THE MADHYA PRADESH AYURVIGYAN VISHWAVIDYALAYA
(SANSHODHAN) VIDHEYAK , 2024
ABill to further amend the Madhya Pradesh Ayurvigyan Vishwavidyalaya Adhiniyam, 2011 .
Be it enacted by the Madhya Pradesh Legislature in the Seventy - fifth year of the Republic of India as follows : -
1. ( 1 ) This Act may be called the Madhya Pradesh Ayurvigyan Vishwavidyalaya Short title and commencement .
(Sanshodhan) Adhiniyam , 2024.
(2) It shall come into force from the date of its publication in the Madhya Pradesh Gazette and nothing contained in this Amendment Act shall apply to batches affiliated to the Madhya Pradesh Ayurvigyan Vishwavidyalaya under the Madhya Pradesh Ayurvigyan Vishwavidyalaya Adhiniyam, 2011 (No. 19 of 2011 ) before the commencement of this Act.
Amendment to the long title of the Act.
2. In the long title of the Madhya Pradesh Ayurvigyan Vishwavidyalaya Adhiniyam , 2011 (No. 19 of 2011) , (hereinafter referred to as the principal Act) , the word " Nursing " and the word " Paramedical " shall be omitted .
3. In Section 2 of the Principal Act, -
Amendment of Section 2.
(a) after clause (c ) , the following clause shall be inserted, namely: - "(ca) "Board " means the Employees Selection Board , Madhya Pradesh , Bhopal . " .
(b) Clause ( s) shall be omitted .
(c) Clause ( v) shall be omitted.
(d) Clause (zh ) shall be omitted.
Amendment Section 5. of 4. In Section 5 of the principal Act, in clause (xxxiii ) , for the word "VYAPAM " , the words "Employees Selection Board " shall be substituted .
5. In Section 6 of the Principal Act, -
Amendment of Section 6.
(i) in sub - section (2) , the words "Nursing " and the word " Paramedical " shall be omitted;
(ii) for sub - section (3) , the following sub- section shall be substituted, namely: -
"(3) Nothing contained in this section shall apply in case of, -
(a) the colleges or schools or institutions which have not been approved by the Medical Council of India , Dental Council of India , Central Council of Homeopathy, Central Council of Indian Medicine , as the case may be , or the Government of Madhya Pradesh;
(b) teaching department of any University engaged in teaching of Medical , Dental , Ayurvedic , Unani , Homeopathy , Yoga, Naturopathy , Siddh or allied subjects;
(c) the colleges or schools or institutions maintained by, or affiliated to , a University or Board established by the Central Government. " .

Amendment of Section 21.
6. In Section 21 of the Principal Act , in sub - section ( 1 ) , in Group - C , in clause (xii ) , the word "Nursing " and word " Paramedical " shall be omitted.
7. In Section 24 of the Principal Act , in sub - section ( 1 ), -
Amendment Section 24. of
(i) for clause (vii ) , the following clause shall be substituted , namely: -
"(vii ) two heads of Department from affiliated colleges to be nominated by the Chancellor by rotation , according to seniority. ".
(ii) in clause (x) , the word " Nursing " and the word "Paramedical " shall be omitted.
Amendment of Section 28.
8. In Section 28 of the Principal Act , in sub - section ( 1 ) , in the proviso to clause (v) , the words "Indian Nursing Council " and the words " or Paramedical Council " shall be omitted.
Amendment Section 61 . of 9. InSection 61 of the Principal Act , in sub - section ( 1 ) , the words "the Indian Nursing Council " , and the words " or the Paramedical Council " shall be omitted.
STATEMENT OF OBJECTS AND REASONS
The Madhya Pradesh Ayurvigyan Vishwavidyalaya Adhiniyam , 2011 (No. 19 of 2011 ) was enacted for the purpose of ensuring systematic , efficient and qualitative education in Medical , Dental , Nursing , Ayurvedic , Unani , Homeopathy, Yoga, Naturopathy, Siddh , Paramedical and other allied subjects at Degree and Diploma level .
2. In view of the growing responsibilities of the Ayurvigyan Vishwavidyalaya and in view of the continuous rise in the number of nursing and paramedical institutions spread across the State and the growing annual intake of students , it is necessary that other recognised Government and Private Universities to take up the responsibility to provide for quality education in nursing and paramedical subjects at Degree and Diploma levels , while the Ayurvigyan Vishwavidyalaya can focus on providing quality education in Medical , Dental, Ayurvedic and other subjects as mentioned in the Statute except nursing and paramedical subjects .
3. Hence this Bill .
