सं. 76- मध्यप्रदेश - वि.स. 153-2024- सी.ई.एम.एस.- III.-यतः, मध्यप्रदेश राज्य की 153- भोपाल मध्य विधान सभा क्षेत्र के साधारण निर्वाचन 2023 अधिसूचना नं. 15 - विधि निर्वा. चार-म.प्र. वि.स. 2023 , दिनांक 21 अक्टूबर 2023 के जरिए की गई थी.
यतः , लोक प्रतिनिधित्व अधिनियम , 1951 की धारा 78 के अनुसार, निर्वाचन लड़ने वाले प्रत्येक अभ्यर्थी को, निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर निर्वाचन व्यय के अपने लेखे की सही प्रति जिला निर्वाचन अधिकारी को दाखिल करनी होती है; और
यतः, 153- भोपाल मध्य विधान सभा निर्वाचन क्षेत्र के रिटर्निंग अधिकारी द्वारा उक्त निर्वाचन का परिणाम 03 दिसम्बर, 2023 को घोषित किया गया था. इस प्रकार, निर्वाचन व्यय का लेखा दाखिल करने की अंतिम तारीख 02 जनवरी 2024 थी; और

यतः, जिला निर्वाचन अधिकारी, भोपाल , मध्यप्रदेश के द्वारा प्रस्तुत संवीक्षा रिपोर्ट और मुख्य निर्वाचन पदाधिकारी, मध्यप्रदेश द्वारा पत्र सं. 10- क/चार/निर्वा.व्यय/ निर्देश/2023-24/ 1032 , दिनांक 25 जनवरी 2024 के जरिए अग्रेषित रिपोर्ट के अनुसार जीशान रहमान, जो मध्यप्रदेश विधान सभा का साधारण निवार्चन 2023 के निर्वाचन क्षेत्र 153- भोपाल मध्य से लड़ने वाले अभ्यर्थी हैं, विधि द्वारा यथापेक्षित रीति से अपने निर्वाचन व्यय का कोई भी लेखा दाखिल करने में विफल रहे हैं. और,
यतः, जिला निर्वाचन अधिकारी , भोपाल, मध्यप्रदेश और उप मुख्य निर्वाचन पदाधिकारी , मध्यप्रदेश की उक्त रिपोर्टों के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उपनियम ( 5 ) के अंतर्गत निर्वाचन व्यय प्रस्तुत नहीं करने के लिए जीशान रहमान को कारण बताओ नोटिस सं. 76 - मध्यप्रदेश- वि.स. 153-2024- सी.ई.एम.एस.- III , दिनांक 19 जुलाई 2024 को जारी किया गया था; और,
यतः, निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उपनियम (6 ) के अनुसार, दिनांक 19 जुलाई 2024 के उपर्युक्त कारण बताओ नोटिस के जरिए जीशान रहमान को निदेश दिया गया था कि वे इस नोटिस के प्राप्त होने के 20 दिनों के अंदर लेखा न प्रस्तुत कर पाने के कारणों को स्पष्ट करते हुए लिखित रूप में अपना अभ्यावेदन प्रस्तुत करें और साथ ही, निर्वाचन व्यय का अपना लेखा दाखिल करें; और
यतः, जिला निर्वाचन अधिकारी, भोपाल द्वारा अपने पत्र सं. 3067/विधान सभा निर्वाचन-2023/2024 , दिनांक 03 सितम्बर 2024 के जरिए आयोग को सूचना दी गई की उक्त नोटिस अभ्यर्थी द्वारा दिनांक 29 जुलाई 2024 को प्राप्त किया गया था; और
यतः, जिला निर्वाचन अधिकारी , भोपाल द्वारा दिनांक 03 सितम्बर 2024 के पत्र सं. 3067/विधान सभा निर्वाचन-2023/2024 के जरिए प्रस्तुत की गई अनुपूरक संवीक्षा रिपोर्ट दिनांक 03 सितम्बर 2024 में यह बताया गया है कि जीशान रहमान ने न तो कोई भी अभ्यावेदन और न ही अपने निर्वाचन व्यय का लेखा दाखिल किया है. इसके अतिरिक्त, उन्होंने भारत निर्वाचन आयोग का सम्यक् नोटिस मिलने के उपरांत उक्त विफलता के लिए न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है ; और
यतः , आयोग का यह समाधान हो गया है कि जीशान रहमान निर्वाचन खर्चों का लेखा दाखिल करने में विफल रहे हैं और उनके पास इस विफलता के लिए कोई भी उचित कारण अथवा औचित्य नहीं है; और,
यतः , लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में अनुबंधित किया गया है कि:-
" यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति-
(क) निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है. दाखिल करने में असफल रहा है; तथा
(ख) उस असफलता के लिए कोई अच्छा कारण या न्यायोचित्य नहीं रखता है , तो निर्वाचन आयोग शासकीय राजपत्र में प्रकाशित आदेश द्वारा उसको निरर्हित घोषित करेगा और ऐसा व्यक्ति उस आदेश की तारीख से तीन वर्ष की कालावधि के लिए निरर्हित होगा".
अतः, अब, लोक प्रतिनिधित्व अधिनियम , 1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग एतद्वारा, घोषणा करता है कि मध्यप्रदेश राज्य के 153 - भोपाल मध्य विधान सभा निर्वाचन क्षेत्र से मध्यप्रदेश राज्य में विधान सभा के साधारण निर्वाचन , 2023 में निर्वाचन लड़ने वाले अभ्यर्थी, जीशान रहमान , म. नं. 4/2 , कमानिगेट महल तब्वा मिया, भोपाल, म. प्र. को इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य क्षेत्र की विधान सभा अथवा विधान परिषद का सदस्य चुने जाने अथवा होने के लिए निरर्हित है.

