क्र. एफ- 1-172-2021- दो - सी- एक्स.-निजी सुरक्षा अभिकरण ( विनियमन) अधिनियम, 2005 (2005 का 29 ) की धारा 25 की उप-धारा (1 ) द्वारा प्रदत्त शक्तियों का प्रयोग में लाते हुए और अधिसूचना क्र. एफ. 4-1-2005 दो- सी- एक, दिनांक 16 मार्च 2012 के माध्यम के राजपत्र में प्रकाशित, मध्यप्रदेश निजी सुरक्षा अभिकरण नियम, 2012 को अतिष्ठित करते हुए , राज्य सरकार , एतद्वारा निम्नलिखित नियम बनाती है , अर्थात्ः-
नियम
1. संक्षिप्त नाम और प्रारंभ.-'
(1 ) इन नियमों का संक्षिप्त नाम मध्यप्रदेश निजी सुरक्षा अभिकरण (विनियमन ) नियम, 2024 है ।
(2) ये मध्यप्रदेश राजपत्र में उनके प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. परिभाषाएं.-
( 1 ) इन नियमों में , जब तक कि संदर्भ से अन्यथा अपेक्षित न हो, -
(क) "अधिनियम" से अभिप्रेत है , निजी सुरक्षा अभिकरण ( विनियमन) अधिनियम, 2005 (2005 का 29);
(ख) "अभिकरण" से अभिप्रेत है, निजी सुरक्षा अभिकरण;
(ग ) "नियंत्रक प्राधिकारी " का वही अर्थ होगा, जो अधिनियम की धारा 2 के खंड ( ख) उसके लिए समनुदेशित किया गया है ;
(घ) " प्ररूप " से अभिप्रेत है , इन नियमों से संलग्न प्ररूप;
(ङ) " अनुज्ञप्ति" से अभिप्रेत है, अधिनियम के अधीन अनुदत्त अनुज्ञप्ति।

(2) उन शब्दों और अभिव्यक्तियों के, जो इन नियमों में प्रयुक्त हुए हैं , किन्तु परिभाषित नहीं किए गए है किन्तु अधिनियम में परिभाषित हैं, वही अर्थ होंगे, जो अधिनियम में उनके लिए समनुदेशित. किए गए हैं ।
3. अनुज्ञप्ति अनुदत्त करने के लिए आवेदन.-
( 1 ) प्रत्येक अभिकरण जब अनुज्ञप्ति को अनुदत्त करने के लिए नियंत्रक प्राधिकारी को प्ररूप- एक में आवेदन करते समय अपने पूर्ववृत्त के सत्यापन के लिए प्ररूप- दो को भी संलग्न करेगा।
(2) यदि आवेदक कोई कंपनी, कोई फर्म या कोई व्यक्तियों का संथा है तो प्ररूप एक में आवेदन के साथ कंपनी के प्रत्येक स्वत्वधारी या बहुसंख्यक शेयरधारक , भागीदार या निदेशक जैसे कि वे भी आवेदक थे, के लिए प्ररूप- दो संलग्न किया जाएगा । इसके अतिरिक्त , वह अधिनियम की धारा 7 की उप - धारा (2 ) में अंतर्विष्ट उपबंधों के संबंध में ब्यौरों को सम्मिलित करते हुए वह प्ररूप - तीन में एक शपथ पत्र प्रस्तुत करेगा ।
(3) नियंत्रक प्राधिकारी , प्ररूप- एक, प्ररूप- दो , प्ररूप- तीन की प्राप्ति पर आवेदन की अन्तर्वस्तु और आवेदक की विशिष्टियों का सत्यापन करने के लिए जो वह आवश्यक समझे , ऐसी जांच कर सकेगा ।
(4) नियंत्रक प्राधिकारी आवेदक के पूर्ववृत्त के सत्यापन के उद्देश्य के लिए अपराध और आपराधियों के इलेक्ट्रॉनिक डाटाबेस जैसे अपराध और अपराधी ट्रैकिंग नेटवर्क और तंत्र (सीसीटीएनएस) , अंतर -संचालन आपराधिक न्याय तंत्र (आईसीजेएस ) का उपयोग करेगा ।
(5) जब कहीं किसी आवेदक का पूर्ववृत्त पहले ही किसी अन्य राज्य में सत्यापित कर लिया गया हो और अनुज्ञप्ति अनुदत्त कर दी गई हो, वहां आवेदक द्वारा विधिमान्य अनुज्ञप्ति के प्रस्तुत किए जाने के अध्यधीन रहते हुए नियंत्रक प्राधिकारी के लिए नए सिरे से पूर्ववृत्त का सत्यापन करना यह आवश्यक नहीं होगा, बशर्ते की अनुज्ञप्ति जिसके लिए पूर्ववृत्त सत्यापित किया गया है, विधिमान्यता की अवधि के भीतर हो ।
( 6) प्ररूप- एक में आवेदन , अधिनियम की धारा 7 की उप- धारा (3) के अधीन यथाविहित फीस के संदाय को दर्शित करने वाले उस राज्य के नियंत्रक प्राधिकारी को देय इलेक्ट्रॉनिक साक्ष्य के साथ होगा , जहां कि आवेदन किया जा रहा है ।
(7) उप - नियम ( 1 ) में निर्दिष्ट आवेदन , पसारा ( PSARA ) पोर्टल के माध्यम से या किसी अन्य माध्यम से, जो विशेष रूप से इस उद्देश्य के लिए नियंत्रक प्राधिकारी द्वारा मान्य किया जाए , नियंत्रक प्राधिकारी को भेजा जाएगा।
(8 ) उप - नियम ( 1 ) में निर्दिष्ट आवेदन की प्राप्ति पर , नियंत्रक प्राधिकारी आवेदन को उसके द्वारा आवेदन प्राप्त किए जाने की तारीख , उस पर लिखने के पश्चात् आवेदक को इलेक्ट्रॉनिक या डिजिटल अभिस्वीकृति अनुदत्त करेगा ।

(9) नियंत्रक प्राधिकारी, प्ररूप- एक में आवेदन प्राप्त करने के पश्चात्, ऐसी जांच करने के पश्चात्, जैसा कि वह आवश्यक समझे और अधिनियम के उपबंधों के अनुपालन के पश्चात् प्ररूप- चार में निजी सुरक्षा अभिकरण को अनुज्ञप्ति अनुदत्त करेगा :
परंतु यदि निजी सुरक्षा अभिकरण ने पहले ही किसी अन्य राज्य के नियंत्रक प्राधिकारी से अनुज्ञप्ति प्राप्त कर ली है, तब विधिमान्य पसारा ( PSARA) अनुज्ञप्ति प्रस्तुत करने पर अनुज्ञप्तिधारी को प्रशिक्षण आवश्यक नहीं होगा।
(10) नियंत्रक प्राधिकारी या तो स्वयं या अपने अधिकारी के माध्यम से या किसी अन्य साधन द्वारा अभिकरण द्वारा दिए गए पते या पतों पर निजी सुरक्षा अभिकरण के परिसर का सत्यापन करेगा ।
( 11 ) नियंत्रक प्राधिकारी अनुज्ञप्ति को अनुदत्त करने के लिए आवेदन में यथा उल्लिखित संबंधित राज्य में निजी सुरक्षा अभिकरण के प्रधान कार्यालय को जारी करने के पंद्रह दिनों के भीतर डाक द्वारा परिदत्त किए जाने वाली अनुज्ञप्ति की भौतिक प्रति को परिदत्त करेगा जिसे वह निजी सुरक्षा अभिकरण अपने कारबार के स्थान पर प्रदर्शित करने के लिए बाध्य होगा।
(12) अनुज्ञप्ति को अनुदत्त करने के लिए आवेदन को अस्वीकृत किए जाने की दशा में, इंकार का कोई आदेश नहीं किया जाएगा , जब तक कि, -
(क) आवेदक को सुने जाने का युक्तियुक्त अवसर नहीं दिया गया हो; और
( ख) जिन आधारों पर अनुज्ञप्ति को नामंजूर किया गया है, आदेश में उल्लिखित न कर दी गयी हो ।
( 13) नियंत्रक प्राधिकारी सभी तरह से पूर्ण आवेदन की प्राप्ति की तारीख से साठ दिनों के भीतर प्ररूप - एक में आदेश पारित करेगा ।
4. अनुज्ञप्ति अनुदत्त करने के लिए शर्तें.-
( 1 ) अनुज्ञप्तिधारी, नियंत्रक प्राधिकारी द्वारा यथा विहित निजी सुरक्षा के संबंध में प्रशिक्षण उसके द्वारा नियत किए गए समय के भीतर सफलतापूर्वक प्राप्त करेगा ।
(2) नियंत्रक प्राधिकारी, अनुज्ञप्तिधारी के प्रशिक्षण के लिए अपेक्षित प्रशिक्षण पाठ्यक्रम के ब्यौरे विरचित करेगा ।
(3) प्रशिक्षण छह कार्य दिवस के लिए होगा तथा प्रशिक्षण में मोटे तौर पर निम्नलिखित विषय सम्मिलित होंगे , अर्थात्: -
(एक) वर्तमान सुरक्षा रूपरेखा;
(क) वीआईपी सुरक्षा;
(ख) आंतरिक सुरक्षा;
(ग) संस्थागत सुरक्षा;

