क्र. 3-3-4-0009-2024 - Sec - 02-05 (CT) (05 ) .- मध्यप्रदेश आबकारी अधिनियम, 1915 ( क्रमांक 2 सन् 1915 ) की धारा 62 की उपधारा ( 1 ) तथा उपधारा ( 2 ) के खण्ड ( घ ) द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुये, राज्य सरकार, एतद्वारा, मध्यप्रदेश विदेशी मदिरा नियम , 1996 में निम्नलिखित और संशोधन करती है , अर्थात्ः-
संशोधन
उक्त नियमों में, -
1. नियम 14 के उप नियम ( 1 ) के द्वितीय परन्तुक में अंक " 40 " के स्थान पर अंक " 15 " स्थापित किया जाए.
2. नियम 14 के उप नियम ( 5 ) के द्वितीय परन्तुक में अंक " 40 " के स्थान पर अंक " 15 " स्थापित किया जाए.
3. यह संशोधन मध्यप्रदेश राजपत्र में इसके प्रकाशन की तारीख से प्रवृत होगा.

No. 3-3-4-0009-2024- Sec - 02-05- ( CT) ( 05 ) . In exercise of the powers conferred by sub - section ( 1 ) and clause (d) of sub - section (2) of Section 62 of the Madhya Pradesh Excise Act, 1915 (No. II of 1915) , the State Government hereby, makes the following further amendment in Madhya Pradesh Foreign Liquor Rules , 1996 , namely
AMENDMENT
In the said rules ,-
1. Inthe second proviso of sub -rule (1 ) of Rule 14, for the figure " 40 " , the figure " 15 " shall be substituted.
2. In the second proviso of sub - rule (5) of Rule 14, for the figure "40 " , the figure " 15 " shall be substituted.
3. This amendment shall come into force from the date of its publication in Madhya Pradesh Gazette.

क्र. 3-3-4-0009-2024 - Sec- 02-05 (CT) ( 06 ).- मध्यप्रदेश आबकारी अधिनियम, 1915 ( क्रमांक 2 सन् 1915 ) की धारा 62 की उपधारा ( 1 ) तथा उपधारा ( 2 ) के खण्ड ( घ ) तथा ( ज ) द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए, राज्य सरकार , एतद्वारा , मध्यप्रदेश आसवनी नियम, 1995 में निम्नलिखित और संशोधन करती है, अर्थात्:-
संशोधन
उक्त नियमों में,-
1. नियम 6 ( 6 ) ( ख ) के स्थान पर, निम्नलिखित नियम स्थापित किया जाए, अर्थात्:-
" अनुज्ञप्तिधारी , गंतव्य इकाई के भारसाधक अधिकारी से एक सत्यापन रिपोर्ट अभिप्राप्त करेगा और अनुज्ञा- पत्र की कालावधि की समाप्ति के 25 दिन के भीतर पूर्वोत्तर राज्यों के लिये एवं 20 दिन के भीतर अन्य राज्यों को निर्यात के लिये तथा परिवहन के लिये 15 दिन के भीतर, उस प्राधिकारी को देगा , जिसने निर्यात परिवहन अनुज्ञा जारी कीहै. यदि अनुज्ञप्तिधारी ऐसा करने में असफल रहता है, तो आबकारी आयुक्त द्वारा निर्धारित राशि, निष्पादित प्रतिभूति बंधपत्र में से वसूल की जाएगी. यह किसी अन्य शास्ति के अतिरिक्त होगी जो नियम 8 के अधीन अधिरोपित की जा सकेगी. "
2. यह संशोधन मध्यप्रदेश राजपत्र में इसके प्रकाशन की तारीख से प्रवृत होगा.

In exercise of the powers conferred by sub - section (1 ) and clause (d) and (h) of sub- section (2 ) of Section 62 of the Madhya Pradesh Excise Act , 1915 (No. II of 1915) , the State Government hereby, makes the following further amendment in Madhya Pradesh Distillery Rules , 1995, namely :-
AMENDMENT
In the said rules ,-
1. For clause (b ) of sub - rule (6 ) of Rule 6 the following clause shall be substituted, namely :-
"The licensee shall obtain a verfication report from the officer - in-charge of the destination unit and furnish it to the authority who issued the export/ transport permit within 25 days for Export to North- Estern State and 20 days for export to other satate and 15 days for transportation of the expiry of period of permit . If the licensee fails todo so , the amount prescribed by the Excise Commissioner shall be recovered from the security bond executed. This shall be in addition to any other penalty which may be imposed under rule 8. "
2. This amendment shall come into force from the date of its publication in Madhya Pradesh Gazette .

