नियम , 1989 को अतिष्ठित करते हुए निम्नलिखित नियम बनाते हैं , अर्थात्:-

नियम

1. संक्षिप्त नाम इन नियमों का संक्षिप्त नाम मध्यप्रदेश लोक स्वास्थ्य एवं परिवार कल्याण (संचालनालय स्वास्थ्य सेवाए) तृतीय श्रेणी लिपिक वर्गीय सेवा भरती नियम , 2023 है ।

2. परिभाषाएं - इन नियमों में, जब तक संदर्भ से अन्यथा अपेक्षित न होः -

(क) "सेवा" से अभिप्रेत है, मध्यप्रदेश लोक स्वास्थ्य एवं परिवार कल्याण संचालनालय स्वास्थ्य सेवाओं तृतीय श्रेणी लिपिकवर्गीय सेवा;

(ख) " पद " से अभिप्रेत है , अनुसूची एक के कालम (2) के समस्त विनिर्दिष्ट पद ;

(ग ) सेवा के सम्बन्ध में " नियुक्ति प्राधिकारी " से अभिप्रेत है, अनुसूची एक के कालम (6) में यथा विनिर्दिष्ट प्राधिकारी;

(घ) "समिति" से अभिप्रेत है, अनुसूची चार के कालम (5) में यथा विनिर्दिष्ट सदस्यों से मिलकर बनी विभागीय पदोन्नति समिति;

(ड़) -" अनुसूचित जाति" से अभिप्रेत है, कोई जाति, मूलवंश या जनजाति अथवा ऐसी जाति, मूलवंश या जनजाति का भाग या उसमें का यूथ जिसे भारत के संविधान के अनुच्छेद 341 के अधीन मध्यप्रदेश राज्य के संबंध में अनुसूचित जातियों के रूप में विनिर्दिष्ट किया गया है;

(च) - "अनुसूचित जनजाति" से अभिप्रेत है, कोई जनजाति या जनजाति समुदाय अथवा ऐसी जनजाति या जनजाति समुदाय का भाग या उसमें का यूथ जिसे भारत के संविधान के अनुच्छेद 342 के अधीन मध्यप्रदेश राज्य के संबंध में अनुसूचित जनजातियों के रूप में विनिर्दिष्ट किया गया है;

(छ) -"अन्य पिछड़े वर्गों" से अभिप्रेत है, राज्य सरकार द्वारा समय- समय पर यथा संशोधित अधिसूचना कमांक एफ-85 / पच्चीस /484 दिनांक 26 दिसम्बर, 1984 में यथाविनिर्दिष्ट नागरिकों के अन्य पिछड़े वर्ग;

(ज) -"शारीरिक रूप से विकलांग व्यक्ति" से अभिप्रेत है, निःशक्त व्यक्ति (समान अवसर अधिकार संरक्षण और पूर्ण भागीदारी ) अधिनियम, 1995 के उपबंधो के अधीन आने वाले व्यक्ति ;

(झ) "राज्य" से अभिप्रेत है, मध्यप्रदेश राज्य ।

३. विस्तार तथा लागू होगा : - मध्यप्रदेश सिविल (सेवा की समान शर्तें) नियम, 1961 में अन्तर्विष्ट उपबंधों की व्यापकता पर प्रतिकूल प्रभाव डाले बिना ये नियम इस सेवा के प्रत्येक सदस्य को लागू होंगे ।

4. सेवा का संगठन, - सेवा में निम्नलिखित व्यक्ति होंगे , अर्थात्: -

(क) वे व्यक्ति, जो इन नियमों के प्रारंभ होने के समय अनुसूची- एक में विनिर्दिष्ट पद मूल रूप से या स्थानापन्न रूप से धारण कर रहे हों;

(ख) वे व्यक्ति, जो इन नियमों के प्रारंभ होने के पूर्व सेवा में भर्ती किए गए हों , और

(ग) वे व्यक्ति, जो इन उपबंधों के अनुसार सेवा में भर्ती किए जाएं ।

5. वर्गीकरण वेतनमान आदि- सेवा का वर्गीकरण, सेवा में सम्मिलित पदों की संख्या और उनसे संलग्न वेतनमान अनुसूची- एक में विनिर्दिष्ट किए गये अनुसार होंगे : परन्तु सरकार सेवा में सम्मिलित पदों की संख्या में, या तो स्थायी या अस्थायी आधार पर समय- समय पर वृद्धि या कमी कर सकेगी:

6. भर्ती का तरीका- ( 1 ) इन नियमों के प्रारंभ होने के पश्चात, सेवा में भरती निम्नलिखित तरीकों से की जायेगी , अर्थात्:-

(क) चयन द्वारा , " मध्यप्रदेश कनिष्ठ सेवा (संयुक्त अर्हता) परीक्षा नियम , 2013 " के तहत् सीधी भरती करके अथवा सामान्य प्रशासन विभाग की विशिष्ट अनुमति से आयोजित अन्य चयन परीक्षा द्वारा सीधी भरती करके ;

(ख) अनुसूची चार के कॉलम (2) के अनुसार सेवा के काडर के सदस्यों की पदोन्नति द्वारा; और

(ग) ऐसे व्यक्तियों के स्थानांतरण द्वारा , जो ऐसी सेवाओं में ऐसे पद, जो इस निमित्त राज्य सरकार द्वारा विनिर्दिष्ट किये जाएं , मूल हैसियत में धारण करते हो .

(2) उपनियम (1 ) के खण्ड (ख) या खण्ड ( ग) के अधीन भरती किये गये व्यक्तियों की संख्या अनुसूची एक में विनिर्दिष्ट कर्तव्य पदों की संख्या के अनुसूची दो में दर्शाये गये प्रतिशत से किसी भी समय अधिक नहीं होगी .

(3) उपनियम (1 ) के खण्ड (क) में अपेक्षित व्यक्तियों की संख्या के 50 प्रतिशत पद उन व्यक्तियों के लिए आरक्षित होंगे जो संविदा आधार पर नियुक्त किये गये हैं किन्तु ऐसे आरक्षण का लाभ केवल एक बार लिया जा सकेगा, इस श्रेणी के अभ्यर्थी समतुल्य या उच्च पद पर संविदा आधार पर की गई सेवा अवधि के लिए अधिकत्म आयु सीमा में छूट के हकदार होगे , वह आयु सीमा आवेदन की तारीख से या पद भरने के लिए जारी विज्ञापन में नियम तारीख को समस्त छूटों को सम्मिलित करते हुए अधिकतम आयु 55 वर्ष से अधिक नहीं होगी ।

(4) उपनियम ( 1 ) के खण्ड (क) में अपेक्षित व्यक्तियों की संख्या के दस प्रतिशत पद आर्थिक रूप से कमजोर वर्ग (ई.डब्ल्यू.एस.) जो, संविधान के अनुच्छेद -341 एवं 342 के अंतर्गत मध्यप्रदेश राज्य के लिए अधिसूचित अनुसूचित जाति एवं अनुसूचित जनजाति तथा राज्य सरकार द्वारा समय - समय पर संशोधित अधिसूचना क्रमांक एफ-85-25-4-84 दिनांक 26 दिसम्बर 1984 द्वारा विर्निदिष्ट अन्य पिछडे वर्ग को प्रदत्त आरक्षण की परिधि में नही आते है, हेतु आरक्षित होंगे ।

7. सेवा में नियुक्ति - इन नियमों के प्रारंभ होने के पश्चात सेवा में के किसी प्रवर्ग या पद में उद्भूत होने वाली रिक्तियों पर समस्त नियुक्तियां, नियुक्ति प्राधिकारी द्वारा की जांएगी और ऐसी कोई भी नियुक्ति नियम 6 में विनिर्दिष्ट भरती की रीतियों में से किसी एक रीति द्वारा चयन किए जाने के बाद ही की जाएगी अन्यथा नहीं ,

8. सीधी भर्ती की पात्रता की शर्तें :- चयन किये जाने के लिए पात्र होने हेतु अभ्यर्थी को निम्नलिखित शर्ते पूरी करनी चाहिये , अर्थात्: -

(1) आयु

(क) उसने उस वर्ष, जिसमें कि चयन किया जाना हो , के आगामी वर्ष की जनवरी के प्रथम दिन को अनुसूचि तीन के कॉलम (3) में यथाविनिर्दिष्ट आयु प्राप्त कर ली हो , किन्तु उक्त अनुसूची के कॉलम (4 ) में यथाविनिर्दिष्ट आयु प्राप्त न की हो.