(दो) निजी सुरक्षा अभिकरणों की भूमिका और कृत्यः
(क) अग्नि शमन;
(ख) आपदा/आपातकालीन प्रबंधन प्रोटोकॉल ;
(ग) सुरक्षा कर्तव्य;
(घ) विभिन्न दस्तावेजों की जांच;
(ङ) सूचना सुरक्षा;
(च) अभिगम नियंत्रक ;
(छ) विस्फोटक , आईईडीएस;
(ज) एंटी सबोटेज चेक ( एएससी);
( झ) सुरक्षा संबंधी उपस्कर एवं सीसीटीव्ही;
(ञ) संसूचना उपस्कर;
(ट) पेट्रोलिंग;
(ठ) चौकी ड्यूटी;
(तीन) विधिक उपबंधः
(क) निजी सुरक्षा अभिकरण (विनियमन) अधिनियम , 2005 (2005 का 29 ) और समय - समय पर यथा संशोधित मध्यप्रदेश निजी सुरक्षा अभिकरण (विनियमन) नियम, 2024 एवं समय - समय पर यथा संशोधित मध्यप्रदेश निजी सुरक्षा अभिकरण ( रोकड़ परिवहन क्रियाकलापो के लिए निजी सुरक्षा ) नियम, 2024 समय - समय पर संशोधित; और (ख) सुसंगत श्रम विधियां;
(चार) सुरक्षा अभिकरणों का प्रबंधनः
(क) वर्दी;
(ख ) निजी सुरक्षा अभिकरणों के कार्मिकों का प्रशिक्षण;
(ग) अनुज्ञप्तिधारी द्वारा दस्तावेजों और अभिलेखों का रखा जाना;
( घ) डाटा शेयरिंग प्रोटोकॉल;
(पांच) जनसाधारण , पुलिस और अन्य विभागों के साथ इंटरफेसः
(क) जनसाधारण के साथ इंटरफेस;
(ख) पुलिस और अन्य संबंधित सरकारी विभागों के साथ संपर्क;
(छह ) निजी सुरक्षा कार्मिक क्या करना है और क्या नहीं करना है (आचरण नियम ) ।

(4) अनुज्ञप्तिधारी, अनुज्ञप्ति की प्राप्ति के पंद्रह दिनों के भीतर अभिकरण बनाने वाले प्रत्येक व्यक्ति का नाम , माता -पिता का नाम , जन्म तारीख , स्थायी पता, पत्र व्यवहार का लिए पता और प्रमुख नियंत्रक प्राधिकारी को वृत्ति को सूचित करेगा ।
(5) अनुज्ञप्तिधारी , अभिकरण के व्यवसाय के मूल स्थल के पते अथवा अभिकरण का गठन करने वाले व्यक्तियों के पते में कोई परिवर्तन या प्रबंध में परिवर्तन के संबंध में , ऐसे परिवर्तन के तीस दिनों के भीतर नियंत्रक प्राधिकारी को सूचित करेगा ।
(6) अनुज्ञप्तिधारी , अभिकरण बनाने वाले व्यक्ति के विरूद्ध या निजी सुरक्षा अभिकरण के रूप में कर्तव्यों के निर्वहन के क्रम में अभिकरण द्वारा नियुक्त या नियोजित निजी सुरक्षा गार्ड के विरूद्ध या पर्यवेक्षक के विरूद्ध विरचित किए गए किसी आपराधिक आरोप के बारे में नियंत्रक प्राधिकारी को तत्काल सूचना देगा । ऐसी संसूचना की एक प्रति उस थाने के भारसाधाक अधिकारी को भेजेगा , जहाँ व्यक्ति जिसके विरूद्ध आरोप लगाया गया है निवास करता है ।
(7) प्रत्येक अनुज्ञप्तिधारी निजी सुरक्षा गार्डों के लिए शारीरिक मानकों और इन नियमों में यथाविहित , उनके प्रशिक्षण शर्तें जिन पर अनुज्ञप्ति अनुदत्त की गई है , अपेक्षाओं का पालन करेगा ।
(8) इन नियमों में यथा उपबंधित के सिवाय , अनुज्ञप्ति के अनुदत्त करने के लिए संदत्त फीस अप्रतिदेय होगी ।
(9) अनुज्ञप्तिधारी , अनुज्ञप्ति प्राप्ति की तारीख से छह माह के भीतर अपने क्रिया - कलाप प्रारंभ करेगा ।
( 10 ) अधिनियम की धारा 9 की उप - धारा ( 3 ) के अधीन यथा उपबंधित और नियम 10 के अनुसरण में कार्यालय परिसर का स्थापन और पर्यवेक्षकों की नियुक्ति क्रियाकलापों के प्रारंभ करने में सम्मिलित होगी ।
( 11 ) किसी ऐसे अभिकरण, भागीदारी फर्म या कंपनी को अनुज्ञप्ति प्रदान नहीं की जाएगी, जिनके नाम में जासूस , जांच , निगरानी , खुफिया आदि जैसे शब्द हों या अन्य कोई नाम शामिल हो , जिनसे जासूस , जांच, निगरानी , खुफिया इत्यादि शब्दों का आशय प्रकट होता हो, या मौजूदा विधिमान्य अनुज्ञप्ति प्राप्त निजी सुरक्षा अभिकरण के समान कोई नाम स्वीकार नहीं किया जाएगा तथा केन्द्र/ राज्य सरकार द्वारा प्रतिबंधित नामों को भी स्वीकार नहीं किया जाएगा ।

