निजी सुरक्षा अभिकरण (विनियमन) अधिनियम, 2005 (2005 कां 29) की धारा 25 द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए , राज्य सरकार, एतद्वारा , मध्यप्रदेश राज्य में निजी अभिकरणों द्वारा रोकड़ परिवहन क्रियाकलापों के लिए निजी सुरक्षा को विनियमित करने के लिए निम्नलिखित नियम बनाती हैं , अर्थात्ः-
नियम
1. संक्षिप्त नाम और प्रारंभ.-
(1) इन नियमों का संक्षिप्त नाम मध्यप्रदेश निजी सुरक्षा अभिकरण (रोकड़ परिवहन क्रियाकलापों के लिए निजी सुरक्षा) नियम , 2024 है ।
(2) ये मध्यप्रदेश राजपत्र में इनके प्रकाशन की तारीख से प्रवृत्तं होंगे ।
2. परिभाषाएंः-इन नियमों में , जब तक कि संदर्भ से अन्यथा अपेक्षित न हो,-
(क) " अधिनियम " से अभिप्रेत है, निजी सुरक्षा अभिकरण (विनियमन) अधिनियम, 2005 (2005 का 29) ;
(ख) "रोकड़ परिवहन क्रियाकलाप ' से अभिप्रेत है, रोकड़, जैसे बैंक नोट, सिक्के, क्रेडिट कार्ड, डेबिट कार्ड या अन्य मूल्यवान वस्तुओं का एक स्थान से दूसरे स्थान को भौतिक अंतरण और इसमें किसी एटीएम मशीन में रोकड़ डालना या उसमें से. रोकड़ निकालना सम्मिलित है;
(ग) " एटीएम " से अभिप्रेत है , स्वचालित गणन मशीनं जो रोकड़ का वितरण करती है या अन्य बैंककारी सेवाएं करती है , जब किसी बैंक का कोई खाता धारक उसमें बैंक कार्ड डालता है या मोबाइल बैंकिंग एप्लीकेशन अथवा संपर्क रहित एप्लीकेशन के माध्यम से संव्यवहार करता है;
स्पष्टीकरण - इस खण्ड के प्रयोजन के लिए 'बैंक कार्ड' में क्रेडिट कार्ड, डेविट कार्ड अथवा फोरैक्स कार्ड सम्मिलित है ।

(घ) "रोकड़ प्रबंधन अभिकरण " या " रोकड़ पुनः पूर्ति अभिकरण " या " मार्गस्थ रोकड़ अभिकरण" से अभिप्रेत है, कोई अभिकरण या सत्ता चाहे किसी भी नाम से पुकारी जाती हो , जो रोकड़ परिवहन के क्रियाकलाप में लगी हुई हो;
(ड.) " निजी सुरक्षा" या " निजी सुरक्षा अभिकरण" का वही अर्थ होगा, जो उसके लिए अधिनियम की धारा 2 के खण्ड (च) या खण्ड (छ) में समनुदेशित है;
(च) "अनुसूची" से अभिप्रेत है, इन नियमों से संलग्न अनुसूची ।
3. परिवहन के क्रियाकलाप आदि के लिए निजी सुरक्षा-
(1 ) निजी सुरक्षा अभिकरण द्वारा रोकड़ के परिवहन के क्रियाकलाप के लिए तब तक कोई सुरक्षा उपलब्ध नहीं कराई जाएगी जब तक कि वह उक्त अधिनियम के अधीन अनुज्ञप्ति धारण न करता हो ।
(2) रोकड़ के परिवहन के क्रियाकलाप के लिए निजी सुरक्षा उपलब्ध कराने के प्रयोजन के लिए निम्नलिखित के बीच एक संविदा की जा सकेगी , -
(क) उक्त अधिनियम के अधीन अनुज्ञप्ति धारण करने वाला कोई निजी सुरक्षा अभिकरण और संबंधित बैंक; या
(ख) कोई रोकड़ प्रबंधन अभिकरण और संबंधित बैंकः
परंतु, यदि रोकड़ प्रबंधन अभिकरण के पास उक्त अधिनियम के उपबंधों के अधीन निजी सुरक्षा अभिकरण के रूप में अनुज्ञप्ति है , तो ऐसा रोकड़ प्रबंधन अभिकरण स्वयं इन नियमों के उपबंधों के अनुसार रोकड़ के परिवहन के क्रियाकलाप के लिए निजी सुरक्षा उपलब्ध करा सकेगा ।
4. विशेष रूप से डिजाइन की गई और तैयार की गई रोकड़ वैन का उपयोग-
(1 ) कोई निजी सुरक्षा अभिकरण किसी बैंक या रोकड़ परिवहन अभिकरण को रोकड़ परिवहन के क्रियाकलाप के लिए तब तक निजी सुरक्षा या निजी सुरक्षा गार्ड उपलब्ध नहीं कराएगा जब तक कि ऐसे क्रियाकलाप किसी ऐसी सुरक्षित रोकड़ वैन में, जो अनुसूची- एक में विनिर्दिष्ट डिजाइन और विशिष्टियों की शर्तों के अनुरूप हो और यथास्थिति , उसके या बैंक के या रोकड़ प्रबंधन अभिकरण के स्वामित्व के हो , नहीं किए जाएं ।
(2) निजी सुरक्षा अभिकरण द्वारा रोकड़ के परिवहन के लिए किसी टैक्सी या किराए पर लिए गए यान का उपयोग नहीं किया जाएगाः
परंतु कोई यान जो निजी सुरक्षा अभिकरण या बैंक या रोकड़ प्रबंधन अभिकरण के साथ दीर्घकालिक अनुबंध (न्यूनतम 2 वर्ष) पर है और यान उप - नियम (1 ) के अधीन निर्धारित डिजाईन और विशिष्टियों के लिए शर्तों का अनुपालन करता है , उसका निजी सुरक्षा अभिकरण द्वारा उपयोग किया जा सकेगाः
परंतु , यह और कि किसी सुदूर अवस्थिति की दशा में, जहाँ निजी सुरक्षा अभिकरण विद्यमान नहीं है और किसी करेंसी तिजोरी (चेस्ट) द्वारा जहां पर सेवाएं 438(1)