(ख) अनुसूचित जाति / अनुसूचित जनजाति / अन्य पिछड़े वर्गों , विभागों / निगमों / मण्डलों /आयोगों/स्वयत्तशासी निकायों / होमगार्ड में कार्यरत शासकीय सेवकों तथा महिला अभ्यर्थियों के लिए आयु सीमा 45 वर्ष होगी । अधिकतम आयु सीमा की गणना भरती के चालू वर्ष की 01 जनवरी की स्थिति में की जाएगी ,

(ग) परन्तु यह और कि अधिकतम आयु सीमा में छूट जो कि शारीरिक रूप से विकलांग / भूतपूर्व सैनिक को प्रदान की जानी है, सामान्य प्रशासन विभाग द्वारा समय - समय पर जारी आदेशों / दिशा निर्देशों के अनुसार होगी ,

(घ) परन्तु यह भी कि सभी प्रकार की छूट सम्मिलित करते हुए किसी भी स्थिति में किसी भी प्रवर्ग के लिए अधिकतम आयु सीमा 45 वर्ष से अधिक नहीं होगी ,

(2) शैक्षणिक / तकनीकी अर्हताएं:-

(क) अभ्यर्थी को उसके द्वारा अपना आवेदन प्रस्तुत करने की तिथि को ऐसी शैक्षणिक अर्हताएं होनी चाहिए जो सेवा के लिए अनुसूची तीन में विहित की गई है, धारण करना अनिवार्य होगा ।

परन्तु

(ख) नियुक्ति प्राधिकारी , अपवाधिक मामलों में किसी ऐसे अभ्यार्थी को चयन समिति / बोर्ड की सिफारिश पर अर्हमान सकेगा , जो यद्यपि इस खण्ड में विहितअर्हताओं में से कोई भी अर्हता नहीं रखता है किन्तु जिसने किन्ही अन्य संस्थाओ द्वारा संचालित परीक्षाए ऐसी स्तर से उत्तीर्ण की हो , जिससे नियुक्ति प्राधिकारी की राय में अभ्यार्थी चयन के लिए अर्ह हो । और

(ग) ऐसे अभ्यार्थियो के , जो अन्यथा अर्ह है , किन्तु जिन्होंने ऐसे विदेशी विश्वविद्यालयो में से, जिन्हें सरकार द्वारा विनिर्दिष्ट रूप से मान्यता प्रदान नहीं की गई , उपाधियाँ प्राप्त की गई है, चयन के लिए भी नियुक्ति प्राधिकारी के विवेकानुसार विचार किया जा सकेगा ।

(घ) अभ्यार्थियो को " मध्यप्रदेश कनिष्ठ सेवा (संयुक्त अर्हता) परीक्षा नियम , 2013 " के नियम (7)- सेवा समूह, अनुसार आयोजित चयन परीक्षा सम्मिलित होना अनिवार्य होगा ।

(ड) अभ्यार्थियों को आवेदित पद के लिए प्राथमिकता अंकित करनी होगा, यदि कोई अभ्यार्थी मध्यप्रदेश कनिष्ठ सेवा (संयुक्त अर्हता ) परीक्षा नियम 2013 के तहत चयन परीक्षा मे अर्ह हो जाता हैं किन्तु वह नियुक्ति के लिए निर्धारित मानदण्डों को पूर्ति नहीं करता है तो ऐसी दशा में उसकी अभ्यार्थिता नामंजूर हो जाएगी और वे अन्य पद के लिए अहस्तांतरणीय होगी तथा पूर्ण दायित्व संबंधित अभ्यार्थी का होगा ।

(च) अभ्यार्थियों को "मध्यप्रदेश कनिष्ठ सेवा (संयुक्त अर्हता ) परीक्षा नियम, 2013 "तहत चयन परीक्षा में अनारक्षित वर्ग के अभ्यार्थियों के लिए 50 प्रतिशत तथा अनुसूचित जाति, अनुसूचित जन जाति, अन्य पिछड़ा वर्ग तथा निःशक्तजन अभ्यर्थियों के लिए 10 प्रतिशत तक अंकों की छूट देते हुए 40 प्रतिशत न्यूनतम अर्ह अंक होगे ।

(छ) ऐसे अभ्यर्थी को, जो भूतपूर्व सैनिक हो, अपनी आयु में से उसके द्वारा पूर्व में की गई संपूर्ण प्रतिरक्षा सेवा की कालावधि कम करने के लिए अनुज्ञात किया जाएगा बशर्ते कि परिणामी आयु अधिकतम आयु सीमा से तीन वर्ष से अधिक न हो ।

स्पष्टीकरण :- पद "भूतपूर्व सैनिक " से द्योतक है । ऐसा व्यक्ति जो निम्नलिखित प्रवर्गो में से किसी एक प्रवर्ग का हो तथा जो भारत सरकार के अधीन कम से कम छह मास कि निरंतर कालावधि तक नियोजित रहा हो और जिसकी किसी भी रोजगार कार्यालय में अपना रजिस्ट्रीकरण कराने या सरकारी सेवा में नियोजन हेतु अन्यथा आवेदन करने की तारीख से अधिक से अधिक तीन वर्ष से पूर्व मितव्ययिता इकाई की सिफारिशों के परिणामस्परूपा स्थापना में प्रसामान्य कमी की जाने के कारण छटनी कर दी गई थी या जिसें अधिशिष्ट (सरप्लस) घोषित कर दिया गया था :-

(1 ) एक सेवा भूतपूर्व सैनिक जो समय पूर्व सेवा निवृत्ति नियायतों (मस्टरिंग आउट कन्सेशन ) के अधीन निर्मुक्त किया गया हैं ।

( 2 ) ऐसा भूतपूर्व सैनिक जिसे दुबारा भरती किया गया हैं तथा जिसे-

(क) अल्पावधि कार्य पूर्ण हो जाने पर ।

(ख) भर्ती की शर्तों को पूर्ण कर लेने पर सेवा मुक्त कर दिया गया हैं ।

(3) मद्रास सिविल यूनिट के भूतपूर्व सैनिक,

(4 ) ऐसे अधिकारी (सैनिक तथा सिविल) जिन्हें उनके संविदा पूर्ण होने पर सेवोन्मुक्त किया गया हैं ।

(5) ऐसे अधिकारी , जिन्हें अवकाश रिक्तियों पर छह माह से अधिक समय तथा निरंतर कार्य कर लेने के पश्चात सेवान्मुक्त किया गया है ।

(6) ऐसे भूतपूर्व सैनिक जिन्हें अशक्त होने के कारण सेवा से अलग कर दिया गया हैं ।

(7) ऐसे भूतपूर्व सैनिक जिन्हें इस आधार पर सेवा सेवान्मुक्त कर दिया गया हैं की वे दक्ष सिपाही बनने योग्य नहीं हैं ।

(8 ) ऐसे भूतपूर्व सैनिक, जिनको गोली लग जाने , घाव हो जाने आदि के कारण चिकित्सीय आधार पर सेवा अलग कर दिया हैं ।

(3) फीस - उसे (अभ्यर्थी को) नियुक्ति प्राधिकारी द्वारा विहित कि गई फीस का भूगतान करना होगा ।

