चूंकि, राज्य सरकार की यह राय है कि दालों की उचित मूल्य पर उपलब्धता सुनिश्चित करने के लिए ऐसा किया जाना आवश्यक तथा समीचीन है ।
अतएव , आवश्यक वस्तु अधिनियम , 1955 ( 1955 का 10 ) की धारा 3 एवं सहपठित धारा 5 एवं केन्द्र सरकार के कृषि एवं सहकारिता मंत्रालय (खाद्य विभाग ) के जीएसआर 800 दिनांक 9 जून , 1978 तथा भारत सरकार की अधिसूचना एस.ओ 2403 (अ ) दिनांक 21 जून , 2024 द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए , राज्य सरकार , एतदद्वारा निम्नलिखित आदेश देती है , अर्थात्ः-
आदेश
संक्षिप्त नाम , विस्तार तथा प्रारंभ.- 1.
(1 ) इस आदेश का संक्षिप्त नाम मध्यप्रदेश दलहन (अधिकतम स्टॉक सीमा एवं स्टॉक की घोषणा ) नियंत्रण आदेश , 2024 है ।
(2 ) इसका विस्तार सम्पूर्ण मध्यप्रदेश राज्य पर होगा ।
(3 ) यह मध्यप्रदेश राजपत्र में इस अधिसूचना के प्रकाशन की तारीख से प्रवृत्त होगा।
2. परिभाषाएं - इस आदेश में , जब तक कि सन्दर्भ से अन्यथा अपेक्षित न हो, -
(क ) "बिग चेन रिटेलर्स " से अभिप्रेत है , कोई व्यक्ति जो प्रत्येक आउटलेट पर एवं डिपो में इस आदेश के अधीन संलग्न अनुसूची में उल्लिखित दालों का क्रय , विक्रय और विक्रय के लिए भंडारण करता है;

(ख ) " मिलर " से अभिप्रेत है कोई व्यापारी जो मिलिंग का कार्य करता है और इस आदेश के अधीन संलग्न अनुसूची में उल्लिखित दालों का क्रय , विक्रय और विक्रय के लिए भंडारण करता है;
(ग ) "खुदरा विक्रेता " से अभिप्रेत है , कोई व्यक्ति जो खुदरा बिक्री के लिए इस आदेश से संलग्न अनुसूची में उल्लिखित दालों का क्रय , विक्रय और भंडारण करता है ;
(घ) "थोक विक्रेता " से अभिप्रेत है, कोई व्यक्ति जो व्यापार/ थोक बिक्री के लिए इस आदेश से संलग्न अनुसूची में उल्लिखित दालों का क्रय , विक्रय और विक्रय के लिए भंडारण करता है;
"आयातक" से अभिप्रेत है, कोई व्यक्ति जो आयात का कार्य करता है और इस आदेश से संलग्न अनुसूची में उल्लिखित दालों का क्रय , विक्रय और विक्रय के लिए भंडारण करता है; (ङ)
3. दालों के क्रय , विक्रय एवं विक्रय हेतु भण्डारण के स्टॉक की घोषणा प्रत्येक थोक विक्रेता /खुदरा विक्रेता/बिग चेन रिटेलर्स / मिलर / आयातक ( विधिक इकाइयां ) धारित स्टॉक स्थिति की नियमित रूप से घोषणा उपभोक्ता मामले विभाग , भारत सरकार के पोर्टल fcainfoweb.nic.in/PSP पर करेगा ।
4. अधिकतम स्टॉक सीमा.- कोई भी थोक विक्रेता / खुदरा विक्रेता/ बिग चेन रिटेलर्स / मिलर /आयातक (विधिक इकाइयां ) भारत सरकार के असाधारण राजपत्र में क 2403.आ. (अ 21 नई दिल्ली ( जून, 2024 की कंडिका खित अवधिके अंतर्गत उल्ले 2 , स्टॉक में एवं इसमें समयसमय पर - भारत सरकार द्वारा संशोधित की जाने वाली अवधि के लिये निर्धारित संशोधित मात्रा से अधिक क कास्टॉक्रय , विक्रय एवं विक्रय के लिये भण्डारण नहीं करेगा ।
परंतु उपरोक्त विधिक ईकाईयां, भारत सरकार के पोर्टल fcainfoweb.nic.in/PSP पर स्टॉक की स्थिति की घोषणा करेंगी तथा यदि किसी थोक विक्रेता /खुदरा विक्रेता/बिग चेन रिटेलर्स /मिलर/आयातक ( विधिक इकाइयां ) द्वारा धारित स्टॉक निर्धारित सीमा से अधिक है, तो वे उक्त अधिसूचना में उल्लिखित तारीख तक निर्धारित स्टॉक सीमा में ले आएंगी ।
5. आदेश के उल्लंघन पर निर्बन्धन.-
