अधि. क्रमांक 7 UDH / 3 /0136 / 2022 / 18-3 ,:: यतः, इन्दौर शहर मध्य भारत में सबसे तीव्र गति से बढ़ता शहर है । वर्तमान में इन्दौर शहर की जनसंख्या में तीव्र गति से वृद्धि हो रही है । यह मध्य भारत में सबसे बड़ा व्यापारिक तथा शैक्षणिक केन्द्र है तथा यहां की चलायमान जनसंख्या अन्य शहरों से उल्लेखनीय रूप से अधिक है । फलस्वरूप , शहर में कानून व्यवस्था बनाए रखना एक गंभीर एवं ज्वलंत समस्या है । इस समस्या के निदान हेतु नवीनतम आधुनिक तकनीक, जैसे कि सामुदायिक कैमरा प्रणाली का उपयोग करने की आवश्यकता है, जो पूर्वोक्त समस्या का समाधान करने में सहायता कर सकता है ;

और, यतः, यह एक अंतरराष्ट्रीय सर्वोत्तम प्रणाली है कि सामुदायिक निगरानी प्रणाली केवल सार्वजनिक स्थानों पर विधि प्रर्वतन अभिकरणों द्वारा कैमरों की तैनाती तक ही सीमित नहीं है, बल्कि यह यहां नीचे यथा परिभाषित विभिन्न निजी/ सार्वजनिक प्रतिष्ठानों द्वारा लगाई गई सीसीटीवी निगरानी प्रणाली का उपयोग करती है । यह न केवल शहर के भीतर व्याप्ति में सुधार करते हैं, बल्कि सार्वजनिक सुरक्षा सुनिश्चित करने के सहयोगात्मक तरीके को बढ़ावा देते हैं;

अतएव, मध्यप्रदेश नगरपालिक निगम अधिनियम , 1956 (क्र. 23 सन 1956) की धारा 427 द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए, इंदौर नगरपालिक निगम, एतद्वारा , इंदौर नगरपालिक निगम सीमा क्षेत्र में, सार्वजनिक स्थानों में क्लोज सर्किट टेलीविजन ( सीसीटीवी) की स्थापना, संचालन , निगरानी एवं अन्य मुद्दों को नियंत्रित करने वाली निम्नलिखित उप- विधियां बनाता है , अर्थात्:-

उप-विधियां

1. संक्षिप्त नाम और प्रारंभ. -

(1 ) इन उप-विधियों का संक्षिप्त नाम इंदौर सामुदायिक कैमरा (निगरानी) उप-विधियां, 2024 है ।

(2) ये मध्यप्रदेश राजपत्र में इनके प्रकाशन की तारीख से प्रवृत्त होंगी ।

2. परिभाषाएं.-

(1) इन उप - विधियों में , जब तक कि संदर्भ से अन्यथा अपेक्षित न हो;-

(क) " अधिनियम" से अभिप्रेत है , गध्यप्रदेश नगरपालिक निगम अधिनियम, 1956 ( क्र. 23सन 1956) ;

(ख ) "अंकेक्षक" से अभिप्रेत है , उप - विधि 13 के उपबंधों के अनुसार सक्षम प्राधिकारी द्वारा नियुक्त संस्था या व्यक्ति;

(ग) " सीसीटीवी" से अभिप्रेत है, आईपी आधारित क्लोज्ड सर्किट टेलीविज़न कैमरा जिसका उपयोग निगरानी प्रणाली के रूप में किया जाता है, जिसमें कैमरे , रिकॉर्डर और किसी भी स्थान पर और उसके आसपास की गतिविधियों की निगरानी के लिए प्रदर्शक (डिस्प्ले) सम्मिलित है;

(घ ) "सक्षम प्राधिकारी" से अभिप्रेत है, आयुक्त, नगरपालिक निगम, इंदौर;

(ङ) " सलाहकार " से अभिप्रेत है , उप - विधि 7 के उपबंधों के अनुसार सक्षम प्राधिकारी द्वारा नियुक्त कोई अभिकरण;

(च ) " सीएसएस " से अभिप्रेत है , केंद्रीकृत निगरानी सॉफ्टवेयर;

(छ) 'डेटा का वही अर्थ होगा, जैसा कि सूचना प्रौद्योगिकी अधिनियम, 2000 ( 2000 का 21 ) की धारा 2 की उप- धारा (1 ) के खंड (ण) के अधीन परिभाषित है ;

(ज) "प्रतिष्ठान " से अभिप्रेत है , वह स्थान अकसर जहां पर बड़ी संख्या में, एक समय में 100 या अधिक लोगों के एकत्रित होने की संभावना हो या 1500 वर्गफिट और उससे अधिक के निर्मित क्षेत्र , जिसमें सम्मिलित हैं किन्तु जिस तक सीमित नहीं है , वाणिज्यिक प्रतिष्ठान, औद्योगिक प्रतिष्ठान , धार्मिक स्थान, शैक्षणिक संस्था, अस्पताल , खेल परिसर, मनोरंजन के स्थान, सभागार, होटल , कार्यालय , बैंक , कन्वेंशन सेंटर , सार्वजनिक स्थान , जैसे रेलवे स्टेशन , बस स्टेशन, संगठित समूह के स्थान और ऐसे अन्य प्रतिष्ठान , जैसा कि निगरानी और नियंत्रण समिति (जैसी कि इन उप - विधियों में परिभाषित है) इन उप- विधियों के प्रयोजन के लिए प्रतिष्ठान के रूप में विनिर्दिष्ट करें ।

प्रतिष्ठान में आवासीय बस्तियों, आवासीय सोसाईटी (रहवासी कल्याण संघ) एवं गेट युक्त कॉलोनी के सभी प्रवेश एवं निकास द्वार किसी दिष्ट समय पर भीड़ जुटने की गुंजाइश वाले विशिष्ट क्षेत्र पर केन्द्रित व्यक्तिगत दुकानों के समूह और अस्थाई प्रतिष्ठान अर्थात , शहर में समय- समय पर धार्मिक / राजनीतिक / सामाजिक / संस्थागत समूह / न्यास / सोसाइटी / व्यक्ति द्वारा आयोजित सभाएं/ आयोजन जिसमें रैली, गेला, पण्डाल आदि के रूप में खुले मैदानों में आयोजित सभी प्रकार की धार्मिक , राजनैतिक तथा सामाजिक सभा, जहां एक बार में 1000 से अधिक व्यक्तियों के एकत्रित होने की संभावना है, सम्मिलित है ।

परंतु-

(एक) किसी प्रतिष्ठान की पहचान करते समय , एक पर्यवेक्षण समिति (उप - विधि 2 के खण्ड (1 ) के उप - खण्ड (प ) में यथा परिभाषित) निम्नलिखित कारकों को, जिसमें सम्मिलित है, किन्तु जिस तक सीमित नहीं है , किसी विशिष्ट प्रतिष्ठान में अथवा उसके आस पास किसी भी समय 100 से अधिक व्यक्ति इकट्ठा है , वहां उस विशिष्ट प्रतिष्ठान का क्षेत्र , उस विशिष्ट प्रतिष्ठान की भेद्यता और एक दिन में उस विशिष्ट प्रतिष्ठान में आने वाले क्षेत्रों की कुल संख्या, आदि विधिवत् ध्यान रखते हुए निरीक्षण करेगी अथवा क्रियान्वयन समिति (उप - विधि 2 के खण्ड (1 ) के उप खण्ड (ञ) में यथा परिभाषित) के माध्यम से निरीक्षण कराएगी;

(दो) जहां किसी वाणिज्यिक प्रतिष्ठान के एक से अधिक स्वामी हैं, वहां पर्यवेक्षण समिति ऐसे बहुस्वामियों के एक क्षेत्रीय समिति गठित करने का सुझाव देगी तथा इन उप - विधियों में परिभाषित क्षेत्र- वार लोक सुरक्षा उपाय लागू करेगी;

(झ ) " आईसीसीसी" से अभिप्रेत है , एकीकृत नियंत्रण और कमान केंद्र;

(ञ) " क्रियान्वयन समिति" से अभिप्रेत है, कम से कम तीन सदस्यों वाली एक समिति, जिसमें पुलिस निरीक्षक से अनिम्न पदश्रेणी का एक अधिकारी भवन निरीक्षक नगरपालिक निगम से अनिम्न पदश्रेणी का एक अधिकारी , सहायक यंत्री, विद्युत विभाग, से अनिम्न पदश्रेणी का एक अधिकारी तथा सक्षम प्राधिकारी द्वारा मनोनीत अन्य सदस्य होंगे , जो कि पर्यवेक्षण समिति के अधीनस्थ कार्य करेंगे एवं उसे रिर्पोट करेंगे । इन उप विधियों को लागू करने के लिए क्रियान्वयन समिति उप - विधि 6 के उपबंधों के अनुसार गठित की जाएगी;

