निदेश
यतः, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 61 क में यह उपबंध किया गया है कि ऐसे निर्वाचन क्षेत्र या निर्वाचन क्षेत्रों में वोटिंग मशीनों द्वारा मतदान और मतों के अभिलेखन का यथाविहित ऐसा तरीका अपनाया जाए, जैसा कि भारत निर्वाचन आयोग द्वारा प्रत्येक मामले की परिस्थितियों को ध्यान में रखते हुए, विनिर्दिष्ट किया जाए;
2. यतः , निर्वाचनों का संचालन नियम, 1961 के नियम 49 क के परन्तुक के अनुसार भारत निर्वाचन आयोग द्वारा यथा- अनुमोदित ऐसे डिजाइन वाला ड्रॉप बॉक्स युक्त एक प्रिंटर, ऐसे निर्वाचन क्षेत्र या निर्वाचन क्षेत्रों या उसके भागों में मत के पेपर ट्रेल के मुद्रण के लिए मतदान मशीन के साथ भी जोड़ा जाए जैसा कि भारत निर्वाचन आयोग द्वारा निदेश दिया जाए;
3. यतः, निर्वाचन आयोग ने अपने प्रेस नोट संख्या ईसीआई/पीएन/120/2024 दिनांक 10 जून 2024 द्वारा घोषित बिहार के 60 - रूपौली विधानसभा निर्वाचन क्षेत्र, पश्चिम बंगाल के 35 -रायगंज; 90-राणाघाट दक्षिण (अ.जा. ) , 94- बगदा (अ०जा०) एवं 167 -माणिकटाला विधानसभा निर्वाचन क्षेत्र, तमिलनाडु के 75-विक्रावांडी विधानसभा निर्वाचन क्षेत्र, मध्य प्रदेश के 123 - अमरवाड़ा(अ.ज.जा. ) विधानसभा क्षेत्र, उत्तराखंड के 04 -बद्रीनाथ एवं 33 - मंगलोर विधानसभा क्षेत्रों, पंजाब के 34 - जालंधर पश्चिम (अ.जा. ) विधानसभा क्षेत्र और हिमाचल प्रदेश के 10-देहरा , 38 - हमीरपुर एवं 51-नालागढ़ विधान सभा निर्वाचन क्षेत्रों के वर्तमान उप -निर्वाचनों में सभी परिस्थितियों पर विचार किया है , और निर्वाचन आयोग संतुष्ट है कि उपर्युक्त विधान सभा निर्वाचन क्षेत्रों में मतदान कराने के लिए पर्याप्त संख्या में इलेक्ट्रॉनिक वोटिंग मशीन (ईवीएम) और पेपर ट्रेल [मतदाता सत्यापनीय पेपर ऑडिट ट्रेल मशीन (वीवीपैट) । मुद्रित करने के लिए प्रिंटर उपलब्ध हैं । मतदान कार्मिक ईवीएम और वीवीपैट प्रिंटरों को कुशलतापूर्वक संभालने में अच्छी तरह से प्रशिक्षित हैं और मतदाता भी ईवीएम और वीवीपैट प्रिंटरों के प्रचालन से पूर्ण रूप से अवगत हैं।
4. अब, इसलिए, भारत निर्वाचन आयोग , लोक प्रतिनिधित्व अधिनियम, 1951 की उक्त धारा 61क तथा निर्वाचनों का संचालन नियम, 1961 के नियम 49 क के तहत अपनी शक्तियों का प्रयोग करते हुए , एतद्द्वारा , निर्वाचन आयोग द्वारा दिनांक 10 जून , 2024 को घोषित कार्यक्रम के अनुसार, वर्तमान उप-निर्वाचन में, बिहार के 60- रूपौली विधानसभा निर्वाचन क्षेत्र, पश्चिम बंगाल के 35 -रायगंज , 90-राणाघाट दक्षिण ( अ.जा. ) , 94 - बगदा (अ०जा०) एवं 167- माणिकटाला विधानसभा निर्वाचन क्षेत्र, तमिलनाडु के 75- विक्रावांडी विधानसभा निर्वाचन क्षेत्र, मध्य प्रदेश के 123 - अमरवाड़ा(अ.ज.जा.) विधानसभा क्षेत्र, उत्तराखंड के 04- बद्रीनाथ एवं 33 -मंगलोर विधानसभा क्षेत्रों, पंजाब के 34- जालंधर पश्चिम (अ.जा. ) विधानसभा क्षेत्र और हिमाचल प्रदेश के 10- देहरा , 38- हमीरपुर एवं 51 - नालागढ़ विधान सभा निर्वाचन क्षेत्रों, को ऐसे निर्वाचन क्षेत्रोंके रूप में विनिर्दिष्ट करता है, जिनमें निर्वाचनों का संचालन नियम , 1961 और इस विषय पर निर्वाचन आयोग द्वारा समय - समय पर जारी किए गए अनुपूरक अनुदेशों के अंतर्गत विहित तरीके से इलेक्ट्रॉनिक वोटिंग मशीनों तथा वीवीपैट प्रिंटरों के माध्यम से मत डाले और अभिलिखित किए जाएंगे ।