कोई थोक विक्रेता / खुदरा विक्रेता/ बिग चेन रिटेलर्स/ मिलर/आयातक ( विधिक इकाइयां ) या सेवक या उसकी ओर से कार्य करने वाला कोई अन्य व्यक्ति , इस आदेश के किन्हीं उपबंधों का उल्लंघन नहीं करेगा ।
6. प्रवेश, तलाशी तथा अभिग्रहण आदि की शक्तियां.-
(1) इस आदेश के उपबंधों का समय पर अनुपालन सुनिश्चित करने के लिए मध्यप्रदेश राज्य सरकार के अपर मुख्य सचिव / प्रमुख सचिव/सचिव/आयुक्त/संचालक, खाद्य नागरिक आपूर्ति एवं उपभोक्ता संरक्षण , या तो स्वयं या उनके द्वारा प्राधिकृत कोई अधिकारी , राज्य की सीमा के भीतर तथा अपर संचालक/संयुक्त संचालक/ उप-संचालक/सहायक संचालक/सहायक आपूर्ति अधिकारी/ कनिष्ठ आपूर्ति अधिकारी , संचालनालय खाद्य , नागरिक आपूर्ति एवं उपभोक्ता संरक्षण, मध्यप्रदेशराज्य की सीमा के भीतर एवं कलक्टर , अपर कलेक्टर , संयुक्त कलेक्टर , डिप्टी कलेक्टर , तहसीलदार , जिला आपूर्ति नियंत्रक, जिला आपूर्ति अधिकारी , सहायक आपूर्ति अधिकारी , कनिष्ठ आपूर्ति अधिकारी उनके अपने अपने जिलों की सीमाओं के भीतर , ऐसी सहायता, यदि कोई हो , जैसी कि वह उचित समझे मध्यप्रदेश राजपत्र, दिनांक 20 सितम्बर 2024

(क) किसी स्थान , परिसर , यान या जलयान के , जिसके संबंध में , उसे यह विश्वास करने का कारण हो कि इस आदेश अथवा इस आदेश के उपबंधों का उल्लंघन हुआ है, किया जा रहा है या किया जाने वाला है, स्वामी , अधिभोगी अथवा अन्य किसी भारसाधक व्यक्ति से संबंधित संव्यवहारों को दर्शाने वाली पुस्तकें , लेखे या अन्य दस्तावेजों को प्रस्तुत करने की अपेक्षा कर सकेगा ।
(ख ) किसी स्थान , परिसर , यान या जलयान में , जिसके संबंध में उसे यह विश्वास करने का कारण हो , कि इस आदेश या इस आदेश के किन्हीं उपबन्धों का उल्लंघन हुआ है , किया जा रहा है या किया जाने वाला है , प्रवेश कर सकेगा , उसका निरीक्षण कर सकेगा या उसे खोल सकेगा तथा उसकी तलाशी ले सकेगा ।
(ग ) ऐसे उल्लंघनों से संबंधित संव्यवहारों को दर्शाने वाले रजिस्टर बिल बुक या किसी अन्य दस्तावेजों का अभिग्रहण कर सकेगा या उन्हें अभिग्रहित करवा सकेगा ।
( घ ) स्टॉक, उपयोग में लाए गए पशुओं , यानों , जलयानों या अन्य वाहनों की तलाशी ले सकेगा , उनका अभिग्रहण कर सकेगा और उन्हें हटा सकेगा और ऐसे समस्त उपाय करेगा या करने के लिए प्राधिकृत करेगा जो इस प्रकार अभिग्रहण किए गए अनुसूचित स्टॉक तथा पशुओं, यानों , जलयानों या अन्य वाहनों का सक्षम न्यायालय के समक्ष पेश किया जाना सुनिश्चित करने के लिए तथा इस प्रकार पेश किए जाने तक उसकी सुरक्षित अभिरक्षा के लिए आवश्यक हों ।
(2 ) तलाशी तथा अभिग्रहण से संबंधित भारतीय नागरिक सुरक्षा संहिता , 2023 (2023 का 46 ) के उपबंध, यथासंभव , इस आदेश के अधीन तलाशी तथा अभिग्रहण को लागू होंगे ।
7 . छूट.-
राज्य सरकार , साधारण या विशेष आदेश द्वारा , किसी वर्ग के व्यक्तियों को इस आदेश के समस्त या किसी उपबन्धों से छूट दे सकेगी और किसी भी समय ऐसी छूट को निलंबित या निरस्त कर सकेगी ।

Bhopal , the 20th September 2024
No. 2303 / 2150949/2024/ 29-1 Whereas , the State Government is of the opinion that it is necessary and expedient to do so, to ensure availability of pulses at reasonable prices.