(ट) " सूचना" का वही अर्थ होगा , जैसा कि सूचना प्रौद्योगिकी अधिनियम, 2000 (2000 का 21 ) की धारा 2 की उप - धारा (1 ) के खंड (फ) के अधीन परिभाषित है;

(ठ) " आईएसपी" से अभिप्रेत है, उप- विधि 12 के उपबंधों के अनुसार सूचीबद्ध इंटरनेट / नेटवर्क सेवा प्रदाता;

(ड) "अनुज्ञप्ति" से अभिप्रेत है, मध्यप्रदेश नगरपालिक निगम अधिनियम , 1956 (क्र. 23 सन 1956) या किसी अन्य अधिनियग या इस प्रयोजन के लिए सुसंगत अधिनियमों के अधीन बनाए गए किन्हीं नियमों के अन्तर्गत किसी प्रतिष्ठान के निर्माण या परिचालन हेतु विधिमान्य अनुज्ञा या अनुज्ञप्तिः

(ढ) " निगरानी और नियंत्रण समिति " से अभिप्रेत है, कम से कम तीन सदस्यों वाली एक समिति, जिसमें अध्यक्ष के रूप में अपर आयुक्त, नगरपालिक निगम अथवा कोई समकक्ष अधिकारी, अतिरिक्त पुलिस उपायुक्त (सुरक्षा) , नगर अभियंता या नगर योजनाकार , नगरपालिक निगम से अनिम्न पद श्रेणी का कोई अधिकारी तथा सक्षम प्राधिकारी द्वारा नामनिर्दिष्ट अन्य सदस्य होंगे । इन उप- विधियों को लागू करने के लिए समिति उप - विधि 4 के उपबंधों अनुसार गठित की जाएगी;

(ण) " एमएसआई" से अभिप्रेत है, उप- विधि 10 के उपबंधों के अनुसार यथा परिभाषित मास्टर सिस्टम इंटीग्रेटर;

(त) "ओईएम" से अभिप्रेत है , मूल उपकरण निर्माता (ओईएग ) जो सिस्टम इंटीग्रेटर को हार्डवेयर की आपूर्ति करने के लिए जिम्मेदार होगा;

(थ) "स्वामी" से अभिप्रेत है, स्वामी या प्राधिकृत प्रतिनिधि या उस प्रतिष्ठान के संचालन के लिए जिम्मेदार कोई व्यक्ति , जहां सीसीटीवी स्थापित किया गया है/ स्थापित किया जाना है, संगठन या संस्था की दशा में, उस विशिष्ट प्रतिष्ठान की संस्था / संगठन का प्रमुख या संस्था / संगठन के प्रमुख द्वारा सम्यक् रूप से नियुक्त प्राधिकृत प्रतिनिधि इन उप - विधियों के प्रयोजन के लिए स्वामी के रूप में निर्दिष्ट किया जाएगा;

(द) "सार्वजनिक सुरक्षा उपाय " से अभिप्रेत है, प्रतिष्ठानों के प्रवेश तथा निकासी बिंदु, उनके पार्किंग क्षेत्र तथा ऐसे सभी क्षेत्र, जैसा कि क्रियान्वयन समिति द्वारा सुभेद्य क्षेत्रों के रूप में अवधारित किए जाएं , पर क्लोज्ड सर्किट कैमरा के माध्यम से निगरानी,- मध्यप्रदेश राजपत्र, दिनांक 12 सितम्बर 2024

(एक) सीसीटीवी के माध्यम से प्रतिष्ठानों के प्रवेश तथा निकास बिन्दुओं तथा संवेदशील महत्वपूर्ण क्षेत्रों की उचित कोण और दृश्यता के साथ निगरानी तथा साथ ही कम से कम 30 (तीस ) दिन तक विडियो फुटेज के भण्डारण का प्रावधानः

परन्तु कोई भी सीसीटीवी इस तरह से स्थापित न किया जाए जिससे किसी व्यक्ति की निजता का उल्लंघन हो;

(दो) तकनीकी उपकरण , सक्षम प्राधिकारी द्वारा समय - समय पर यथा अधिसूचित विशिष्टियों के पालन में हों। तकनीकी विशिष्टियों का विनिश्चय करते समय इस बात का ध्यान रखा जाएगा कि किसी विशिष्ट ओईएम / एसआई / आईएसपी का न तो पक्षपात किया जाए और ना ही विरोध तथा विनिर्माताओं / एसआई / आईएसपी के बीच एक स्वस्थ प्रतिस्पर्धा को प्रोत्साहित किया जाए । इसके साथ ही, विशिष्टियों का विनिश्चय करते समय यह भी ध्यान रखा जाएगा कि शहर में पूर्व से स्थापित अधिकांश कैमरे नेटवर्क में सम्मिलित हों; और

(तीन) किसी राष्ट्रीय खतरे, राष्ट्रव्यापी या राज्य स्तरीय आपात की स्थिति में और/ या दाण्डिक अपराध अंतर्ग्रस्त करने वाले मामलों में , मध्यप्रदेश पुलिस विभाग , सक्षम प्राधिकारी या कोई अन्य जांच अभिकरण सामुदायिक निगरानी प्रणाली तक पहुंच और उससे डेटा प्राप्त कर सके;

(ध) "क्षेत्रीय समिति" से अभिप्रेत है, उप-विधि 9 के उपबंधों के अनुसार निर्मित कोई समिति;

(न) "एसआई"से अभिप्रेत है, उप- विधि 11 के उपबंधों के अनुसार सूचीबद्ध सिस्टम इंटीग्रेटर्स (एसआई) ;

(प) " पर्यवेक्षण समिति" से अभिप्रेत है , कम से कम चार सदस्यों वाली समिति जिसमें अध्यक्ष के रूप में अपर आयुक्त, नगरपालिक निगम, के पद से अनिम्न पदश्रेणी का कोई अधिकारी, सहायक पुलिस आयुक्त से अनिग्न पदश्रेणी का एक अधिकारी, भवन अधिकारी नगरपालिक निगम से अनिम्न पदश्रेणी का एक अधिकारी, राजस्व निरीक्षक, नगरपालिक निगम से अनिम्न पदश्रेणी का एक अधिकारी तथा सक्षम अधिकारी द्वारा मनोनीत अन्य सदस्य , निगरानी एवं नियंत्रण समिति के अधीन कार्य करेंगे तथा उसे रिपोर्ट करेंगे । इन उप - विधियों को प्रवृत्त करने के लिए यह समिति इन उप- विधियों की उप- विधि 5 के उपबंधों के अनुसार निर्मित की जाएगी;

(2) उन शब्दों तथा अभिव्यक्तियों के, जो इन उप- विधियों में प्रयुक्त हुए हैं, किन्तु परिभाषित नहीं किए गए हैं, वही अर्थ होंगे , जो सूचना प्रौद्योगिकी अधिनियम, 2000 (2000 का 21 ) में उनके लिए समनुदेशित किए गए हैं ।

उप-विधियों की प्रयोज्यता.-

यह उप-विधियां समय- समय पर यथा संशोधित , इंदौर नगरपालिक निगम की नगरीय सीमाओं के भीतर अवस्थित, इन उप - विधियों में यथा परिभाषित सभी प्रतिष्ठानों पर लागू होंगी ।

4. निगरानी और नियंत्रण समिति के कृत्य.-

सक्षम प्राधिकारी , इन्दौर द्वारा नामनिर्दिष्ट निगरानी और नियत्रंण समिति (उप- विधि 2 के खण्ड (1 ) के उप - खण्ड (ढ) में यथा परिभाषित) इन उप - विधियों को बनाएगी । निगरानी एवं नियंत्रण समिति की भूमिका एवं कृत्य निम्नानुसार होंगे, लेकिन इन तक सीमित नहीं होंगे , अर्थात्ः-

(1 ) नगरपालिक सीमा के भीतर विद्यमान सामुदायिक सीसीटीवी निगरानी प्रणाली पर प्रतिवेदन तैयार करने के लिए पर्यवेक्षण समिति की निगरानी करना ।

(2) उप - विधियों के अनुसार सीसीटीवी निगरानी प्रणाली के समुचित काम - काज की समीक्षा करने तथा उसे सुनिश्चित करने हेतु पर्यवेक्षण समिति से वार्षिक रूप से प्रतिवेदन प्राप्त करना ।

(3 ) पर्यवेक्षण समिति द्वारा प्रतिष्ठानों को जारी कारण बताओं सूचना पत्र के अपालन के पश्चात् पर्यवेक्षण समिति द्वारा प्रस्तुत प्रतिवेदनों के अनुसार प्रतिष्ठानों के विरूद्ध सीलिंग आदेश / सदृश आदेश का मूल्यांकन , उसकी समीक्षा और उसका अनुमोदन करना ।

(4) इन उप- विधियों में यथा परिभाषित सार्वजनिक सुरक्षा उपाय सुनिश्चित करते हुए उप-विधियों के क्रियान्वयन के संबंध में सक्षम प्राधिकारी को प्रतिवेदन (रिपोर्ट) करना ।