5. अनुज्ञप्ति का नवीकरण.-
(1 ) प्रत्येक अभिकरण , अनुज्ञप्ति के नवीनीकरण के लिए , नियंत्रक अनुज्ञप्ति के नवीनीकरण के लिए , प्राधिकारी को प्ररूप- दो और प्ररूप-तीन के साथ प्ररूप - एक में , सभी तरह से परिपूर्ण उसकी विधिमान्यता की अवधि के अवसान होने की तारीख से कम से कम पैंतालीस दिन से पूर्व और अधिनियम की धारा 8 की अन्य शर्तों का पालन करने के पश्चात् , आवेदन करेगा ।
(2) यदि आवेदक कोई कम्पनी , कोई फर्म या कोई व्यक्तियों का संगम है तो प्ररूप- एक में आवेदन कम्पनी के प्रत्येक स्वत्वधारी या बहुसंख्यक शेयरधारक , भागीदार या निदेशक वैसे ही जैसे की वे भी आवेदक थे , के लिए प्ररूप - दो संलग्न होगा ।
(3) नियंत्रक प्राधिकारी , नियम 3 के उप- नियम (4 ) में यथाउल्लिखित रीति में आवेदक का पूर्ववृत्त सत्यापन करेगा ।
(4) नियंत्रक प्राधिकारी प्ररूप - एक में आवेदन की प्राप्ति के पश्चात्, ऐसी जांच करने के पश्चात् जैसा वह आवश्यक समझे और अधिनियम के उपबंधों के अनुपालन के पश्चात् प्ररूप- चार में अनुज्ञप्ति के नवीकरण को अनुदत्त करेगा ।
(5) उप - नियम ( 1 ) में उल्लिखित अवधि के भीतर अनुज्ञप्ति के नवीकरण के लिए आवेदन के प्राप्त न होने की दशा में, अनुज्ञप्ति के अंवसान होने के पश्चात्, अभिकरण गैर- अनुज्ञप्ति अभिकरण माना जाएगा ।
(6) अनुज्ञप्ति के नवीकरण के लिए आवेदन करने की अवधि के अवसान के पश्चात्, अभिकरण अधिनियम की धारा 7 के अनुसार नई अनुज्ञप्ति के लिए आवेदन कर सकेगा ।
(7) अनुज्ञप्ति के नवीकरण के लिए प्रभार्य फीस वैसी ही होगी जैसी नियम 3 के उप- नियम ( 6) में यथाउल्लिखित अनुज्ञप्ति को अनुदत्त करने के लिए है।
(8) उप - नियम ( 1 ) में नियत अवधि के पश्चात् और अनुज्ञप्ति के अवसान होने से पूर्व प्राप्त किए गए आवेदन पर अनुज्ञप्ति के नवीकरण की कार्यवाही नहीं होगी ।
( 9) नियंत्रक प्राधिकारी , सभी प्रकार से पूर्ण आवेदन की प्राप्ति की तारीख से तीस दिनों के भीतर प्ररूप - एक में अनुज्ञप्ति के नवीकरण के लिए आवेदन पर आदेश पारित करेगा ।
( 10 ) नवीकृत अनुज्ञप्ति की विधिमान्यता पूर्व अनुज्ञप्ति के अवसान होने की तारीख से गणना की जाएगी और उसके नवीकरण की तारीख को विचार में लाए बिना पांच वर्ष की अवधि तक होगी। विद्यमान अनुज्ञप्ति के अवसान होने के पश्चात् नियंत्रक प्राधिकारी द्वारा आवेदन का विनिश्चय किए जाने की दशा में , मध्यवर्ती अवधि विधिमान्य अनुज्ञप्ति के अधीन होना समझी जाएगी।

( 11 ) नियंत्रक प्राधिकारी और निजी सुरक्षा अभिकरण , मानव नियंत्रक से परे परिस्थितियों के कारण, जिसमें सिविल या सैनिक प्राधिकारी के कृत्य , राष्ट्रीय आपात, बलवा, दैवीकृत्य तक सीमित नहीं हैं, किन्तु शामिल है , हुई देरी के लिए उत्तरदायी नहीं होंगे।
( 12 ) यदि कोई निजी सुरक्षा अभिकरण अधिनियम या नियमों की शर्तों को पूरा नहीं करता है तो नियंत्रण प्राधिकारी द्वारा उसकी अनुज्ञप्ति से इन्कार किया जा सकेगा।
6. अनुज्ञप्ति के नवीकरण के लिए शर्तें.- अनुज्ञप्ति का नवीकरण निम्नलिखित शर्तों के अध्यधीन प्रदान की जाएगी , अर्थात्: -
(एक) आवेदक, नियंत्रक प्राधिकारी के क्षेत्राधिकार में अपने कारबार के प्रधान स्थान को निरंतर बनाए रखेगाः ।
(दो) आवेदक, इन नियमों के नियम 8 के उप - नियम (2 ) के अधीन अपेक्षित अपने निजी सुरक्षा गार्डों और पर्यवेक्षकों के लिए प्रशिक्षण की उपलब्धता सुनिश्चित करना जारी रखेगा;
(तीन) आवेदक , अनुज्ञप्ति शर्तों का पालन करना जारी रखेगा;
(चार) आवेदक का अपराधिक पूर्ववृत्त न हो, जो अपराध और आपराधिक डाटा से सत्यापित किया जा सकेगा ।
7. निजी सुरक्षा गार्ड और पर्यवेक्षक के चरित्र और पूर्ववृत्त का सत्यापन.-
( 1 ) किसी व्यक्ति को सुरक्षा गार्ड या पर्यवेक्षक के रूप में नियोजित या नियुक्त करने से पहले, अभिकरण को निम्नलिखित किसी एक या अधिक रीति में ऐसे व्यक्ति के चरित्र और पूर्ववृत्तियों के बारे में स्वयं का समाधान करेगा , अर्थात्: -
(क) व्यक्ति द्वारा प्रस्तुत किए गए चरित्र और पूर्ववृत्त सत्यापन प्रमाणपत्र पर निर्भर होकरः
परंतु चरित्र और पूर्ववृत्त प्रमाणपत्र विधिमान्य रहेगा और अभिकरण के पास किसी अन्य स्त्रोत से व्यक्ति के चरित्र और पूर्ववृत्त के संबंध में कोई प्रतिकूल रिपोर्ट न हो;
(ख ) नियंत्रक प्राधिकारी या पुलिस के माध्यम से चरित्र और पूर्ववृत्त के सत्यापन के लिए अपराध और अपराधी का इलेक्ट्रोनिक डेटाबेस जैसे अपराध और अपराधी ट्रेनिंग नेटवर्क और तंत्र (सीसीटीएनएस) , अंतर -संचालन आपराधिक न्याय तंत्र ( आई सी जे एस ) के अभिगम द्वारा ।