Now, therefore , in exercise of the powers conferred by Section 3 read with Section 5 of the Essential Commodities Act , 1955 ( 10 of 1955) and GSR 800 dated 9th June 1978 of the Ministry of Agriculture and Cooperation ( Food Department ) of the Central Government and Notification S.O. No. 2403 ( E) dated 21st June , 2024 of the Government of India , the State Government hereby makes the following order , namely: -
ORDER
1. Short title , extension and commencement- ( 1 ) This order may be called the Madhya Pradesh Pulses ( Maximum Stock Limit and Stock Declaration ) Control Order, 2024.
(2) It shall extend to the whole of the state of Madhya Pradesh .
(3) They shall come into force from the date of publication of this Notification in the Madhya Pradesh Gazette .
2. Definitions- In this order, unless the context otherwise requires -
( a) " Big Chain Retailers " means any person who purchases , sells and stores for sale at each outlet and in depot the pulses specified in the Schedule appended to this order;
( b) " Miller" any trader who carries out milling and purchases , sells and stores for sale the pulses specified in the Schedule appended to this order ;
( c) " Retailer " means any person who purchases , sells and stores for sale the pulses specified in the Schedule appended to this order for retail sale;
(d) "Wholesaler " means any person who purchases , sells and stores for sale the pulses specified in the Schedule appended to this order for trade/wholesale sale;
( e) " Importer " means any person who imports and purchases , sells and stores for sale pulses specified in the Schedule appended to this order .
3. Declaration of stock of pulses for purchase , sale and storage for sale -
Every Wholesaler/Retailer/ Big Chain Retailers / Millers /Importers ( legal entities) shall regularly declare the stock position on the portal of Department of Consumer Affairs, Government of India at fcainfoweb.nic.in/PSP .
4. Maximum stock limit-
No Wholesaler/ Retailer/ Big Chain Retailers/ Millers/Importers ( legal entities ) shall purchase , sell and store for sale the stock more than the prescibed stock limit mentioned in clause 2 of Extraordinary Gazette notification S.O. No. 2403 ( E) New Delhi dated 21st June , 2024 and amendment hereto at different time intervals by theGovernment of India for the prescribed period .
Provided that the above mentioned legal entities shall declare the stock position on the portal fcainfoweb.nic.in/PSP of the Government of India and in case the stock held by any Wholesaler/ Retailer/ Big Chain Retailers/Millers/Importers (legal entities ) is higher than the prescibed limits then they shall bring the same to the prescibed stock limits by the date mentioned in the said notification .

5. Restrictions on violation of order -
No Wholesaler/ Retailer/ Big Chain Retailers/ Millers/Importers ( legal entities ) or employee or any other person acting on his behalf, shall violate any of the provisions of this order .
6. Powers of entry , search and seizure etc.-
(1) To ensure timely compliance with the provisions of this order , the Additional Chief Secretary/ Principal Secretary/Secretary/ Commissioner/ Director Food, Civil Supplies and Consumer/ Protection of the State Government , Madhya Pradesh either himself/ herself or any officer authorized by him /her, within the limits of the state and Additional Director/Joint Director/ Deputy Director/Assistant Director/Assistant Supply Officer/Junior Supply Officer , Directorate of Food , Civil Supplies and Consumer Protection , Madhya Pradesh within the limits of the state of Madhya Pradesh and the Collector , Additional Collector, Joint Collector , Deputy Collector, Tehsildar, District Supply Controller , District Supply Officer , Assistant Supply Officer, Junior Supply Officer within the limits of their respective districts with such assistance , if any, as he thinks fit may requireto-
(a) expect the submission of books and accounts related to concerned transactions and other documents from the owner, occupant or other person in charge, in respect of which he has reason to believe that this order or the provisions of this order have been violated , is being violated , or about to be violated in any place, premises, vehicle or vessel .
(b) enter, inspect, open or search any place , premises , vehicle or vessel in respect of which he has reason to believe that this order or the provisions of this order have been violated , is being violated , or about to be violated in any place, premises, vehicle or vessel .
(c) seize or cause to be seized the register , bill book or any other documents showing the transactions in respect of which there is a violation .
(d) search the stocks , used animals , vehicles , vessels or other vehicles and seize or remove them and shall take such measures or authorize someone for this to facilitate the production of seized scheduled stock and animals , vehicles , vessels or other vehicles before the competent court and safe custody of these items until such production .
(2) The provisions of the Bharatiya Nagarik Suraksha Sanhita , 2023 ( 46 of 2023) relating to search and seizure shall , as far as possible , apply to search and seizures under this order .
7. Exemption-
TheState Government , may by general or special order , exempt any class of persons from all or any of the provisions of this order and may at any time suspend or cancel such exemption .