नहीं दी जाती हैं , ऐसी अवस्थिति पर स्थानीय पुलिस के कठोर सुरक्षा नियंत्रण और सहायता के अधीन किसी अपवाद के रूप में, किसी भी यान का उपयोग किया जा सकेगा ।
5. प्रति रोकड़ वैन के लिए प्रशिक्षित कर्मचारिवृंद की अपेक्षित संख्या-
(1 ) निजी सुरक्षा अभिकरण , रोकड़ परिवहन के लिए नियम 5 के उप- नियम (2) में यथा विनिर्दिष्ट निजी सुरक्षा अभिकरण द्वारा प्रत्यक्षतः नियुक्त या नियोजित अपेक्षित संख्या में प्रशिक्षित कर्मचारिवृंद को निजी सुरक्षा के लिए उपलब्ध कराएगा ।
(2) प्रत्येक रोकड़ वैन में, प्रत्येक एकल रोकड़ परिवहन क्रियाकलाप के लिए वाहन पर सवार, उक्त अधिनियम की धारा 10 के अधीन अधिकथित अर्हताएं और प्रशिक्षण धारण करने वाले निम्नलिखित न्यूनतम कर्मचारिवृंद होंगे , अर्थात्ः-
(एक) चालक एक;
(दो) सशस्त्र सुरक्षा गार्ड- दो; और
(तीन) एटीएम अधिकारी या अभिरक्षक दो
(3) रोकड़ वैन की सदैव वाहन पर सवार कम से कम दो प्रशिक्षित सशस्त्र सुरक्षा गार्डों द्वारा रक्षा की जाएगीः
परंतु वहन की जा रही रोकड़ की रकम पर निर्भर करते हुए और व्यष्टिक कंपनी के बीमा मार्गदर्शन सिद्धांतों या ग्राहक संविदा या प्रचालन के स्थान के अनुसार किसी रोकड़ वैन में दो से अधिक सुरक्षा गार्डों को तैनात किया जा सकेगा ।
(4) जहां कोई रोकड़ वैन मध्यम मोटरयान है, वहां चालक के साथ आगे एक सशस्त्र गार्ड बैठेगा और दूसरा वैन के पिछले भाग में बैठेगा और अभिवहन, लादने या उतारने , शौच, चाय या भोजनावकाश के दौरान कम से कम एक सशस्त्र सुरक्षा गार्ड सभी समय पर रोकड़ वैन में उपस्थित रहेगा ।
(5) इन नियमों में किसी अन्य उपबंध के होते हुए भी, अन्यथा पात्र भूतपूर्व सैनिक को, रोकड़ परिवहन क्रियाकलापों के लिए सुरक्षा उपलब्ध कराने के लिए निजी सुरक्षा अभिकरण द्वारा प्राथमिकता से नियुक्त या नियोजित किया जा सकेगा ।
6. कार्मिकों के पूर्ववृत की जांच
(1 ) कोई भी निजी सुरक्षा अभिकरण, रोकड़ परिवहन क्रियाकलाप के लिए किसी कार्मिक को तब तक नियुक्त, नियोजित या तैनात नहीं करेगा , जब तक अधिनियम या तत्समय प्रवृत्त किसी अन्य विधि के उपबंधों के अनुसार अभिकरण द्वारा उन्हें नियुक्त नियोजित या तैनात करने से पूर्व ऐसे कार्मिकों के पूर्ववृत्त की पूर्ण जांच और उसका उचित मध्यप्रदेश राजपत्र, दिनांक 7 अगस्त 2024