(5) पर्यवेक्षण समिति या क्रियान्वयन समिति द्वारा प्रतिवेदित किए गए डेटा का दुरूपयोग / उससे छेड़‌छाड़ करने वाले किसी भी व्यक्ति के विरूद्ध कार्रवाई करना ।

(6) सक्षम प्राधिकारी के अनुमोदन पर, निरीक्षण एवं नियंत्रण समिति सामुदायिक निगरानी परियोजना के सफल क्रियान्वयन के लिए एक तकनीकी टीम नियुक्त कर सकेगी ।

(7) ऐसे अन्य कृत्यों का निर्वहन करना, जैसा कि सक्षम प्राधिकारी द्वारा समय- समय पर विहित किए जाएं ।

5. पर्यवेक्षण समिति के कृत्य.-

पर्यवेक्षण समिति, निम्नलिखित कृत्यों का निर्वहन करेगी , अर्थात्ः-

(1 ) निगरानी और नियंत्रण समिति के पर्यवेक्षण के अधीन कार्यरत परिभाषित क्षेत्र के लिए प्रतिष्ठानों से जानकारी प्राप्त करके और इन उप - विधियों से संलग्न अनुलग्नक -1 के अधीन विहित प्ररूप में नवीन प्रतिष्ठानों की पहचान करके शहर में विद्यमान सामुदायिक सीसीटीवी निगरानी प्रणाली पर प्रतिवेदन ( रिपोर्ट) तैयार करना ।

(2 ) पर्यवेक्षण समिति , उसके अधिकार क्षेत्र के भीतर न्यूनतम 10 प्रतिशत प्रतिष्ठानों का वार्षिक आधार पर आकस्मिक निरीक्षण करेगी तथा इन उप- विधियों के अनुलग्नक-2 के अधीन विहित प्ररूप में निरीक्षण रिपोर्ट निरीक्षण एवं नियंत्रण समिति को प्रस्तुत करेगी ।

(3) इन उप- विधियों के उल्लंघन या अननुपालन की स्थिति में प्रतिष्ठानों पर शास्ति अधिरोपित करना जब कभी भी आवश्यक हो सक्षम प्राधिकारी को शास्ति के धनीय मूल्य को विनिश्चित तथा उसे पुनरीक्षित / संशोधित करने का अधिकार होगा ।

(4) निरीक्षण एवं नियत्रंण समिति से अननुमोदन के पश्चात् डेटा का दुरुपयोग / उससे छेड़छाड़ करने वाले किसी भी व्यक्ति के विरूद्ध विहित कार्रवाई करना ।

(5) पर्यवेक्षण समिति क्रियान्वयन समिति से प्रतिष्ठानों द्वारा अनुसरित किए जाने वाले सार्वजनिक सुरक्षा उपायों की वार्षिक अनुपालन रिपोर्ट प्राप्त करेगी ।

(6) शास्ति अधिरोपण के बाद भी किसी भी प्रतिष्ठान द्वारा सार्वजनिक सुरक्षा उपायों का अनुपालन करने में विफल रहने की दशा में, पर्यवेक्षण समिति संबंधित प्रतिष्ठान के विरूद्ध सीलिंग आदेश / सदृश आदेश से संबंधित कारण बताओं सूचना पत्र जारी करेगी ।

(7) पर्यवेक्षण समिति को इन उप- विधियों के अननुपालन / उल्लंघन के लिए निरीक्षण एवं नियंत्रण समिति से अनुमोदन के पश्चात् सीलिंग आदेश / सदृश आदेश जारी करने का अधिकार होगा, यदि किसी प्रतिष्ठान द्वारा ऐसा अननुपालन / उल्लंघन लगातार दो महीने से अधिक की अवधि के लिए जारी रहता है और प्रतिष्ठान के विरूद्ध सीलिंग आदेश / सदृश आदेश से संबंधित कारण बताओं नोटिस जारी किया गया है ।

(8 ) प्रतिष्ठान को सील करते समय पर्यवेक्षण समिति प्रतिष्ठान के किसी भी खराब होने वाले सामान के आवश्यक निपटान के लिए प्रतिष्ठान को कम से कम 24 घंटे का नोटिस देगी ।

(9) ऐसे अन्य कृत्यों का निर्वहन करेगी जैसा कि सक्षम प्राधिकारी द्वारा समय - समय पर विहित किया जाए ।

(10) क्रियान्वयन समिति के कार्यों की निगरानी करना ।

6. क्रियान्वयन समिति के कृत्य.-

प्रत्येक पुलिस थाना क्षेत्र के लिए सक्षम प्राधिकारी द्वारा नामनिर्दिष्ट कोई क्रियान्वयन समिति पर्यवेक्षण समिति के पर्यवेक्षण के अधीन काम करेगी । क्रियान्वयन समिति में निम्नलिखित भूमिकाएं और उत्तरदायित्व निहित , किन्तु इस तक ही सीमित नहीं होंगे , अर्थात्ः-

(1 ) क्रियान्वयन समिति, पर्यवेक्षण समिति द्वारा उसकी अधिकारिता के क्षेत्र में पहचाने गए प्रतिष्ठानों के लिए अनुलग्नक 3 में यथा विहित एक अभिलेख रजिस्टर संधारित करेगी ।

(2) क्रियान्वयन समिति सूचीबद्ध सिस्टम इंटीग्रेटर्स के साथ उसके क्षेत्राधिकार के भीतर प्रतिष्ठानों का निरीक्षण करेगी तथा अनुलग्नक 4 के अधीन यथा विहित प्ररूप में वार्षिक निरीक्षण रिपोर्ट पर्यवेक्षण समिति को प्रस्तुत करेगी । अस्थायी प्रतिष्ठानों के लिए क्रियान्वयन समिति प्रत्येक समागम से पूर्व इन प्रतिष्ठानों का निरीक्षण करेगी ।

(3) क्रियान्वयन समिति इन उप- विधियों में यथा परिभाषित सार्वजनिक सुरक्षा उपायों को सुनिश्चित करने के लिए प्रतिष्ठानों का वार्षिक निरीक्षण करने के लिए एक सूचीबद्ध संपरीक्षकों की सहायता प्राप्त कर सकेगी ।

(4) प्रतिष्ठान के क्षेत्र पर अधिकारिता रखने वाली क्रियान्वयन समिति, पर्यवेक्षण समिति से आदेश प्राप्त करने के पश्चात् निगरानी एवं नियंत्रण समिति के अनुमोदन से परिसर को सील करेगी ।

(5) क्षेत्र पर अधिकारिता रखने वाली क्रियान्वयन समिति पूर्व सूचना देते हुए किसी भी प्रतिष्ठान में प्रवेश , सार्वजनिक सुरक्षा उपायों के स्थापन एवं कार्यकरण का निरीक्षण एवं जांच कर सकेगी तथा किसी लोप या उल्लंघन की दशा में वह पर्यवेक्षण समिति को प्रतिवेदन प्रेषित करेगी ।

(6) क्रियान्वयन समिति सार्वजनिक सुरक्षा उपायों के प्रभावी क्रियान्वयन के लिए क्षेत्रीय समिति के साथ समन्वय स्थापित करेगी ।

(7) ऐसे अन्य कृत्यों का निर्वहन करेगी, जैसा कि सक्षम प्राधिकारी द्वारा समय - समय पर विहित किया जाए ।

7. परामर्शदाता की भूमिकाएं और उत्तरदायित्व. -

परामर्शदाता की निम्नलिखित भूमिकाएं और उत्तरदायित्व होंगे , किन्तु इन तक ही सीमित नहीं होगें, अर्थात्ः-

(1) विद्यमान निगरानी प्रणाली और उसके प्रदर्शन और नेटवर्क उपबंधो की समीक्षा करना ।

(2) सार्वजनिक सुरक्षा उपायों के क्रियान्वयन के लिए आवश्यक उपस्करों के तकनीकी विशिष्टियों को तैयार करने में सक्षम प्राधिकारी की सहायता करना । तकनीकी विशिष्टियों का विनिश्चय करते समय यह ध्यान रखा जाएगा कि किसी विशेष ओ.ई. एम का न तो पक्षपात किया जाए और न ही विरोध तथा निर्माताओं के बीच स्वस्थ प्रतिस्पर्धा को बढ़ावा दिया जाए ।

(3 ) सिस्टम इंटीग्रेटर और इंटरनेट / नेटवर्क सेवा प्रदाताओं की सूची तैयार करने में सक्षम प्राधिकारी की सहायता करना । सूचीबद्ध करने की शर्तों का विनिश्चिय करते समय इस बात का ध्यान रखा जाएगा कि किसी विशेष एस . आई / आई.एस.पी. का न तो पक्षपात किया जाए और न ही विरोध तथा सिस्टम इंटीग्रेटर / इंटरनेट / नेटवर्क सेवा प्रदाता के बीच स्वस्थ प्रतिस्पर्धा को बढ़ावा दिया जाए ।

