सामंजस्यपूर्ण ढंग से उनके अध्ययन से यह स्पष्ट होता है कि यद्यपि मत देने का अधिकार निर्वाचक नामावली में नाम के होने से ही होता है, यह निर्वाचन आयोग द्वारा राज्य की लागत पर, मतदान के समय उनकी पहचान सुनिश्चित करने के साधन के रूप में प्रदान करवाएं गए निर्वाचक फोटो पहचान- पत्र के प्रयोग पर भी निर्भर करता है, तथा दोनों का एक साथ प्रयोग करना होता है ; तथा
5. यतः, निर्वाचन आयोग ने एक समयबद्ध कार्यक्रम के अनुसार सभी निर्वाचकों को निर्वाचक फोटो पहचान- पत्र ई.पी.आई.सी. जारी करने का निदेश देते हुए 28 अगस्त, 1993 को एक आदेश जारी किया है ; तथा
6. यतः, मिजोरम , छत्तीसगढ़, मध्यप्रदेश, राजस्थान , तेलंगाना एवं नागालैंड राज्यों में लगभग 100 % निर्वाचकों को निर्वाचक फोटो पहचान- पत्र जारी किए जा चुके हैं; तथा 664(2)

7. अतः अब, सभी संबंद्ध कारकों तथा विधिक एवं तथ्यात्मक स्थितियों को, ध्यान में रखते हुए, निर्वाचन आयोग , एतद्वारा , यह निदेश देता है कि दिनांक 13-10-2023 , 21-10-2023,30-10-2023, एवं 03-11-2023 को अधिसूचित/अधिसूचित होने वाले मिजोरम , छत्तीसगढ़ , मध्यप्रदेश , राजस्थान, तेलंगाना के चालू साधारण निर्वाचन और नागालैण्ड के 43 - तापी ( अ.ज.जा. ) विधानसभा निर्वाचन क्षेत्र के उप निर्वाचन में, सभी निर्वाचक जिन्हें निर्वाचक फोटो पहचान पत्र जारी किए गए हैं , से अपेक्षा की जाती है कि वे मतदान स्थल पर अपना मत डालने से पहले अपनी पहचान सुनिश्चित करने हेतु अपना निर्वाचक फोटो पहचान- पत्र दिखाएंगे . ऐसे निर्वाचक जो अपना निर्वाचक फोटो पहचान पत्र प्रस्तुत नहीं कर पाते हैं , उन्हें अपनी पहचान स्थापित करने के लिए निम्नलिखित वैकल्पिक फोटो पहचान दस्तावेजों में से कोई एक प्रस्तुत करना होगा :-
i. आधार कार्ड,
ii. मनरेगा जॉब कार्ड ,
बैंको / डाकघरों द्वारा जारी किए गए फोटोयुक्त पासबुक,
iv. श्रम मंत्रालय की योजना के अन्तर्गत जारी स्वास्थ्य बीमा स्मार्ट कार्ड,
V. ड्रायविंग लाइसेन्स,
vi . पैन कार्ड,
vii . एनपीआर के अंतर्गत आरजीआई द्वारा जारी किए गए स्मार्ट कार्ड ,
viii . भारतीय पासपोर्ट;
ix. फोटोयुक्त पेंशन दस्तावेज,
Χ. केन्द्र / राज्य सरकार / लोक उपक्रम / पब्लिक लिमिटेड कंपनियों द्वारा अपने कर्मचारियों को जारी किए गए फोटोयुक्त सेवा पहचान-पत्र,
xi . सांसदों विधायकों / विधान परिषद् सदस्यों को जारी किए गए सरकारी पहचान- पत्र, और
xii . यूनिक डिसएबिलिटी आईडी( यूडीआईडी) कार्ड , सामाजिक न्याय एवं अधिकारिता मंत्रालय , भारत सरकार.
8. एपिक के संबंध में, लेखन अशुद्धि, वर्तनी की अशुद्धि इत्यादि को नजरअंदाज कर देना चाहिए बशर्तें निर्वाचक की पहचान एपिक से सुनिश्चित की जा सके. यदि कोई निर्वाचक फोटो पहचान- पत्र प्रदर्शित करता है , जो कि किसी अन्य सभी निर्वाचन क्षेत्र के निर्वाचक रजिस्ट्रीकरण अधिकारी द्वारा जारी किया गया है, ऐसे एपिक भी पहचान स्थापित करने हेतु स्वीकृत किए जाएंगे बशर्तें उस निर्वाचक का नाम जहां वह मतदान करने आया है उस मतदान केन्द्र से संबंधित निर्वाचक नामावली में उपलब्ध हो. यदि फोटोग्राफ इत्यादि के बेमेल होने के कारण निर्वाचक की पहचान सुनिश्चित करना संभव न हो तब निर्वाचक को उपर्युक्त पैरा 7 में वर्णित किसी एक वैकल्पिक फोटो दस्तावेज को प्रस्तुत करना होगा.
9. उक्त पैरा 7 में किसी बात के होते हुए भी, प्रवासी निर्वाचकों को जो अपने पासपोर्ट में विवरणों के आधार पर लोक प्रतिनिधित्व अधिनियम, 1950 की धारा 20 क के अधीन निर्वाचक नामावलियों में पंजीकृत हैं , मतदान केन्द्र में केवल उनके मूल पासपोर्ट ( तथा कोई अन्य पहचान दस्तावेज नहीं ) के आधार पर ही पहचाना जाएगा.