अपने ग्राहक को जानिए (नो युअर कस्टमर) सत्यापन तथा पुलिस सत्यापन न कर लिया जाए ।
स्पष्टीकरण. - इस उप- नियम के प्रयोजनों के लिए पद " के वाई सी" " (अपने ग्राहक को जानिए) " से अभिप्रेत है, अभिकरण या कारबार से सहयोजित या सहयोजित किए जाने वाले उसके ग्राहकों या व्यक्ति की पहचान और सत्यापन करने वाले अभिकरण या कारबार की , अपने ग्राहक को जानने की प्रक्रिया ।
(2) प्रत्येक निजी सुरक्षा अभिकरण , रोकड़ परिवहन क्रियाकलाप में भाग लेने के लिए किसी व्यक्ति को नियुक्त करने या लगाए जाने से पूर्व निम्नलिखित जांचों का अनुपालन करने के लिए उत्तरदायी होगा, अर्थात्ः-
(क) पुलिस अनापत्ति प्रमाण- पत्र प्रत्येक व्यक्ति नियुक्ति या लगाने से पूर्व अपने स्थानीय पुलिस थाने से पुलिस अनापत्ति प्रमाण - पत्र प्राप्त करेगा;
(ख) निवास स्थान सत्यापन निजी सुरक्षा अभिकरण प्रत्येक व्यक्ति के निवास स्थान के पते का भौतिक सत्यापन, जिसके अंतर्गत सामान्य आचरण की जांच भी सम्मिलित है, करने के लिए अपने स्वयं संसाधनों का प्रयोग करेगा और व्यक्ति रोकड़ परिवहन क्रियाकलाप के लिए नियुक्ति या लगाए जाने से पूर्व कम से कम तीन वर्ष के निवास स्थान पते का प्रमाण सुरक्षा अभिकरण को देगा;
(ग) पूर्व नियोजक जांच निजी सुरक्षा अभिकरण व्यक्ति के पूर्व नियोजकों से, यदि कोई हों, की संदर्भ जांच करने के लिए अपने स्वयं के संसाधनों का प्रयोग करेगा;
(घ) आधार सत्यापन रोकड़ परिवहन क्रियाकलापों के लिए नियुक्त या लगा हुआ प्रत्येक व्यक्ति भारत के विशिष्ट पहचान प्राधिकरण से आधार नंबर के माध्यम से पूर्ववृत्त का सत्यापन कराएगा;
(ड. ) प्रत्यय इतिवृत्त की जांच निजी सुरक्षा अभिकरण प्रत्येक नियुक्त या लगे हुए व्यक्ति के प्रत्यय इतिवृत्त की जांच , यह सुनिश्चत करने के लिए करेगा , कि रोकड़ परिवहन क्रियाकलाप के लिए जानबूझकर प्रत्यय व्यतिक्रम करने वाले न नियुक्त किए या लगाए जाएं ;
(च) विश्वसनीयता बीमा - निजी सुरक्षा अभिकरण रोकड़ परिवहन क्रियाकलाप के लिए नियुक्त किए गए या लगाए गए प्रत्येक कार्मिक के संबंध में विश्वसनीयता बीमा अभिप्राप्त करेगा;

7. कार्मिक का पर्याप्त प्रशिक्षण और प्रमाणन.-
निजी सुरक्षा अभिकरण यह सुनिश्चित करेगा कि रोकड़ परिवहन क्रियाकलाप के लिए नियुक्त या लगाए गए प्रत्येक कार्मिक को, -
(1 ) अनुसूची- दो में अधिकथित प्रशिक्षण की अपेक्षाओं के अनुसार ऐसे क्रियाकलापों की सुरक्षा और सुरक्षित प्रबंध के लिए प्रशिक्षण और प्रमाणन दिया जाए ।
(2) प्रत्येक दो वर्षों में एक बार पुनश्चर्या प्रशिक्षण दिया जाए ।
8. प्रचालनों के दौरान रोकड़ वैन की लाइव ग्लोबल पोजीषनिंग सिस्टम ट्रेकिंग -
(1 ) प्रत्येक रोकड़ परिवहन क्रियाकलाप केवल ग्लोबल पोजिशनिंग सिस्टम ट्रेकिंग उपकरण युक्त सुरक्षित रोकड़ वैनों से किए जाएंगे ।
स्पष्टीकरण- इस उप नियम के प्रयोजनों के लिए "जीपीएस " पद से ऐसी वैश्विक स्थिति प्रणाली अभिप्रेत है, जो ऐसी अंतरिक्ष आधारित नेवीगेशन प्रणाली है जो सभी मौसम की दशा में अवस्था और समय की सूचना पृथ्वी पर कहीं भी या उसके निकट वहां उपलब्ध करती है जहां चार या अधिक जीपीएस उपग्रहों की दृष्टि की अवाधित रेखा हो ।
(2) निजी सुरक्षा अभिकरण यह सुनिश्चित करेगा कि प्रत्येक रोकड़ वैन की हर रोकड़ परिवहन क्रियाकलाप के दौरान सदैव परिपूर्ण संचार नवाचार के माध्यम से निगरानी की जाए ।
9. एकल रोकड़ वैन में अधिकतम रोकड़ अभिवहन के लिए मार्गदर्शन-
(1 ) रोकड़ परिवहन क्रियाकलाप में शामिल निजी सुरक्षा अभिकरण यह सुनिश्चित करेगा कि कोई रोकड़ वैन प्रति फेरा पांच करोड़ रूपए से अधिक नहीं ले जाए ।
(2) निजी सुरक्षा अभिकरण यह सुनिश्चित करेगा कि प्रति फेरा दस लाख रूपए से अधिक रोकड़ ले जाने के लिए सुरक्षित रोकड़ वैन अभिनियोजित की जाए ।
10. बैंक करेंसी को रात भर अंतःकक्ष में रखने के लिए प्रयोग किए जाने वाले निजी रोकड़ अंतःकक्ष के लिए विनिर्देश.-
निजी सुरक्षा अभिकरण यह सुनिश्चित करेगा कि सभी रोकड़ प्रबंधन जिसके अंतर्गत गणना , छटाई और बंडल बांधने संबंधी क्रियाकलाप सम्मिलित हैं, निम्नलिखित मार्गदर्शी सिद्धांतों के अनुसार सुरक्षित परिसरों में किए जाएं, अर्थात्ः-
(क) निजी रोकड़ अंतःकक्ष परिसरों की अवस्थिति- रोकड़ प्रबंधन क्रियाकलापों के लिए उपयोग किए जाने वाले परिसर इस तरह से अवस्थित होंगे जिससे कि मध्यप्रदेश राजपत्र, दिनांक 7 अगस्त 2024