9. निरर्हता

(1) अभ्यर्थी की ओर से अपनी अभ्यर्थिता के लिये किसी भी साधन से प्राप्त करने हेतु समर्थन अभिप्राप्त करने के लिये किसी भी प्रयास को नियुक्ति प्राधिकारी द्वारा परीक्षा/चयन के लिये निर्हरता माना जाएगा ।

(2) कोई भी अभ्यर्थी जिसकी एक से अधिक जीवित पत्नियां हो और कोई भी महिला अभ्यर्थी जिसने ऐसे व्यक्ति से विवाह किया है जिसकी पहले से ही एक पत्नि जीवित हो, सेवा के लिए अपात्र होगा ।

(3) अभ्यर्थी सेवा में नियुक्ति के लिए पात्र होगा यदि समय समय पर यथासंशोधित मध्यप्रदेश सिविल सेवा (सेवा की सामान्य शर्ते) नियम , 1961 के नियम 6 के उपबंधों के अनुसार 26 जनवरी, 2001 के पश्चात् उसे कोई तीसरी संतान नहीं होती है । उम्मीदवार का मानसिक तथा शारीरिक स्वास्थ्य अच्छा होना चाहिये और उसमें ऐसा कोई शारीरिक दोष नहीं होना चाहिए जिससे उसके द्वारा विशेष कर्तव्यों का निर्वहन प्रतिकूलतः प्रभावित हो सकता हो । नियुक्त नहीं किया जायेगा ।

(4) कोई भी अभ्यर्थी, जिसे महिलाओं के विरूद्ध किसी अपराध का सिद्धदोष ठहराया गया हो, सेवा के लिए अपात्र होगा ।

(5) कोई भी अभ्यर्थी, जिसने विवाह के लिए नियत की गयी न्यूनतम आयु से पूर्व विवाह किया हो, किसी सेवा या पद पर नियुक्ति के लिए अपात्र होगा ।

10. अभ्यर्थियों की पात्रता के संबंध में समिति का विनिश्चय अंतिम होगा नियुक्ति के लिए अभ्यर्थी की पात्रता या अपात्रता के संबंध में चयन समिति का विनिश्चय अंतिम होगा ।

11. चयन द्वारा सीधी भरती हेतु सफल अभ्यर्थियों की सूची:-

(1 ) अनुसूचित जाति , अनुसूचित जनजाति तथा अन्य पिछड़े वर्ग का कोई उम्मीदवार अपनी योग्यता के आधार पर अनारक्षित (ओपन) सूची में स्थान प्राप्त कर लेता है तो उसकी अनारक्षित श्रेणी में गणना की जायेगी और ऐसे उम्मीदवार को उसकी संबंधित आरक्षित प्रवर्ग की संख्या में नहीं जोड़ा जावेगा ।

(2) आरक्षित श्रेणी का कोई अभ्यर्थी अनारक्षित पदों के विरूद्ध समायोजित किया जाएगा यदि वह बिना किसी छूट के अनारक्षित अभ्यर्थी के समान अर्ह पाया जाता है । ऐसे अभ्यर्थी को आयु संबंधी छूट प्राप्त नहीं होगी ।

(3) आरक्षण का लाभ देते हुए संयुक्त खुली सूची जारी करने के पश्चात्, अनुसूचित जातियों/अनुसूचित जनजातियों/ अन्य पिछड़े वर्गों के सफल अभ्यर्थियों की पृथक् पृथक सूची जारी की जाएगी जिसमें संबंधित आरक्षित श्रेणी के पात्र अभ्यर्थियों के नाम हारिजेन्टल आरक्षण के अनुसार भी सम्मिलित किए जाएंगे ।

(4) यदि आरक्षित श्रेणी का कोई अभ्यर्थी अर्थात महिला/ भूतपूर्व सैनिक /शारीरिक रूप से निःशक्त अभ्यर्थी जो अपनी योग्यता के आधार पर अनारक्षित श्रेणी में स्थान प्राप्त कर लेता है तो उसकी गणना अनारक्षित हारिजेन्टल श्रेणी में की जाएगी । इसके बाद प्रवर्गवार सूची में होरीजेंटल आरक्षण संबंधित प्रवर्ग के अभ्यर्थी को ही दिया जाएगा । अनुसूचित जातियों/अनुसूचित जनजातियों/ अन्य पिछड़े वर्गों/महिलाओं , शारीरिक रूप से निःशक्त व्यक्ति और भूतपूर्व सैनिक संबंधित श्रेणी कम्पार्टमेंट में स्थान प्राप्त कर सकेंगे ।

12. सफल अभ्यर्थियों की अंतिम सूची की विधिमान्यता की अवधि :- किसी भरती वर्ष में परीक्षा में सफल अभ्यर्थियों की अंतिम सूची, अंतिम सूची की घोषणा होने की तारीख से 18 मास के लिए विधिमान्य होगी किन्तु आगामी वर्ष की परीक्षा के परिणाम घोषित हो जाने के पश्चात् अविधिमान्य हो जाएगी ।

13. सफल अभ्यर्थियों के प्रमाण पत्रों का सत्यापन तथा नियुक्ति की प्रक्रियाः-

(1 ) परीक्षा में सफल अभ्यर्थियों की अंतिम सूची के आधार पर , विभाग , शैक्षणिक तकनीकी और व्यावसायिक अर्हताओं की उपाधि / पत्रोपाधि / प्रमाण पत्रों का सत्यापन करेगा ।

(2) सामान्य प्रशासन विभाग द्वारा जारी दिशा निर्देशों के अनुसार , नियुक्ति के संबंध में आवश्यक कार्यवाही, अभ्यर्थियों के प्रमाण पत्रों, चरित्र प्रमाण पत्र का सत्यापन आदि की कार्यवाही सुनिश्चित करना नियुक्तिकर्ता अधिकारी का दायित्व होगा ।

14. परिवीक्षा- सेवा में सीधी भर्ती से लिया गया प्रत्येक व्यक्ति तीन वर्ष की कालावधि के लिए " परिवीक्षा पर नियुक्त किया जाएगा । क्रमशः 70 , 80, 90

15. आरक्षण :-

(1 ) मध्यप्रदेश लोक सेवा (अनुसूचित जातियों / अनुसूचित जनजातियों / अन्य पिछड़े वर्गों के लिए आरक्षण) संशोधन अधिनियम , 2019 (क्रमांक 12 सन् 2019 ) के उपबंधों के अनुसार , अभ्यर्थियों के लिए निम्नलिखित लंबवत (वर्टीकल) आरक्षण लागू होगाः-

20 प्रतिशत

अनुसूचित जनजाति

16 प्रतिशत

अनुसूचित जाति,

27 प्रतिशत

अन्य पिछड़े वर्ग

स्पष्टीकरण – सीधी भरती से भरे जाने वाले राज्य स्तरीय पदों / संवर्गो के लिये सामान्य प्रशासन विभाग द्वारा जारी माडल आरक्षण रोस्टर लागू होगा ।

16. क्षैतिज आरक्षण : -

(क) मध्यप्रदेश सिविल सेवा (महिलाओं की नियुक्ति हेतु विशेष उपबंध ) नियम , 1997 के उपबंधों के अनुसार राज्य के अधीन सीधी भरती के प्रक्रम पर समस्त पदों के पैंतीस प्रतिशत पद महिलाओं के लिए आरक्षित रहेंगे तथा उक्त आरक्षण समस्तर और प्रभागवार (हॉरिजेन्टल एण्ड कम्पार्टमेंटवाइज) होगा ।

(ख ) दिव्यांगजन अधिकार अधिनियम 2016 तथा मध्यप्रदेश दिव्यांगजन अधिकार नियम 2017 के परिप्रेक्ष्य में सामान्य प्रशासन विभाग , मध्यप्रदेश शासन द्वारा दिव्यांगजन आरक्षण के संबंध में जारी आदेश दिनांक 03.07.2018 एवं 17.09.2018 अनुसार निःशक्त या शारीरिक रूप से विकलांग व्यक्तियों हेतु क्षैतिजिक (हॉरिजेन्टल) आरक्षण चिन्हित किए गए पदों के लिए दिया जाएगा ।

(ग ) मध्यप्रदेश के भूतपूर्व सैनिकों को मध्यप्रदेश सिविल सेवा (तृतीय श्रेणी और चतुर्थ श्रेणी की रिक्तियों में आरक्षण ) नियम , 1985 के अनुसार क्रमशः तृतीय श्रेणी , के लिए 10 प्रतिशत तथा चतुर्थ श्रेणी के लिए 20 प्रतिशत क्षैतिजिक (हॉरिजेन्टल) होगा ।

17. पदोन्नति द्वारा नियुक्ति :-

(1 ) पदोन्नति की कार्यवाही मध्यप्रदेश सामान्य प्रशासन विभाग द्वारा समय - समय पर जारी नियम / आदेशों के अनुसार होगी ।

(2) पात्र अभ्यर्थियों की पदोन्नति के लिए प्रारम्भिक चयन करने हेतु एक समिति गठन किया जायेगा जिसमें अनुसूची चार में वर्णित सदस्य होंगे .