(4) सामुदायिक निगरानी प्रणाली के समुचित एवं प्रभावी क्रियान्वयन को सुनिश्चित करने के लिए नगरपालिक सीमा के भीतर पर्यवेक्षण समितियों, क्रियान्वयन समितियों और प्रतिष्ठानों के साथ- साथ सिस्टम इंटीग्रेटर्स का वार्षिक प्रशिक्षण कार्यक्रम आयोजित करना ।

(5) क्रियान्वयन समिति के साथ एक वार्षिक रिपोर्ट तैयार करना ।

(6) सेंट्रलाइज्ड इंटीग्रेटेड़ कमांड एंड कंट्रोल सेंटर (आई.सी.सी.सी) के साथ सम्पूर्ण शहर की सीसीटीवी कनेक्टिविटी को सुनिश्चित करने के लिए प्रतिष्ठानों के साथ -साथ मास्टर सिस्टम इंटीग्रेटर्स, सिस्टम इंटीग्रेटर और इंटरनेट/ नेटवर्क सेवा प्रदाता के साथ समन्वय करना ।

(7) सक्षम प्राधिकारी के निर्देश पर जब कभी भी अपेक्षित हो, ऐसे हार्डवेयर , सॉफ्टवेयर और इंस्टॉलेशन सहायता की आपूर्ति के लिए , जो आशयित गुणवत्ता के साथ पूर्णतः क्रियाशील और संचालन योग्य हो, पारदर्शी प्रक्रिया के माध्यम से मास्टर से मास्टर इंटीग्रेटर का चयन करना ।

(8) इन उप - विधियों के क्रियान्वयन के प्रयोजन के लिए यातायात पुलिस, पुलिस , नगर पालिक निगम और अन्य स्थानीय निकायों के बीच समन्वय स्थापित करना ।

(9) संपूर्ण प्रणाली के प्रभावी क्रियान्वयन के लिए मोबाईल आधारित एप्लिकेशन विकसित करना ।

(10) एस.एम.एस. और ई- मेल आधारित प्रणाली विकसित करना , जिससे कि किसी भी उप -विधि के उल्लंघन के बारे में प्रतिष्ठान के स्वामी को सूचित किया जा सके ।

(11 ) ऐसे अन्य कृत्यों का निवर्हन करना , जैसा कि सक्षम प्राधिकारी द्वारा समय - समय पर विहित किया जाए ।

8. प्रतिष्ठान के लिए निर्देश.-

सार्वजनिक सुरक्षा उपायों को सुनिश्चित करने के प्रयोजन के लिए प्रतिष्ठान निम्नलिखित उपबंधों का अनुपालन करेगाः-

(1 ) प्रत्येक स्वामी या अधिकृत प्रतिनिधि या प्रतिष्ठान के संचालन के लिए उत्तरदायी व्यक्ति 30 दिवस की अवधि के लिए विनिर्दिष्ट प्रारूप में वीडियो फुटेज को सुरक्षित/ संग्रहित रखेगा तथा सूचीबद्ध आई.एस.पी. द्वारा प्रदान की गई नेटवर्क प्रणाली के साथ सीसीटीवी की चौबीस घंटे कनेक्टिविटी को सुनिश्चित करेगा और क्रियान्वयन समिति द्वारा जब कभी भी अपेक्षित किया जाए फुटेज प्रदान करेगा।

(2) सीसीटीवी प्रतिष्ठान के ऐसे स्थानों पर स्थापित किया जाना चाहिए, कि वह प्रतिष्ठानों के प्रवेश और निकासी बिंदुओं और उनके पार्किंग क्षेत्रों को कवर करता हो ।

(3) प्रतिष्ठान डेटा की गोपनीयता बनाए रखेगा । फुटेज का उपयोग कानून प्रवर्तन, सुरक्षा और जांच के प्रयोजनों के सिवाय किसी अन्य प्रयोजन के लिए नहीं किया जाएगा । इस प्रकार स्थिर डेटा के किसी दुरूपयोग की दशा में संबंधित व्यक्ति कार्रवाई के लिए दायी होगा ।

(4) प्रत्येक मालिक / बिल्डर / वाणिज्यिक प्रतिष्ठानों का संगठन/प्रतिष्ठान संचालित करने वाले व्यक्ति, अपनी स्वयं की लागत और व्यय पर सार्वजनिक सुरक्षा उपायों की स्थापना के लिए व्यक्तिगत या संयुक्त रूप से उत्तरदायी होंगे ।

(5) किसी क्षेत्र के वाणिज्यिक प्रतिष्ठान / प्रतिष्ठानों के समूह उनके क्षेत्रमें सार्वजनिक सुरक्षा उपायों के क्रियान्वयन में पर्यवेक्षण रामिति का सहयोग और सहायता करने के लिए अपने क्षेत्र में एकक्षेत्रीय समिति बना सकेंगे जिसमें ऐसे वाणिज्यिक प्रतिष्ठानों / प्रतिष्ठानों के समूह के स्वामियों के प्रतिनिधि समाविष्ट होंगे ।

(6) ऐसी क्षेत्रीय समिति के गठन की सूचना उस क्षेत्र पर अधिकारिता रखने वाली क्रियान्वयन समिति के माध्यम से पर्यवेक्षण समिति को दी जाएगी ।

(7) सार्वजनिक सुरक्षा उपायों को प्राप्त करने के उद्देश्य से वैध उद्देश्य और आवश्यकता के साथ , निगरानी कैमरा प्रणाली का उपयोग सदैव विनिर्दिष्ट प्रयोजन के लिए होगा । स्वामी यह सुनिश्चित करेगा कि सीसीटीवी प्रणाली से एकत्र जानकारी का किसी भी रीति में दुरुपयोग न हो ।

(8) समस्त संवेदनशील क्षेत्रों को कवर करने के लिए प्रतिष्ठानों द्वारा सीसीटीवी कैमरे सावधानीपूर्वक स्थापित किए जाएंगे । यह महत्वूपर्ण है कि संवेदनशील और महत्वपूर्ण क्षेत्रों को उचित कोण और दृश्यता के साथ कवर किया जाए, जिससे कि सीसीटीवी द्वारा प्रदत्त जानकारी गतिविधि की स्पष्ट तस्वीर प्रदान कर सके और व्यक्तियों की पहचान कर सके ।

(9) समस्त प्रतिष्ठान यह सुनिश्चित करेंगे कि सीसीटीवी प्रणाली व्यक्ति की निजता का उल्लंघन न करे । प्रतिष्ठान सीसीटीवी निगरानी प्रणाली के अस्तित्व के बारे में पारदर्शी होंगे तथा यह स्पष्ट रूप से सूचित करेंगे कि "क्षेत्र सीसीटीवी निगरानी के अंतर्गत है" । ऐसी अधिसूचना में किसी भी शिकायत के दशा में संपर्क किए जाने वाले अधिकारियों के नाम और टेलीफोन नंबर का भी उल्लेख किया जाएगा ।

(10) प्रतिष्ठान सक्षम प्राधिकारी द्वारा यथा विनिर्दिष्ट मानकों और विशिष्टियों को पूरा करने वाले सीसीटीवी कैमरे और संबंधित घटक सूचीबद्ध सिस्टम इंटीग्रेटर से स्वयं के व्यय पर स्थापित करेंगे ।

(11) प्रतिष्ठान यह सुनिश्चित करेंगे कि सीसीटीवी कैमरे सम्पूर्ण वर्ष में चौबीसों घंटे संचालित हों । शास्ति से बचने के लिए किसी भी रख - रखाव या कटौती के संबंध में क्रियान्वयन समिति को पूर्व से सूचित किया जाएगा ।

(12) किसी भी अनधिकृत व्यक्ति के लिए सीसीटीवी डेटा तक पहुंच सुलभ नहीं होगी । प्राधिकृत व्यक्तियों द्वारा की गई पहुंच का अभिलेख उनकी पहचान के साथ एक रजिस्टर में रखा जाएगा ।

(13) सीसीटीवी प्रणाली के माध्यम से एकत्र की गई कोई भी जानकारी किसी भी ऐसे व्यक्ति को प्रकट नहीं की जाएगी, जो इस संबंध में प्राधिकृत नहीं है । सीसीटीवी प्रणाली के माध्यम से एकत्रित जानकारी, अपराधों की रोकथाम, पता लगाने, जांच , अभियोजन और दण्ड के प्रयोजनों के लिए जानकारी प्राप्त करने के लिए कानून के अधीन अधिकृत सरकारी एजेंसियों को मांगने पर उपलब्ध कराई जाएगी ।

(14) सीसीटीवी प्रणाली की आवधिक संपरीक्षा में क्रियान्वयन समितियों और संपरीक्षकों को सहायता प्रदान करना ।

(15) किसी भी सुरक्षा के उल्लंघन या किसी आपराधिक घटना के लिए प्रतिष्ठान 24 घंटे के भीतर क्रियान्वयन समिति को रिपोर्ट करेंगे ।