5. निर्वाचन आयोग, एतद्द्वारा भारत इलेक्ट्रॉनिक्स लिमिटेड, बंगलोर तथा इलेक्ट्रॉनिक्स कार्पोरेशन ऑफ इण्डिया लिमिटेड, हैदराबाद द्वारा यथा - विकसित इलेक्ट्रॉनिक वोटिंग मशीनों और वीवीपैट प्रिंटरों, जिन्हें सभी निर्वाचन क्षेत्रों में मत डालने और अभिलिखित करने के लिए उक्त मशीनों से जोड़ा जाएगा, के डिजाइन को भी अनुमोदित करता है ।

DIRECTION
Whereas , Section 61A of the Representation of the People Act, 1951 , provides that the giving and recording of votes by voting machines in such manner as may be prescribed, may be adopted in such constituency or constituencies as the Election Commission of India may, having regard to the circumstances of each case, specify;
2. Whereas , as per the proviso to Rule 49A of the Conduct of Elections Rules , 1961 , a printer with a drop box of such design , as ma
ybe approved by the Election Commission of India , may also be attached to voting machine for printing a paper trail of the vote , in such constituency or constituencies or parts thereof as the Election Commission of India may direct ;
3. Whereas , the Election Commission has considered the circumstances in current bye elections to the 60 - Rupauli Assembly Constituency in Bihar , 35 - Raiganj , 90- Ranaghat Dakshin ( SC) , 94 - Bagda ( SC) & 167 - Maniktala Assembly Constituencies in West Bengal , 75 -Vikravandi Assembly Constituency in Tamil Nadu , 123 -Amarwara (ST) Assembly Constituency in Madhya Pradesh , 04- Badrinath & 33 -Manglaur Assembly Constituencies in Uttrakhand, 34 -Jalandhar West (SC) Assembly Constituency in Punjab and 10- Dehra , 38 - Hamirpur & 51 -Nalagarh Assembly Constituencies in Himachal Pradesh, announced vide the Election Commission's Press Notes No. ECI/PN/ 120 / 2024 dated 10th June 2024 , and is satisfied that sufficient number of Electronic मध्यप्रदेश राजपत्र , दिनांक 25 जून 2024

Voting Machines ( EVMs ) and Printers for printing Paper Trail [ Voter Verifiable Paper Audit Trail (VVPAT) ] are available for taking the poll in the above said Assembly Constituencies . The polling personnel are well trained in efficient handling of EVMs and ' VVPAT Printers ' and the electors are also fully conversant with the operation of the EVMs and the VVPAT Printers;
4. Now, therefore, the Election Commission of India , in exercise of its powers under the said Section 61A of the Representation of the People Act , 1951 , and Rule 49A of the Conduct of Elections Rules , 1961 , hereby specifies current byc elections to the 60 -Rupauli Assembly Constituency in Bihar , 35 -Raiganj , 90 - Ranaghat Dakshin (SC) , 94 - Bagda (SC) & 167 -Maniktala Assembly Constituencies in West Bengal , 75 - Vikravandi Assembly Constituency in Tamil Nadu , 123- Amarwara ( ST) Assembly Constituency in Madhya Pradesh , 04 -Badrinath & 33- Manglaur Assembly Constituencies in Uttrakhand , 34- Jalandhar West ( SC ) Assembly Constituency in Punjab and 10- Dehra , 38 -Hamirpur & 51 - Nalagarh Assembly Constituencies in Himachal Pradesh , as per the schedule announced by the Election Commission on 10th June , 2024, as the constituencies in which the votes , shall be given and recorded by means of EVMs and VVPAT printers in the manner prescribed , under the Conduct of Elections Rules , 1961 , and the supplementary instructions issued by the Election Commission from time to time on the subject .
5. The Election Commission also hereby approves the design of EVMs and VVPAT Printers as developed by the Bharat Electronics Lid. , Bangalore and Electronics Corporation of India Ltd. , Hyderabad , which shall be attached to the said machines , to be used for the giving and recording of votes in all the Constituencies .