(3) आरक्षित रिक्तियों में पदोन्नति करने के लिए प्रक्रिया सरकार के सामान्य प्रशासन विभाग द्वारा समय- समय पर जारी किए गए अनुदेशों के अनुसार होगी ।

(4) समिति की बैठक वर्ष में कम से कम एक बार होगी ।

18 . पदोन्नति के लिये पात्रता संबंधी शर्ते :-

(1) उप नियम (2) के उपबंधों के अधीन रहते हुए समिति, उन सभी व्यक्तियों के मामलों पर विचार करेगी, जिन्होने उस वर्ष की 01 जनवरी को उन पदों पर या सेवाओं में उतने वर्षों की सेवा (चाहे स्थानापन्न रूप में या मूल रूप में ) जैसा अनुसूची के कॉलम (2) में वर्णित है, या किसी अन्य पद या पदों पर, जिन्हें सरकार द्वारा उसके समतुल्य घोषित किया गया है, पूर्ण कर ली हो तथा जो उपनियम (2 ) के उपबन्धों के अनुसार विचारण के क्षेत्र (जोन आफ कन्सीडरेशन) के भीतर आते हों :

(2) चयन का क्षेत्र सामान्य प्रशासन विभाग द्वारा पदोन्नति के संबंध में समय - समय पर जारी नियम/अनुदेशों के अनुसार होगा :

19. चयन सूची: -

(1 ) नियुक्ति प्राधिकारी, समिति द्वारा तैयार की गई सूची पर विचार करेगा तथा यदि वह उसमें कोई परिवर्तन आवश्यक नहीं समझता है तो सूची को अनुमोदित करेगा .

(2) यदि नियुक्ति प्राधिकारी , सूची में कोई परिवर्तन करना आवश्यक समझता है तो वह ऐसे उपान्तरणों के साथ यदि कोई हो, उसके कारणों को लेखबद्ध करते हुए , सूची को अन्तिम रूप से अनुमोदित करेगा.

(3) नियुक्ति प्राधिकारी द्वारा अंतिम रूप से यथा अनुमोदित की गई सूची, अनुसूची-चार के कॉलम ( 2 ) में वर्णित पदों से सेवा के सदस्यों की, अनुसूची चार के कॉलम (3 ) में वर्णित पदों पर पदोन्नति के लिए चयन सूची होगी .

(4) चयन सूची सामान्यतः एक वर्ष तक या जब तक नियम 15 के उपनियम (4) के अनुसार उनका पूनर्विलोकन या पुनरीक्षण नहीं कर लिया जाता प्रवृत्त रहेगी , किन्तु उसकी विधिमान्यता ऐसी सूचि तैयार किये जाने की तारीख से 18 मास की कुल कालावधि के परे नहीं बढ़ाई जायेगी :

परन्तु चयन सूची में सम्मिलित किसी व्यक्ति की ओर से आचरण या कर्तव्यों के निर्वहन में गंभीर चूक होने की दशा में नियुक्ति प्राधिकारी की प्रेरणा पर समिति द्वारा चयन सूची का विशेष रूप से पुनर्विलोकन किया जा सकेगा तथा समिति, यदि वह उचित समझे ऐसे व्यक्तियों का नाम चयन सूची से हटा देगी ।

20 . चयन सूची से सेवा में नियुक्ति-

(1) चयन सूची में सम्मिलित व्यक्तियों की नियुक्तियां सेवा के संवर्ग के अन्तर्गत आने वाले पदों पर उसी क्रम से की जाएंगी जिस क्रम में ऐसे कर्मचारियों के नाम चयन सूची में हों :

परन्तु जहां प्रशासकीय अत्यआवश्यकताओं के कारण ऐसा करना अपेक्षित हो, वहां उस व्यक्ति को, जिसका नाम चयन सूची में सम्मिलित न हो या जिसका नाम चयन सूची में क्रम में अगला न हो सेवा के लिए नियुक्त किया जा सकेगा , यदि नियुक्त प्राधिकारी का यह समाधान हो जाए कि रिक्त के तीन मास के अधिक समय तक चालू रहने की सम्भावना नहीं है.

(2) ऐसी किसी व्यक्ति को जिसका नाम चयन सूची में सम्मिलित है, सेवा में नियुक्ति के पूर्व समिति से परामर्श करना सामान्यतः तब तक आवष्यक नहीं होगा जब तक चयन सूची में उसका नाम सम्मिलित किए जाने तथा प्रस्तावित नियुक्ति की तारीख के बीच की कालावधि के दौरान उसके कार्य में ऐसी कोई गिरावट न आ गई हो, जो नियुक्ति प्राधिकारी की राय में ऐसी हो जिससे वह सेवा में नियुक्ति के लिए अनुपयुक्त हो गया हो.

21. परीक्षण:- सेवा में सीधी भरती कियें गये प्रत्येक व्यक्ति को दो वर्ष की कालावधि के लिये परीक्षण पर नियुक्त किया जाएगा.

22. निर्वचन :- यदि इन नियमों के निर्वचन निर्वचन के संबंध में कोई प्रश्न उद्भूत होता हैं तो वह सरकार को निर्दिष्ट किया जाएगा, जिसका उस पर विनिश्चय अंतिम होगा.

23 . शिथिलीकरण :- इन नियमों में कि किसी बात का यह अर्थ नही लगाया जाएगा की वह किसी ऐसे व्यक्ति के मामले में , जिस पर यह नियम लागू होते हो , राज्यपाल की ऐसी रीति में कार्यवाही करने की शक्ति को जो उस न्यायसंगत और साभ्यीपूर्ण प्रतित होती हो , सीमित या कम करती हो .

परन्तु कोई मामला ऐसी रीति में नहीं निपटाया जाएगा , जो इन नियमों में उपबधित रीति की अपेक्षा उसके लिए अनुकूल हो.

24. व्यावृत्ति:- इन नियमों में की कोई भी बात अनुसूचित जातियों, तथा अनुसूचित जनजातियों के लिये, राज्य सरकार द्वारा इस संबंध में समय समय पर जारी किये गये आदेशों के अनुसार अपेक्षित आरक्षण तथा अन्य रियायतों के लिए उपबंध्द किये जाने को प्रभावित नहीं करेगी.