(16) उपरोक्त उप- विधियों/ विनियमों के उल्लंघन / अननुपालन परसूचना प्रौद्योगिकी अधिनियम, 2000 (2000 का 21 ) , पुलिस अधिनियम , 1861 (1861 का 5), मध्यप्रदेश नगरपालिक निगम अधिनियम, 1956 (1956 का 23 ) , भारतीय न्याय संहिता , 2023 (2023 का 45) और भारतीय नागरिक सुरक्षा संहिता, 2023 (2023 का 46) आदिकी सुसंगत धाराओं के साथ विधि के उपबंधों के अधीन यथा विहित दडात्मक कार्रवाई की जा सकेगी ।

(17) इन उप-विधियों में यथा अधिदेशित सार्वजनिक सुरक्षा उपायों के क्रियान्वयन के संबंध में अननुपालन के लिए सक्षम प्राधिकारी प्रतिष्ठानों पर पर्यवेक्षण समिति के माध्यम से शास्ति अधिरोपित कर सकेगा । समक्ष प्राधिकारी द्वारा शास्ति की रकम विनिश्चित की जाएगी और आवश्यकतानुसार संशोधित की जा सकेगी ।

(18) स्वामी या प्राधिकृत प्रतिनिधि या प्रतिष्ठान के संचालन के लिए उत्तरदायी व्यक्ति क्षेत्राधिकार रखने वाली क्रियान्वयन समिति को ऐसी प्रमाणक रीति में, कि सार्वजनिक सुरक्षा उपाय सक्षम प्राधिकारी द्वारा विहित किए गए अनुसार उपलब्ध कराए गए हैं, बनाए रखे गए हैं तथा संबंधित उपस्कर काम करने की स्थिति में है; वार्षिक विवरणी (अनुलग्नक-5 के अनुसार) फाइल करेगा ।

9. क्षेत्रीय समिति.-

क्षेत्रीय समिति निम्नलिखित भूमिकाओं का निर्वहन करेगी , अर्थात्.-

(1 ) किसी स्थानीय क्षेत्र की छोटी दुकानों (समीप के प्रतिष्ठान ) का कोई समूह , जो संयुक्त क्षेत्रों को कवर कर रहे हों, एक साथ आ सकेंगे और संयुक्त रूप से सार्वजनिक सुरक्षा उपायों के क्रियान्वयन के उद्देश्य से ऐसे व्यक्तिगत प्रतिष्ठानों के स्वामियों के प्रतिनिधियों को समाविष्ट करते हुए एक क्षेत्रीय समिति बना सकेंगे ।

(2) ऐसी समिति के गठन की सूचना क्रियान्वयन समिति को दी जाएगी और क्षेत्रीय समिति संयुक्त रूप से प्रतिष्ठानों के लिए उप- विधि 08 में उल्लिखित समस्त निर्देशों का पालन करेगी ।

10. मास्टर सिस्टम इंटीग्रेटर (एम.एस.आई. ).-

मास्टर सिस्टम इंटीग्रेटर (एम.एस.आई.) निम्नलिखित भूमिकाओं और कृत्यों का निर्वहन करेगा, अर्थात्ः-

(1) सक्षम प्राधिकारी सेवा अनुबंध के माध्यम से सामुदायिक निगरानी प्रणाली के क्रियान्वयन के लिए एक मास्टर सिस्टम इंटीग्रेटर नियुक्त करेगा ।

(2) एम.एस.आई. प्रत्येक प्रतिष्ठान में स्थापित सीसीटीवी से 24x7 निर्बाध फीड सुनिश्चित करने के लिए एसआई और आईएसपी के साथ समन्वय करने के लिए तकनीकी सेटअप के साथ केंद्रीकृत निगरानी सॉफ्टवेयर (सीएसएस) एप्लिकेशन प्रदान करेगा ।

(3) एम.एस.आई. यह सुनिश्चित करेगा कि सम्पूर्ण प्रणाली के प्रभावी क्रियान्वयन और निगरानी के लिए एप्लीकेशन विकसित करते हुए नगर की सीसीटीवी निगरानी प्रणाली, स्वास्थ्य निरीक्षण प्रणाली (एचएमएस) के माध्यम से प्रभावी रूप से कार्य कर रही है । एचएमएस सम्पूर्ण नगर मे स्थापित समस्त सीसीटीवी की जीवंत उपलब्धता की अद्यतन स्थिति प्रदान करेगा । यदि कोई सीसीटीवी ऑफलाईन पाया जाता है तो एचएमएस , आईसीसीसी स्क्रीन पर अलार्ग के रूप में एक दृश्य संकेतक प्रस्तुत करेगा ।

(4) आईसीसीसी पर ऑपरेशन का प्रचालन करने के लिए 24x7 विशेषज्ञों की पर्याप्त टीम उपलब्ध कराएगा ।

(5) एमएसआई प्रणाली की खराबी की प्रकृति के आधार पर विशिष्ट एसआई और आईएसपी के साथ समन्वय करेगा, कैमरे की अनुपलब्धता के मूल कारण का निदान करेगा, जो या तो नेटवर्क समस्या, बिजली की समस्या या स्वास्थ्य निगरानी प्रणाली द्वारा ज्ञात की गई यांत्रिक समस्या हो सकता है । इस समन्वय के लिए , एमएसआई द्वारा स्वचालित घटना से निपटने वाला तंत्र (इंसीडेट हैडंलिंग मेकानिडम) विकसित किया जाएगा ।

(6) सक्षम प्राधिकारी सेवा अनुबंध के निर्बंधनों के संबंध में अपालन के लिए एमएसआई पर शास्ति अधिरोपित कर सकता है ।

11. सिस्टम इंटीग्रेटर (एसआई).-

ऐसे समस्त एसआई जो सूचीबद्ध किए जाने के लिए सक्षम प्राधिकारी द्वारा यथा विनिश्चित सेवा स्तर की शर्तों से सहमत हैं, निम्नलिखित भूमिकाओं का निर्वहन करेंगे , अर्थात्ः-

(1 ) एसआई, ओईएम से हार्डवेयर क्रय करके पहचाने गए प्रतिष्ठानों में हार्डवेयर में स्थापित करेगा और सक्षम प्राधिकारी द्वारा विनिश्चित किए गए सेवा स्तर अनुबंध के निर्बन्धनों के अनुसार हार्डवेयर का रखरखाव करेगा ।

(2) ओईएम प्रदाय किए गए हार्डवेयर को बदलने/ सुधार संबंधी आवश्यकता के लिए पर्याप्त मात्रा में स्टॉक बनाए रखेगा ।

(3) एसआईके पास प्रत्येक पुलिस स्टेशन क्षेत्र के लिए ऑपरेशन के प्रचालन हेतु विशेषज्ञों की पर्याप्त टीम होनी चाहिए ।

(4) एसआई सीसीटीवी स्थापित करेगा, और तत्पश्चात आईसीसीसी में जी.आई.एस. मेप पर स्थापित प्रत्येक कैमरे की अवस्थति अंकित (जियो टैगिंग ) करेगा ।

(5) एसआई द्वारा सीसीटीवी के लिए एक्सेस लॉगिन आईडी और पासवर्ड , यह सुनिश्चित करते हुए , कि सिस्टम में कोई आईपी टकराव न हो, क्रियान्वयन समिति को उपलब्ध कराया जाएगा ।

(6) सक्षम प्राधिकारी सेवा स्तर के अनुबंध के संबंध में अपालन के लिए सिस्टम इंटीग्रेटर्स पर शास्ति अधिरोपित कर सकता है । अथवा निगरानी और नियंत्रण समिति के माध्यम से शास्ति अधिरोपित करने के लिए निदेश दे सकता है । शास्ति की रकम सक्षम प्राधिकारी द्वारा विनिश्चित और आवश्यकताओं के अनुसार संशोधित की जा सकती है ।

12. इंटरनेट / नेटवर्क सेवा प्रदाता (आईएसपी).-

इंटरनेट / नेटवर्क सेवा प्रदाता वायरलेस या ऑप्टिकल फाईबर के माध्यम से इंटरनेट / नेटवर्क और ईथरनेट पॉइंट - टू- पॉइंट कनेक्टिविटी प्रदान करने के लिए प्राधिकृत हैं । सक्षम प्राधिकारी के साथ सूचीबद्ध होने वाले आईएसपी निम्नलिखित भूमिकाओं का निर्वहन करेंगे , अर्थात्ः-

(1 ) इंदौर नगरपालिक निगम की नगरीय सीमाओं के भीतर संचालित समस्त आईएसपी से सक्षम प्राधिकारी के साथ सूचीबद्ध होने की अपेक्षा की जाएगी । इन उप -विधियों के लागू होने के पश्चात् 90 दिनों के भीतर पैनल सूचीबद्ध किया जाना आवश्यक है ।

(2) आईएसपी सक्षम प्राधिकारी द्वारा विनिश्चित किए गए सेवा स्तर अनुबंध (एसएलए) के निबंधनों के अनुसार कार्य करेगा ।