क्रियाकलापों / संक्रियाओं की सुरक्षा सुनिश्चित हो सके, जिनके अंतर्गत ऐसे क्षेत्र भी सम्मिलित हैं जो बैंक के रोकड़ निकासी केन्द्र या पुलिस थाने के समीपतम हैं, और अल्प संयोजकता वाले एकांत क्षेत्रों से बचा जाएगा ।
(ख) परिसरों का डिजाइन- परिसरों को इस तरह से डिजाइन किया जाएगा कि उनमें दो भौतिक रूप से स्वतंत्र क्षेत्र होंगे , जिनमें से एक साधारण कार्यालय प्रयोजन के लिए और दूसरा सुरक्षित रोकड़ प्रक्रिया एवं प्रबंधन क्रियाकलापों के लिए होगा और उसमें रोकड़ का जमा, संग्रहण, छंटाई, गणना और सुरक्षित रोकड़ वैनों पर रोकड़ के परिदान और प्रेषण के लिए स्थान होगा;
(ग) रोकड़ अंतःकक्ष- निम्नलिखित विनिर्देशों के अनुसार रोकड़ अंतःकक्षों के संबंध में भारतीय रिजर्व बैंक की विनिर्दिष्ट अपेक्षा को पूरा करने हेतु रोकड़ भंडारण के लिए सुरक्षित क्षेत्र डिजाइन किया जाएगा, अर्थात्: -
(एक) दस करोड़ रूपए से कम की सीमित रात भर की अंतःकक्ष आवश्यकता वाले छोटे शहरों में , रक्षक तिजोरी वाले कोष कक्ष (स्ट्रांग रूम) ;
(दो) दस से एक सौ करोड़ रूपए तक की रात भर की अंतःकक्ष आवश्यकता वाले प्रचालन केन्द्रों पर 'ग' श्रेणी अंतःकक्षों के लिए विनिर्दिष्ट भारतीय रिजर्व बैंक के संनियमों के अनुसार अंतःकक्ष सुविधा;
(तीन) सौ करोड़ रूपए से अधिक की रात भर की अंतःकक्ष आवश्यकता वाले बृहद् प्रचालन केन्द्रों पर, संबंधित बैंक के परामर्श से वर्धित अंतःकक्ष सुविधा; और
(चार) समस्त रात भर की अंतःकक्ष सुविधाओं में पृथक् और अनन्य पात्रों में बहु बैंकों की करेंसी को भंडारित करने की व्यवस्था;
(घ) रोकड़ अंतःकक्ष की सुरक्षा- निजी सुरक्षा अभिकरण बैंक के निमित्त रोकड़ के सुरक्षित प्रबंधन के लिए प्रयोग किए जाने वाले उसके रोकड़ अंतःकक्ष में निम्नलिखित सुरक्षा पहलुओं को सुनिश्चित करेगा , अर्थात्:-
(एक) चौबीस घंटे सशस्त्र निजी सुरक्षा गार्डों की पर्याप्त संख्या तैनात की जाए ;
(दो) परिसर 24x7 इलैक्ट्रानिक निगरानी और मानीटरिंग के अधीन हो;
(तीन) रोकड़ अंतःकक्ष में कैमरों की पर्याप्त संख्या के साथ सीसीटीवी प्रणाली उपलब्ध कराई जाए, जिसमें कम से कम नब्बे दिन की रिकार्ड करने की सुविधा हो;
(चार) रोकड़ अंतःकक्ष में क्रियाकलाप दोहरी अभिरक्षा आधार के अधीन हो;