25. निरसनः- इन नियमों, के तत्स्थानी तथा इसके प्रारंभ होने के अव्यवहित पूर्व प्रवृत्त सभी नियमों के अन्तर्गत आने वाले विषयों के संबंध में, एतद् द्वारा निरस्त किये जाते हैं,

परन्तु इस प्रकार निरसित नियमों के अधीन किया गया कोई आदेश या की गई कोई कार्यवाही इन नियमों के तत्स्थानी उपबंधों के अधीन किया गया आदेश या की गई कार्यवाही समझी जाएगी ।

मुख्य चिकित्सा एवं स्वास्थ्य अधिकारी 5200-20200+ ग्रेड पे 1900 म.प्र . पुनरीक्षण नियम-2016 अनुसार लेवल क्र. 4 (19500-62000)

म.प्र. शासन, सामान्य प्रशासन विभाग (वेतन आयोग प्रकोष्ठ) के आदेश कमांक/ एफ-2-6/ 1 / वे.अ.प्र. / 96 , दिनांक 05/17 अक्टूबर , 2006 एवं मध्यप्रदेश शासन, वित्त विभाग , मंत्रालय के परिपत्र क्रमांक एफ 8-6/ 2015 / नियम / चार, दिनांक 19.07.2017 अनुसार अनुसचिवीय सेवायें ( लिपिकीय अनला) की पद संरचना वेतनमान एवं पदोन्नति के संबंध में निर्णय लिया गया है । उपर्युक्त अनुसार संशोधन दिनांक 01 जनवरी 2016 से लागु होगें ।

# मध्यप्रदेश शासन वित्त विभाग (राज्य वेतन आयोग प्रकोष्ट) , मंत्रालय के आदेश क्रमांक एफ 8-1-2015 / नियम / चार, दिनांक 07.06.2018 के अनुसार वेतनमानों का पुनरीक्षण करने का निर्णय लिया गया है । उपर्युक्त वेतन उन्नयन दिनांक 01-01-2016 से लागू कर नगद लाभ दिनांक 01-07-2018 (अगस्त 2018 में देय ) से दिया जाते । दिनांक 01-01-2016 को उपर्युक्त अनुसार देय ग्रेड वेतन के आधार पर म.प्र. वेतन पुनरीक्षण नियम , 2017 में वेतन निर्धारण किया जावेगा । दिनांक 01-01-2016 से 30-06-2018 तक की अवधि के लिये काल्पनिक वेतन वृद्धियों दी जायेंगी ।

**** शीघ्रलेखक के 50 प्रतिशत पद वांछित अर्हता रखने वाले स्टेनों टायपिस्ट की पदोन्नति से भरे जायेंगे । वांछित अर्हताधारी स्टेनो टायपिस्ट पर्याप्त संख्या में उपलब्ध नहीं होने पर पदोन्नति कोटे के शेष पद सीधी भरती से भरे जायेंगे ।

3. निम्नलिखित मान्यता प्राप्त संस्थाओं में से किसी एक संस्था से एक वर्षीय कम्प्यूटर डिप्लोमा / सर्टिफिकेट परीक्षा उर्तीण करना अनिवार्य है:-

(i ) यू.जी.सी. द्वारा मान्यता प्राप्त किसी भी विश्वविद्यालय से डिप्लोमा ।

(ii ) यू.जी.सी द्वारा मान्यता प्राप्त किसी भी मुक्त विश्वविद्यालय से डिप्लोमा ।

(iii) डी.ओ.ई.ए.सी.सी. से डिप्लोमा स्तर की परीक्षा ।

(iv) शासकीय पॉलीटेक्निक कॉलेज से मॉडर्न ऑफिस मैनेजमेंट कोर्स ।

(v) राष्ट्रीय व्यावसायिक प्रशिक्षण परिषद (N.C.V.T. ) नई दिल्ली अथवा राज्य व्यावसायिक प्रशिक्षण परिषद (S.C.V.T. ) मध्यप्रदेश द्वारा प्रदत्त एक वर्षीय "कम्प्यूटर ऑपरेटर एवं प्रोग्रामिंग असिस्टेंट ( COPA ) प्रमाण पत्र ।

4. उक्त मान्यता प्राप्त संस्थाओं से कम्प्यूटर डिप्लोमा के अलावा निम्न अर्हता भी मान्य होगी:- (i) बी.ई. (सी.एस.ई./ आई.टी.)/एम.सी.ए. /बी.सी.ए./एम.एस.सी. (आई.टी.सी.एस. ) / *बी.एस.सी. (आई.टी. / सी.एस .) एम.टेक/ एम.ई. इत्यादि ।

(v) राष्ट्रीय व्यावसायिक प्रशिक्षण परिषद (N.C.V.T. ) नई दिल्ली अथवा राज्य व्यावसायिक प्रशिक्षण परिषद (S.C: V.T.) मध्यप्रदेश द्वारा प्रदत्त एक वर्षीय 'कम्प्यूटर ऑपरेटर एवं प्रोग्रामिंग असिस्टेंट ' ( COPA ) प्रमाण पत्र ।

4. उक्त मान्यता प्राप्त संस्थाओं से कम्प्यूटर डिप्लोमा के अलावा निम्न अर्हता भी मान्य होगी:--

(i) बी.ई. (सी.एस.ई./ आई.टी. )/ एम.सी.ए. / बी.सी.

ए./ एम.एस.सी. (आई.टी.सी.एस. ) / * बी.एस. सी. (आई.टी./ सी.एस .) एम.टेक / एम.ई. इत्यादि।

टिप्पण * मध्यप्रदेश शासन , वित्त विभाग , मंत्रालय के परिपत्र क्रमांक एफ 8-6 / 2015/ नियम/ चार, दिनांक 19.07.2017 अनुसार अनुसचिवीयं सेवायें (लिपिकीय अमला) की पद संरचना वेतनमान एवं पदोन्नति संबंधी निर्णयानुसार संशोधन दिनांक 01 जनवरी 2016 से लागु होगें ।

** ( ii ) वित्त विभाग , म.प्र . शासन के परिपत्र क्र. एफ 8-6 / 2015 / नियम/ चार , दिनांक 19.07.2017 अनुसार नवीन संरचना में कनिष्ठ लेखा परीक्षक का वेतनमान 5200-20200+ग्रेड पे 2800 में लेखापाल पद के समकक्ष किया गया है । विभाग अन्तर्गत पूर्व में कनिष्ठ लेखा परीक्षक के पद वेतनमान 5200-20200+ ग्रेड पे 2800 में स्वीकृत होने तथा उक्त्त पद पर लेखापाल के पद से पदोन्नति का प्रावधान होने के फलस्वरूप कनिष्ठ लेखा परीक्षक के 09 पदों को नवीन प्रावधान अनुसार लेखापाल के पद से आगामी पदोन्नति पद, वरिष्ठ लेखा परीक्षक के पद में समाहित किया जाता है ।

(६). यू.जी.सी. द्वारा मान्यता प्राप्त किसी भी विश्वविद्यालय से डिप्लोमा ।

(ब) यू.जी.सी द्वारा मान्यता प्राप्त किसी भी मुक्त विश्वविद्यालय से डिप्लोमा ।

4. यदि 02 वर्ष की परीक्षण अवधि में संबंधित कर्मचारी द्वारा यह योग्यता प्राप्त नहीं कर ली जाती है, तो उन्हें उनके मूल चतुर्थ श्रेणी पद पर प्रत्यावर्तित कर दिया जाये ।

5. 45 वर्ष से अधिक आयु के चतुर्थ श्रेणी कर्मचारियों को उक्त शर्त से छूट प्रदान की जाये ।

Bhopal , the 4th March 2024 In exercise of the powers conferred by the proviso to article 309 of the Constitution of India and in supersession of the Madhya Pradesh Public Health and Mertical ( Directorate of Health Services ) Class - III Ministerial Service Recruitment Rules , 1989 , the Governor of Madhya Pradesh , hereby , makes the following rules , namely: -

RULES

1. Short title and commencement.-

(1 ) These rules may be called the Madhya Pradesh Public Health and Medical Education ( Directorate of Health Services ) Class - III Clerical and Non- Clerical Service Recruitment Rules , 2024 .

(2) They shall come into force from the date of their publication in the Madhya Pradesh Gazette .