क्र. 3-3-4-0009-2024 - Sec- 02-05 (CT) ( 07 ).- मध्यप्रदेश आबकारी अधिनियम, 1915 ( क्रमांक 2 सन् 1915 ) की धारा 62 की उपधारा ( 1 ) तथा उपधारा ( 2 ) के खण्ड ( घ ) तथा ( ज ) द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए, राज्य सरकार, एतद्द्वारा , मध्यप्रदेश देशी स्पिरिट नियम , 1995 में निम्नलिखित और संशोधन करती है, अर्थात्:-
संशोधन
उक्त नियमों में, -
1. नियम 6 के उपनियम (6 ) के द्वितीय एवं तृतीय परन्तुक में अंक " 40 " के स्थान पर अंक " 15 " स्थापित किया जाए.
2. नियम 8 के उपनियम ( 3 ) के द्वितीय एवं तृतीय परन्तुक के स्थान पर, निम्नलिखित द्वितीय एवं तृतीय परन्तुक स्थापित किया जाए, अर्थात्:-
" परन्तु यह और अनुज्ञप्तिधारी, आयातक इकाई के भारसाधक अधिकारी से निर्यात के सत्यापन की रिपोर्ट अभिप्राप्त करेगा और अनुज्ञा- पत्र की कालावधि का अवसान होने के 25 दिन के भीतर पूर्वोत्तर राज्यों के लिये एवं 20 दिन के भीतर अन्य राज्यों के लिये, उस प्राधिकारी को, प्रस्तुत करेगा, जिसने परिवहन अनुज्ञा जारी की थी. यदि अनुज्ञप्तिधारी ऐसा करने में असफल रहता है, तो निर्यात की गई बोतलबंद देशी स्पिरिट पर उग्रहणीय शुल्क, उसके द्वारा किये गये जमा, दी गई बैंक गारंटी या निष्पादित किये गये, बंधपत्र से वसूल किया जायेगा. यह किसी अन्य शास्ति के अतिरिक्त होगा, जो कि नियम 12 के अधीन अधिरोपित किया जा सकेगाः
परन्तु यह भी कि सत्यापन रिपोर्ट नियत समयावधि के पश्चात् प्रस्तुत की जाती है तो, वसूला गया शुल्क, सम्यक् सत्यापन के पश्चात् अनुज्ञप्तिधारी को प्रतिदाय कर दिया जायेगा . उस दशा में, जहां कि किसी प्राधिकारी द्वारा परेषण ( परेषित माल ) रास्ते में ही अधिगृहीत कर लिया जाता है और वह गंतव्य स्थान तक नहीं पहुंचता है तो उग्रहणीय शुल्क वसूल नहीं किया जाएगा. "
3. यह संशोधन मध्यप्रदेश राजपत्र में इसके प्रकाशन की तारीख से प्रवृत होगा.

AMENDMENT
In the said rules ,-
1. In the second and third proviso of sub - rule (6 ) of Rule 6, for the figure " 40 " , the figure " 15 " shall be substituted.
2. For the second and third proviso of sub -rule (3 ) of Rule 8 the following second and third proviso shall be substituted, namely :-
Provided further that the licensee shall obtain as export verification report from the officer- in -charge of the importing unit and furnish it to the authority who issued the export permit within 25 days for export to north-Eastern State and 20 days for export to other state of the expiry of period of permit . If the licensee fails to do so, the leviable duty on the bottled country spirit exported shall recovered from deposits made , bank guarantee furnished or the security bond executed by him . This shall be in addition to any other penalty which may be imposed under rule 12:
Provided also that in case the verification report is submitted after the stipulated time period, the recovered duty shall be refunded, after due verification , to the license . In case the consignment is seized midway by any authority and it does not reach the destination , the leviable duty shall not be recovered. "
3. This amendment shall come into force from the date of its publication in Madhya Pradesh Gazette.