(पांच) मुख्य रोकड़ अंतःकक्ष क्षेत्र सभी सुरक्षा सन्नियमों जैसे अग्नि शमन प्रणाली, धूम्र खोज प्रणाली, आपात प्रकाषक, यानों के संचलन की निगरानी करने के लिए नियंत्रण कक्ष , स्व- डायलकर्ता और चोरी सुरक्षा प्रणाली का अनुपालन करता हो;
(छह) मोबाईल संचार हेतु, ग्लोब्ल सिस्टम अधारित स्व-डायलकर्ता, अग्नि और मैग्नेटिक सेंसर वाले सुरक्षा अलार्म संस्थापित किए गए हों;
(सात) रोकड़ की लदाई और उतराई क्षेत्र नाइट विजन सीसीटीवी कैमरों द्वारा आवृत्त हों;
(आठ) रोकड़, अंतःकक्ष के अंदर विद्युत आपूर्ति प्लग इन प्लग आउट प्रणाली के माध्यम से उपलब्ध कराई जाएगी;
(नौ) रोकड़ अंतःकक्ष के भीतर अनावृत लाईट ले जाना पूर्णतया प्रतिषिद्ध होगा और तिजोरी कक्ष के अंदर शुष्क बैटरी प्रचालित टार्च या आपात लाईट का प्रयोग किया जाएगा;
(दस) इन्वर्टर की सहायता से आपात प्रकाशक सुरक्षा कर्मचारिवृंदों को सदैव उपलब्ध हो; और
(ग्यारह) प्रसंस्करण और अंतःकक्ष क्षेत्रों की अधिमानतः इंटरलॉकिंग प्रणालियों और फ्रिस्किंग के माध्यम से निर्बाधित और नियंत्रित पहुंच हो;
स्पष्टीकरण- इस नियम के प्रयोजनों के लिए " सीसीटीवी " पदं से ऐसा बंद परिपथ वाला टेलीविजन अभिप्रेत है, जो भंडार या कंपनी में क्रियाकलापों की निगरानी करने के लिए कैमरों , रिकार्डरों और डिस्पले से मिलकर बनी स्वतः पूर्ण निगरानी प्रणाली हो ।
11. जोखिम न्यूनीकरण के लिए उपाय. -
(1 ) निजी सुरक्षा अभिकरण यह सुनिश्चित करेगा, कि चालक दल उठाईगीरी की स्वचालित टेलर मशीन धोखाधड़ी की घटनाओं को कम करने के लिए उसकी सुरक्षा के अधीन स्वचालित टेलर मशीन को वन टाइम इलेक्ट्रानिक काम्बिनेषन के साथ लगाया जाए ।

(2) किसी स्वचालित टेलर मशीन में लोड करने के लिए रोकड़ पूर्व के दिन को या दिन के पूर्वाहन में बैंक से संग्रहीत किया जाएगा, ताकि उप- नियम (3 ) में निर्धारित समय से पूर्व परिचालन समाप्त किया जा सके ।
(3) स्वचालित टेलर मशीन में रोकड़ की कोई लोड़िग या कोई रोकड़ परिवहन गतिविधियां निम्न के अतिरिक्त नहीं की जाएंगी-
(क) नगरीय क्षेत्रों में 9:00 बजे अपराह्न के पश्चात्;
(ख) ग्रामीण क्षेत्रों में 7:00 बजे अपराह्न के पश्चात्; तथा
(ग) वाम पंथ अतिवाद प्रभावित क्षेत्रों के रूप में केन्द्रीय सरकार द्वारा अधिसूचित जिलों में 9:00 बजे पूर्वाह्न के पहले या 4:00 बजे अपराह्न के पष्चात् नहीं किया जाएगा ।

अनुसूची-एक
[नियम 4 ( 1 ) देखिए ]
(1 ) मेक- रोकड़ वैन. -
(क) 2200 सीसी से अनिम्न क्षमता वाले इंजन, अधिमानतः टर्बोचार्जित के साथ एक हल्का वाणिज्यिक यान होगी;
(ख) सात वर्ष से अधिक पुरानी नहीं होगी ;
(ग ) ट्यूबरहित टायर वाली होगी;
(घ) कम से कम 190 मि० मी ० ग्राउंड क्लीयरेंस वाली होगी ; और
(ड. ) न्यूनतम पांच यात्रियों की जगह वाली होगी ।
(2) अभिन्यास. रोकड़ वैन में रोकड़ भंडारण के लिए यात्री कंपार्टमेंट यूनिट से वस्तुतः पृथकतः और ताले द्वारा बंद कंपार्टमेंट होगा ।
(3) रोकड़ कंपार्टमेंट सुरक्षा. -
(क) रोकड़ कंपार्टमेंट वैन के बाहर से पहुंच विहीन होगा, जब तक कि हाथ से संचालित या इलेक्ट्रॉनिक ताले के माध्यम से आंतरिक रूप से संचालित नहीं किया जाता है और रोकड़ कंपार्टमेंट विशेष रूप से केवल एक दरवाजे और ग्रिल गेट के साथ स्टील से विषेष रूप से प्रबलित है;
(ख) रोकड़ कंपार्टमेंट का प्रवेश उचित दृश्यमानता, संक्रियात्मक साध्यता और क्लोज्ड सर्किट टेलीविजन से (सीसीटीवी ) निगरानी सुनिश्चित करने के लिए पीछे की ओर से होगा;
(ग) सभी खिड़कियां और हवा रोधक शीशे एक वर्ग इंच से अनधिक के तार की जाली से बने होंगे और प्रत्येक खिड़की की जाली में हाथियारों के उपयोग के लिए छह इंच व्यास का एक चक्रीय छिद्र होगा;
(घ ) हूटर चलाने के लिए पेनिक स्विच ड्राइवर तथा अन्य अधिभोगियों के पास उपलब्ध है ।
(4 ) रोकड़ पेटी सुरक्षा. - प्रत्येक रोकड़ पेटी तल पर पृथक् जंजीरों और तालों से सुरक्षित की जाएगी, जो विभिन्न अभिरक्षकों के पास रखी हुई अलग -अलग चाबियों के प्रयोग से खोली औद बंद की जा सके और प्रत्येक बैंक के लिए रोकड़, अधिमानतः, पृथक पेटी में, जिस पर उस बैंक का नाम लिखा हो, ले जाया जाएगा ।
(5) अन्य सुरक्षा विशिष्टियां.-
(क) रोकड़ वैन में एक छोटा सीसीटीवी सिस्टम उपलब्ध कराया जाएगा, जिसमें कम से कम पांच दिन की रिकॉर्डिंग करने की सुविधा हो और तीन कैमरे केबिन के आगे , पीछे और भीतर लगाए जाएंगे ;
(ख ) मोबाइल संचार आधारित स्व - डायलर के लिए ग्लोबल सिस्टम के साथ एक सुरक्षा अलार्म एक मोटरयुक्त सायरन के साथ उपलब्ध कराया जाएगा;
(ग) किसी आक्रमण की दशा में, त्वरित प्रतिक्रिया सुनिश्चित करने के लिए रोकड़ वैन को हूटर , अग्निशमन यंत्र और आपातकालीन रोशनी से सुसज्जित किया जाएगा ।