( 2 ) व्यक्ति जो सुरक्षा गार्ड या पर्यवेक्षक के रूप में नियोजित या नियुक्त होने की वांछा रखता है , अभिकरण को प्ररूप - पांच प्रस्तुत करेगा । इसके अतिरिक्त , वह अधिनियम की धारा 10 की उप - धारा (2) में अंतर्विष्ट उपबंधों से संबंधित ब्यौरों को समाविष्ट करते हुए प्ररूप -छह में एक शपथपत्र प्रस्तुत करेगा।
(3 ) राज्य सरकार चरित्र और पूर्ववृत्त सत्यापन के लिए इलेक्ट्रॉनिक रूप में जमा की जाने वाली फीस स्वीकृत करने की व्यवस्था करेगी ।
(4) प्राधिकारी जिसको आवेदन दिया गया है, सुनिश्चित करेगा कि चरित्र और पूर्ववृत्त सत्यापन रिपोर्ट चरित्र और पूर्ववृत प्ररूप की प्राप्ति के पंद्रह दिनों के भीतर जारी की जाए ।
(5) एक बार जारी की गई चरित्र और पूर्ववृत्त सत्यापन रिपोर्ट नियोजक की प्रास्थिति में परिवर्तन हो जाने के बावजूद भी पांच वर्षों तक के लिए विधिमान्य रहेगी ।
(6) अभिकरण , चरित्र और पूर्ववृत सत्यापन के आधार पर , प्ररूप - सात में एक चरित्र और पूर्ववृत प्रमाणपत्र जारी करेगा और यह प्रमाणपत्र ऐसे अभिकरण द्वारा वापस नहीं लिया जाएगा, भले ही वह व्यक्ति अभिकरण का कर्मचारी न रहे ।
सुरक्षा प्रशिक्षण.-
( 1 ) नियंत्रक प्राधिकारी , राष्ट्रीय कौशल अर्हता ढांचा के अनुसार, सुरक्षा गार्डों के प्रशिक्षण के लिए आवश्यक विस्तृत प्रशिक्षण पाठ्यक्रम तैयार करेगा । प्रारंभिक स्तर के लिए , यह प्रशिक्षण न्यूनतम बीस कार्य दिनों की अवधि में दिया जाने वाला, न्यूनतम सौ घंटे की कक्षा शिक्षण तथा साठ घंटे का फील्ड प्रशिक्षण होगा । भूतपूर्व सैनिकों/ पूर्व अद्धसैनिक बल / पुलिस कार्मिकों से न्यून्तम सात कार्य दिवसों में न्यूनतम चालीस घंटे के कक्षा में निर्देश और सोलह घंटे के फील्ड प्रशिक्षण के संघनित पाठ्यक्रम में उपस्थित होने की अपेक्षा की जाएगी।।
(2) प्रशिक्षण में निम्नलिखित विषय सम्मिलित होंगे , अर्थात्: -
(क) जनता में आचरण और वर्दी को सही ढंग से धारण करना ;
(ख ) शारीरिक सक्षमता प्रशिक्षण ;
(ग) शारीरिक सुरक्षा, संपत्ति की सुरक्षा , भवन/अपार्टमेंट की सुरक्षा, कार्मिक सुरक्षा, घरेलू सुरक्षा ;
(घ) अग्नि शमन ;
(ङ) भीड़ नियंत्रक ;
(च) पहचान पत्र , पासपोर्ट तथा स्मार्ट कार्ड सहित पहचान कागजातों की जांच ;

(छ) उम्मीदवार को अंग्रेजी अक्षरों तथा अरबी अंकों को पढ़ने और उन्हें समझने योग्य होना चाहिए , जैसा कि सामान्यतः पहचान दस्तावेजों, शस्त्र अनुज्ञप्ति , यात्रा दस्तावेजों और सुरक्षा निरीक्षण शीट में आते हैं ;
(ज) तात्कालिक विस्फोटक उपकरणों की पहचान ;
(झ ) प्राथमिक चिकित्सा ;
(ञ) संकट से निपटना और आपदा प्रबंधन ;
(ट) रक्षात्मक ड्राइविंग ( सशस्त्र गाड़ियों के ड्राइवर के लिए अनिवार्य तथा अन्य के लिए वैकल्पिक);
(ठ) अवर्जित आयुधों तथा आग्नेयास्त्रों का उठाना - रखना और संचालन (वैकल्पिक ) ;
(ड) भारतीय दंड संहिता का प्रारंभिक ज्ञान , निजी प्रतिरक्षा का अधिकार , पुलिस थाने में प्राथमिकी सूचना रिर्पोट दर्ज कराने की प्रक्रिया , आयुध अधिनियम (केवल प्रभावी धाराएं) , विस्फोटक अधिनियम (प्रभावी धाराएं) ;
(ढ) पुलिस तथा सैन्य बलों में रैंक के बैज ;
(ण) जनता और पुलिस में प्रयोग किए जाने वाले विभिन्न प्रकार के शस्त्रों की पहचान ;
(त) सुरक्षा उपकरण और यंत्रों का उपयोग ( उदाहरण के लिए; सुरक्षा अलार्म और स्क्रीनिंग उपकरण ) ; और
(थ ) नेतृत्व और प्रबंधन (केवल पर्यवेक्षकों के लिए) ।
(3) सुरक्षा गार्ड/पर्यवेक्षक/भूतपूर्व सैनिक तथा पूर्व पुलिस कर्मियों आदि को नियंत्रक प्राधिकारी द्वारा विहित प्रशिक्षण सफलतापूर्वक पूर्ण करना होगा।
(4) प्रशिक्षण के पूर्ण होने पर, प्रत्येक सफल प्रशिक्षणार्थी को शासन द्वारा मान्यताप्राप्त प्रशिक्षण संस्थान प्ररूप- आठ में एक प्रमाणपत्र प्रदान किया जाएगा ।
(5) अन्य राज्य के प्रशिक्षण संस्थान से गार्ड/ पर्यवेक्षकों/ अनुज्ञप्ति हेतु आवेदन करने वालों को जारी किया गया प्रशिक्षण प्रमाण-पत्र मध्यप्रदेश राज्य में स्वीकार किया जाएगा ।

(6) नियंत्रक प्राधिकारी समय - समय पर स्वयं या अपने स्वंय अधिकारियों से उसके द्वारा इस उद्देश्य के लिए या विशेष रूप सशक्त किसी अन्य अधिकारी के माध्यम से प्रशिक्षण संस्थान के काम - काज का निरीक्षण करेगा। सामान्यतः ऐसा निरीक्षण प्रति वर्ष कम से कम दो बार किया जाएगा-
(क) नियंत्रक प्राधिकारी प्रशिक्षण संस्थान को मान्यता देने के लिए विस्तृत दिशा-निर्देश तथा विनिर्देश तैयार करेगा और आवश्यक दिशा- निर्देशों एवं विनिर्देशों की पूर्ति करने पर संस्थान को मान्यता प्रदान कर सकेगा;
(ख) इस उद्देश्य के लिए नियंत्रक प्राधिकारी द्वारा प्राधिकृत अधिकारी , मान्यताप्राप्त प्रशिक्षण संस्थान का नियमित निरीक्षण करेगा और यदि अपेक्षित दिशानिर्देश एवं विनिर्देशों को पूरा न करने की दशा में ऐसे प्रशिक्षण संस्थान की मान्यता रद्द करने का सुझाव दे सकेगा ;
( ग) प्राधिकृत अधिकारी से सुझाव प्राप्त होने पर, नियंत्रक प्राधिकारी प्रशिक्षण संस्थान को उचित अवसर प्रदान करने के बाद , प्रशिक्षण सुविधा की मान्यता को रद्द कर सकेगा।
(7) सभी प्रशिक्षण अभिकरण नियंत्रक प्राधिकारी को प्ररूप - बारह में विहित रीति में सफल प्रशिक्षणार्थियों की एक सूची प्रस्तुत करेंगे ।
( 8 ) प्रशिक्षण पूर्ण होने और रोजगार की अपेक्षा के आधार पर , निजी सुरक्षा अभिकरण अपने स्वयं के पदनाम रख सकेगें , परन्तु कोई अभिकरण की सशस्त्र सेना , अर्ध सैनिक बल या राज्य पुलिस बल के किसी रैंक को अंगीकृत नहीं करेगा ।
(9) नियंत्रक प्राधिकारी या तो स्वयं या अपने अधिकारियों के माध्यम से या इस प्रयोजन के लिए विशेष रूप से सशक्त किसी अन्य अधिकारी द्वारा किसी निजी प्रशिक्षण संस्थान के निजी सुरक्षा गार्डों और पर्यवेक्षकों को दिए गए प्रशिक्षण और कौशल को सत्यापन कर सकेगा।
( 10 ) नियंत्रक प्राधिकारी ऐसे सुरक्षा अभिकरणों की अनुज्ञप्ति को जारी रखने या अन्यथा पुनर्विलोकन कर सकेगा, जिन्होने अपनी नामावली पर प्रशिक्षिण कार्मिकों की शर्तों का अनुपालन न किया हो ।