(3) आईएसपी को उसके द्वारा उपयोग किए जा रहे नगरपालिक निगम के संसाधनों की सक्षम प्राधिकारी द्वारा विनिश्चित दरों के अनुसार लागत वहन करनी होगी ।

(4) समस्त आईएसपी के लिए प्रतिष्ठानों से निर्दिष्ट भण्डारण इकाई से आईसीसीसी तक ऑप्टिकल फाईबर नेटवर्क कनेक्टिविटी प्रदान करना अनिवार्य होगा ।

(5) आईएसपी के पास आईसीसीसी के साथ सीसीटीवी कैमरों की 24x7 निर्बाध कनेक्टिविटी सुनिश्चित करने के लिए विशेषज्ञों की पर्याप्त टीम होनी चाहिए ।

(6) सक्षम प्राधिकारी सेवा स्तर के अनुबंध के संबंध में अपालन के लिए आईएसपी पर शास्ति अधिरोपित कर सकता है अथवा निगरानी और नियंत्रण समिति के माध्यम से शास्ति अधिरोपित करने के लिए निदेश दे सकता है । शास्ति की रकम सक्षम प्राधिकारी द्वारा विनिश्चित और आवश्यकताओं के अनुसार संशोधित की जा सकती है ।

13. संपरीक्षक की भूमिकाएं और उत्तरदायित्व.-

संपरीक्षक की भूमिकाएं और उत्तरदायित्व निम्नलिखित होंगे, किन्तु इन्हीं तक सीमित नहीं होंगे , अर्थात्ः-

(1 ) निगरानी प्रणाली के क्रियान्वयन और उसके प्रदर्शन की संपरीक्षा करना और किसी भी प्रतिष्ठान द्वारा इन उप - विधियों के किसी भी उल्लंघन के बारे में सक्षम प्राधिकारी को रिपोर्ट करना ।

(2) सक्षम प्राधिकारी के निर्देशानुसार, आवधिक संपरीक्षा रिपोर्ट तैयार करना और प्रस्तुत करना ।

(3) एमएसआई , प्रतिष्ठानों, एसआई, आईएसपी और इन उप- विधियों के में यथा उपबंधित समस्त समितियों के बीच समन्वय स्थापित करना ।

(4) संपरीक्षक ,सक्षम प्राधिकारी द्वारा विनिश्चित दरों के अनुसार अपनी सेवाओं के लिए प्रतिष्ठान पर शुल्क प्रभारित कर सकेगा ।

(5) सामुदायिक निगरानी प्रणाली के सफल क्रियान्वयन के लिए नियमित निरीक्षणों में संपरीक्षक क्रियान्वयन समितियों के साथ समन्वय स्थापित करेगा ।

14. विवाद समाधान.-

उप- विधियों के क्रियान्वयन के संबंध में किसी भी विवाद का न्यायनिर्णयन आयुक्त, नगरपालिक निगम द्वारा किया जाएगा । इन उप - विधियों के किसी प्रावधान के भंग या उल्लंघन की दशा में अभियुक्त और उसके लिए उत्तरदायी प्रत्येक व्यक्ति भारतीय न्याय संहिता, 2023 (2023 का 45) और सूचना प्रौद्योगिकी अधिनियम, 2000 (2000 का 21 ) के लागू उपबंधो के अधीन अभियोजन और अन्य दंडात्मक कार्रवाई के लिए उत्तरदायी होगा ।

15. पूर्व विधियों की व्यावृत्ति.-

इन उप - विधियों के उपबंध इन उप - विधियों के प्रवृत्त होने के पूर्व बनाए गए किसी अधिनियम विनियम, नियगों और उप - विधियों को प्रभावित नहीं करेंगे ।

Bhopal , the 12th September 2024

Notification No - 07 UDH/ 3 / 0136/ 2022 / 18-3:: Whereas , the Indore city is the fastest -growing city in central India. Currently , the population of Indore city is rapidly increasing . It is the largest commercial and educational centre in central India and the floating population here is significantly higher than other cities . Consequently, maintaining law and order in the city is a serious and burning issue . To address this problem , there is a need to utilize the latest modern technology , such as the use of community camera systems , which may help in resolving the aforementioned issue ;

And , whereas , it is an international best practice that the community surveillance is not restricted to only deployment of cameras by Law Enforcement Agencies in public places , but it uses the CCTV Surveillance Systems implemented by various private / public establishments as defined hereunder . This not only improves the coverage within the city , but also promotes collaborative way of ensuring public safety ;

Now, therefore , in exercise of the powers conferred by section 427 of the Madhya Pradesh Municipal Corporation Act , 1956 ( No. 23 of 1956) , the Indore Municipal Corporation , hereby , makes the following Bye - laws governing the installation , operation , monitoring and other issues related to the Closed Circuit Television ( CCTVs ) in Public Spaces in Indore Municipal area , namely: -

BYE - LAWS

1. Short title and commencement.-

( 1) These Bye - laws may be called the Indore Community Cameras (Surveillance ) Bye - laws 2024 .

(2) They shall come into force from the date of their publication in the Madhya Pradesh Gazette .

2. Definitions.-

(1.) In these bye- laws , unless the context otherwise requires , -

( a) " Act " means the Madhya Pradesh Municipal Corporation Act , 1956 (No. 23 of 1956 ) ;

( b) " Auditor " means an agency or a person appointed by the Competent Authority , in accordance with the provisions of bye- law 13;

( c ) " CCTV " means the IP Based Closed- Circuit Television Camera used as a surveillance system comprising cameras , recorders and displays for monitoring activities in and around any place;

( d) " Competent Authority" means the Commissioner , Municipal Corporation , Indore ;

( e) " Consultant " means an agency appointed by the Competent Authority , in accordance with the provisions of bye - law 7 ;

( f) " CSS" means Centralized Surveillance Software ;

( g) " Data " shall have the same meaning as defined under clause ( o) of sub - section ( 1 ) of section 2 of the Information Technology Act , 2000 ( 21 of 2000) ;

( h ) " Establishment " means a place frequented by large number of people with a likelihood of gathering of 100 people or more at a time or built - up area of 1500 square feet or above , including but not limited to commercial establishments , industrial establishments , religious places , educational institutions , hospitals, sports complexes , places of entertainment , auditoriums , hotels , offices , banks , convention centers , public places like railway stations , bus stations , places of organized congregation and such other establishments as the Monitoring and Control Committee ( as defined in this bye - laws ) may specify to be an establishment for the purpose of the these bye- laws .

Establishment also includes all entry and exit gates of residential townships , housing societics ( RWA's ) and gated colonies , group of individual shops concentrated at a particular area giving scope for more congregation at any given point of time and temporary establishments i.e. the conventions / events organized by religious/ political/ social / institutional group/ trust/ society/ individual in the city from time to time including religious , political and social gathering of all types such as open ground , etc. in form of rallies , mela , pandals etc. , where there is a possibility of gathering more than 1000 persons at a time :

Provided that-

( i) While identifying an establishment , a Supervising Committee ( as defined under sub - clause ( u) of clause (1) of bye -law 2) shall inspect or get inspected through Implementation Committee ( as defined under sub - clause (j ) of clause ( 1 ) of bye - law 2 ) , the establishment duly taken into account , including but not limited to , the following factors whether there is a gathering of more than 100 people at any point of मध्यप्रदेश राजपत्र, दिनांक 12 सितम्बर 2024

time in or around a particular establishment , the area of that particular establishment , the vulnerability of that particular establishment and total number of people visiting that particular establishment in a day, etc .;

(ii) where there are multiple owners of commercial establishments the Supervising Committee shall advise such multiple owners to form a Sectoral Committee and implement sector - wise public safety measures , defined in these bye - laws ;

( i ) " ICCC" means Integrated Control and Command Center ;

(j ) " Implementation Committee " means the committee , with minimum three members , one officer not below the rank of Police Inspector , one officer not below the rank of Building Inspector , Municipal Corporation , one officer not below the rank of Assistant Engineer , Electrical Department and other members nominated by the Competent Authority , working under and reporting to Supervising Committee . The Implementation Committee shall be formed to enforce these bye- law, in accordance with the provisions of bye - law 6 ;

(k) " Information " shall have the same meaning as defined under clause (v) of sub - section ( 1 ) of section 2 of the Information Technology Act , 2000 ( 21 of 2000 ) ;

(1 ) " ISP " means Internet / Network Service Provider empaneled in accordance with the provisions of bye - law 12 ;

(m) " Licence " means a valid permission or licence to build or operate an establishment obtained under the Madhya Pradesh Municipal Corporation Act , 1956 ( No. 23 of 1956) or any other Act or the rules made under the relevant Acts for this purpose ;

(n) "Monitoring and Control Committee " means a Committee with minimum three members chaired by Additional Commissioner , Municipal Corporation or an equivalent officer , Additional Police Deputy Commissioner ( Security) , an officer not below the rank of City Engineer or City Planner Municipal Corporation and other members nominated by the Competent Authority . The Committee shall be formed to enforce these bye- laws , in accordance with the provisions of bye - law 4 ;