2. Definitions . In these rules , unless the context otherwise requires , -

( a) " Appointing Authority" , in respect of the service means the authority as specified in columra (6 ) of Schedule - I (A) and Schedule - I (B ) ;

(b) "Board" means the Madhya Pradesh Employees Selection Board;

the Commissioner , Health "Commissioner " means Services , Madhya Pradesh ;

(e) " Committee" means the Departmental Promotion Committee consisting of such members as specified in column (5) of Schedule - IV (A) and Schedule - IV (B ) ;

(f) "Disabled Persons " means those persons who are covered under the provisions of the Rights of Persons with Disabilities Act , 2016 (49 of 2016 ) ;

(g) " Economically Weaker Section ( E.W.S. ) " means a citizen who does not come under any reserve category such as Scheduled Castes and Scheduled Tribes as per the circular of the General Administration Department No. F-07-11 / 2019 / आ.प्र ./one , dated 2nd July , 2019 ;

(h) " Examination " means an examination organized for recruitment under clause ( a) of sub - rule ( 1 ) of rule 6 ;

(i) "Ex - serviceman " means a person who belongs to any of the following categories and was employed under the Government of India for a continuous period of not less than six months and was retrenched or declared surplus as a result of the recommendation of the economy unit or due to normal reduction in establishment not more than 3 years before the date of his registration at any employment exchange or of application made otherwise for employment in Government Service .

( 1 ) ex- serviceman released under mustering out concession ;

(2) ex - serviceman who was employed for more than six months continuously in army of country and not released due to any misconduct ;

(3) ex - serviceman enrolled for the second time and discharged on-

(a) completion of short term engagement ;

(b) fulfilling the conditions of enrolment ;

ex- personnel of Madras Civil Units ;

(4)

(5) officer discharged after working for more than six months continuously against leave vacancies ;

(6) ex - serviceman who are medically boarded out on account of gunshot , wounds , etc. or they are unlikely to become efficient soldiers ;

(j ) "Government " means the Government of Madhya Pradesh;

(k) "Governor " means the Governor of Madhya Pradesh ;

(1) " Other Backward Classes " means Other Backward Classes of citizens as specified by the State Government vide Notification No. F - 8-5 - XXV - 4-84 , dated 26th December , 1984 , as amended from time to time ;

(m) " Retrenched Government Servant " means a person who was in a temporary Government Service of this State or of any constituent units , for a continuous period of not less than six months and who was discharged because of reduction in establishment not more than 3 years prior to the date of his registration at the employment exchange or an application made otherwise for employment in Government Service ;

(n) " Schedule " means a Schedule appended to these rules ;

(0) " Scheduled Castes " means any caste , race or tribe or part of or group within such caste , race or tribe specified as Scheduled Castes with respect to the State of Madhya Pradesh under article 341 of the Constitution of India ;

" Scheduled Tribes " means any tribe or tribal community or part of or group within such tribe or tribal community specified as Scheduled Tribes with respect to the State ofMadhya Pradesh under article 342 of the Constitution ofIndia; (p)

(q) "Service" means the Madhya Pradesh Public Health and Medical Education ( Directorate of Health Services ) Class - III Clerical and Non- Clerical Service ;

(r ) " State" means the State of Madhya Pradesh .

3. Scope and Application.-

Without prejudice to the generality of the provisions contained in the Madhya Pradesh Civil Services ( General Conditions of Service ) Rules , 1961 , these rules shall apply to every member of the service .

4. Constitution of the service . The service shall consist of the following persons , namely : -

(1) persons who at the time of commencement of these rules are holding substantively or an officiating capacity the posts specified in Schedule - 1 (A) and Schedule - 1 (B );

persons recruited to the service (2) commencement of these rules ; and before the (3) persons recruited to the service in accordance with the provisions of these rules .

5. Classification , Pay Scale , etc.-

The classification of the service , pay scale attached thereto and the number of posts included in the service shall be as specified in Schedule - I ( A) and Schedule - I ( B ) and shall be eligible for time pay scale under the provisions of the Finance Department :

Provided that the Government may from time to time , add to or reduce the number of posts included in the service , either on a permanent or temporary basis .

6. Method of Recruitment.-

(1) Recruitment to the service , after the commencement of these rules shall be made by the following methods , namely: -

(a) by selection , by direct recruitment generally through competitive examination organized by the Board or by other selection examination conducted with the specific permission of the General Administration Department ;

(b) by promotion of members appointed in the service as specified in column (2 ) of Schedule - IV (A) and Schedule - IV ( B ) ;

(c) by transfer of such persons holding in their substantive capacity such posts in such services as may be specified in this behalf by the State Government .

(2) The number of persons recruited under clause (b) or clause (c) of sub- rule ( 1 ) shall not at any time exceed the percentage shown in Schedule - II (A) and Schedule - II (B) 138 (31)

of the number of duty posts specified in Schedule - I (A) and Schedule - I ( B) .

(3) Fifty percent of the total number of persons recruited under clause ( a) of sub - rule ( 1 ) shall be reserved for those persons who have been appointed on contractual basis , but the benefit of such reservation may be availed only once by the persons belonging to this category. For the period of service rendered on contractual basis in an equivalent or higher post , the candidates shall be entitled to relaxation in the upper age limit and that age limit shall be the maximum age including all relaxations as on the date of application or as per the date mentioned in the advertisement issued to fill the post , the upper age limit shall not exceed 55 years .

(4) Fifty percent of the total number of contractual officers /employees who have completed 5 years of continuous service on contractual posts equivalent to regular posts of direct recruitment in the department or up to 50% of the vacant posts of direct recruitment in the department (whichever is less ) , shall be reserved for appointment of contractual officers / employees vide the circular of the Government of Madhya Pradesh , General Administration Department No. C - 5-2 / 2018 / 1 / 3 , dated 22nd July , 2023. Once they have taken advantage of the reservation facility under these instructions or the earlier instructions referred to , they shall not be eligible for the benefit again.

(5) Subject to the provisions of these rules , the method of recruitment to be adopted for the purpose of filling any particular vacancy or vacancies in the service as may be required to be filled during any particular period of recruitment and the number of persons to be recruited by each method , shall be determined on each occasion by the Government / Appointing Authority .

(6) The reservation for Economically Weaker Section (E.W.S. ) shall be given 10 % vide circular issued by the Government of Madhya Pradesh , General Administration Department No. F-07- 11 / 2019 / आ.प्र./ one , dated 2nd July , 2019. Similarly the reservation shall also be granted to the candidates of the Scheduled Castes and Scheduled Tribes as per the article 341 and 342 of the Constitution of India and reservation for the Other Backward Classes shall be in accordance with the Notification No. F - 8-5 - XXV - 4-84 , dated 26th December , 1984 , amended from time to time .

7. Appointment to the service.-

All appointments to the service after the commencement of these rules shall be made by the appointing authority and no such appointment shall be made after selection except by one of the methods of recruitment specified in rule 6 .

8. Conditions of eligibility for direct recruitment.-

In order to be eligible for direct recruitment , a candidate must satisfy the following conditions , namely : - 138(33)

(1) Age.-

The minimum age , upper age and relaxation in upper age limit shall be , as determined by the State Government as per the circular issued by the General Administration Department , from time to time .

(a) The candidate must have attained the age as shown in column ( 3) of Schedule - III ( A) and Schedule - III ( B ) and not attained the age as shown in column (4 ) of the said Schedule on the first day of January next following date of commencement of the examination / selection ;

(b) the upper age limit shall be relaxable up to a maximum of 5 years if a candidate belongs to Scheduled Castes or Scheduled Tribes category;

in regard of Vikram Award holders , the upper age limit shall be relaxable up to 5 years ; (c)

(d) in accordance with the provisions of Madhya Pradesh Civil Services ( Special Provisions for Appointment of Women ) Rules , 1997 the upper age limit shall be relaxable up to 10 years for women candidates;

(e) the general upper age limit shall be relaxable up to 5 years in respect of a partner belonging to unreserved category who has been awarded under the Inter - Caste Marriage Incentive Scheme of Tribal , Scheduled Castes and Other Backward Classes Welfare Department ;

(1) in respect of the male and female candidates working under the Government / Corporation / Board/ Autonomous body and Nagar Sainik and male and female candidates belonging to reserved category and all female candidates including widow/ abandoned / divorced , the maximum age limit shall be 45 years :

Provided that the maximum age limit for any cadre including all relaxations in any case shall not exceed more than 45 years .