9. सुरक्षा गार्डों के लिए शारीरिक योग्यता के मानदंड.-
( 1 ) कोई निजी सुरक्षा अभिकरण , अधिनियम की धारा 10 के उपबंधों के अनुसार किसी व्यक्ति को निजी सुरक्षा गार्ड के रूप में नियोजित करेगा या रखेगा।
(2) कोई व्यक्ति सुरक्षा गार्ड के रूप में नियुक्त या नियोजित होने के लिए पात्र होगा, यदि वह नीचे दिए गए शारीरिक योग्यता के मानकों को पूरा करता है : -
(एक) कद , 160 से.मी. (महिला 150 से.मी. ) , वजन , कद तथा वजन की मानक सारणी के अनुसार , सीना 80 से.मी. जो 4 से.मी. फूलना चाहिए ( महिलाओं के लिए लिए सीना माप की कोई न्यूनतम आवश्यकता नहीं है) ।
(दो) नेत्र दृष्टि दूर दृष्टि 6/6 , निकट दृष्टि 0.6/0.6 चश्मे अथवा इसके बिना, वर्णांधता से मुक्त, सुरक्षा उपकरणों में प्रदर्श रंगों को पहचानों और विभेद करने और अंग्रेजी अक्षरों तथा अरबी में प्रदर्शित अंको को पढ़ने और उन्हें समझने में समर्थ होना चाहिए ।
(तीन) घुटने मिलना (नी नोक) और सपाट पैर से मुक्त और छह मिनट में एक किलोमीटर दौड़ने में सक्षम होना चाहिए ।
(चार) श्रवणः दोष से मुक्त हो; सुनने और बोलने की आवाज तथा सुरक्षा उपकरणों द्वारा उत्पन्न अलार्म को सुनने और प्रतिक्रिया करने में सक्षम होना चाहिए ।
(पांच) अभ्यर्थी तलाशी लेने , वस्तुओं को हाथ में लेने और आवश्यकता पड़ने पर व्यक्तियों को रोकने के लिए बल प्रयोग करने के लिए कुशल और समर्थ हो ।
(2) अभ्यर्थी किसी छुआ- छूत या संक्रमाक बीमारी लक्षण से मुक्त हो । वह ऐसी किसी बीमारी से ग्रस्त न हो जिसका उसकी सेवा के दौरान बढ़ने की आशंका हो या जिससे वह सेवा के लिए अनुपयुक्त हो जाए या जिससे जनता के स्वास्थ्य को खतरा उत्पन्न हो जाए।
(3) अभिकरण यह सुनिश्चित करेगा कि उसके लिए काम करने वाले प्रत्येक निजी सुरक्षा गार्ड / सुपरवाइजर की , उसकी पिछली स्वास्थ्य परीक्षा के प्रत्येक 12 माह पश्चात् , एक चिकित्सा परीक्षा हो , ताकि उसके प्रवेश के समय निर्धारित शारीरिक मानदंड का सतत् अनुरक्षण सुनिश्चित किया जा सके ।

10. सुपरवाइजरों के लिए उपबंध.-
( 1 ) पंद्रह से अनधिक निजी सुरक्षा गार्डों के कार्य का पर्यवेक्षण करने के लिए एक पर्यवेक्षक होगा ।
(2) निजी सुरक्षा गार्ड विभिन्न परिसरों में सुरक्षा ड्यूटी पर होने की दशा में और एक पर्यवेक्षक द्वारा उनके कार्य का पर्यवेक्षण करना व्यवहार्य न हो तो अभिकरण अधिक संख्या में पर्यवेक्षकों को नियुक्त करेगा ताकि कम से कम प्रत्येक छह निजी सुरक्षा गार्डों की सहायता , सलाह और पर्यवेक्षण के लिए एक पर्यवेक्षक उपलब्ध हो ।
11. अपील और प्रक्रिया.-
( 1 ) अधिनियम की धारा 14 की उपधारा ( 1 ) के अधीन प्रत्येक अपील प्ररूप नौ में की जाएगी और व्यथित व्यक्ति या उसके प्राधिकृत अधिवक्ता द्वारा हस्ताक्षर किए जाएंगे तथा उसे राज्य सरकार के अपर मुख्य सचिव/मुख्य सचिव , गृह विभाग , मध्यप्रदेश शाासन को व्यक्तिगत रूप से या इलैक्ट्रानिक या डिजीटल प्ररूप में प्रस्तुत किया जाएगा या रजिस्ट्रीकृत डाक से भेजा जाएगा ।
(2) अपील , अपील प्राधिकारी को विहित शीर्ष में देय रूपए पांच हजार (5000/- रूपए ) के चालान के साथ होगी।
12. अभिकरण द्वारा रखे जाने वाले रजिस्टर. अधिनियम के अधीन अभिकरण द्वारा संधारित किए जाने के लिए अपेक्षित रजिस्टर को प्ररूप - दस में यथाविहित इलैक्ट्रानिक रूप में रखा जाएगा।
13. फोटो पहचान पत्र.-
( 1 ) अधिनियम की धारा 17 की उप- धारा ( 2) के अधीन अभिकरण द्वारा जारी प्रत्येक फोटो पहचान पत्र प्ररूप ग्यारह में विहित किए गए अनुसार होगा ।
(2) फोटो पहचान पत्र में पूरे चेहरे का रंगीन फोटो , निजी सुरक्षा गार्ड का पूरा नाम , अभिकरण का नाम तथा उस व्यक्ति की कर्मचारी संख्या होगी , जिसे फोटो पहचान पत्र जारी किया गया है । फोटो पहचान पत्र पर अभिकरण का होलोग्राम चिपका होना चाहिए।
(3) फोटो पहचान पत्र में व्यक्ति की अभिकरण में प्रास्थिति और वह तारीख जिस तक फोटो पहचान पत्र वैध है स्पष्ट रूप से उपदर्शित होगी ।
(4) फोटो पहचान पत्र को अद्यतन रखा जाएगा और विशिष्टियों में किसी परिवर्तन को उसमें प्रविष्ट किया जाएगा ।

(5) निजी सुरक्षा गार्ड को जारी फोटो पहचान पत्र को उसे जारी करने वाले अभिकरण को लौटा दिया जाएगा जब निजी सुरक्षा गार्ड और नियोजन में नहीं रहता है या उसके द्वारा नियोजित नहीं किया जाता है ।
(6) फोटो पहचान पत्र के गुम या चोरी , तुरंत उस अभिकरण की जानकारी में लाया जाएगा, जिसने उसे जारी किया है ।
14. अन्य शर्तें.-
( 1 ) इस बात के होते हुए भी अभिकरण अपने निजी सुरक्षा गार्ड के लिए ड्यूटी पर यूनिफार्म पहनना अनिवार्य करे , या न करे , प्रत्येक निजी सुरक्षा अभिकरण अपने सुरक्षा गार्डों को;
(क) अभिकरण को सुभिन्न करने वाला बाजू पर पहनने वाला बैज ;
(ख) संगठन में उसका पद दर्शाने वाला कंधे या सीने का बैज ;
(ग) सीटी की डोरी से बंधी सीटी और जो बाँयी जेब में रखी जाएगी ;
( घ) फीते और सूराख सहित जूते ;
(ङ) सिर पर पहनने की टोपी जिस पर निजी सुरक्षा अभिकरण का विशिष्ट चिह्न भी हो सकता है ;
जारी करेगा और उन्हें पहनना बाध्यकर करेगा ।
(2) निजी सुरक्षा गार्ड, जब वह ड्यूटी पर हो, तो उसके द्वारा धारण किए जाने वाले वस्त्र ऐसे होंगे जो उसकी दक्षतापूर्ण पालन में बाधा उत्पन्न न करें । विशेषकर , वे न तो बहुत तंग हों और न ही बहुत ढीले हो जिससे उसकी गतिविधियों या अंगों को मोडने में बाधा डालते हों ।
(3) प्रत्येक निजी सुरक्षा गार्ड अपने साथ एक नोट- बुक और एक लेखन उपकरण रखेगा
(4) प्रत्येक निजी सुरक्षा गार्ड, जब वह सक्रिय सुरक्षा ड्यूटी पर हो, अधिनियम की धारा 17 के अधीन जारी फोटो पहचान पत्र , अपने शरीर पर किसी सहज दृश्य स्थान पर कमर से ऊपर बाहरी वस्त्र पर प्रदर्शित करते हुए धारण करेगा ।
(5) स्टेशन हाउस अधिकारी या किसी पुलिस स्टेशन के प्रभारी अधिकारी से वरिष्ठ श्रेणी का कोई पुलिस अधिकारी या हैड कांस्टेबल की श्रेणी से अनिम्न का कोई अन्य पुलिस अधिकारी , जो यथास्थिति विशेष रूप से एस.एच.ओ. द्वारा सशक्त किया गया हो , वह अपने क्षेत्राधिकार में किसी उचित समय पर किसी निजी सुरक्षा अभिकरण या उसके व्यवसाय स्थल के परिसर में निरीक्षण/ दौरा/प्रवेश कर सकेगा।