ORDER
No. 76- MP- LA- 153-2024- CEMS - III . - WHEREAS , the General Election to 153 -Bhopal Madhya Legislative Assembly of Madhya Pradesh, 2023 was announced by Notification No. 15 विधि निर्वा. चार. म.प्र.-वि.स. - 2023, dated 21st October 2023 .
WHEREAS , as per Section 78 of the Representation of the People Act , 1951 , every contesting candidate at an election has to , within 30 days from the date of election of the returned candidate, lodge a true copy of the account of his election expenses with the District Election Officer ; and ,
WHEREAS , the result of the said election along with 153 - Bhopal Madhya Assembly Constituency was declared by the concerned Returning Officer on 3rd December 2023. Hence , the last date for lodging the account of Election Expenses was 2nd January, 2024 ; and ,
WHEREAS , as per the scrutiny report submitted by the District Election Officer, Bhopal , Madhya Pradesh and forwarded by the Chief Electoral Officer, Madhya Pradesh vide their letter No. 10 - क/चार/ निर्वा.व्यय/निर्देश/ 2023-24/1032, dated 25th January 2024, Zeeshan Rehman , a contesting candidate from 153 -Bhopal Madhya Assembly Constituency of Madhya Pradesh in General Election to Legislative Assembly 2023, has failed to lodge account of his Election Expenses , in the manner , as required under law; and ,
WHEREAS , on the basis of the reports of the District Election Office , Bhopal , Madhya Pradesh and the Deputy Chief Electoral Officer , Madhya Pradesh a Show- Cause Notice , 76- MP-LA- 153-2024- CEMS - III , dated 19th July 2024 was issued under sub - rule (5) of Rule 89 of the Conduct of Elections Rules , 1961 by the Election Commission of India to Zeeshan Rehman , for not lodging the account of Election Expenses ; and ,
WHEREAS , As per the sub - rule (6 ) of Rule 89 of the Conduct of Elections Rules , 1961 , through the above said Show- Cause Notice , dated 19th July 2027 , Zeeshan Rehman , was directed to submit his representation in writing with explaining the reasons for not lodging the account and to lodge account of Election Expenses within 20 days from the date of receipt of the notice; and,
WHEREAS , the said notice was received by the candidate on 29th July 2024. The Acknowledgment receipt has been submitted to the Commission by the District Election Officer , Bhopal vide its letter No. 3067 /विधान सभा निर्वाचन-2023/2024 , dated 3rd September 2024; and,
WHEREAS , the District Election Officer , Bhopal in his Supplementary Report dated 3rd September 2024 vide its letter 3067/विधान सभा निर्वाचन-2023/2024 ,dated 3rd September 2024; has reported that Zeeshan Rehman , has neither submitted any representation nor any statement of account of election expenses . Further, after receipt of the due notice of the Election Commission of India, he has furnished neither any reason nor explanation for the said failure ; and,
WHEREAS , the Commission is satisfied that Zeeshan Rehman , has failed to lodge the account of election expenses and has no good reason or justification for the failure ,
WHEREAS , Section 10A of the Representation of the People Act, 1951 provides that :-
"If the Election Commission is satisfied that a person-
(a) has failed to lodge an account of election expenses , within the time and in the manner required by or under this Act ; and

the Election Commission shall by order published in the Official Gazette , declare him to be disqualified and any such person shall be disqualified for a period of three years from the date of the order " ;
NOW, THEREFORE , in pursuance of Section 10A of the Representation of the People Act, 1951 , the Election Commission of India hereby declares Zeeshan Rehman ,, resident of H. No. 4/2 , KaminiGate , Mahal Tabba Miya , Bhopal , M.P. , a contesting candidate from 153 - Bhopal Madhya Assembly Constituency of the state of Madhya Pradesh in the General Election to the Legislative Assembly 2023 to be disqualified for being chosen as and for being a member of either House of the Parliament or the the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of this order.