(o ) " MSI " means Master System Integrator as defined in accordance with the provisions of bye - law 10 ;

(p ) " OEM " means Original Equipment Manufacturer ( OEM) who shall be responsible for supplying hardware to the System Integrator ;

( q) " Owner " means the owner or the authorized representative or the person who is responsible for operations of the establishment where the CCTV is installed/ to be installed , in case of Organization or Institution , the head of the Institution/ Organization of that particular establishment or the authorized representative duly appointed by the head of the Institution/ Organization shall be referred as owner for the purpose of these bye- laws;

( r) " Public Safety Measures " means Closed - Circuit Television ( CCTV) Surveillance at entry and exit points of the establishments , their parking areas and all such areas , as may be determined by the Implementation Committee , as vulnerable areas by installing-

( i) surveillance through CCTV placed so as to cover the entry and exit points of the establishments and vulnerable , sensitive and critical areas with proper angle and visibility along with a provision for storage of video footage for minimum 30 ( thirty) days:

Provided that no CCTV should be installed in a manner that it violates privacy of any individual ;

(ii) The technical equipment , adhering to the specifications as notified by the Competent Authority from time to time . While deciding the technical specifications , it shall be taken care of that no particular OEM / SI / ISP is either favored or disfavored and a healthy competition is promoted among manufacturers / SIs / ISPs . Also , while deciding the specifications , it shall also be taken care of that most of the pre- installed cameras in the City are included in the network; and

(iii ) in case of any National threat , Nation - wide or State level emergencies and/ or in cases involving criminal offences , Madhya Pradesh Police Department , Competent Authority or any other investigating agency may access and take the Data from community surveillance system ;

( s) " Sectoral Committee " means a Committee formed in accordance with the provisions of bye - law 9 ;

(t) "SI " means System Integrators ( SI ) empaneled in accordance with the provisions of bye - law 11 ;

(u) " Supervising Committee " means the Committee with minimum four members chaired by an officer not below the rank of Additional Commissioner , Municipal Corporation comprising one officer not below the rank of Assistant मध्यप्रदेश राजपत्र, दिनांक 12 सितम्बर 2024

Commissioner of Police , one officer not below the rank of Building Officer , Municipal Corporation , one officer not below Revenue Inspector , Municipal Corporation and other members nominated by the Competent Authority , working under and reporting to Monitoring and Control Committee . This Committee shall be formed to bring these bye - laws in force according to the provisions of bye - law 5 .

(2) Words and expressions used but not defined in these bye - laws shall have the same meaning as assigned to them in the Information Technology Act , 2000 (21 of 2000) .

3. Applicability of the bye - laws . These bye - laws shall be applicable to all the establishments as defined in these bye - laws , located within the city limits of Indore Municipal Corporation as amended from time to time.

4. Functions of the Monitoring and Control Committee.-

Monitoring and Control Committee ( as defined in sub- clause ( n) of clause ( 1 ) of bye -law 2) nominated by the Competent Authority , Indore shall form these bye - laws . The roles and functions of the Monitoring and Control Committee shall be as follows , but not limited to, namely: -

( 1 ) Monitor Supervising Committees to prepare a report on existing community CCTV Surveillance System within the municipal limit .

(2) Annually procure a report from Supervising Committees to review and ensure proper working of CCTV Surveillance System as per the bye - laws .

( 3) Evaluate , review and approve sealing order / similar order against establishments as per the reports submitted by Supervising Committee after non- compliance of Show Cause Notice issued to establishments by Supervising Committee .

(4) To report the Competent Authority regarding implementation of the bye - laws ensuring public safety measure as defined in the bye- laws .

(5) To take action against any person misusing/ mishandling the data reported by Supervising Committee or Implementation Committee .

(6) Upon the approval of the Competent Authority , Monitoring and Control Committee may appoint a technical team for successful implementation of Community Surveillance Project .

(7) Perform such other functions as may be prescribed by the Competent Authority from time to time .

5. Functions of the Supervising Committee.-

The Supervising Committee shall perform the following functions , namely: -

(1) To prepare a report on existing community CCTV Surveillance System in the city by obtaining the Information from the establishments and identification of new establishments in the format prescribed under Annexure - 1 appended to these bye- laws for a defined area working under the supervision of the Monitoring and Control Committee .

(2) The Supervising Committee shall randomly inspect minimum 10% of the Establishments within the area of their jurisdiction on an annual basis and shall submit the Inspection Report , in the prescribed format under Annexure - 2 appended to these bye- laws to the Monitoring and Control Committee .

(3) To impose fines on the establishments in the event of non- compliance or violation of these bye - laws , the Competent Authority shall decide and have right to revise/ amend the monetary value of the fines , as and when required .

(4) To take prescribed action against any person misusing/ mishandling the data after approval from Monitoring and Control Committee .

(5) The Supervising Committee shall procure yearly compliance report of public safety measures being followed by establishments from the Implementation Committee .

(6) In case of any failure by any establishment to comply with the public safety measures even after imposing fine , the Supervising Committee shall issue show cause notice relating to sealing order/ similar order against the respective Establishment .

(7) The Supervising Committee shall have the right to issue the sealing order/ similar order after approval from the Monitoring and Control Committee for non- compliance / violation of these bye - laws , in case , such non - compliance/ violation by an establishment continues for a period of more than two consecutive months and a show cause notice relating to sealing order/ similar order has been issued against the establishment.

(8) At the time of sealing the establishment , the Supervising Committee shall give a notice of minimum 24 hours to the establishment for necessary disposal of any perishable goods at the establishment .

(9) Perform such other functions as may be prescribed by the Competent Authority from time to time .

( 10) To monitor operations of Implementation Committee .

6. Functions of the Implementation Committee.-

An Implementation Committee , nominated by the Competent Authority for each Police Station area shall work under the supervision of the Supervising Committee . The Implementation Committee shall be vested with the following roles and responsibilities included but not limited to , namely: -

(1) The Implementation Committee shall maintain a record register as prescribed in Annexure - 3 for establishments as identified by Supervising Committee in the area of its jurisdiction .

(2) The Implementation Committee shall inspect the establishments within the area of jurisdiction with an empaneled System Integrators and submit annual Inspection report in the format as prescribed under Annexure - 4 to the Supervising Committee . For temporary establishments , the Implementation Committee shall inspect these establishment before each gathering .

(3) The Implementation Committee may take assistance of an empaneled Auditor for annually inspecting the establishments to ensure public safety measures as defined in these bye - laws .

(4) The Implementation Committee having jurisdiction over the area of Establishment shall seal the premises with the approval of Monitoring and Control Committee after obtaining order from the Supervising Committee.

(5) The Implementation Committee having jurisdiction over the arca , by giving prior notice , may enter into any establishment , inspect and check the installation and functioning of the public safety measures and in case of any default or violation , it shall send a report to the Supervision Committee .

(6) Implementation Committee shall co - ordinate with the Sectoral Committee in the effective implementation of public safety measures .

(7) Perform such other functions as may be prescribed by the Competent Authority from time to time .

7. Roles and Responsibilities of Consultant.-

The Consultant shall have the following roles and responsibilities included but not limited to , namely: -

(1) Review the existing Surveillance System and its performance and network provisions .

(2) Assisting the Competent Authority in preparing technical specifications of the equipments required for implementation of public safety measure . While deciding the technical specifications , it shall be taken care that no particular OEM is either favored or disfavored and a healthy competition is promoted among manufacturers .

(3 ) Assisting the Competent Authority in the empanelment of System Integrator's and Internet/ Network Service Provider's . While deciding the empanelment conditions , it shall be taken care that no particular SI / ISP is either favored or disfavored and a healthy competition is promoted among System Integrator's / Internet/ Network Service Provider's .

(4) Organize annual training program of System Integrator's along with Supervising Committees , Implementation Committees and establishments within the Municipal Boundary to ensure proper and effective implementation of Community Surveillance System.

(6) Coordinate with Master System Integrator , System Integrator's and Internet/ Network Service Provider's along with Establishment to ensure the CCTV connectivity of entire city with the Centralized Integrated Command and Control Centre (ICCC) .

(7) Selection of Master System Integrator and empanelment of System Integrator's and Internet/ Network Service Provider's through a transparent process , as and when required on instructions of Competent Authority for supply of hardware , software and installation support that shall be fully functional and operational with intended quality .

(8) Co- ordination among Traffic Police , Police , Municipal Corporation and other local bodies for the purpose of implementation of these bye - laws .

(9) Developing mobile based application for effective implementation of the entire system .

( 10) Develop an SMS and E - mail based system so as to notify the owner of establishment about violation of any bye - laws .

(1.1 ) Perform such other functions as may be prescribed by the Competent Authority from time to time .