(6) अभिकरण , नियंत्रक प्राधिकारी को सुरक्षा ड्यूटी में लगे हुए सुरक्षा गार्डों तथा पर्यवेक्षकों की संख्या के बारे में फर्मवार विस्तृत जानकारी प्ररूप तेरह में , डिजिटली माध्यम से या किसी अन्य माध्यम से जो विशेष रूप से इस प्रयोजन के लिए नियंत्रक प्राधिकारी द्वारा नियत किया गया हो, अर्धवार्षिक रूप से प्रस्तुत करेगा।
(7) अभिकरण , नियंत्रक प्राधिकारी को, ऐसे प्रारूपों में , जैसे कि नियंत्रक प्राधिकारी द्वारा विहित किए जाएं, अर्धवार्षिक/वार्षिक विवरण प्रस्तुत करेगा।
15. निरसन तथा व्यावृत्ति.-
( 1 ) मध्यप्रदेश निजी सुरक्षा अभिकरण नियम, 2012 एतद्वारा निरसित किए जाते हैं:
परंतु इन नियमों के प्रवृत्त होने के पूर्व इन नियमों के अधीन किए गए किसी कार्य या की गई किसी कार्रवाई पर निरसन का कोई प्रभाव नहीं पड़ेगा।
(2) इन नियमों के अधीन किया गया कोई कार्य या की गई कोई कार्रवाई या किया गया या जारी किया गया कोई आदेश आदि, इस प्रकार निरसित नियमों के तत्स्थानी उपबंधों के अधीन किया गया या जारी किया गया समझा जाएगा।

(तीन) नियंत्रण प्राधिकारी को समय- समय पर अपने पते , प्रबंधन के किसी परिवर्तन के संबंध में जानकारी देने की बाध्यता ।
(चार) नियंत्रण प्राधिकारी को समय- समय पर उनके द्वारा नियोजित या नियुक्त, यथास्थिति निजी सुरक्षा अभिकरण या निजी सुरक्षा गार्ड के कर्तव्यों के पालन के अनुक्रम में उनके विरूद्ध किसी भी दांडिक आरोप के संबंध में सूचना देने की बाध्यता ।

In exercise of the powers conferred by sub - section ( 1 ) of section 25 of the Private Security Agencies (Regulation ) Act, 2005 (29 of 2005 ) and in supersession of the Madhya Pradesh Private Security Agencies Rules , 2012 , published in the Official Gazette vide Notification No. F.4-1-2005 - II - C - I , dated 16th March , 2012 , the State Government , hereby , makes the following rules , namely : -
RULES
1. Short title and commencement .
( 1 ) These rules may be called the Madhya Pradesh Private Security Agencies (Regulation ) Rules , 2024 .
(2) They shall come into force from the date of their publication in the Madhya Pradesh Gazette .
2. Definitions .
(1 ) In these rules , unless the context otherwise requires , - (a) "Act" means the Private Security Agencies (Regulation ) Act , 2005 ( 29 of 2005 ) ;
(b) "Agency" means the Private Security Agency;
(c) " Controlling Authority" shall have the same meaning as assigned to it in clause ( b) of section 2 of the Act;
(d) " Form " means Forms appended to these rules ;
(e) " Licence " means a licence granted under the Act .
(2) Words and expressions used but not defined in these rules but defined in the Act , shall have the same meaning respectively as assigned to them in the Act .

3. Application for grant of licence .
( 1 ) Every Agency while making an application in Form I to the Controlling Authority for the grant of licence shall also enclose the Form II for verification of his antecedents .
(2) If the applicant is a company , a firm or an association of persons , the application in Form I shall be accompanied by Form II for every proprietor or majority shareholder , partner or director of the company, as if they were also the applicants . In addition , he shall submit an affidavit in form of Form III incorporating the details in relation to the provisions contained in sub- section (2 ) of section 7 of the Act .
(3) On receipt of Form I , Form II and Form III , the Controlling Authority shall make such inquiries , as it considers necessary to verify the contents of the application and the particulars of the applicant .
(4) The Controlling Authority shall utilize electronic databases of crime and criminals like the Crime and Criminal Tracking Networks and Systems ( CCTNS ) , Interoperable Criminal Justice System ( ICJS ) for the purpose of verification of antecedents of the applicant .
(5) Wherever any applicant's antecedents have been verified in any other State earlier and licence is granted , subject to production of valid licence by the applicant , itshall not be necessary for the Controlling Authority to verify the antecedents afresh , provided that the licence for which antecedents are verified is under period of validity .

(6) Application in Form I shall be accompanied by an electronic evidence showing the payment of fees as prescribed under sub - section ( 3 ) of section 7 of the Act , payable to the Controlling Authority of the State concerned where the application is being made .
(7) The application referred in sub - rule ( 1 ) shall be sent to the Controlling Authority through PSARA Portal or any other means which is specially recognized by the Controlling Authority for this purpose .
(8) On receipt of the application referred to in sub - rule ( 1 ) , the Controlling Authority shall after noting the date of receipt by him of the application thereon shall grant an electronic or digital acknowledgement to the applicant .
(9) The Controlling Authority, after receiving an application in Form I shall grant a licence to the private security agency in Form IV after making such enquiry as it considers necessary and after compliance with the provisions of the Act :
a Provided that if the Private Security Agency has already obtained licence from the Controlling Authority of any other State , then requirement of training of licencee shall not be necessary production of valid PSARA licence . on मध्यप्रदेश राजपत्र, दिनांक 7 अगस्त 2024

( 10) The Controlling Authority either by itself or through its officer or any other means shall verify the premises of the Private Security Agency at the address or addresses provided by the Agency .
(11 ) The Controlling Authority shall cause a physical copy of the licence to be delivered by post within fifteen days of issue to the principal office of the Private Security Agency in the State concerned as mentioned in the application for grant of licence which the Private Security Agency shall be bound to display at its place of business .
( 12) In case of rejection of the application for grant of licence , no order of refusal shall be made unless-
(a) the applicant has been given a opportunity of being heard ; and reasonable (b) the grounds on which licence is refused is mentioned in the order .
( 13) The Controlling Authority shall pass an order on Form I within sixty days from the date of receipt of application complete in all respects .
4. Conditions for grant of licence.-
(1) The licencee shall successfully undergo a training relating to the private security as prescribed by the Controlling Authority within the time frame fixed by it .
(2) The Controlling Authority shall frame the detailed training syllabus required for training the licencee .