(4) अभिकरण.-
(क) निजी सुरक्षा अभिकरण (विनियमन) अधिनियम, 2005 (2005 का 29 ) के अधीन नियंत्रण प्राधिकारी;
(ख) पुलिस थाना , पुलिस नियंत्रण कक्ष वैन, पुलिस दूरभाष सहायता;
(ग) नियंत्रणकारी पर्यवेक्षक और प्रचालन प्रबंधक;

(5) शस्त्र, गोला-बारूद और दस्तावेज. -
(क) गार्डों को न्यूनतम 12 बोर डीबीबीएल बंदूक उपलब्ध कराई जानी चाहिए । बंदूक का दो वर्ष में कम से कम एक बार फायर (गोली चलाने का ) परीक्षण होना चाहिए । बंदूक के कारतूस दो वर्ष में एक बार बदले जाएंगे । बंदूक सरकार से अनुमोदित शस्त्र साज द्वारा जांच तथा प्रमाणित कराई जानी चाहिए ;
(ख) दस्तावेज- बंदूक की अनुज्ञप्ति, पहचान पत्र और प्राधिकारियों द्वारा अधिरोपित निर्बधनों के दौरान शस्त्र ले जाने की अनुज्ञा;
(ग) बदमाशों द्वारा ले जाए जाने वाले वास्तविक शस्त्र;
(घ ) अन्य वस्तुएं, जो बदमाशों द्वारा शस्त्र के रूप में उपयोग की जा सकें ;
(6) आपातकाल और घटना प्रतिक्रिया.-
(क) संकट अलार्म प्रक्रिया;

In exercise of the powers conferred by section 25 of the Private Security Agencies ( Regulation ) Act, 2005 ( 29 of 2005 ) , the State Government , hereby , makes the following rules to regulate the private security for Transportation of Cash Activities by the Private Agencies in the State of Madhya Pradesh , namely : -
RULES
1. Short title and commencement.-
( 1 ) These rules may be called the Madhya Pradesh Private Security Agencies ( Private Security for Transportation of Cash Activities ) Rules , 2024 ..
(2) They shall come into force from the date of their publication in the Madhya Pradesh Gazette .
2. Definitions . In these rules , unless the context otherwise requires , -
(a) " Act" means the Private Security Agencies (Regulation ) Act , 2005 (29 of 2005) ;
(b) "Activities of transportation of cash " means the physical transfer of cash , such as banknotes , coins , credit card , debit card or other items of value from one location to another and includes loading cash into or unloading cash from an ATM machine ;
(c) "ATM" means the Automatic Teller Machine that dispenses cash or performs other banking services when an account holder of any bank inserts a bank card मध्यप्रदेश राजपत्र, दिनांक 7 अगस्त 2024

therein or through any mobile banking application or contactless applications .
Explanation . For the purposes of this clause , 'Bank Card' includes credit card , debit card and forex card .
(d) " Cash Handling Agency" or " Cash Replenishment Agency" or " Cash - In transit Agency" means an agency or entity , by whatever name called , engaged in cash transportation activities ;
(e) " private security " or " private security agency " shall have the same meaning as assigned to it in clause (f) or clause (g) of section 2 of the Act ;
(f) " Schedule " means the Schedules appended to these rules .
3. Private security for transportation activities etc.-
(1) No private security shall be provided by the private security agency for activities of transportation of cash unless he holds a licence under the said Act .
(2) For the purpose of providing private security for activities of transportation of cash a contract may be entered into between , -
(a) a private security agency holding licence under the said Act and the concerned bank ; or
(b) a cash handling agency and the concerned bank:

Provided that in case , the cash handling agency holds a licence as a private security agency under the provisions of the said Act , such cash handling agency may itself provide the private security to activities of transportation of cash in accordance with the provisions of these rules .
4. Use of specially designed and fabricated cash van.-
(1) No private security agency shall provide private security or private security guards to a Bank or a cash handling agency for transportation activities , unless such activities are carried out in a secured cash van , which complies with the conditions for design and specification specified in the Schedule - I and owned by it or owned by the Bank or the Cash Handling Agency , as the case may be .
(2) No taxi or hired vehicle shall be used for transportation of cash by the private security agency:
Provided that a vehicle which is on long term (minimum two years ) contract with the private security agency or Bank or Cash Handling Agency and the vehicle complies with the conditions for design and specification laid down under sub - rule ( 1 ) , may be used by the private security agency:
Provided further that in case of any remote location where private security agency is not present

and not serviced by a currency chest , any vehicle at such location may be used as an exception under the strict security control and support of the local police .
5. Requisite number of trained staff per cash van.-
( 1 ) The private security agency shall provide private security for the transportation of cash with the requisite number of trained staff, directly appointed or engaged by the private security agency, as specified in sub - rule (2) of rule 5.
(2) Every cash van shall have the following minimum staff, possessing the qualifications and training laid down under section 10 of the said Act , on board of every single cash transportation activity , namely : -
One
(1) Driver
Two; and (ii) Armed Security Guards
Two .
( iii ) ATM officer or Custodian
(3) The cash van shall always be escorted by at least two trained Armed Security Guards on board:
Provided that more than two Armed Security Guards may be deputed on a cash van depending on the amount of cash carried and in accordance with the individual company's insurance guidelines or client contract or terrain of operation .

(4) Where the cash van is medium motor vehicle , one armed guard shall sit in the front along with the driver and another in the rear portion of the van and while in transit , loading or unloading , nature's call , tea or lunch break , at least one armed security guard shall remain present with the cash van all the time .
(5) Notwithstanding any other provision in these rules , the ex - serviceman , otherwise eligible , may preferably be appointed or engaged by the Private Security Agency for providing security for cash transportation activities .
6. Antecedent check of personnel.-
(1) No Private Security Agency shall appoint or engage or deploy any personnel for the cash transportation activities , unless such personnel has undergone through antecedent check and his proper know your customer verification and police verification is done , before appointing or engaging or deploying them by the agency , in accordance with the provisions of the Act or any other law for the time being in force .
Explanation . For the purposes of this sub - rule , the expression " KYC " means the know your customer process of an agency or business identifying and verifying the identity of its clients or person associated or to be associated with the agency or business .

(2) Every Private Security Agency shall be responsible to comply with the following checks before an individual is to participate in cash appointed engaged transportation activities , namely : - or
(a) Police Clearance Certificate . Every individual shall obtain the police clearance certificate from his local police station before appointment or engagement;
(b) Residence Verification . The Private Security Agency shall use its own resources to conduct a physical verification of the residential address of every individual , including general conduct check and the individual shall furnish to the security agency the proof of residential address of at least three years before appointment or engagement for the cash transportation activities ;
(c) Previous Employer Check . The private security agency shall use its own resources to conduct reference check with previous employers of the individual , if any ;
(d) Aadhaar Verification . Each individual appointed or engaged for the cash transportation activities shall be antecedent verified through Aadhaar number from the Unique Identification Authority ofIndia;

(e) Credit History Check .-- The Private Security Agency shall conduct a credit history check of every individual appointed or engaged to ensure that wilful credit defaulters are not appointed or engaged for the cash transportation activities;
(f) Fidelity Insurance.- The Private Security Agency shall obtain a fidelity insurance in respect of every personnel appointed or engaged for the cash transportation activities .
7 . Adequate training and certification of personnel.-
The Private Security Agency shall ensure that every personnel appointed or engaged for cash transportation activities shall be imparted , -
(1) The training and certification for the security and safe handling of such activities as per the requirements of training laid down in the Schedule - II .
(2) The refresher training once in every two years .
8. Live Global Positioning System tracking of cash van during operation.-
( 1 ) Every cash transportation activity shall be carried out only in secured cash vans fitted with Global Positioning System tracking device .
Explanation . For the purposes of this sub - rule , the expression " GPS " means the Global Positioning System which is a space based navigation system that provides location and time information in all weather conditions ,

anywhere on or near the Earth where there is an unobstructed line of sight to four or more GPS satellites .
(2) The Private Security Agency shall ensure that cach cash van is monitored at all times during cash transportation activities through a redundant communications protocol .
9. Guideline for maximum cash carrying limit in a single cash van.-
(1) The Private Security Agency involved in cash transportation activities shall ensure that no cash van carries cash of more than five crore rupees per trip .
(2) The Private Security Agency shall ensure that cash secured van is deployed for carrying cash of more than ten lakh rupees per trip .
10. Specification for private cash vaults used for holding overnight vaulting Bank currency.-
The Private Security Agency shall ensure that all cash handling , including counting , sorting and bundling activities shall be carried out in secured premises in accordance with the following guidelines , namely : -
(a) Location of private cash vault premises the premises used for cash handling activities shall be located to ensure safety of activities / operations , including areas closer to bank's cash withdrawal centre or police station and secluded connectivity be avoided ; areas with poor 438(19)