ORDER
No.3/4/ID/2023 /SDR/Vol - 1.- 1 . WHEREAS , Section 61 of the Representation of the People Act, 1951 , provides that with a view to preventing personation of electors , so as to make the right of genuine electors to vote under section 62 of that Act more effective , provisions may be made by rules under that Act for use of Electors Photo Identity Card for electors as the means of establishing their identity at the time of polling ; and
2. WHEREAS , Rule 28 of the Registration of Electors Rules , 1960 , empowers the Election Commission to direct, with a view to preventing personation of electors and facilitating their identification at the time of poll , issue of Electors Photo Identity Card to electors bearing their photographs at State cost ; and
3. WHEREAS , Rules 49H (3) and 49K (2) (b) of the Conduct of Elections Rules , 1961 , stipulate that where the electors of a constituency have been supplied with Electors ' Photo Identity Card under the said provisions of Rule 28 of the Registration of Electors Rules , 1960, the electors shall produce their Elector Photo Identity Card at the polling station and failure or refusal on their part to produce those Elector Photo Identity Card may result in the denial of permission to vote; and
4. WHEREAS , a combined and harmonious reading of the aforesaid provisions of the said Act and the Rules , makes it clear that although the right to vote arises by the existence of the name in the electoral roll , it is also depandent upon the use of the Elector Photo Identity Card, where provided by the Election Commission at State cost, as the means of establishing their identity at the time of polling and that both are to be used togather; and
5. WHEREAS , the Election Commission made an Order on the 28th August, 1993 , directing the issue of Electors , Photo Identity Card (EPIC) to all electors , according to a time bound programme ; and
6. WHEREAS, Electors ' Photo Identity Card have been issued to approximate 100% electors in the States of Mizoram, Chhattisgarh, Madhya Pradesh, Rajasthan , Telangana and Nagaland; and
7. NOW, THEREFORE , after taking into account all relevant factors and the legal and factual position , the Election Commission hereby directs that for the current general elections to the Legislative Assemblies of Mizoram, Chhattisgarh, Madhya Pradesh, Rajasthan , Telangana and bye election in 43 - Tapi (ST) Assembly Constituency of Nagaland, notified / to be notified on 13-10-2023 , 21-10-2023 , 30-10-2023 & 03-11-2023 , all electors who have been issued EPIC are expected to produce the EPIC for their identification at the polling stations before casting their votes . Those electors who are not able to produce the EPIC shall produce one of the following alternative photo identity documents for establishing their identity :-
(i) Aadhaar Card ,
(ii) MNREGA Job Card,
(iii) Passbooks with photograph issued by Bank / Post Office ,
(iv) Health Insurance Smart Card issued under the scheme of Ministry of Labour,
(v) Driving License ,
(vi) PAN Card
(vii) Smart Card issued by RGI under NPR ,
(viii) Indian Passport,
(ix) Pension document with photograph ,
(x) Service Identity Card with photograph issued to employees by Central / State Govt./ PSUs / Public Limited Companies , 664(4)

(xi) Official identity cards issued to MPs / MLAs / MLCs , and
(xii ) Uniqe Disability ID (UDID) Card, M/ o Social Justice & Empowerment , Government of India.
8. In the case of EPIC, clerical errors , spelling mistakes , etc. should be ignored provided the identity of the elector can be established by the EPIC . If an elector produces an EPIC which has been issued by the Electoral Registration Officer of another Assembly Constituency, such EPIC shall also be accepted for identification provided that the name of that elector finds place in the electoral roll pertaining to the polling station where the elector has turned up for voting. If it is not possible to establish the identity of the elector on account of mismatch of photograph , etc. the elector shall have to produce one of the alternative photo documents mentioned in Para 7 above .
9. Notwithstanding anything in Para 7 above , overseas electors who are registered in the electoral roll under Section 20A of the Representation of the People Act , 1950 , based on the particulars in their Indian Passport, shall be identified on the basis of their original passport only (and no other identity document) at the polling station .