(3) The training shall be for a period of six working days and it shall broadly include the following subjects , namely; -
(1) present security scenario :
( a) VIP security;
(b) internal security ; and
(c) institutional security ;
(ii) role and functioning of Private Security Agencies :
( a) fire fighting ;
(b) disaster / emergency management protocol ;
(c) security duties ;
(d) checking of various documents ;
(e) information security ;
(f) access control ;
(g) explosives , IEDs ;
(h) Anti Sabotage Checks (ASC ) ;
( i ) security related equipments and CCTV ;
(j ) communication equipments ;
(k) patrolling; and
( 1) post duties ;
( iii) legal provisions:
(a) The Private Security Agencies ( Regulation ) Act , 2005 ( 29 of 2005) , The Madhya Pradesh Private Security Agencies (Regulation ) Rules , 2024 as amended from time to time and the Madhya Pradesh Private Security Agencies ( Private Security for Transportation of Cash Activities ) Rules , 2024 as amended from time to time ; and (b) relevant labour laws ;

(iv) management of security agencies :
(a) uniform;
(b) training of personnel of Private Security Agencies ;
(c ) documentation and records to be maintained by the licencee ; and
(d) data sharing protocol ;
(v) interface with departments : public , police and other ( a) Interface with public ; and
(b) liaison with police and other concerned Government Departments ; and
(vi ) Private Security Personnel (Conduct Rules ) . DO's and DON'TS (4) The licencee shall intimate the name , parentage , date of birth , permanent address , address for correspondence and the principal profession of each person forming the Agency within fifteen days of receipt of the licence to the Controlling Authority .
(5) The licencee shall inform the Controlling Authority regarding any change in the address of principal place of business of Agency or change in the address of persons forming the Agency or change of management within thirty days of such change .
(6) The licencee shall immediately intimate to the Controlling Authority about any criminal charge framed against the persons forming the Agency or against a

or private security guard or supervisor engaged employed by the Agency , in the course of performance of duties as Private Security Agency . A copy of such communication shall also be sent to the officer - in- charge of the police station where the person charged against resides .
(7) Every licencee shall abide by the requirements of physical standards for the private security guards and their training as prescribed in these rules as the condition on which the licence is granted .
(8) Save as provided in these rules , the fees paid for the grant of licence shall be non - refundable .
(9) The licencee shall commence its activities within six months of obtaining the licence .
( 10) Commencement of activities shall include establishment of office premises and engagement of supervisors as provided under sub - section ( 3 ) of section 9 of the Act and in accordance with rule 10 .
( 11 ) No licence shall be granted to any agency , partnership firm or company that has a name in which words like detective , investigation , surveillance , intelligence etc. or any other name which denotes the meaning of words like detective , investigation , surveillance , intelligence etc. included or any name similar to existing valid Private Security Agency shall not be accepted for granting licence , also names which are prohibited by the Central/ State Government shall not be accepted .

5. Renewal of licence .-
(1) Every Agency shall apply to the Controlling Authority for renewal of the licence with complete details in Form I along with Form II and Form III not less than forty - five days before the date of expiry of the period of validity thereof and after complying other conditions of section 8 of the Act .
(2) If the applicant is a company , a firm or an association of persons , the application in Form I shall be accompanied by Form II for every proprietor or majority shareholder , partner or director of the company , as if they were also the applicants.
(3) The Controlling Authority shall verify the antecedents of the applicant in the same manner as mentioned in sub- rule (4) of rule 3 .
(4) The Controlling Authority , after receiving an application in Form I shall grant a renewal of licence in Form IV after making such enquiry as it considers necessary and after compliance with the provisions of the Act .
(5) In case of non - receipt of the application for renewal of licence within the period mentioned in sub - rule ( 1 ) , the agency shall be treated as un - licensed agency after the expiry of licence .
(6) After expiry of period of applying for renewal of licence , the Agency may apply for fresh licence as per section 7 ofthe Act.
(7) The fees chargeable for renewal of the licence shall be the same as for the grant of licence as mentioned in sub- rule (6) of rule 3 .

(8) Applications received after the period stipulated in sub- rule ( 1 ) and before the expiry of licence shall not be processed for renewal of licence .
(9 ) The Controlling Authority shall pass an order on application for renewal of licence in Form I within thirty days from the date of receipt of application complete in all respects .
( 10 ) The validity of renewed licence shall be counted from the date of expiry of the previous licence and shall be upto a period of five years irrespective of its date of renewal . In case the application is decided by the Controlling Authority , then after expiry of the existing licence , the intervening period shall deem to be under valid licence.
(11) The Controlling Authority and the Private Security Agencies shall not be liable for delays occurring by reason of circumstances beyond human control , including but not limited to acts of civil or military authority , national emergencies , riot and acts of God .
(12) If a Private Security Agency does not fulfill the conditions of the Act or rules , its licence may be refused by the Controlling Authority.
6. Conditions for renewal of licence . The renewal of the licence shall be granted subject to the following conditions , namely: -
(i) The applicant continues to maintain his principal place of business in the jurisdiction of the Controlling Authority;

(ii) The applicant continues to ensure the availability of the training for its private security guards and supervisors required under sub - rule (2) of rule 8 of these rules ;
(iii ) The applicant continues to adhere to the licence conditions;
(iv) The applicant has no criminal antecedents as may be verified from a database of crime and criminals .
7 . Verification of character and antecedents of the private security guard and supervisor.-
(1) Before any person is employed or engaged as a security guard or supervisor , the Agency shall satisfy itself about the character and antecedents of such person in any one or more of the following manner , namely: -
(a) by relying upon the character and antecedents verification certificate produced by the person:
Provided that the character and antecedent certificate shall be valid and the Agency does not have any adverse report regarding the person's character and antecedents from any other source ;
(b) by accessing electronic databases of crime and criminals like the Crime and Criminal Tracking Networks and Systems ( CCTNS ) , Interoperable Criminal Justice System ( ICJS ) for verification of the character and antecedents through the Controlling Authority or the Police.

(2) The person desirous of getting employed or engaged as security guard or supervisor shall submit Form V to the Agency. In addition , he shall submit an affidavit in Form VI incorporating the details in relation to the provisions contained in sub- section (2 ) of section 10 of the Act .
(3) The State Government shall arrange to accept the fee to be deposited electronically for character and antecedent verification .
(4) The authority to which the application is made shall ensure that character and antecedent verification report is issued within fifteen days of the receipt of the character and antecedent form .
(5) Character and antecedents ' verification report once issued shall remain valid for five years irrespective of the change in employer status .
(6) On the basis of character and antecedents ' verification , the Agency shall issue in Form VII a character and antecedents certificate and this certificate shall not be taken back by such Agency even if the person ceases to be the employee of that Agency .
8. Security Training.-
( 1 ) The Controlling Authority shall frame the detailed training syllabus required for training the security guards in accordance with National Skill Qualification Framework . For entry level , this training shall be for a minimum period of hundred hours of classroom instruction and sixty hours of field training , spread over at least twenty working days . former paramilitary forces / police personnel / home guard personnel and home guard volunteers shall however be required to attend a condensed course only , of minimum forty hours of classroom instructions and sixteen hours of field training spread over at least seven working days.
(2) The training shall include the following subjects , namely:
(a) conduct in public and correct wearing of uniform;
(b) physical fitness training ;
( c) physical security , security of the assets , security of the building/ apartment , personnel security , household security;
(d) fire fighting;
(e) crowd control ;
(f) examining identification papers including identity cards , passports and smart cards ;
(g) must be able to read and understand English alphabets and Arabic numerals as normally encountered in the identification documents , arms licence , travel documents and security inspection sheet;
(h ) identification of improvised explosive devices ;
(i) first - aid;
(j ) crisis response and disaster management ;
(k) defensive driving ( compulsory for the driver of armoured vehicle and optional for others ) ;