(b) Design of premises - the premises shall be designed to include two physically independent areas , one for general office purpose and other for secured cash processing and handling activities and it shall accommodate space for cash deposit , collection , sorting , counting and delivery and dispatch of cash on secured cash vans;
(c) Cash vault- a secured area shall be designed to store cash , to meet with the requirements of the Reversed Bank of India specified for cash vaults in accordance with the following specifications , namely: -
(i) in smaller cities with limited overnight vaulting requirements of less than ten crore rupees , a strong room with defender safes ;
(ii) at operation centres with overnight vaulting requirements between ten to one hundred crore rupees , vaulting facility as per the norrns of the Reserve Bank of India specified for C - Class vaults;
( iii ) at large operation centres with overnight vaulting requirements of more than one hundred crore rupees , increased vaulting facility in consultation with the concerned Bank; and.
(iv) all overnight vaulting facilities shall have provision to store currency of multiple Banks in separate and exclusive bins ;

(d) Security of cash vault the Private Security Agency shall ensure the following security aspects at its cash vault used for secured handling of cash on behalf of the Bank , namely: -
(i) adequate number of armed private security guards are deputed round the clock ;
( ii ) premises is under 24x7 electronic surveillance and monitoring ;
(iii ) cash vault is provided with Closed Circuit Television System with adequate number of cameras having at least ninety days recording facility;
(iv) the activities at cash vault is undertaken under dual custody basis ;
(v) the main cash vault area complies with all safety norms , like fire fighting systems , smoke detection systems , emergency lighting , control room for monitoring the movement of vehicles , auto - dialer and burglar security system;
(vi) security alarm with Global System for Mobile Communication based auto dialer , fire and magnetic sensor are installed ;
(vii ) the loading and unloading area of cash is covered by night vision Closed Circuit Television cameras ;

(viii ) electric power supply inside the cash vault is provided through plug - in , plug - out system;
(ix) carrying of naked light inside the cash vault shall be strictly prohibited and dry battery operated torches or emergency lights shall be used inside strong rooms ;
emergency lighting with the help of inverter shall always be available to the security staff; and (x)
(xi ) processing and vault areas shall have restricted and controlled access , preferably through interlocking systems and frisking .
Explanation: For the purposes of this rule , the expression " CCTV " means the closed circuit television , which is a self- contained surveillance system comprising cameras , recorders and displays for monitoring activities in a store or company .
11. Measure for risk mitigation.-
(1 ) The Private Security Agency shall ensure that the Automatic Teller Machine under its security shall be fitted with one time electronic combination locks for reducing the instances of crew pilferage Automatic Teller Machine frauds .

(2) The cash for loading into an Automatic Teller Machine shall be collected from the Bank on previous day or in the first half of the day so that operations can be concluded before the time stipulated in sub - rule (3 ) of rule 11.
(3) No cash loading of the Automatic Teller Machine or cash transportation activities shall be done-
(a) after 9.00 PM in urban areas ;
(b) after 7.00 PM in rural areas; and
(c) before 9.00 AM or after 4.00 PM in the districts notified by the Central Government as Left Wing Extremism affected areas .

SCHEDULE - I

( 1 ) Make . The cash van shall-
(a) be a Light Commercial Vehicle , with an engine capacity of not less than 2200 CC , preferably turbocharged ;
(b) not be more than seven years old ;
(c) have tubeless tyres ;
(d) have ground clearance of not less than 190 mm ; and (e) accommodate minimum of five passengers .
(2) Layout . The cash van shall have the compartment for storing cash , physically separated and locked from the passenger compartment unit .
(3) Cash compartment security.-
(a) The cash compartment shall be inaccessible from outside the van unless operated internally through manual or electronic lock and cash compartment is specially reinforced with steel with only one door and grill gate;
rear (b) the entrance of the cash compartment shall be from the side to ensure proper visibility , operational feasibility and Closed Circuit Television surveillance ;
(c) all windows and wind screen shall have wire mesh protection of not more than one square inch and each window mesh shall have a circular port- hole of six inches diameter for use of weapons ;

(d) the panic switches for operating the hooter are available with the driver and other occupants .
(4) Cash Box Security .- Each of the cash boxes shall be secured to the floor with separate chains and have locks that can be opened or locked only by using separate keys kept with different custodians and cash for each bank shall be carried, preferably , in separate box with the name of the bank written on it.
( 5) Other security features.-
(a) The cash van shall be provided with a small Closed Circuit Television System with at least five days recording facility and three cameras installed in front , rear and inside of the cabin ;
(b) a security alarm with Global System for Mobile Communication based auto- dialer shall be provided with a motorised siren ;
(c) the cash van shall be equipped with hooter , fire extinguishers and emergency lights to ensure quick reaction in case of an attack .

the guards . Gun must be tested fired at least once in
two years . Gun cartridges must be replaced once in 2

Government approved armourer;
(b) documents - Gun Licence , Identity Card and permission
to carry weapon during restriction imposed by
authorities;
(c) real weapons carried by miscreants ;
(d) other objects which can be used as weapon by
miscreants .