8. Directions for the establishment.-

The establishment shall comply with the following provisions for the purpose ofensuring public safety measures , namely: - मध्यप्रदेश राजपत्र, दिनांक 12 सितम्बर 2024

( 1) Every owner or the authorized representative or the person who is responsible for operations of the establishment shall save/ store video footage in the specified format for a period of 30 days and should ensure 24x7 connectivity of CCTV with the network system provided by empaneled ISPs and shall provide the footage as and when required by Implementation Committee .

( 2) The CCTV should be installed at such locations of the establishment that it covers the entry and exit points of the establishments and their parking areas .

(3) The establishment shall maintain the confidentiality of the data . Except for the purposes of law enforcement , security and investigation , the footage shall not be used for any other purpose . The concerned person shall be liable for action , in case of any misuse of the data entails .

(4) Every owner/ builders/ association of commercial establishments / persons running the establishment shall severally and jointly be responsible for installation of public safety measures at their own costs and expenses .

a (5) The commercial establishments / group of establishments of a locality may form Sectoral Committee consisting of representatives from the owners of such commercial establishments / group of establishments in their locality to aid and assist the Supervising Committee in the implementation of the public safety measures .

(6) The formation of such Sectoral Committee shall be informed to Supervising Committee through the Implementation Committee having jurisdiction over the area .

(7) Use of a surveillance camera system shall always be for a specified purpose , with the legitimate aim and necessity , in order to achieve the public safety measures . The owner shall ensure that the information collected through CCTV system is not misused in any manner .

(8) Establishments shall carefully place the CCTV cameras to cover all the vulnerable areas . It is important that sensitive and critical areas are covered with proper angle and visibility , so that the CCTV feeds give the clear picture of the activity and identify individuals .

( 9) All establishment shall ensure that CCTV system does not breach individual privacy . Establishments shall be transparent about the existence of the CCTV Surveillance System and shall clearly notify that " The Area is under CCTV Surveillance " . Such notification shall also mention name and telephone number of authorities to be contacted in case of any complaint .

( 10) Establishments shall install CCTV Cameras and related components meeting the standards and specifications as specified by the Competent Authority, at their own costs from empaneled System Integrator's .

( 11 ) Establishment shall ensure that CCTV cameras operate 24x7 throughout the year . Any scheduled maintenance or outages shall be informed to the Implementation Committee well in advance to avoid the penalty .

( 12) The CCTV data shall not be accessible to any unauthorized person . The record of access made by authorized persons along with their identity shall be maintained in a register .

(13) No information collected through the CCTV system shall be disclosed to any person , not authorized in this regard . The Information collected through CCTV system shall be made available on demand to the Government Agencies mandated under the law to obtain information for the purposes of prevention, detection , investigation , prosecution and punishment of offences .

(14) Support the Implementation Committees and Auditors in periodic auditing of the CCTV system .

( 15) For any security breach or any criminal incident the establishments shall report to the Implementation Committec within 24 hours .

(16) Violations / failure to comply with the above bye- laws / regulations may lead to punitive action as prescribed under the provisions of law including the relevant sections of the Information Technology Act , 2000 (21 of 2000) , the Police Act, 1861 ( 5 of 1861 ) , the Madhya Pradesh Municipal Corporation Act, 1956 ( No. 23 of 1956 ) , the Bharatiya Nyaya Sanhita , 2023 ( 45 of 2023) and the Bharatiya Nagarik Suraksha Sanhita , 2023 ( 46 of 2023 ) , etc.

(17) The Competent Authority can impose the fine or can direct the fine to be imposed through the Supervising Committee upon the establishments for non- compliance with respect to the implementation of public safety measures as mandated in these bye - laws . The amount of penalty shall be decided and could be amended as per the requirements by the Competent Authority .

(18) Owner or the authorized representative or the person who is responsible for operations of the establishment shall file annual returns in such certifying manner that the public safety measures are provided , properly maintained and the relevant equipment's are in working condition as prescribed by the Competent Authority ( as per Annexure - 5) to the Implementation Committee having jurisdiction .

9 . Sectoral Committee . The Sectoral Committee shall perform the following roles , namely: -

(1) A group of small shops ( neighboring establishments ) of a locality , covering common areas may come together and form a Sectoral Committee consisting of representatives from the owners of such individual establishments with the aim of implementation of public safety measures collectively .

(2) The formation of such Committee shall be informed to the Implementation Committee and the Sectoral Committee shall collectively follow all the directions for establishments as mentioned in bye - law 8.

10. Master System Integrator ( MSI) . The Master System Integrator (MSI ) shall perform the following roles and functions , namely : -

( 1) The Competent Authority shall appoint a Master System Integrator for implementation of Community Surveillance System through a service agreement .

(2) MSI shall be providing Centralized Surveillance Software ( CSS ) application with a technical setup for co- ordinating with SI's and ISP's ensuring 24x7 uninterrupted feed from CCTV installed at every establishment .

(3) MSI shall ensure that CCTV surveillance system of the city is effectively working through Health Monitoring System (HMS ) by developing application for effective implementation and monitoring of the entire system. The HMS shall give live availability updates of all the CCTV installed throughout the city . If any CCTV is detected offline the HMS shall present a visual signifier as an alarm on the ICCC screen .

(4) Shall provide adequate team of experts 24x7 to run the operations at ICCC .

(5) MSI shall co- ordinate with particular SI and ISP depending on the nature of system malfunction , diagnosing the root cause of the camera's non - availability which could either be a network issue , electricity issue or a mechanical issue as detected by Health Monitoring System . For this co- ordination , automatic incident handling mechanism shall be developed by MSI .

(6) The Competent Authority can impose the penalty upon the MSI for non- compliance with respect to the terms of service agreement .

11. System Integrator ( SI) .- All the SI's that agree to the service level conditions , as decided by the Competent Authority to be empaneled shall perform the following roles , namely : -

( 1) SI shall procure the hardware from the OEM , install the hardware at the identified establishments and maintain the hardware as per the terms of Service Level Agreement decided by the Competent Authority.

(2) The SI shall maintain a sizeable amount of stock for any replacement/ service requirement of the supplied hardware .

(3) SI's should have an adequate team of experts to run the operations for each Police Station areas .

(4) SI shall install the CCTV and thereafter punch the locations of every installed camera ( geo - tagging) on a GIS map at ICCC .

( 5) The SI's must provide the access login ID and password for each CCTV to the Implementation Committee ensuring no IP conflicts in the system .

(6) The Competent Authority can impose the penalty or can direct the fine to be imposed through the Monitoring and Control Committee upon the System Integrators for non - compliance with respect to the Service Level Agreement . The amount of penalty shall be decided and could be amended as per the requirements by the Competent Authority.

12. Internet / Network service providers ( ISP) .- Internet/ Network Service Providers are authorized to provide internet/ network and ethernet point to point connectivity through wireless or optical fiber . ISP to be empaneled with the Competent Authority shall perform the following roles , namely: -

( 1 ) All the ISP's operating within the city limits of Indore Municipal Corporation are required to be empaneled with Competent Authority . Empanelment has to be done within 90 days after commencement of these bye - laws .

(2 ) The ISP's shall work in accordance with the terms of Service Level Agreement ( SLA) decided by the Competent Authority.

(3) The ISP's need to bear the cost of resources of Municipal Corporation , being utilized by them as per the rates decided by the Competent Authority .

(4) It shall be mandatory for all the ISP's to provide optical fiber network connectivity from establishments to specified storage unit to ICCC .

ensure (5) ISP should have adequate team of experts to uninterrupted connectivity of the CCTV cameras 24x7 with the ICCC .

(6) The Competent Authority can impose the penalty or can direct the fine to be imposed through the Monitoring and Control Committee upon the ISP's for non - compliance with respect to the Service Level Agreement . The amount of penalty shall be decided and could be amended as per the requirement by the Competent Authority.

13. Roles and responsibilities of the Auditor . The roles and responsibilities of the Auditor shall be the following , but shall not be limited to , namely : -

( 1) To audit the implementation of the Surveillance System and its performance and report to the Competent Authority about any violation of these bye - laws by any establishment .

(2) Prepare and submit a periodic audit report , as per the instruction of the Competent Authority .

(3) Co - ordinate between MSI , establishments , SI's , ISP's and all the Committees as provided in these bye - laws .

(4) Auditor may charge the establishment for his services as per the rates decided by the Competent Authority .

(5) Auditor shall co - ordinate with the Implementation Committees in regular inspections for successful implementation of Community Surveillance System .

14. Dispute Resolution.- Any dispute with regard to implementation of the bye - laws shall be adjudicated upon by the Commissioner , Municipal Corporation . In case of breach or violation of any of the provisions of these bye - laws , the accused and every person responsible thereof shall be liable for prosecution and other punitive actions under the applicable provisions of the Bharatiya Nyaya Sanhita , 2023 ( 45 of 2023) and the Information Technology Act , 2000 (21 of 2000) .

15. Saving of previous laws . The provisions of these bye - laws shall not affect any of the Act , Regulations , Rules and Bye - laws made before the commencement of these bye - laws .