(1 ) handling and operation of non- prohibited weapons and firearms (optional ) ;
(m) rudimentary knowledge of the Bharatiya Nagarik Suraksha Sanhita , 2023 ( 46 of 2023 ) , right to private defence , procedure for lodging First Information Report in the police station , the Arms Act , 1959 ( 54 of1959) (only operative sections ) and the Explosives Act , 1884 (4 of 1884 ) (operative sections ) ;
(n )badges of rank in police and military forces ;
(o) identification of different types of arms in use in public and police ;
(p) use of security equipments and devices ( for example : security alarms and screening equipments ) ; and
(q) leadership and management (for supervisors only) .
(3 ) Security guard / supervisor / ex - servicemen and former police personnel etc. shall have to successfully undergo the training as prescribed by the Controlling Authority .
(4) On completion of the training each successful trainee shall be awarded a certificate in the form of Form VIII by the Government recognized Training Institute .
(5) The training certificates issued to the guards / supervisors/ licencee applicants from Training Institutes in other State shall be accepted in the State ofMadhya Pradesh .
(6) The Controlling Authority shall inspect the functioning of training facility from time to time either by itself or through its own officers or by any other officer specially empowered by him for this purpose . Normally such मध्यप्रदेश राजपत्र, दिनांक 7 अगस्त 2024

inspection shall be conducted at least two times every year-
(a) the Controlling Authority shall frame detailed guidelines and specifications for recognizing the training center and may recognize the facility if it fulfills the required guidelines and specifications ;
(b) the officer authorized by the Controlling Authority for the purpose shall carry out regular inspections of the recognized training center and if it ceases to fulfill the requisite guidelines and specifications , may suggest de - recognition of such training facility;
(c) on receiving the suggestion from the authorized officer , the Controlling Authority may after affording a reasonable opportunity to the training center , de - recognize the training facility .
(7) All the training Institutions shall quarterly submit a list of successful trainees to the Controlling Authority in the manner prescribed in Form XII .
(8) Based on completion of training and requirements of the job , Private Security Agency may have their own designations provided that no agency shall adopt any of the ranks of the Armed Forces , Paramilitary Forces or State Police Forces .
(9 ) The Controlling Authority either by itself or through its officers or by any other officer specially empowered by him for this purpose may verify the training and skills imparted to the private security guards and supervisors of any private training Institution .

( 10) The Controlling Authority may review the continuation or otherwise of licence of such security agencies which may not have adhered to the conditions of trained personnel on its rolls .
9. Standard of physical fitness for security guards ..
(1) A Private Security Agency shall employ or engage a person as a private security guard as per the provisions of section 10 of the Act .
(2) A person shall be eligible for being engaged or employed as security guard if he fulfils the standards of physical fitness as specified below , namely: -
(i) Height : 160 cms ( Females 150 cms ) , weight according to standard table of height and weight , chest 80 cms with an expansion of 4 cms ( for females no minimum requirement for chest measurement) .
(ii ) Eye sight : Far sight vision 6/6 , near vision 0.6 / 0.6 with or without correction , free from colour blindness , must be able to identify and distinguish colour display in security equipment and read and understand display in English alphabets and Arabic numerals .
( iii) Free from knock knee and flat foot and should be able to run one kilometer in six minutes .
(iv) Hearing: free fron defeci , must be able to hear and respond to the spoken voice and the alarms generated by security equipments .
(v) The candidate must have dexterity and strength to perform searches , handle objects and use force for restraining the individuals in case of need .

(2) A candidate should be free from evidence of any contagious or infectious disease . He should not be suffering from any disease which is likely to be aggravated by service or is likely to render him unfit for service or endanger the health of the public .
(3 ) Agency shall ensure that every private security guard / supervisors working for it undergoes a medical examination after every twelve months from his last such examination so as to ensure his continued maintenance of physical standard as prescribed for the entry level .
10. Provision for Supervisors.-
(1) There shall be one supervisor to supervise the work of not more than fifteen private security guards .
(2) In case the private security guards are on security duty in different premises and it is not practical to supervise their work by one supervisor , the agency shall depute more number of supervisors so that at least for every six private security guards there is one supervisor available for assistance , advice and supervision .

11. Appeals and procedure . -
(1 ) Every appeal made under sub - section ( 1 ) of section 14 of the Act shall be preferred in Form IX signed by the aggrieved person or his authorized advocate and presented to the Additional Chief Secretary / Principal Secretary , Government of Madhya Pradesh , Home Department in person or electronic or digital form or sent to him by registered post .
(2) The appeal shall be accompanied by a challan of Rupees Five thousand ( Rs . 5000 / - ) in prescribed head payable to the Appellate Authority.
12. Register to be maintained by the Agency . The register required to be maintained under the Act by the Agency shall be maintained electronically as prescribed in Form X. 13. Photo identity card.-
( 1) Every photo identity card issued by the Agency under sub - section (2 ) of section 17 of the Act shall be as prescribed in Form XI .
(2) The photo identity card shall convey a full - face image in colour , full name of the private security guard , name of the Agency and the employee number of the individual to whom the photo identity card is issued . Hologram of the Agency must be affixed to the photo identity card .
(3) The photo identity card shall clearly indicate the individual's position in the Agency and the date up to which the photo identity card is valid .
(4) The photo identity card shall be maintained upto date and any change in the particulars shall be entered therein .

(5) The photo identity card issued to the private security guard shall be returned to the Agency issuing it , once the private security guard is no longer engaged or employed by it .
(6) Any loss or theft of photo identity card shali be immediately brought to the notice of the Agency that issued it .
14. Other conditions.-
( 1 ) Notwithstanding whether the Agency mandates its private security guards to put on uniform while on duty or not, every private security agency shall issue and make it obligatory for its security guards to put on- (a) an arm badge distinguishing the Agency;
(b) shoulder or chest badge to indicate his position in the organization ;
(c) whistle attached to the whistle cord and to be kept in the left pocket ;
(d) shoes with eyelet and laces ;
( e) a may also carry the headgear which distinguishing mark of the Agency .
(2) The clothes worn by the private security guard while on active duty shall be such that they do not hamper it in his efficient performance . In particular they shall neither be too tight nor too loose as to obstruct movement or bending of limbs .
(3) Every private security guard shall carry a notebook and a writing instrument with hirn .
(4) Every private security guard while on active security duty shall wear and display photo identity card issued under section 17 of the Act , on the outer most garment above waist level on his person in conspicuous manner .

(5) Station House Officer or any police officer superior in rank to an officer- in- charge of a police station or any other police officer not below the rank of head constable , who is specially empowered by SHO as the case may be , may , inspect / visit/ enter in the premises of any Private Security Agency or it's place of business , at any reasonable time , in their jurisdiction .
(6) Agency shall half yearly submit a detailed information prepared firm wise to the Controlling Authority regarding number of security guards and supervisors engaged in security duties in Form XIII by digital means or any other means which is specially recognized by the Controlling Authority for this purpose .
(7) Agency shall submit half yearly/ annual statement to the Controlling Authority in such forms as may be prescribed by the Controlling Authority.
15. Repeal and Saving.-
( 1 ) The Madhya Pradesh Private Security Agencies Rules , 2012 are hereby repealed:
Provided that the repeal shall not affect anything done or any action taken under these rules before coming into force of these rules .
(2) Anything done or any action taken or any order etc. made , taken or issued under these rules shall be deemed to have been done , made of issued under the corresponding provisions of the rules so repealed .