( g ) the upper age limit regarding disabled candidates shall be relaxable as the State Government may prescribe from time to time ;

(h) a candidate , who is a Retrenched Government Servant shall be allowed to deduct from his age , the period of all temporary service previously rendered by him to a maximum limit of seven years even if it represents more than one spell , provided that the resultant age does not exceed the upper age limit by more than three years ;

(i) a candidate who is an ex - serviceman shall be allowed to deduct from his age , the period of all defence services previously rendered by him provided that the resultant age does not exceed the upper age limit by more than 3 years ;

(j ) the upper age limit shall be relaxable in the case of voluntary Home Guards and non commissioned officers of Home Guards equal to the period of 138 (35)

(2) Educational Qualifications .

( a) The candidate must possess the educational qualifications prescribed for the service as shown in the Schedule - III (A) and Schedule - III (B) appended hereto :

Provided that-

( i) in exceptional cases , the Appointing Authority may, on the recommendation of the Selection Committee/ Board, appoint a candidate who , although does not possess any of the prescribed qualifications but has passed the examinations conducted by other Institutions at such a level . So that in the opinion of the Appointing Authority the candidate is eligible for selection; and

(ii) such candidates , who are otherwise qualified but have obtained degrees from Foreign Universities not specifically recognized by the Government , may also be considered for selection at the discretion of the Appointing Authority .

(b) It shall be mandatory for the candidates to appear in the selection examination conducted by the Board.

(c) For the post applied for , the candidates shall have to choose their preference , if a candidate qualifies in the selection examination conducted by the Board , but does not fulfill the prescribed criteria for appointment then in such a case , his / her candidature shall be rejected and shall be non- transferable to any other post and the entire responsibility shall be on the concerned candidate .

(3) Fees.-

The candidates must pay the fees prescribed by the Appointing Authority / Government , as revised from time to time .

9. Disqualifications.-

( 1) Any attempt on the part of a candidate to obtain support for his candidature by any means may be held by the Appointing Authority / Board / Committee to disqualify him from appearing in the examination / selection .

(2) Any candidate , who has married earlier to the minimum age fixed for marriage shall be disqualified for appointment in the service or on any post .

(3) Any candidate , who has more than two living children , one of whom is born in or after 26th January , 2001 shall not be eligible for the service or post :

Provided that no candidate shall be disqualified for appointment to a service or post , who already has one 138(37)

living child and next delivery takes place on or after the 26th day of January , 2001 , in which two or more than two children are born .

(4) Any candidate , who has been convicted for any offence against woman shall be disqualified for appointment in the service:

Provided that if criminal proceedings are still pending in a court , his appointment shall be kept on hold until disposal of such criminal proceedings .

(5) Any male candidate , having more than one living wife and any female candidate who married to a person who already has a living wife shall be disqualified for service :

(6) Any other reason , as prescribed by the State Government .

10. Decision regarding eligibility.-

The decision of the Appointing Authority/ Board/ Committee regarding the eligibility of a candidate for examination / interview shall be final and no candidate who has been disqualified shall be permitted for the examination / interview .

11. Selection of Candidates by direct recruitment.-

(1) For the recruitment to the service , competitive examination shall be held at such intervals , as the Government may from time to time determine in consultation with the Commission . Examination shall be conducted in accordance with the orders issued by the State Government .

(2) After releasing the joint open list giving the benefit of reservation , a separate list of successful candidates of Scheduled Castes , Scheduled Tribes and Other Backward Classes shall be released in which the names of eligible candidates of the respective reserved category shall also be included as per horizontal reservation separately .

(3) If any reserved category candidate i.e. Female / Ex- Serviceman , disabled candidate is placed in the unreserved category on the basis of his / her merit , then he / she shall be counted in the unreserved horizontal category . After this , horizontal reservation in the category wise list shall be given only to the candidate of the respective category . Scheduled Castes , Scheduled Tribes , Other Backward Classes , Women , Disabled Persons and Ex - Serviceman shall be able to get seats in the respective category .

(4) For the direct recruitment , the 16 % posts shall be reserved for Scheduled Castes , 20 % posts for Scheduled Tribes and 27% posts for Other Backward Classes candidates in accordance with the provisions of the Madhya Pradesh Lok Seva (Anusuchit Jatiyon , Anusuchit Janjatiyon Aur Anya Pichhade Vargon Ke Liye Arakshan) Adhiniyam , 1994 ( No. 21 of 1994 ) . In the said reserved posts , 10 % posts shall be reserved for Economically Weaker Sections ( E.W.S. ) as per the provisions of the Constitution ( One Hundred and Third Amendment) Act , 2019 of the Central Government and 138(39)

33 % posts shall be reserved horizontally and compartment- wise for the female candidates as per the provisions of the amended sub - rule ( 1 ) of rule 3 of the Madhya Pradesh Civil Services ( Special Provisions for the Appointment of Women ) Rules , 1977 as amended on 17th November , 2015 .

(5) In filling vacancies so reserved , candidates who are members of the Scheduled Castes , Scheduled Tribes and Other Backward Classes shall be considered for appointment in the order in which their names appear in the select list without considering their relative position in comparison to other candidates .

(6) If sufficient number of candidates belonging to the Scheduled Castes , Scheduled Tribes candidates are not available for filling all the vacancies reserved for them , then the remaining vacancies shall not be filled by other candidates in any way .

(7) The provisions for reservation for disabled persons as declared by the State Government shall be horizontal and compartment - wise .

12. Period of validity of the final list of successful candidates.-

The final list of successful candidates in the examination in any recruitment year shall be valid for a period of 18 months from the date of declaration of the final list or the declaration of the results of next year's examination , whichever is earlier , after that the final list shall be invalid .

13. Process of verification of certificates of successful candidates and appointment.-

(1) On the basis of the final list of successful candidates in the examination , the Department shall verify the degrees / certificates of educational , technical and professional qualifications .

(2) As per the guidelines issued by the General Administration Department , it shall be the responsibility of the appointing officer to ensure the necessary action regarding verification of candidate's certificates , character certificate and appointment .

14. Probation.-

Every person selected in service by direct recruitment shall be appointed on probation for a period of three years . During this period an amount of 70 % for 1st year , 80% for 2nd year and 90% for 3rd year of minimum pay- scale of the post shall be payable as the stipend . The pay in the pay - scale of the post shall be started after successful completion of the probation period .

15. List of candidates recommended by the selection Committee/ Board/ Commission.-

(1 ) The Board / Commission shall forward to the Government a list arranged in order of merit of the candidates who have qualified by such standards as the Board / Commission may determine and of the candidates belonging to the Scheduled Castes , Scheduled Tribes and Other Backward Classes who though not qualified by that standard are declared by 138(41)

the Board/Commission to be suitable for appointment to the service with due regard to the maintenance of efficiency of administration . The list shall also be published for general information .

(2) Subject to the provisions of these rules and of the Madhya Pradesh Civil Services ( General Conditions of Service ) Rules , 1961 , candidates shall be considered for appointment to the available vacancies in the order in which their names appeared in the list .

(3) The inclusion of candidate's name in the list shall confer no right to appointment unless the Government is satisfied , after such enquiry as may be considered necessary that the candidate is suitable in all respects for appointment in the service .

16. Reservation.-

17. Horizontal Reservation.-

(a) The women candidates shall be given 33 % reservation as per the provisions of the Madhya Pradesh Civil Services ( Special Provisions for Appointment of Women ) Rules , 1997 .

(b) In accordance with the provisions of the Rights of Persons with Disabilities Act , 2016 (49 of 2016 ) and the Madhya Pradesh Rights of Persons with Disabilities Rules , 2017 and as per the order No. F / 8 / 2001 / आ.प्र./one (Part) , dated 03-07-2018 and 17-09-2018 issued by the General Administration Department , Government of Madhya Pradesh , regarding reservation of persons with disabilities , 6 % posts reserved as per the horizontal reservation shall be given .

(c) The ex - serviceman belonging to Madhya Pradesh shall get (horizontal reservation ) 10 % reservation for Class - III and 20% for Class - IV , respectively according to the Madhya Pradesh Civil Service ( Reservation of Vacancies for Class III and IV) Rules , 1985 .

.8 . Appointment by promotion.-

(1) Promotion proceedings shall be as per the rules / orders issued from time to time by the General Administration Department , Government of Madhya Pradesh .

(2) A Committee shall be formed to make preliminary selection for promotion of eligible candidates which shall have the members mentioned in column (5) of Schedule - IV (A) and Schedule - IV ( B ) .

(3) The procedure for making promotions against reserved vacancies shall be in accordance with the instructions issued from time to time by the General Administration Department , Government of Madhya Pradesh .

(4) The Committee shall meet at least once in a year .

19. Conditions of eligibility for promotion.-

( 1) Subject to the provisions of sub - rule (2 ) of rule 18 , the Committee shall consider the cases of all persons who have rendered that number of years of service (whether officiating or substantively) in those posts or services on the 1st January of that year , mentioned in column (2) of the Schedule - IV (A) and Schedule - IV (B) , or in any other post or posts declared equivalent thereto by the Government and which are within the scope of consideration in accordance with the provisions of sub- rule (2) of rule 18 and are within the zone of consideration .

(2) The field of selection shall be as per the rules / instructions issued from time to time by the General Administration Department regarding promotion .

20. Consultation with the Commission / Board.-

The recommendation of the Departmental Promotion Committee shall be deemed to have compliance of the requirement of the consultation with the Commission / Board under sub - clause (b ) of clause ( 3) of article 320 and a separate consultation with the Commission / Board shall not be necessary .

21. Select List.-

(1) The appointing authority shall consider the list prepared by the Committee and if it does not consider any change necessary, it shall approve the list .

(2) If the appointing authority considers it necessary to make any changes in the list , it shall finally approve the list along with such modifications , if any , recording the reasons therefore .

(3) The list as finally approved by the appointing authority shall be the select list for promotion of members of the service from the posts mentioned in column (2) of Schedule - IV (A) and Schedule - IV (B ) to the posts mentioned in column (3 ) of Schedule - IV (A) and Schedule - IV (B ) .

(4) The selection list ordinarily shall remain in force for one year or until it is reviewed or revised , but its validity shall not extend beyond a period of 18 months , from the date of preparation of such list:

Provided that in case of serious lapse in conduct or discharge of duties on the part of any person included in the select list , the select list may be reviewed specially by the committee constituted by the Government and if the committee deems appropriate , may remove the names of such persons , from the select list .

22. Preparation of the list of suitable candidates.-

(1) The list of suitable candidates shall be prepared according to the rules/ instructions issued by the General Administration Department from time to time . The names of the selected candidates included in the list shall be arranged in an order of service of posts on the basis of seniority at the time of preparation of such select list .

Provided that any junior person , who in the opinion of the Departmental Promotion Committee has specifically qualified and appropriate shall be given a comparatively upper place .

(2) A person whose name is included in the select list but is not promoted during the validity of the list shall have no claim to seniority over those considered in a subsequent selection merely by the fact of his earlier selection .

(3) If in the process of selection , review or revision , as the case may be , it is proposed to supersede any member of the service , the Departmental Promotion Committee shall record its reasons in writing for the proposed supersession .

(4) The list so proposed shall be reviewed and revised every year .

23. Appointment to the service from the select list.-

(1 ) The appointment of the candidate included in the select list to the posts borne on the cadre of the service shall be made as per the provisions of sub - rule ( 1 ) of rule 22:

(2) It shall not ordinarily be necessary to consult the Departmental Promotion Committee before the appointment of a person , whose name is included in the select list unless during the period intervening between the inclusion of his name in the select list and the date of his proposed appointment there deterioration in his work which , in the opinion of the appointing authority is such as to render him unsuitable for appointment in the service . occurs any 24. Interpretation.-

If any question arises relating to the interpretation of these rules , it shall be referred to the Government whose decision thereon shall be final .

25. Relaxation.-

Nothing in these rules shall be construed to limit or. abridge the powers of the Governor to deal with the case of any person to whom , these rules apply in such a manner , as may appear to him to be just and equitable :

Provided that the case shall not be dealt with any manner less favourable to him than that provided in these rules .

26. Saving.-

Nothing in these rules shall adversely affect reservations and other conditions required to be provided for the Scheduled Castes , Scheduled Tribes and Other Backward Classes in accordance with the orders issued by the State Government , from time to time .

27. Repeal.-

All rules corresponding to these rules and in force immediately before the commencement of these rules are hereby repealed and in respect of matters covered by these rules:

Provided that any order made or any action taken under these rules so repealed shall be deemed to have been made or taken under the corresponding provisions of these rules .

Note -I:

(i) Government of Madhya Pradesh , Finance Department's Circular No. F8-6/2015/Rules /Four , dated 19.07.2017 by Assistant Grade - I /Accountant/Auditor/ Chief Clerk Received Pay Scale PB-1 ( 5200-20200) +2800 accepted from 01.01.2016 have been done . In the order of the Government of Madhya Pradesh , Finance Department's Circular dated 19.07.2017 , the post of Junior Auditor from the post of Accountant in the Directorate shall be eligible for the Pay Scale PB -2 (9300.34800 ) +3200 approved for senior auditors promoted to the post of Junior Auditor from the post ofAccountant.

(ii) Government of Madhya Pradesh , as per the Finance Department's Circular No. F8-6/2015 /Rules /Four, 19.07.2017 , the Pay Scale of the Junior Auditor in the new structure is equivalent to the post of Accountant in 5200-20200 + Grade Pay 2800. Under the department , the post of Junior Auditor's post Pay Scale is approved in 5200.20200+ Grade Pay 2800 and the provisions of promotion from the post of Accountant to the said post , as a result of the new provision of 9 posts of Junior Auditor's 9 posts , the post of Accountant from the post of Accountant , It is contained in the post of Senior Auditor .

Note -II :

1. Such Class - IV employees who have the desired educational qualification for appointment to the post o Assistant Grade- III , should be appointed on the said post with the condition on the testing period of 2 year with the condition that they were organized by the Department of Science and Technology during this perioć It shall be compulsory to have a Computer Proficiency Certification examination ( CPCT) certificate (scor card) and it shall be mandatory to appear a one -year Computer Diploma / Certificate Examination from an one of the recognized institutions and a diploma from the following institution , it shall be mandatory to get - (i) U.G.C. Diploma from any University recognized by the Government .

( ii ) UGC Diploma from any free University recognized by the Government .

(iii) DOEACC Examination of the diploma level .

( iv) Modern Office Management Course from Government Polytechnic College .

(v) One -year "Computer Operator and Programming Assistant " ( C.O.PA. ) Certificate provided by National Council of Vocational Training (NCVT) , New Delhi or State Vocational Training Counci (SCVT) , Madhya Pradesh .

2. In addition to computer diploma from the above recognized institutions , the following qualification shall also bevalid: -

(i) B.E. ( CSE /IT) /MCA/BCA/M.Sc ( IT / CS) / * B.Sc . (IT/ CS)/M.Tech/M.E . and so on .

( ii ) AICTE Polytechnic Diploma in Computer Finance/Computer Application and Information Technology etc.

3. B.Sc/B.Com/degrees which include only a subject of computer will not be valid .

4. If this qualification'is not obtained by the concerned employee in the testing period of 2 years , then they shal be reverted to their original Class - IV post .

5. Class - IVemployees above 45 years of age shall be exempted from the above condition .
